WHEREAS, West 34 Partners LLC. has requested from the City of Rochester Final Plat approval for a subdivision to be known as Badger Heights. WHEREAS, the Final Plat proposes 32 residential lots on 8.5 acres of land located th northeast of the intersection of 50 Ave NW and Valleyhigh Rd NW. WHEREAS, the Council adopts the findings as described in the Community Development memo dated February 2, 2026, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on February 2, 2026, the City of Rochester Common Council held a public hearing to consider a Final Plat application for the development, adopted the findings of fact, and approved the Final Plat subject to five conditions. NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester, at a public hearing duly noticed and held on February 2, 2026, the following plat of lands in Olmsted County, Minnesota is to be known and designated as follows: Outlot A and Outlot B, BADGER HEIGHTS, according to the recorded plat thereof, Olmsted County, Minnesota Property is Abstract TO BE KNOWN as “Badger Heights Second”, by West 34 Partners LLC. Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to the recordation of the Final Plat, updated Civil Plans, Grading Plan, and Stormwater Management Plan for the Badger Heights Second subdivision must be approved by Rochester Public Works. 2. Prior to the recordation of the Final Plat, a City-prepared Revocable Permit and Agreement is required for the proposed retaining wall to be located within the 20- foot-wide drainage and utility easement located adjacent to the east property line of Lots 1 through 5, Block 3. 3. Prior to the recordation of the Final Plat, dedication of a 5-foot-wide pedestrian facilities easement is required for the pedestrian path that will be constructed on the private property adjacent to the north property line of proposed Block 3. 4. Prior to the recordation of the Final Plat, the required Parkland Dedication fee shall be paid to the Rochester Parks & Recreation Department. 5. Prior to the recordation of the Final Plat, the required Final Plat GIS fees shall be paid to Olmsted County Public Works.
