RESOLUTION
Approving Conditional Use Permit Amendment No. CD2025-010CUP, By UCI Tower,
for the Construction of an Unmanned Wireless Communications Facility Consisting
of a 105-Foot Monopole Tower and Ancillary Equipment in a R-2 (Low Density
Residential – Small Lot) Zoning District, Located at 1807 Marion Road SE.
WHEREAS, UCI Tower, Applicant, has requested approval for Conditional Use Permit
Amendment.
WHEREAS, the project is being proposed through the Conditional Use Permit Amendment
process; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, The Council adopts staff findings included within the staff memo dated
December 10, 2025, finding the proposal meets the regulations of UDC Section
60.300.020F(1) applicable to Commercial Wireless Telecommunication Service
facilities.
WHEREAS, on December 10, 2025, the City of Rochester Planning Commission
considered this application, along with application findings of fact, and recommended
approval of the subject application.
WHEREAS, on January 21, 2026, the City of Rochester Common Council held a public
hearing to consider this application, and adopted the findings of fact, as recommended by
the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that based on the above-stated findings, the Applicant has shown, by a preponderance of
the evidence submitted at the public hearing, the application satisfies the Conditional Use
Permit Approval Criteria provided within UDC Section 60.500.050.A.4.
