RESOLUTION
Approving Annexation No. CD2026-004ANX, to Annex Approximately 16 Acres,
th
Generally Situated Northwest of the Intersection of Valleyhigh Dr NW and 60 Ave
NW in Accordance with the Third Term outlined in the Joint Resolution for
Designation of Certain Land and Orderly Annexation Agreement, Approved
September 19, 2003.
WHEREAS, a joint Resolution for Orderly Annexation between the City of Rochester and
Kalmar Township, known as Joint Resolution for Designation of Certain Land and Orderly
Annexation Agreement, was accepted by the Office of Administrative Hearings on
September 19, 2003; and
WHEREAS, the property owner has requested annexation of the subject site via Orderly
Annexation Resolution on July 15, 2026, pursuant to Minnesota Statute § 414.0325; and
WHEREAS, Kalmar Township was notified of the property owner’s annexation petition; and
WHEREAS, the subject Resolution provides a legal description encompassing the
approximate 16-acre site; and
WHEREAS, the Joint Resolution for Designation of Certain Land and Orderly Annexation
Agreement establishes that lands ordered annexed pursuant to the Agreement will not be
subject to any differential taxation as referenced in Minnesota Statute § 414.0325 and
property taxes payable on annexed land shall continue to be paid to the Township pursuant
to the terms outlined in the Joint Resolution for Designation of Certain Land and Orderly
Annexation Agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester,
MN, that the area of land located within Section 24, Township 107 N, Range 15 W, Olmsted
County, Minnesota, be annexed into the City of Rochester Incorporated Limits in accordance
with the Joint Resolution for Designation of Certain Land and Orderly Annexation Agreement
between the City of Rochester and Kalmar Township, more particularly described herein by
the following legal description:
That part of the East 1/2 of the Northeast 1/4 of Section 24, Township 107 North, Range
15, Olmsted County described as follows:
Beginning at the Southeast corner of said Northeast 1/4, Section 24; thence North 89
degrees 20' 08" West along the South line of said Northeast 1/4 (for the purposes of this
description the bearing of said South line is assumed) a distance of 1322.46 feet to the
Southwest corner of the East 1/2 of said Northeast 1/4; thence North 0 degrees 00' 07"
East along the West line of said East 1/2 of the Northeast 1/4 329.41 feet; thence South
89 degrees 20' 08" East parallel with the South line of said Northeast 1/4 1322.45 feet
to a point on the East line of the Northeast 1/4, Section 24; thence South 0 degrees 00'
00" along said East line 329.41 feet to the point of beginning; subject to road right of
way along the southerly portion thereof and containing 10.00 acres more or less
including said right of way.
AND
That part of the East 1/2 of the Northeast 1/4 of Section 24, Township 107 North, Range
15 West, Olmsted County, Minnesota, described as follows: Commencing at the
Southeast corner of said Northeast 1/4 of Section 24; thence North 0 degrees 00' 00"
along the east line of said Northeast 1/4 (for purposes of this description the bearings
are assumed and based on said East line being North 0 degrees 00' 00") a distance of
329.41 feet to the point of beginning of the tract to be described; thence North 89
degrees 20' 08" West parallel with the South line of said Northeast 1/4 a distance of
1322.45 feet to the West line of the East 1/2 of said Northeast 1/4; thence North 0
degrees 00' 07" East along the West line 329.41 feet; thence South 89 degrees 20' 08"
East parallel with the South line of said Northeast 1/4, 1322.44 feet to the East line of
said Northeast 1/4; thence South 0 degrees 00' 00" along said East line of the Northeast
1/4 a distance of 329.41 feet to the point of beginning, said tract being subject to road
right of way over the northeasterly portion thereof and containing 10.00 acres more or
less including said right of way.
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be maintained in
the office of the Community Development Department of the City of Rochester and shall be
available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this Resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
