RESOLUTION
Awarding Contract for Project No. J3501-2 Mayo Civic Center Arena Tuckpointing
Phase 1
WHEREAS,, pursuant to an advertisement for bids for the following improvement(s):
Project No. J3501 Mayo Civic Center Arena Tuckpointing Phase 1, the following bids
were received complying with the advertisement:
Restoration Systems Inc $242,701.00; and
WHEREAS, Restoration System Inc, Inc is the lowest responsive and responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that the bid of $242,701 is hereby accepted and execution of the standard
City contract for construction with Restoration Systems Inc, is authorized for the
following approved local improvements: Project No. J3501-2 Mayo Civic Center Arena
Tuckpointing Phase 1;
BE IT FURTHER RESOLVED that pursuant to Section 5.3.1 of AIA Document A701-
2018, the Common Council waives any claimed irregularity in the “Unit Pricing” portion
of Restoration Systems Inc’s bid, as the irregularity reflected an understandable
misinterpretation of the exact definition of the unit price (an error made by more than
one bidder) and regardless, is minor, easily corrected, and not material to the
determination of the lowest responsible bidder.
BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder, which shall be retained until the contract has been executed; and
BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days
after the contract is ready for their signature, and if not executed by them in said time,
they shall be deemed to have abandoned the same.
