HomeMy WebLinkAboutCHAPTER 37CHAPTER 37. HOUSING CODE. CONDEMNATION AND REMOVAL Updated 2014 37-1 37. HOUSING CODE. CONDEMNATION AND REMOVAL OF UNFIT BUILDINGS 37.01. Condemnation of Dwellings and Apartments. Any dwelling or apartment which shall be found to have any of the following defects shall be condemned as unfit for human habitation and shall be so designated and placarded by the director of building and safety: (1) One which is so damaged, decayed, dilapidated, unsanitary, unsafe, or vermin- infested that it creates a serious hazard to the health or safety of the occupants or of the public. (2) One which lacks illumination, ventilation or sanitation facilities adequate to protect the health or safety of the occupants or of the public. (3) One which because of its general condition or location is unsanitary, or otherwise dangerous, to the health or safety of the occupants or of the public. 37.02. Vacating of Condemned Dwellings and Apartments. Any dwelling or apartment condemned as unfit for human habitation, and so designated and placarded by the director of building and safety, shall be vacated within a reasonable time as ordered by the director of building and safety. 37.03. Use of Condemned Buildings and Apartments Prohibited. No dwelling or apartment which has been condemned and placarded as unfit for human habitation shall again be used for human habitation until written approval is secured from, and such placard is removed by the director of building and safety. The director of building and safety shall remove such placard whenever the defect or defects upon which the condemnation and placarding action were based have been eliminated. 37.04. Removal or Demolition of Condemned Dwellings. Any dwelling which has been condemned as unfit for human habitation and cannot be repaired as to comply with the minimums set in this code or any building which because of inadequate maintenance, dilapidation, physical damage, unsanitary condition or abandonment, constitutes a fire hazard or a hazard to public safety or health, may be removed or demolished by the city, following the procedures established by Minnesota Statutes, sections 463.15 to 463.261. 37.05. Removal of Placard Prohibited. No person shall deface or remove the placard from any dwelling or apartment which has been condemned as unfit for human habitation and placarded as such, except as provided in 37.03. CHAPTER 37. Any person affected by any notice or order relating to the condemning and placarding of a dwelling or apartment as unfit for human habitation may request and shall be granted a hearing on the matter before the board, under the procedure set forth in Chapter 33. 37.07. Enforcement. The city attorney may enforce any provision of this chapter, including any order to vacate condemned dwellings and apartments, by mandamus, injunction, or any other appropriate remedy in any court of competent jurisdiction.
