HomeMy WebLinkAboutResolution No. 181-25 - Resolution - Link Bus Rapid Transit BRT Civil Underground Utilities and Architecture - Project No. J8707 RESOLUTION Awarding Contract for Project No. J8707 Link Bus Rapid Transit (BRT) Architecture, Stations and Transit Center- Project No. J8707 (TRF-0047-018B) WHEREAS, pursuant to an advertisement for bids for the following improvement(s): Project No. J8707 Project No. Link Bus Rapid Transit (BRT) Architecture, Stations and Transit Center - Project No. J8707 (TRF-0047-018B), the following bids were received complying with the advertisement: Elcor Construction, Inc. $73,174,436.62 WHEREAS it appears that Elcor Construction, Inc is the lowest responsive and responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the bid of $73,174,436.62 is hereby accepted and execution of the standard City contract for construction with Elcor Construction, Inc., is authorized for the following approved local improvements: Project No. Link Bus Rapid Transit (BRT) Civil Underground Utilities and Architecture - Project No. J8707 (TRF-0047-018B); and WHEREAS, the Destination Medical Center Corporation (DMCC) must adopt an annual Funding request and a Five Year Capital Plan; and WHEREAS, the City Council approved the 2025 Destination Medical Center Corporation (DMCC) Operating Budget, the 2025 DMCC Capital Budget, the DMCC and the DMC Economic Development Agency Working Capital Loan Extensions; and WHEREAS, the City has identified additional contingency experience and additional surveying and engineering analysis; and WHEREAS, the associated budget amendment necessary for these unforeseen infrastructure construction related improvements is $21,240,393; and WHEREAS, the City Council of the City of Rochester must review and approve the DMCC’s annual budget. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester that the previously amended 2025 Capital Improvement Plan (CIP) for the Destination Medical Center Corporation totaling $175,493,515, be amended to include in the 2025 DMC CIP an additional $23,016,727 from DMC County Transit Aid and reducing the DMC State Transit Aid for this project by $1,776,334, all to fund additional modifications to unforeseen circumstances related to construction for a total project budget of $196,733,908. BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the deposits made with their bids, except the deposits of the successful bidder and the next lowest bidder, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days after the contract is ready for their signature, and if not executed by them in said time, they shall be deemed to have abandoned the same. BE IT FINALLY RESOLVED by the Common Council of the City of Rochester, Minnesota, that the above listed financing plans and contract award in the above Resolutions are approved and the corresponding amendments to the 2025 Adopted City Budget are authorized, contingent upon approval by Destination Medical Center Corporation (DMCC).
