RESOLUTION
Adopting a Record of Decision for a Final Alternative Urban Areawide Review
(AUAR) for Rochester Technology Campus, for the future redevelopment of the
site.
WHEREAS, the laws of the State of Minnesota allow for a local unit of government to use
the Alternative Urban Areawide Review (AUAR) instead of the Environmental Assessment
Worksheet (EAW) or Environmental Impact Statement (EIS) to review anticipated
residential, commercial, warehousing, and light industrial development and associated
infrastructure in a particular geographic area within its jurisdiction (Minnesota Rules
4410.3610 Subpart 1); and
WHEREAS, the Rochester Technology Campus (“Project”) is within the City of Rochester
and meets the criteria established for the preparation of the AUAR; and
WHEREAS, the Project is required to provide a Scoping Document as an additional
procedure to the review process (Minnesota Rules 4410.3610 Subpart 5a); and
WHEREAS, an AUAR Scoping Document was prepared for the Project and reviewed by the
Development Review Team and the document was circulated for comments to the required
state and federal agencies, as provided by law; and
WHEREAS, a notice of the availability of the AUAR Scoping Document was published in
the EQB Monitor on August 20, 2024, and the thirty-day comment period expired on
September 19, 2024, and during such period two written comments were received; and
WHEREAS, the Common Council is required by law to make a finding on the adequacy of
the AUAR Scoping Document and to adopt the Final Order and a Record of Decision; and
WHEREAS, the Common Council met at a regularly scheduled meeting on December 13,
2024, and considered the AUAR Scoping Document, the reports of City staff, and the
comments received from the parties as noted above; and
WHEREAS, a Draft AUAR was prepared for the Project and reviewed by the Development
Review Team and the document was circulated for comments to the required state and
federal agencies, as provided by law; and
WHEREAS, a notice of the availability of the Draft AUAR was published in the EQB Monitor
on August 12, 2025, and the thirty-day comment period expired on September 11, 2025,
and during such period, two written comments were received; and
WHEREAS, the Final AUAR document was prepared for the Project and reviewed by the
Development Review Team and the document was circulated for comments to the required
state and federal agencies, as provided by law; and
WHEREAS, a notice of the availability of the Final AUAR was published in the EQB Monitor
on November 4, 2025, and the ten-day objection period expired on November 14, 2025, and
during such period no objections were filed; and
WHEREAS, the Common Council is required by law to adopt a Record of Decision for the
adequacy of the Final AUAR; and
WHEREAS, the Common Council met at a regularly scheduled meeting on January 5, 2026,
and considered the Final AUAR, City Staff reports, and received comments.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that the Common Council has officially adopted the Final AUAR for Rochester
Technology Campus.
BE IT FURTHER RESOLVED that nothing in this adoption of the Final AUAR should be
interpreted in any way to suggest that the City approves of future applications related to the
project.
