45C. USE OF MOTORIZED VEHICLES OR MOTORIZED BOATS
45C.01. Purpose, Intent And Application: As authorized by Minnesota Statutes 86B.
201, 86B 205, and 459.20, AND Minnesota Rules 6110.3000 – 6110.3800 as now in effect
and as hereafter amended, this Ordinance is enacted for the purpose and with the intent to
control and regulate the use of the waters of Silver Lake, Foster Arend Pond, Flood Control
Reservoir WR-6A and Cascade Lake in Rochester, Minnesota. These bodies of water are
located entirely within the boundaries of the City of Rochester. This Ordinance is intended
to: A) promote the fullest use and enjoyment by the public in general in said waters; B) to
insure safety for persons and property in connection with the use of said waters; C) to
harmonize and integrate the varying uses of said waters; and D) to promote the general
health, safety and welfare of the citizens of Rochester, Minnesota.
45C.02 Definitions: Terms used in this ordinance related to boating are defined in
Minnesota Statutes 86B.005, which terms are incorporated into this Ordinance by reference
as though fully set forth herein.
45C.03. Prohibitions. Subd. 1. No person shall operate or permit the operation of
any motorized vehicle, motorboat or any boat powered by an internal combustion engine
upon the waters of Silver Lake, Foster Arend Pond, Flood Control Reservoir WR -6A or
Cascade Lake except in compliance with this chapter.
Subd. 2. No person shall swim in Silver Lake, Foster Arend Pond, Flood Control
Reservoir WR-6A or Cascade Lake, except in those areas specifically designated for
swimming.
Subd. 3. Any violation of this section shall be a misdemeanor.
45C.04. Exemptions. Subd. 1. Motorized vehicles or motorboats used by rescue
personnel or authorized resource management personnel acting in the course of their
employment shall be exempt from this chapter.
Subd. 2. The City of Rochester Common Council may issue a permit allowing
the use of internal combustion engine boats at a specific location after review of a
reasonable request.
CHAPTER 45C. USE OF MOTORIZED VEHICLES OR MOTORIZED BOATS

45C.05 Use Standards. Subd. 1. Notwithstanding any other provision of this
chapter, the operation of motorized vehicles or motorboats powered by electric motors shall
be allowed provided that:
A. No person shall operate a motorized vehicle or motorboat in such a condition of
disrepair as to create loud, unreasonable or unnecessary grating, grinding, rattling,
or other noise.
B. No person shall create any loud, unreasonable or excessive noise in connection with
the unloading or unpacking of any motorized vehicle or motorboat.
