RESOLUTION
Approving Annexation No. CD2026-002ANX, to Annex Approximately 175 Acres,

Generally Situation South of Valleyhigh Dr NW, East of 60 Ave NW, North of 19 St

NW and West of 50 Ave NW in Section 30, Township 107 North, Range 14 West, in
Accordance with the Second Term Outlined in the Joint Resolution for Designation
of Certain Land and Orderly Annexation Agreement, Approved on March 11, 2024.
WHEREAS, a joint Resolution for Orderly Annexation between the City of Rochester and
Cascade Township, known as Joint Resolution for Designation of Certain Land and Orderly
Annexation Agreement, was accepted by the Office of Administrative Hearings on March
11, 2024; and
WHEREAS, the property owner has requested annexation of the subject site via Orderly
Annexation Resolution on March 30, 2026, pursuant to Minnesota Statute § 414.0325; and
WHEREAS, the subject Resolution provides a legal description encompassing the
approximate 175-acre site; and
WHEREAS, the Joint Resolution for Designation of Certain Land and Orderly Annexation
Agreement establishes that lands ordered annexed pursuant to the Agreement will not be
subject to any differential taxation as referenced in Minnesota Statute § 414.0325 and
property taxes payable on annexed land shall continue to be paid to the Township for the
entire year in which the annexation becomes effective.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester,
MN, that the area of land located within Section 30, Township 107 North, Range 14 West,
Olmsted County, Minnesota, be annexed into the City of Rochester Incorporated Limits in
accordance with the Joint Resolution for Designation of Certain Land and Orderly
Annexation Agreement between the City of Rochester and Cascade Township, more
particularly described herein by the following legal description:
Legal Description
The East Half of the Northwest Quarter, and those parts of the West Half of the
Northeast Quarter, and the Southeast Quarter of the Northeast Quarter of Section 30,
Township 107 North, Range 14 West, Olmsted County, Minnesota, described as
follows:
Beginning at the North Quarter Corner of said Section 30; thence South 89 degrees 45
minutes 37 seconds East, assumed bearing, along the north line of the Northeast
Quarter of Section 30, a distance of 725.77 feet; thence South 00 degrees 14 minutes
29 seconds West 429.98 feet; thence South 45 degrees 14 minutes 56 seconds East
855.81 feet to the east line of the Northwest Quarter of the Northeast Quarter of said
Section 30; thence South 00 degrees 19 minutes 54 seconds East, along said east line,
a distance of 285.85 feet to the northwest corner of the Southeast Quarter of the
Northeast Quarter of said Section 30; thence South 89 degrees 43 minutes 01 seconds
East, along the north line of said Southeast Quarter of the Northeast Quarter, a distance
of 813.03 feet; thence South 00 degrees 13 minutes 21 seconds West, 986.39 feet;
thence South 89 degrees 40 minutes 23 seconds East, 170.00 feet; thence South 00
degrees 13 minutes 21 seconds West 270.00 feet to the north line of the South 60 feet
of the West 170 feet of the East 500 feet of said Southeast Quarter of the Northeast
Quarter; thence North 89 degrees 40 minutes 23 seconds West, along said north line, a
distance of 170.00 feet to the west line of the East 500 feet of said Section 30; thence
South 00 degrees 13 minutes 23 seconds West, along said west line, a distance of
60.00 feet to the east - west quarter line of said Section 30; thence North 89 degrees 40
minutes 23 seconds West, along said east - west quarter line, a distance of 3443.34
feet to the southwest corner of the East Half of the Northwest Quarter of said section
30, thence North 00 degrees 33 minutes 34 seconds West, along the west line of said
East Half of the Northwest Quarter, a distance of 2633.89 feet to the northwest corner of
said East Half of the Northwest Quarter; thence South 89 degrees 29 minutes 52
seconds East, along the north line of said Northwest Quarter, a distance of 1327.76 feet
to the point of beginning.
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be maintained in
the office of the Community Development Department of the City of Rochester and shall be
available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy
of this Resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
