HomeMy WebLinkAboutResolution No. 045-26 - Resolution - CD2026-001PLAT - Westbury 1st Major Land Subdivision RESOLUTION Approving Major Land Subdivision No. CD2026-001PLAT, To Be Known As Westbury First, A Project Consisting Of 105 Single-Family Residential Lots On 34.4 th Acres, Located East of 60 Avenue NW and 500 Feet South of King Aurthur Road NW. WHEREAS, Bigelow Homes LLC. requested from the City of Rochester approval of a Major Land Subdivision to be known as Westbury First. WHEREAS, the Major Land Subdivision proposes 105 Single-Family Residential Lots, on 34.4 acres of land east of 60th Ave NW and approximately 500 feet south of King Arthur Road NW. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated January 28, 2026, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on January 28, 2026, the City of Rochester Planning Commission reviewed the application and recommended approval subject to five conditions. WHEREAS, on February 18, 2026, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to five conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated four conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2026-001PLAT, requested by Bigelow Homes, LLC, subject to the five conditions of approval shown below: CONDITIONS 1. Prior to the submission of a Final Plat, the following Public Works items shall be addressed: a. Civil Plans, Grading Plan, and Stormwater Management Plan have been submitted for review, and approval will be required as part of the subdivision approval process for this property. The current street geometry should be considered conceptual. b. Execution of a new / updated Development Agreement to replace the existing agreement is required to address applicable terms and obligations related to the current development proposal. Owner’s execution of the City-prepared new / updated development agreement is required prior to recording the Final Plat for the first phase of development. c. Proposed “Outlot A” should not extend to Cambry Avenue NW between Lot 34, Block 4, and Lot 1, Block 5. Plans shall be revised to include this area as part of said Lot 34, Block 4, and Lot 1, Block 5. The area currently shown as an extension of proposed Outlot A to Cambry Ave NW shall be dedicated as a drainage and utility easement for the proposed public utilities to be installed in this area. d. Proposed Outlot C should be incorporated as part of Outlot B for this phase of development. Dedication of a Temporary Drainage & Utility Easement may be needed over all of the updated Outlot B, in lieu of dedicating separate temporary easements for utility stubs defined temporary drainage easements off stub streets. 2. The Utility Easement linework shall continue across the park and “Outlot A” parcels unless parcels are also covered entirely with a UE. The applicant shall provide corrections on the Final Plat application, subject to the satisfaction of RPU Electric. 3. Phase one development only has a single fire department apparatus access road shown which does not fulfil Fire Department Requirements. Applicant shall sprinkle homes as noted on “Option A” provided by the Fire Department or provide temporary fire department access road along south side as demonstrated by “Option B” provided by the Fire Department. 4. This plat is currently responsible for 9.12 acres of Parkland dedication. The identified 8.16-acre park will satisfy a portion of this. The remaining .96 acres should be fulfilled via cash-in lieu of land. 5. The name for HAZEL DR NW should be changed to HAZEL ST NW.
