CIRCUSES AND OTHER SHOWS 104.001 Definitions. Subdivision 1. As used in this chapter, the following terms shall have the meaning ascribed to them. Subd. 2. "Circus" means a production or variety show conducted in an arena or under a tent which includes feats of physical skill and daring, wild animal acts, and/or performances by jugglers and clowns. Subd. 3. "Menagerie" means the exhibition of a collection of wild and/or foreign animals. Subd. 4. "Dog and pony show" means a show featuring performances by dogs, ponies, horses, or other trained domestic animals. Subd. 5. "Carnival" means a traveling enterprise offering amusements such as rides, games of chance, and sideshows. Subd. 6. "Cars and trucks" means each vehicle used in the transportation of performers, workers, animals, equipment, and other materials used in the exhibition. Subd. 7. "Wild west show" means a performance featuring trick riding, trick roping, trick shooting, and other acts intended to portray the old west. 104.01. License Required. No person shall conduct or exhibit within the city any circus, dog and pony show, carnival or other tent show transported upon cars or trucks without being licensed under this chapter. 104.02. Class A License. Circuses, menageries and circuses combined, and wild west shows, with a general admission charge of 50 cents or over, shall pay $2.50 per day for each car or truck used up to 35, and $2.00 for each car or truck used in excess of 35; with a minimum fee of $60.00 per day and a maximum fee of $120.00 per day. 104.03. Class B License. Circuses, menageries and circuses combined, and wild west shows, with a general admission charge of less than 50 cents, shall pay $2.00 per day for each car or truck used up to 25, and $1.50 for each car or truck used in excess of 25; with a minimum fee of $30.00 per day and a maximum fee of $60.00 per day. CHAPTER 104. CIRCUSES AND OTHER SHOWS ─────────────────────────────────────────────────────────────────── Updated 2014 104-2 104.04. Class C License. Dog and pony shows and other tent shows shall pay for the first day's performance $1.50 per day for each car or truck used not exceeding 10, and $1.00 for each car or truck in excess of 10, and shall pay one-half that amount for each succeeding day; provided that no license shall be granted to any show of this class for less than $20.00 for the first day and $10.00 for each succeeding day. 104.05. Class D License. Carnivals and like amusements shall pay $10.00 per day for each car or truck used not exceeding 10, and $5.00 per day for each car or truck in excess of 10; provided that no license shall be granted to any show of this class for less than $120.00 per day. 104.06. Littering Prohibited. No license shall permit any accumulation of rubbish or litter upon any streets or grounds used by it, and shall at its own expense remove said litter at the end of the license period. 104.07. Insurance and Bond. No class D license shall be granted until the applicant has filed with the city clerk a policy of public liability insurance in the amount of $5,000.00 or a surety bond in the sum of $5,000.00 running to the city and indemnifying persons who may be injured on account of the operation under said class D license. The insurance or bond shall contain a clause requiring the issuing company to give ten days' written notice to the city before cancellation, and any license granted hereunder shall be automatically revoked upon the lapse or termination of said insurance or bond.
