HomeMy WebLinkAboutCHAPTER 42 CHAPTER 42. GROUND TRANSPORTATION AT AIRPORT Updated 2015 42-1 42. GROUND TRANSPORTATION AT AIRPORT 42.01. Definitions. Subdivision 1. As used in this chapter, the following terms shall have the meaning ascribed to them. Subd. 2. Airport" means the Rochester International Airport in High Forest Township, Olmsted County, approximately 9 miles south of the city. (4205, 8/17/15) Subd. 3. "Airport Executive Director" means the person authorized by the city to manage the airport. (4205, 8/17/15) Subd. 4. "Ground transportation carrier" means any person operating buses, limousines, taxicabs or other vehicles for hire pursuant to a permit, license or franchise granted by the State of Minnesota, the city, or any other duly authorized governmental authority to transport members of the traveling public to or from the airport. Subd. 5. "Terminal building" means the building on the airport designated by the city for the use of the public and the certificated airlines to process, enplane and deplane airplane passengers and to provide space for various concessions, services, supplies and convenience for the public. 42.02. Regulation of Parking. The council by written resolution may regulate parking on the airport; establish, locate and relocate loading zones for ground transportation carriers, trucks, and for use by the general public; provide special parking areas for vehicles available for hire on a rental basis; and impose parking fees. In regulating parking on the airport the council shall take into consideration the needs, conveniences, safety and welfare of the traveling public; the amount of public ground transportation needed to meet the requirements of the public; the needs and regulations of the airlines operating through the terminal buildings; the efficient and orderly operation of the terminal building and the airport; the safe, orderly and efficient movement of the public into, through, and out of the terminal building and the airport; traffic hazards involved; and such other considerations as relate to the matter of parking. (4205, 8/17/15) 42.03. Regulation and Procedure. The following provisions of the code shall apply to the airport and shall govern the parking of vehicles and conduct of persons on the airport, and any references in said sections to streets or parts of streets shall be deemed also to refer to the airport or any part thereof: 134.29 (limited parking zones), 134.31 (removing marks), 134.40 (collections), 134.43 (impounding), 134.44 (tampering with vehicles), 134.47 (prima facie evidence of violation), and 134.48 (council to designate zones). (4205, 8/17/15) CHAPTER 42. GROUND TRANSPORTATION AT AIRPORT Updated 2015 42-2 42.04. General Parking Limitations. It is unlawful for any person, except for drivers of authorized airport operations/maintenance vehicles and emergency vehicles, to park a vehicle on the airport in any place where such parking is prohibited, or for a longer consecutive period of time than is designated for such space on the signs or markings posted, painted or erected in the area, or in any place regulated by a parking meter except in accordance with the parking instructions set forth on the parking meter instruction plate or on signs erected or painted in the area. (4205, 8/17/15) 42.05. Airport Parking Meter Fees. Repealed by Ordinance No. 4205 on August 17, 2015. 42.06. Parking Meter Fund. Repealed by Ordinance No. 4205 on August 17, 2015. 42.07. Petty Misdemeanor. Each violation of an airport parking regulation shall be a petty misdemeanor punishable by a fine of not more than $300.00. 42.08. Airport Police. The police officers of the city police department are appointed airport police with full police powers to enforce all laws, ordinances, rules and regulations applicable to the airport and to such portion of the territory as adjoins or lies within one mile of the limits of the airport as is subject to the control and management of the city. 42.09. Solicitation of Passengers. All drivers of taxicabs, buses, limousines and other vehicles for hire and all other employees of ground transportation carriers, while on duty and soliciting passengers, shall be and remain within three feet of their respective vehicles. Such drivers and employees are prohibited from soliciting passengers at any point or place in the terminal building including specifically the baggage areas thereof. The presence of any such driver or employee in the terminal building in the ticket, baggage or waiting room areas while airplane passengers are being discharged or while passengers are waiting for ground transportation, shall be deemed to be solicitation and shall constitute a violation of this chapter. 42.10. Regulation of Drivers. Whenever any driver of a taxicab or limousine or any other employee of a ground transportation carrier, while on duty, desires to use the facilities of the terminal building for personal needs, such person shall, while in the terminal building, have his or her cap and any other badge or identifying insignia removed. any such driver or employee who has procured a passenger whose baggage or any part thereof is still in the terminal building, may enter the terminal building for the sole purpose of obtaining such baggage, provided such driver or employee has in possession the passenger's baggage claim check or checks, enters the terminal building only after such baggage is available to be claimed, immediately claims such baggage and immediately thereafter leaves the terminal CHAPTER 42. The airport manager shall maintain at appropriate places within the terminal building, signs which shall advise or inform the public of the various types of ground transportation available and the cost or approximate cost of such transportation between the airport and the city when such cost has been fixed by governmental authority. 42.12. Registration of Ground Transportation Carriers. No business or person shall provide ground transportation services to the Airport without first registering with the Airport Executive Director and providing the following: A. Identify whether the registrant is an individual, corporation, partnership or other form of organization. B. Provide the name of a contact person and the address, phone number, and email address for that person. C. Identify registrant’s vehicles that will be used to provide ground transportation carrier service by year, make, model, and license number. D. Execution of an airport transportation provider agreement if deemed necessary by the Rochester Airport Company. (4205, 8/17/15) 42.13. Airport Access Fee. Every business or person providing ground transportation carrier service to the Airport shall pay a per trip airport access fee each time one of its vehicles is driven to the Airport to pick up or drop off a passenger. This fee may be collected from the passenger. The Council shall establish the amount of fee by resolution. For taxicabs charging a flat rate fee for service between the Airport and the Downtown District as defined in 95A.16, the airport access fee shall be included within that flat rate fee. It shall be the responsibility of the business or person providing ground transportation carrier services to keep a daily manifest upon which shall be recorded each time that business or person arrived at the Airport to pick up or drop off a passenger. All trip fees shall be paid monthly and not later than the fifth day of the following month. A copy of the manifest shall be presented with payment. (4205, 8/17/15) 42.14. Violations; Registration Revocation. It shall be a misdemeanor for any business or person to provide ground transportation carrier services without first being registered, except that the first violation shall be a warning. It shall be a misdemeanor for CHAPTER 42. GROUND TRANSPORTATION AT AIRPORT Updated 2015 42-4 any business or person providing ground transportation carrier services to fail to pay the monthly per trip access fees in a timely manner.
