As used in this chapter the words and phrases defined in this section shall have the meanings ascribed to them. Subd. 2. "Congested zone" means the following areas: (1) The streets and alleys included within the area enclosed within the outside boundaries of the following designated streets: Beginning at the intersection of 3rd Ave. S.E. and 5th St. S.E. thence west on 5th St. S.E. and 5th St. S.E. if continued, to South Broadway, thence south on South Broadway to the bridge over the Zumbro River, thence due west to 2nd Ave. S.W. if extended, thence north along the line of 2nd Ave. S.W. if extended, to 6th St. S.W., thence west on 6th St. S.W. to 4th Ave. S.W., thence north on 4th Ave. S.W. and 4th Ave. N.W. to 5th St. N.W., thence east on 5th St. N.W. to 2nd Ave. N.W., thence north on 2nd Ave. N.W. to 7th St. N.W., thence east on 7th St. N.W. and 7th St. N.E. to 2nd Ave. N.E. if extended from the south, thence south on 2nd Ave. N.E., if extended, and 2nd Ave. S.E. to 2nd St. S.E., thence southeasterly across the Mayo Park Bridge, and south on 3rd Ave. S.E. to the place of beginning; (2) Also the following designated streets and alleys: 2nd St. S.W. from 11th Ave. S.W. west to the City Limits; 17th Ave. S.W. and N.W. (U.S. Highway No. 52) from 5th St. S.W. north to 4th St. N.W. as platted; 16th Ave. S.W. from 2nd St. S.W. north to 4th St. S.W. as platted; the alley between 1st St. S.W. and 2nd St. S.W. from 11th Ave. S.W. west to 16th Ave. S.W. Subd. 3. "Crosswalk" means that portion of a roadway ordinarily included within the prolongation or connection of the lateral lines of sidewalks at intersections; or train crossing by lines or other markings upon the surface. Subd. 4. "Curb" means the lateral boundaries of a roadway, whether or not marked by curbing. Subd. 5. "Double parking" means the parking of a vehicle on the roadway side of any vehicle stopped or parked at the edge or curb of a roadway. Subd. 6. "Driver" means every person who drives or is in actual physical control of a vehicle. Subd. 7. "Explosives" means any chemical compound or mechanical mixture that is CHAPTER 134. PARKING REGULATIONS Updated 2018 134-2 commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities, or packing that an ignition by fire, by friction, by percussion, or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructible effects on contiguous objects or of destroying life or limb. Subd. 8. "Flammable liquid" means any liquid which has a flash point of 70 degrees Fahrenheit, or less, as determined by a tagliabus or equivalent closed cup test device. Subd. 9. "Intersection" means the area embraced within the prolongation or connection of the lateral curbing lines, or if none, then the lateral boundary lines of the roadway of two streets which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different streets joining at any other angle may come in conflict. Subd. 10. "Limited parking zone" means a zone or area in which the council has restricted parking on the streets or parts of streets therein to less than 12 hours. Subd. 11. "Motor vehicle" means every vehicle which is self-propelled. Subd. 12. "One-way street or alley" means a street or alley designated and sign- posted for one-way traffic and on which all vehicles are required to move in one indicated direction. Subd. 13. "Owner" means a person who holds the legal title of a vehicle, or in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee or in the event a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this chapter. Subd. 14. "Park or parking" means the stopping, standing or parking of vehicles upon a street or alley whether accompanied or unaccompanied by the operator thereof, except temporary stops for the purpose of loading and unloading passengers. Subd. 15. "Parking meter" means any mechanical device or meter installed on public streets for the purpose of regulating the parking on such streets, and operated by the insertion of U.S. coins therein. Subd. 16. "Parking meter space" means the space adjacent to a parking meter designated for the parking of a single vehicle by lines painted or otherwise marked on the curbing or on the surface of the roadway. CHAPTER 134. PARKING REGULATIONS Updated 2018 134-3 Subd. 17. "Primary traffic street" means a street designated by the council as a primary traffic street because of the volume of traffic which such street is required or expected to accommodate. Subd. 18. "Private road or driveway" means every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons. Subd. 19. "Right-of-way" means the privilege of the immediate use of the street or alley. Subd. 20. "Roadway" means that portion of a street or alley improved, designed, or ordinarily used for vehicular travel. Subd. 21. "Semi-trailer" means every vehicle without motive power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle. Subd. 22. "Sidewalk" means that portion of a street between the curbing or the lateral lines of a roadway and the adjacent property lines, intended for the use of pedestrians. Subd. 23. "Street or alley" means the entire width between boundary lines of any way or place when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular traffic. The term "street" specifically includes highway. Subd. 24. "Traffic control devices" means all signs, signals, parking meter instruction plates, markings and devices not inconsistent with this chapter placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic. Subd. 25. "Trailer" means every vehicle without motive power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle. Subd. 26. "Truck" means every motor vehicle designed, used or maintained primarily for the transportation of property. Subd. 27. "Vehicle" means every device in, upon, or by which any person or property is or may be transported or drawn upon a street or alley, except devices moved by human power or used exclusively upon stationary rails or tracks. Subd. 28. “Parking Lot” or “Parking Lots” means every parking area owned or CHAPTER 134. (4193, 5/4/15) Subd. 29. “Transportation Network Company Driver” is defined at section 95B.01(O). (4291, 4/3/17) 134.02. Parallel Parking. Except where angle parking is required, each vehicle parked upon a two-way street where there is adjacent curbing, shall be parked with the right wheels of the vehicle parallel with and within 12 inches of the right hand curbing. 134.03. No Curbs. Upon streets having no curbing, each vehicle shall be parked with the left wheels parallel with and as near to the right edge of the paved or improved or main traveled part of the street as practicable, having due regard for the state of improvement of the boulevard. 134.04. One-Way Streets. On a one-way street where parking is permitted on both sides of the street, vehicles parking on the left side of the street shall park with the left wheels of the vehicles adjacent to and within 12 inches of the left hand curbing; or, in the case of one- way streets having no left hand curbing, where parking is permitted on both sides of the street, vehicles parking on the left hand side of the street shall park with the right wheels parallel with and as near to the left edge of the paved or improved or main traveled part of the street as practicable, having due regard for the state of improvement of the boulevard. 134.05. Angle Parking. On those streets or parts of streets designated by the council for angle parking and which have been lined or marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such lines or marks, with the right front tire within 12 inches of the curb or as near as practicable. It shall be unlawful to park any vehicle across such lines or marks; or to park a vehicle in such a position that it shall not be entirely within the space designated by such lines or marks; or park the vehicle with the back of the car to the curb. 134.06. Alley Parking. When parking is permitted in an alley, vehicles shall park as near to the right hand edge of the alley as possible so as not to obstruct the course of traffic through the alley. Provided, that when loading or unloading operations require, vehicles may park for such time as is necessary, in whatever manner is required to accomplish the loading or unloading operations. 134.07. Procedures for Parallel Parking. The driver of a vehicle intending to parallel park in a space about to be vacated by another vehicle, shall stop back of such parking space and wait until the other vehicle has vacated the same. The driver desiring to park shall then move his vehicle to a place immediately in front of the vacated parking space and back into it. The driver of any other vehicle approaching from the rear shall yield the right-of-way to the driver so parking. Provided, that in case there is no one in position immediately in front of a vacant parallel parking space prepared to back into it, and such parking space is large enough CHAPTER 134. PARKING REGULATIONS Updated 2018 134-5 to permit it, the driver of a vehicle may head into the parking space without backing. 134.075. Parking Lots Within the Congested Zone. No person shall park a vehicle or leave a vehicle parked in whole or in part within a parking lot owned or operated by the City of Rochester within the congested zone unless such vehicle is parked entirely within a place or space within the lot which is specially lined or marked for such parking and in no event shall any person park such vehicle contrary to any signs, markings, or parking meter instructions posted, painted or erected in said lot. 134.08. Brakes to be Set. No driver of a motor vehicle shall permit it to stand unattended on a grade without effectively setting the brakes thereon and turning the front wheels to the curb. 134.09. Ignition to be Locked. Every person parking a passenger vehicle on a street or alley shall lock the ignition, remove the key and take the key with him. 134.10. Prohibited Stops. No person shall park a vehicle, whether attended or unattended, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in any of the places listed in this section. Subd. 2. On a sidewalk or on an improved boulevard between a sidewalk and a roadway. Subd. 3. In front of a public or private driveway or alley or within five feet of the intersection of any public or private driveway or alley with any street. Subd. 4. Within an intersection. Subd. 5. Within ten feet of a fire hydrant located on or near any public street. This distance is measured by taking a direct line to the nearest street and measuring ten feet in either direction. All other fire hydrants will be measured as having a no parking zone within a ten foot circumference of the hydrant itself. Subd. 6. Within ten feet of any curb side public or private mailbox. Subd. 7. On a crosswalk. Subd. 8. Within 20 feet of a crosswalk at an intersection. Subd. 9. Within 30 feet upon the approach of any flashing school signal, stop sign, traffic control signal, or school sign at the side of a roadway. Subd. 10. Except for a bus or taxicab, within a designated or marked bus stop or CHAPTER 134. PARKING REGULATIONS Updated 2018 134-6 taxicab stand. Subd. 11. Within 50 feet of the nearest rail of a railroad crossing. Subd. 12. Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite the entrance to any fire station, within 75 feet of said entrance when properly sign-posted. Subd. 13. Alongside or opposite any street excavation or obstruction when such stopping, standing, or parking would obstruct traffic. Subd. 14. Upon any bridge or other elevated structure upon a street except the Fourth Street S.E., bridge over the Zumbro River and the East Center Street bridge over the Zumbro River. Subd. 15. So as to block a fire escape or the emergency exit from any building. Subd. 16. At any place where temporary signs prohibit parking, stopping, or standing as long as such signs are in place. Subd. 17. At any place where official signs or markings prohibit stopping, standing, or parking. Subd. 18. On a street or alley when directed or ordered to proceed by any person or police officer invested by law with authority to direct, control, or regulate traffic. Subd. 19. Within a designated or marked taxicab or Transportation Network Company Driver stand. (4291, 4/3/17) 134.105. Solicitation of Passengers. No person shall solicit passengers for limousine service at a taxicab stand. 134.11. Parking Prohibited. Subdivision 1. Private Property. No person shall park a vehicle or leave a vehicle parked on private property without consent of the owner or person in lawful possession of such property; provided, however, that enforcement of this subdivision on property the principal use of which is for other than single-family and duplex purposes is subject to the condition that there be a sign at each entrance to such parking lot stating: "Restricted Parking. For Use Only By " followed by a description of the type of parking permitted. CHAPTER 134. PARKING REGULATIONS Updated 2018 134-7 Subd. 2. No Parking Zones. No person shall park a vehicle, except as otherwise provided or unless directed to do so by a police officer, on any street or alley where the council or the city engineer has established a no parking zone and such zone is marked by a sign or yellow curbing. Subd. 3. No person shall park in a front yard in a residential neighborhood except as provided in Section 63.455(c) of the Rochester Code of Ordinances (also known as the Zoning Ordinance and Land Development Manual). Subd. 4. No person shall park any vehicle or trailer on any public street or alley within the City of Rochester that does not display current registration as required by law. Subd. 5. Repealed per ordinance #4251 on June 20, 2016. 134.12. No Parking Zones -- Hazardous Conditions. Whenever the city engineer determines that the accumulation of snow and ice have reduced the improved width of a street or alley so that the parking of vehicles on such street or alley during such conditions will create a hazardous condition endangering or impeding the movement of vehicular traffic or otherwise endangering the safety, health or welfare of the public, the city engineer shall designate either side or both sides of such street or alley as a no parking zone. The designation of a no parking zone by the city engineer shall be made by filing a notice of such designation in the offices of the city clerk and chief of police and by posting signs or markers along the streets or alleys so designated. The city engineer shall state in the notice the specific hour when the no parking restrictions go into effect and shall identify the streets or alleys affected by the restrictions. No parking zones designated under this section shall not go into effect until at least 12 hours after the signs or markers have been posted and shall remain in effect until removed at the direction of the city engineer. 134.13. Special Parking Zones. No person, excepting a person authorized to do so, shall park a vehicle on any street or alley where the council has established a special parking zone. The council may establish special parking zones wherever the convenience or necessity of the traveling public requires or wherever necessary in the proper exercising of the police power. 134.14. Truck Loading Zones. No person shall park a vehicle, other than a commercial vehicle, in any space established by the council as a truck loading zone, and so signed or marked, during the hours when the regulations, applicable to such truck loading zone are effective. Commercial vehicles may park in designated truck loading zones for the purpose of loading or unloading commodities and for no other purpose, and such stops shall not be for a longer period of time than necessary to accomplish such purpose. In no case shall the stop for loading or unloading commodities exceed 30 minutes. 134.15. Passenger Loading Zones. No person shall park a vehicle for any purpose or CHAPTER 134. PARKING REGULATIONS Updated 2018 134-8 period of time other than for the expeditious loading or unloading of passengers in any space established by the council as a passenger loading zone, and so signed or marked, during the hours when the regulations applicable to such zone are effective. In no case shall the stop for loading or unloading passengers in such zones exceed fifteen minutes. 134.16. Passenger and Commodity Loading Zones. No person shall park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers or commodities in any space established by the council as a passenger and commodity loading zone, and so signed or marked, during the hours when the regulations applicable to such zone are effective. In no case shall the stop for loading or unloading passengers or commodities in such zones exceed 15 minutes. 134.17. Parking in Alleys in Congested Zone. No person shall park a vehicle in a public alley within the congested zone for a longer period of time that is necessary to load or unload commodities. In loading or unloading commodities, a non-commercial vehicle must not park for longer than ten minutes and a commercial vehicle must not park for longer then 30 minutes. This section does not apply to alleys specifically signed for no parking. 134.18. Loading Hours in Congested Zone. This section repealed per ordinance # 3474 – effective 5/6/02. 134.19. Double Parking. Subdivision 1. Except as provided in subdivision 2 of this section, no person shall double park a vehicle on any street. Subd 2. A person may double park a truck on a street, other than a U.S. Highway, so long as: A. The time of double parking does not exceed 15 minutes; B. The double parking occurs solely for the purpose of loading or unloading commodities; e hereinafter provided. Trucks may be double parked not to exceed 15 minutes for the purpose of loading and unloading commodities under the following conditions: C. Alley access to the place of loading or unloading does not exist. D. Access to the curb at or immediately adjacent to the place of loading or unloading is blocked by other vehicles; E. The double parking of the truck does not cause another vehicle to cross into the opposing lane of traffic in order to pass the double parking. 134.20. Vehicles Backed to Curb. No vehicle shall be backed up to the curb or parked CHAPTER 134. PARKING REGULATIONS Updated 2018 134-9 backed up to the curb unless: a) within the congested zone for the purpose of loading or unloading commodities and a permit to do so is first obtained from the police department; or b) outside the congested zone, a vehicle may be backed up to the curb but only when the weight or bulk of the load necessitates loading or unloading in such position, and then only for the period of time necessary to so load or unload such commodities. 134.21. Vehicles for Sale. No person shall place any vehicle on a street or alley to display the same for sale or exchange. A vehicle shall be deemed to be displayed in violation of this section when found standing upon a street or alley, and bearing a sign or other marking indicating that it is for sale or exchange. 134.22. Parking of Certain Vehicles Prohibited in Congested Zone. No person shall park any of the following described vehicles, for any purpose, in the congested zone, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device. (1) Any vehicle exceeding 25 feet in length except as provided in section 134.17. (2) Any trailer or semi-trailer or vehicle with a trailer or semi-trailer attached, except as provided in section 134.17. (3) Any vehicle transporting explosives or flammable liquids as a cargo or part of a cargo except for the purpose of making deliveries. 134.23. Parking of Certain Vehicles Restricted. Subdivision 1. No person shall park any of the following described vehicles on any street, alley or City-owned public parking lot for more than one hour: (A) Trucks of a capacity of more than 3/4 ton, according to manufacturer's rating. (B) Trucks or motorhomes having an over-all length of more than 20 feet, or width at any point of more than six feet. (C) Dump trucks, tractors, truck-tractors, trailers, boats and boat trailers, semi- trailers or any heavy machinery. (D) Any truck, trailer or semi-trailer which is being used for the transportation of livestock or has been used for the transportation of livestock and has not been cleaned. CHAPTER 134. PARKING REGULATIONS Updated 2018 134-10 (E) Any vehicle, truck, trailer or semi-trailer which is being used for the display of advertising. Subd. 2. Subdivision 1 does not apply to overnight parking related to emergencies, public works projects, construction projects, or Civic Center or community events where such overnight parking is approved by the Police Department or the Public Works Department. Subd. 3. No trucks or other commercial vehicles of a rated weight over ¾ ton shall be parked in any residential zoning district for more than four consecutive hours. Subd. 4. Subdivision 3 does not apply to parking: (A) on nonresidential properties; (B) in a fully enclosed garage or similar permanent structure; C) on a site under construction where the vehicles are related to the con struction activity in progress; or (D) of public or private utility or emergency first responder vehicles when approved by the City Administrator. (3722, 7/18/05; 3775, 6/19/06; 3860, 3/3/08) 134.24. Certain Vehicles Prohibited from Angle Parking. No vehicle or combination of vehicles exceeding 20 feet in length shall stop, stand or park in any place or space lined or marked for angle parking. 134.25. Restrictions on Primary Traffic Streets; Two-Way Streets. On two-way streets where the width of the roadway or the distance between the curbs is less than 30 feet, no person shall park any vehicle at any time except for the purpose of loading or unloading commodities, and such stops shall not be for a longer period of time than necessary to accomplish such purpose. On two-way streets where the width of the roadway or the distance between the curbs is 30 feet or more but less than 36 feet, parking is prohibited on one side of such street and no person shall park any vehicle on that side of such street on which the council has prohibited parking, except for the purpose of loading and unloading commodities, and such stops shall not be for a longer period of time than necessary to accomplish such purpose. 134.26. Restrictions on Primary Traffic Streets; One-Way Streets. On a one-way CHAPTER 134. PARKING REGULATIONS Updated 2018 134-11 street where the width of the roadway or the distance between the curbs is less than 28 feet, no person shall park any vehicle at any time except for the purpose of loading or unloading commodities, and such stops shall not be for a longer period of time than necessary to accomplish such purpose. On one-way streets where the width of the roadway or the distance between the curbs is 28 feet or more but less than 34 feet, parking is prohibited on one side of such street and no person shall park any vehicle on that side of such street on which the council has prohibited parking, except for the purpose of loading and unloading commodities, and such stops shall not be for a longer period of time than necessary to accomplish such purpose. 134.27. Primary Traffic Streets; Exceptions. Subdivision 1. The council may make exceptions to the parking restrictions and prohibitions set forth in sections 134.25 and 134.26 in justifiable cases where the safety and convenience of the traveling public will not be substantially impaired. Subd. 2. The city engineer may make exceptions to the parking restrictions and prohibitions set forth in sections 134.25 and 134.26 in justifiable cases when: A. There is no viable option to the requested exception; B. The safety and convenience of the traveling public will not be substantially impaired; and, C. The exception will not be in effect for more than seven days. (3870, 5/19/08) 134.28. Parking Zones; General Limitation. Subdivision 1. Except as provided in Subdivision 2, no person, including any person in possession of a parking privilege for physically disabled certificate issued by state law, shall park any vehicle in any parking zone for a longer consecutive period of time than is designated on the signs, markings or parking meter instruction plates posted, painted or erected in such zone. In those zones or areas where no signs, markings or parking meter instruction plates are posted, painted or erected, no person, including any person in possession of a parking privilege for phys ically disabled certificate issued by state law, shall park any vehicle for more than 12 consecutive hours. Subd. 2. A person in possession of a parking privilege for physically disabled certificate issued by state law may park for a maximum of four hours at one-hour, 90-minute, two-hour and three-hour parking meters. (3803, 2/21/07; 3880, 8/18/08; 3896, 11/3/08) CHAPTER 134. PARKING REGULATIONS Updated 2018 134-12 134.29. Limited Parking Zones. Subdivision 1. The following limited parking zones are hereby established and parking in such zones is limited as indicated in this section on the days and between the hours established by the council pursuant to Section 134.48. Subd. 2. Zone A. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicles is limited to 12 consecutive minutes. Subd. 3. Zone B. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to 20 consecutive minutes. Subd. 4. Zone C. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to 30 consecutive minutes. Subd. 5. Zone D. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to 60 consecutive minutes. Subd. 6. Zone E. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to 90 consecutive minutes. Subd. 7. Zone F. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to two consecutive hours. Subd. 8. Zone G. All those streets or parts of streets hereafter designated by the council and so signed or marked on which the parking of any vehicle is limited to three consecutive hours. 134.30. Moving Vehicles to Avoid Overparking. Moving Vehicles to Avoid Overparking. For purposes of determining a violation, a vehicle shall be considered to have remained parked or to have been re-parked within the same block, lot, or ramp when it is established that the same vehicle has been found parked along either side of the same street or road between two intersecting roads, or has been parked within the same lot or ramp at any time within a four hour period, regardless of any evidence that the vehicle was moved between the time it was initially parked and later re-parked. Each 12-, 20-, 30-, 60-, 90-, 120-, 180-minute or other time-limited period during which a vehicle is parked shall constitute a separate and additional violation. (4354, 9/17/18) CHAPTER 134. PARKING REGULATIONS Updated 2018 134-13 134.31. Removing Marks. No person shall obliterate, erase or remove any mark or sign placed on a vehicle by a police officer for the purpose of measuring the length of time such vehicle has parked. 134.32. Parking Meters; Installation. The council may purchase parking meters and have the same installed in all or part of any limited parking zone for the purpose of regulating the parking of vehicles in such zone and for the purpose of collecting a fee for parking where such meters are installed. All installations and removals of parking meters shall be under the control and by authority of the council. In those limited parking zones or parts of limited parking zones where parking meters have been installed by authority of the council, the parking of vehicles shall be regulated and controlled not only by the parking limits applicable to such zones but also by the regulations and provisions hereinafter set forth in this section relating to parking meters. The installation of parking meters in any limited parking zone shall be prima facie evidence that the council has authorized such installation and that the parking of vehicles in such zone is regulated and controlled by parking meters, wherever installed. 134.33. Parking in Metered Areas. No person shall park a vehicle in any limited parking zone where parking meters have been installed, except in accordance with the provisions of this section relating to parking meters, which parking limits and parking meter provisions shall be set forth on the parking meter instruction plates or on signs erected or painted in the area. 134.34. Use of Parking Meters. Subdivision 1. When the operator of any vehicle parks the same in a parking meter space, the operator shall immediately deposit or cause to be deposited in the parking meter installed for such space the coin of the United States prescribed for such meter on the instruction plate attached. Upon such coin being deposited, the parking meter space may then be occupied by such vehicle for the period of time indicated on the parking meter time dial or for the period of the parking limit established for the particular limited parking zones, whichever is shorter. Subd. 2. A vehicle is unlawfully parked: (A) If it remains in such block, lot, or ramp beyond the legal parking limit established for the particular limited parking zone; or (B) When such parking meter displays a sign or signal indicating a parking violation and payment has not been made by alternative city-authorized payment method. (4354, 9/17/18) Subd. 3. This section does not apply to, and is not enforceable against, a person who parks in a parking meter space on any of the following holidays: New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day. When any of the holidays falls on a Saturday, the preceding Friday shall be considered the CHAPTER 134. PARKING REGULATIONS Updated 2018 134-14 holiday. When any of the holidays falls on a Sunday, the succeeding Monday shall be considered the holiday. Subd. 4. This section does not apply to vehicles that are owned by a governmental entity and are being operated when the vehicle’s driver is on duty or performing a governmental service. (3750, 2/22/06; 3774, 6/19/06) 134.35. Parking Meter Fees. Subdivision 1. The fees for parking in parking meter spaces are established in this section. Subd. 2. Parking fee for Zone A (12 minutes) is: 12 minutes - token or 5 cents (minimum charge and maximum parking time) Subd. 3. Parking fee for Zone B (20 minutes) is: 5 minutes - Token or 5 cents (minimum charge) 10 minutes - 10 cents 20 minutes - 20 cents (maximum parking time) Subd. 4. Parking fee for Zone C (30 minutes) is: 12 minutes - token or 5 cents (minimum charge) 24 minutes - 10 cents 30 minutes - 15 cents (maximum parking time) Subd. 5. Parking fee for Zone D (60 minutes) is: 12 minutes - token or 5 cents (minimum charge) 24 minutes - 10 cents 60 minutes - 25 cents (maximum parking time) Subd. 6. Parking fee for Zone E (90 minutes) is: 12 minutes - token or 5 cents (minimum charge) 24 minutes - 10 cents 60 minutes - 25 cents 90 minutes - 40 cents (maximum parking time) Subd. 7. Parking fee for Zone F (2 hours) is: 12 minutes - token or 5 cents (minimum charge) CHAPTER 134. PARKING REGULATIONS Updated 2018 134-15 24 minutes - 10 cents 60 minutes - 25 cents 2 hours - 50 cents (maximum parking time) Subd. 8. Parking fee for Zone G (3 hours) is: 12 minutes - token or 5 cents (minimum charge) 24 minutes - 10 cents 1 hour - 25 cents 3 hours - 75 cents (maximum parking time) Subd. 9. Parking fee for Zone H (10 hours) is: 30 minutes - token or 5 cents (minimum charge) 1 hour - 10 cents 2 1/2 hours- 25 cents 10 hours - $1.00 (maximum parking time). Subd. 10. Fee for Meter Bags is $6.00 for each 30-minute, 90-minute, two- hour, and three-hour meters for each enforcement day. Fee for Meter Bags is $3.00 for each ten-hour meter for each enforcement day. There is no fee for Meter Bags for loading zones. A minimum set-up charge based on $3.00 for each metered space for each event would be charged for set-up and signing for weekend or holiday parking. (For example, if ten meters were needed to be blocked off for Saturday and Sunday, the charge would be $30.00.) This subdivision does not apply to city construction projects, parades, city-sponsored or non-profit organization-sponsored events, security/emergency events, and events involving dignitaries. (4092, 11/5/12) 134.36. Unused Meter Time. When the operator of any vehicle parks the same in a parking meter space and the time dial of the parking meter installed for such space indicates that unused meter time remains, then such vehicle may be parked in such space for the period of unused meter time remaining without depositing additional coins. 134.37. Slugs Prohibited. No person shall deposit or cause to be deposited in any parking meter any slug, device or substitute for a coin of the United States. 134.38. Tampering Prohibited. No person shall deface, tamper with, open, or willfully injure, break, destroy or impair any parking meter installed by authority of the council, except that designated employees of the city may open said meters for the purpose of repairing or maintaining the same or making collections therefrom. 134.39. Installation of Posts. Installation of necessary parking meter posts shall be done by the city engineer or under contract subject to the supervision and control of the city CHAPTER 134. PARKING REGULATIONS Updated 2018 134-16 engineer. 134.40. Collections. Installation, maintenance and repair of parking meter heads, together with collection of coins deposited therein, shall be done by designated city employees under the control and supervision of the Director of Public Services. All coins collected from parking meters shall be delivered forthwith by such designated employees to the city treasurer. 134.41. Parking Meter Fund. There is established a parking meter fund into which shall be deposited all fees collected from parking meters for parking in metered spaces. Expenditures may be made by the council from the parking meter fund for any purpose authorized by law. 134.42. Moving Parked Vehicles. No person shall move a vehicle not owned to him into any prohibited area or away from a curb such distance as is unlawful. 134.43. Impounding. Any unoccupied vehicle found parked in violation of the provisions of this chapter may be immediately removed and impounded by any police officer or person duly authorized by such police officer. The cost of removing and impounding such vehicle shall be borne by the owner thereof. 134.44. Tampering with Vehicles. No person shall molest any vehicle parked on any street or alley without the consent of the owner or driver of such vehicle, nor shall any person set such vehicle in motion or otherwise damage or interfere with the same. 134.45. Moving for Street Maintenance, etc. Whenever the city engineer or assistants, for the purpose of facilitating street maintenance operations, including snow removal, find it necessary to move any vehicle parked on any street or alley in the city, said city engineer or assistants are authorized to move such vehicle to the extent necessary for such purpose. 134.46. Disabled Vehicles. Subdivision 1. The provisions of this chapter relating to stopping, standing and parking of vehicles shall not apply to the owner or driver of any vehicle which is disabled while on the roadway of any street or alley in such manner and to such extent that it is impossible to avoid stopping and temporarily leaving such disabled vehicle in an illegal position. Subd. 2. Notwithstanding the provisions of Subdivision 1, any police officer finding a vehicle unattended upon any street or alley where such vehicle constitutes an obstruction to traffic or a safety hazard is authorized to provide for the vehicle’s removal. The vehicle’s owner will be responsible for the costs of the vehicle’s removal. CHAPTER 134. PARKING REGULATIONS Updated 2018 134-17 134.47. Permissible Inference of Violation. Based on the presence of a vehicle in or upon any street or alley in the city, stopped, standing or parked in violation of this chapter, a fact finder may reasonably infer that in light of the surrounding circumstances shown by the evidence of the case, the person in whose name such vehicle is registered as owner committed or authorized the commission of the violation. 134.48. Council to Designate Zones. When the provisions of this chapter require further action by the council to designate, establish or provide for angle parking, no parking zones, truck loading zones, passenger loading zones, primary traffic streets, one-way streets, prohibited or restricted parking on primary traffic streets, streets or parts of streets included in limited parking zones, installation of parking meters in limited parking zones, or any other detail or action to be supplied or taken by the council, the same shall be by written resolution, and following the adoption of such written resolution the action taken thereby shall be conveyed to the public by signs, markings, parking meter instruction plates, traffic control devices or any other authorized means whereby the public will be apprised of such action. 134.49. Parking Lot and Cleaning, Maintenance, Construction. No person, unless authorized by the Public Works Department to do so, shall park a vehicle in a City public parking lot, or any portion thereof, that has been signed for no parking for cleaning, maintenance, or construction activities. The no parking areas designated under this section shall go into effect no earlier than 12 hours after the signs have been posted, and shall remain in effect until removed at the dire ction of the Public Works Department or the City’s contracted parking management company. A violation of any provision of this section will result in the towing and impounding of the violator’s vehicle. All costs associated with towing, impoundment and storage shall be the responsibility of the vehicle owner. The order for towing shall be placed by the Rochester Police Department, Public Works Department, or the City’s contracted parking management company.
