HomeMy WebLinkAboutResolution No. 298-25 - Resolution - CD2025-008CUP Broadway Park and Ride RESOLUTION Approving Conditional Use Permit No CD2025-008CUP, a request by the City of Rochester to permit a parking garage in the MXT-NOD zoning district. WHEREAS, the City of Rochester requested approval for Conditional Use Permit No. CD2020-008CUP for a parking garage in the MXT-NOD zoning district. The site is 11.54 acres and is located northwest of the intersection of Elton Hills Dr NW and Broadway Ave N. WHEREAS, Findings 1-6 in the staff report are adopted. th WHEREAS, on November 12, 2025, the City of Rochester Planning and Zoning Commission reviewed the application according to the requirements of Section 60.500.050A.4. of the Unified Development Code and recommended approval with staff’s recommended findings and conditions. th WHEREAS, on December 8, 2025, the City of Rochester Common Council held a public hearing to consider this application and adopted findings of fact and recommended approval subject to the conditions listed below, based on the Conditional Use Permit Site Plan Exhibit. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based on the above stated findings of fact, the applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the conditions of approval stated below. BE IT FURTHER RESOLVED, that the Common Council of the City of Rochester approve Conditional Use Permit No. CD2020-008CUP requested by the City of Rochester subject to the below stated conditions of approval: 1. Prior to issuance of a building permit, the applicant shall submit to Community Development an updated set of building elevations demonstrating that the proposed parking garage meets the design standards in the UDC, including 360-degree architecture and horizontal articulation; or that the applicant obtain approval for design modification to the satisfaction of the Community Development Department. 2. Prior to issuance of a building permit, Civil Plans, Stormwater Management Plans, and Grading Permit shall be approved. 3. Prior to issuance of a building permit, RPU Electric comments shall be addressed. 4. Prior to issuance of a building permit, RPU Water comments shall be addressed. 5. Prior to issuance of a building permit, Rochester Fire Department comments shall be addressed. 6. Prior to issuance of a building permit, a Final Plat for Recreation Center shall be approved and recorded.
