RESOLUTION
Approving Conditional Use Permit No CD2025-007CUP, a request by ML Group I
LLC, for the placement of excavated fill within the 100-year Flood Prone subdistrict
and compensatory stormwater area improvement for the future development of a
multifamily development project.
WHEREAS, the ML Group I LLC requested approval for Conditional Use Permit No.
CD2025-007CUP for the placement of excavated fill within the 100-year Flood Prone
subdistrict and compensatory stormwater area improvement for the future development of
a multifamily development project located southeast of the intersection of Country Club Rd

W and 45 Ave SW.
WHEREAS, Findings 1-6 in the Community Development Memo dated January 28, 2026,
are adopted.
WHEREAS, on January 28, 2026, the City of Rochester Planning and Zoning Commission
reviewed the application according to the requirements of Section 60.500.060H.4 of the
Unified Development Code and recommended approval with City teammates’ findings and
conditions.

WHEREAS, on February 18, 2026, the City of Rochester Common Council held a public
hearing to consider this application and adopted findings of fact and recommended approval
subject to the conditions listed below, based on the Community Development Memo dated

January 28, 2026.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based on the above stated findings of fact, the applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria, subject to the imposition of the conditions of approval stated below.
BE IT FURTHER RESOLVED, that the Common Council of the City of Rochester approve
Conditional Use Permit No. CD2025-007CUP requested by the ML Group I LLC, subject to
the following conditions of approval:
1. The work contained within the Conditional Use Permit is subject to a grading permit
approval. No work may commence until a grading permit has been obtained.
2. Any permanent or temporary wetland impacts will need to be permitted with the
Technical Evaluation Panel prior to any work commencing.
3. A second Floodplain Development Permit is required for future construction of
buildings on the site.
