RESOLUTION
Approving Conditional Use Permit Amendment No. CD2026-011CUP, By UCI Tower,
for the Construction of an Unmanned Wireless Communications Facility Consisting
of a 125-Foot Monopole Tower and Ancillary Equipment in a LI (Light Industrial)
Zoning District, Located at 1811 7th St, NW.
WHEREAS, UCI Tower, Applicant, has requested approval for Conditional Use Permit
Amendment.
WHEREAS, the project is being proposed through the Conditional Use Permit Amendment
process; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, The Council adopts staff findings included within the staff memo dated July
22, 2026, finding the proposal meets the regulations of UDC Section 60.300.020F(1)
applicable to Commercial Wireless Telecommunication Service facilities.
WHEREAS, on July 26, 2026, the City of Rochester Planning Commission considered this
application, along with application findings of fact, and recommended approval of the
subject application.
WHEREAS, on August 17, 2026, the City of Rochester Common Council held a public
hearing to consider this application, and adopted the findings of fact, as recommended by
the Planning Commission, subject to two Conditions of approval:
1. The proposed monopole, footings/foundations, equipment cabinets, transformer,
vaults, and meter utility rack must all be installed a minimum of 10 feet clear of
existing water service. It is the applicant’s responsibility to ensure this requirement
is met.
2. Subject to the satisfaction of the reviewing agency, provide updated an site plan
addressing agency comments provided by RPU Electric.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that based on the above-stated findings, the Applicant has shown, by a preponderance of
the evidence submitted at the public hearing, the application satisfies the Conditional Use
Permit Approval Criteria provided within UDC Section 60.500.050.A.4.
