HomeMy WebLinkAboutResolution No. 188-25 - Resolution - CD2025-026PLAT - Harvestview 8th Final Plat RESOLUTION Approving Final Plat No. CD2025-026PLAT, To Be Known as Harvestview Eighth, for the Subdivision of 11.8 Acres Into 38 Single Family Lots, Located at the West Terminus of Harvest Lake Dr. NW & the West terminus of October Rd. NW. WHEREAS, Bigelow Homes has requested from the City of Rochester Final Plat approval for a subdivision to be known as Harvestview Eighth. WHEREAS, the Final Plat proposes 38 single family lots on 11.8 acres of land located west terminus of Harvest Lake Dr. NW & the west terminus of October Rd. NW. WHEREAS, the Council adopts the findings as described attached to the Community Development memo dated April 21, 2025, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on August 11, 2025, the City of Rochester Common Council held a public hearing to consider a Final Plat application for the development, adopted the findings of fact, and approved the Final Plat subject to four conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester, at a public hearing duly noticed and held on August 11, 2025, the following plat of lands in Olmsted County, Minnesota is to be known and designated as follows: That part of the East Half of the Southwest Quarter of Section 7, Township 107 North, Range 14 West, Olmsted County, Minnesota, more particularly described: Commencing at the southeast corner of the East Half of the Southwest Quarter of said Section 7; thence North 00 degrees 20 minutes 20 seconds West, (Note: All bearings are based on the Olmsted County Coordinate System, NAD ’83, Adjusted 1996), along the east line of said Southwest Quarter, 1736.15 feet to the northeast corner of HARVESTVIEW SIXTH, according to the recorded plat thereof and the Point of Beginning (the next eight courses are along the boundary of HARVESTVIEW SIXTH); thence South 89 degrees 57 minutes 37 seconds West, 617.24 feet; thence South 00 degrees 00 minutes 00 seconds West, 190.07 feet; thence North 90 degrees 00 minutes 00 seconds East, 15.91 feet; thence South 00 degrees 00 minutes 00 seconds West, 140.31 feet; thence South 90 degrees 00 minutes 00 seconds West, 374.00 feet; thence South 00 degrees 00 minutes 00 seconds West, 140.31 feet; thence South 90 degrees 00 minutes 00 seconds West, 13.12 feet; thence South 00 degrees 00 minutes 00 seconds West, 124.00 feet; thence North 90 degrees 00 minutes 00 seconds West, 317.74 feet to the west line of said East Half of the Southwest Quarter; thence North 00 degrees 14 minutes 06 seconds West, along said west line, 474.62 feet; thence South 90 degrees 00 minutes 00 seconds East, 117.64 feet; thence northeasterly along a nontangential curve, concave southeasterly having a radius of 328.00 feet, a central angle of 87 degrees 18 minutes 43 seconds, a chord bearing North 46 degrees 18 minutes 16 seconds East, and a chord length of 452.85 feet; thence North 89 degrees 57 minutes 37 seconds East, parallel with the north line of HARVESTVIEW SIXTH, 687.16 feet; thence North 00 degrees 00 minutes 00 seconds East, 29.10 feet; thence North 90 degrees 00 minutes 00 seconds East, 174.61 feet to a point on said east line; thence South 00 degrees 20 minutes 20 seconds East, along said east line, 221.92 feet to the Point of Beginning. Containing 11.80 acres, more or less. TO BE KNOWN as “Harvestview Eighth”, by Bigelow Homes Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the follow conditions: 1. Prior to the recordation of the Final Plat, the applicant shall meet their boulevard tree obligation through either direct payment to the City of Rochester Parks Department or through a Boulevard Tree Green Facilities Agreement. 2. Prior to recordation of Final Plat, the applicant shall update Final Plat mylar by removing the two 30-foot wide easements identified by the Public Works memo as “Utility Easements” and redesignating such easements as a “Pedestrian Facility Easement”. Subject easements shall be recorded by separate document with recordation number notated on Final Plat mylar. 3. Prior to Final Plat recordation, the applicant shall record “Temporary Utility Easements” that are required for the public utilities extending beyond the platted public roadways of Lavendar Ave NW, Harvest Lake Dr NW, and Harvestview Drive NW.
