RESOLUTION
Approving Major Land Subdivision No. CD2025-022PLAT, To Be Known As Pebble
Creek Sixth and Interim Use Permit CD2025-001IUP, For the subdivision 185 of
acres into 454 single family lots and 12 Outlots and Associated Substantial Land
Alteration of The Property, Located North of Behrens Ln. NW & West of 60th Ave.
NW
WHEREAS, Lennar, requested from the City of Rochester approval of a Major Land
Subdivision and associated substantial land alteration to be known as Pebble Creek
Sixth.
WHEREAS, the Major Land Subdivision proposes 454 Single-Family Residential Lots and
twelve outlots, on 185 acres of land located north of Behrens Ln NW & west of 60th Ave
NW.
WHEREAS, the Council adopts the Planning Commission findings as described in the
attached Community Development memo dated June 11, 2025, and finds the proposal
meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit.
WHEREAS, on June 11, 2025, the City of Rochester Planning Commission reviewed the
application and recommended approval subject to seven conditions.
WHEREAS, on July 7, 2025, the City of Rochester Common Council held a public hearing
to consider this application and adopted the findings of fact and approved the application
subject to conditions.
NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated four conditions of approval.
BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No.
CD2025-020PLAT, requested by Lennar, subject to the seven conditions of approval
shown below:
CONDITIONS
1. Prior to the submission of Civil Engineering Improvement Plans, the Traffic Impact
Study and a Drainage Proof of Concept shall be finalized and accepted by the
Public Works Department.
2. Prior to the submission of a grading plan, the applicant shall demonstrate to the
Parks and Recreation Department that the UDC Minimum Standards of Land
Dedicated and Dedication of Non-Buildable Land can be met by the proposed
parkland dedication.
3. Prior to the submission of a final plat, Civil Plans, Grading Plans, and Stormwater
Management Plan approvals will be required for the review and approval of
Rochester Public Works and Rochester Public Utilities as part of the subdivision
approval process.
4. Prior to the submission of a final plat, any private facilities will require the execution
of a City prepared Maintenance Declaration.
5. Prior to the recordation of a final plat, execution of a new / updated Development
Agreement to replace existing agreement is required to address applicable terms
and obligations related to public improvements contained within the current
development proposal.
6. A pedestrian access corridor to the park (Outlot M) shall be added between lots 7
& 8 of Block 18 on the south side of the project.
7. Prior to the submission of Grading and Drainage Plans, the applicant shall provide
information and clarifications regarding the IUP application to Public Works,
subject to the satisfaction of the City Engineer.
