HomeMy WebLinkAboutResolution No. 284-25 - Resolution - CD2025-007VAC Olmsted Medical Center RESOLUTION Approving Vacation Petition No. CD2025-007VAC by Olmsted Medical Center, to Vacate a 66-Foot-Wide Public Right-of-Way Having a Length of Approximately 450 Feet, Dedicated for the 19th Ave. SE Street Alignment, South of College Parkway SE. WHEREAS Olmsted Medical Center, requests that the city vacate an existing public right- of-way; and WHEREAS Section 17.00 of the City of Rochester Home Rule Charter states that, “the Common Council may, by resolution adopted by five affirmative votes, vacate any public street, alley, way, grounds, or easement, or any part thereof, upon its own motion or by acting upon a petition filed by the owners of at least fifty percent of the lands which abut the line of the portion of the public street, alley, way, grounds or easement, or parts thereof, proposed to be vacated”; and WHEREAS Section 17.00 of the City of Rochester Home Rule Charter further states that “no vacation shall be made unless the Common Council finds that to do so is in the public interest”; and WHEREAS Rochester Community Development filed the petition in their office and, by publication in the official newspaper at least ten days prior to the public hearing, gave notice that the petition had been filed, briefly stating its request, and stated that the petition would be heard and considered by the Common Council on November 17, 2025; and WHEREAS on the basis of the petition filed, the testimony and evidence presented by interested parties, and the investigation and consideration of the matter by the Common Council, it appears that it is in the best interests of the members of the public to vacate the right-of-way; and WHEREAS the specific areas in which are to be vacated are provided by the following legal description and as depicted by the Map attached to this resolution. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the easement described as follows is hereby vacated and abandoned. AREA OF RIGHT-OF-WAY RELEASE That part of the Northwest Quarter of the Northwest Quarter of Section 6, Township 106 North, Range 13 West, Olmsted County, Minnesota, described as follows: Commencing at the northwest corner of the Northwest Quarter of the Northwest Quarter of said Section 6; thence South 00 degrees 31minutes 37 seconds East, assumed bearing, along the west line of said Northwest Quarter of the Northwest Quarter, 861.52 feet to the southerly line of the 25 foot Temporary Pedestrian Facilities Easement as described and recorded in Document Number A-1396743, in Olmsted County, for the point of beginning; thence continue South 00 degrees 31minutes 37 seconds East, along said west line of the Northwest Quarter of the Northwest Quarter, 455.14 feet to the southwest corner of said Northwest Quarter of the Northwest Quarter; thence North 89 degrees 30 minutes 09 seconds East, along the south line of said Northwest Quarter of the Northwest Quarter, 33.00 feet to a line which is 33.00 feet easterly of, as measured at right angles to and parallel with, the west line of said Northwest Quarter of the Northwest Quarter; thence North 00 degrees 31minutes 37 seconds West, along said parallel line, 454.35 feet to the southerly line of said 25 foot Temporary Pedestrian Facilities Easement; thence North 89 degrees 07 minutes 05 seconds West, along said southerly easement line, 33.01feet to the point of beginning. and, That part of the 33.00 foot right of way easement as described and recorded in Document Number 510630 in Lot 18, AUDITOR'S PLAT-A, Olmsted County, Minnesota, described as follows: Commencing at the northwest corner of the Northwest Quarter of the Northwest Quarter of Section 6, Township 106 North, Range 13 West; thence South 00 degrees 31minutes 37 seconds East, assumed bearing, along the west line of said Northwest Quarter of the Northwest Quarter, 861.52 feet to the southerly line of the 25 foot Temporary Pedestrian Facilities Easement as described and recorded in Document Number A-1396743, in Olmsted County, for the point of beginning; thence continue South 00 degrees 31minutes 37 seconds East, along said west line of the Northwest Quarter of the Northwest Quarter, 413.99 feet to the southeast corner of Lot 18 in said AUDITOR'S PLAT-A; thence North 89 degrees 37 minutes 09 seconds West, along the south line of said Lot 18, a distance of 33.00 feet to a line which is 33.00 feet westerly of, as measured at right angles to and parallel with, the west line of said Northwest Quarter of the Northwest Quarter; thence North 00 degrees 31minutes 37 seconds West, along said parallel line, 413.56 feet; thence North 89 degrees 28 minutes 23 seconds East, 33.00 feet to the point of beginning. BE IT FURTHER RESOLVED that the City has approved Vacation Petition No. CD2025- 007VAC.
