3. DEFINITIONS
3.01. Minnesota Definitions Apply. Unless clearly in conflict with definitions or other
provisions of this code or otherwise clearly inapplicable, the definitions contained in Minnesota
Statutes, chapter 645 and other Minnesota statutes or case law shall apply to this code.
3.02. Certain Terms Defined. Subdivision l. As used in this code unless the particular
context clearly requires some other meaning, the following terms shall have the meanings
given in this section.
Subd. 2. "Charter" means the Rochester city charter.
Subd. 3. "City" means the City of Rochester, Minnesota.
Subd. 4. "Code" means the Rochester Code of Ordinances.
Subd. 5. "Council" means the Common Council of the City of Rochester.
Subd. 6. "Person" means any individual, corporation, firm, partnership, association,
organization, or other group acting as a unit. It also includes any executor, administrator,
trustee, receiver, or other representative appointed by law. Whenever the word 'person' is
used in any section prescribing a penalty or fine, it shall include the partners or members of
any partnership and the officers, agents, or members of any corporation, who are responsible
for the violation.
Subd. 7. "Property" means tangible or intangible, real, personal, or mixed property.
Subd. 8. "Sidewalk" means that portion of the street between the curb line and the
adjacent property line intended for the use of pedestrians.
Subd. 9. "State" means the State of Minnesota.
Subd. 10. "Street" means any public way, highway, street, avenue, boulevard, alley, or
other public thoroughfare. Each of said words shall include the others, and, if the context
permits, shall also include sidewalks.
3.03. Other Definitions. Certain chapters of this code contain other definitions
applicable particularly to such chapters. In case of any conflict between the definitions in 3.02
and such other definitions, the other definitions shall prevail in the chapters where applicable.

3.04. Fiscal Year. Pursuant to the authority contained in section 11.00 of the Charter,
as amended, the fiscal year of the city is established as the calendar year; i.e. from and
including January 1 to an including December 31 of each year.
