WHEREAS, pursuant to an advertisement for bids for the following improvement(s): Project No. J8707 Link Bus Rapid Transit (BRT) Maintenance Bay Addition (TRF-0047-018B), the following bids were received complying with the advertisement; and Brennan Construction of MN, Inc. $4,592,000 Kraus-Anderson Construction. $4,700,000 Alvin E. Benike, Inc. $4,800,000 WHEREAS, it appears that Brennan Construction of MN, Inc., is the lowest responsive and responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the bid of $4,592,000 is hereby accepted and execution of the standard City contract for construction with Brennan Construction of MN, Inc., is authorized for the following approved local improvements: Project No. J8707 Link Bus Rapid Transit (BRT) Maintenance Bay Addition (TRF-0047-018B); and BE IT FURTHER RESOLVED, that contract shall be contingent upon additional funding approved by the DMC Corporation Board, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED, that the City Clerk is directed to return to all bidders the deposits made with their bids, except the deposits of the successful bidder and the next lowest bidder, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED, that the bidder shall execute all contracts within ten days after the contract is ready for their signature, and if not executed by them in said time, they shall be deemed to have abandoned the same.
