Approval of Certificate of Appropriateness - Silver Lake Park & Dam Alterations OFFICIAL ACT The Common Council of the City of Rochester, Minnesota hereby denies the appeal that requests an overturn of the approved Certificate of Appropriateness for alterations to the park, including the dam, lake, and bicycle trail based on the following:  Rochester’s Unified Development Code (UDC), Section 60.200.040.C, provides for both historic landmark designation and the regulation of alterations to locally designated historic landmarks through the Certificate of Appropriateness (COA) process; and  The City of Rochester Public Works Department submitted a request for a COA for approval of alterations proposed at Silver Lake Park, a locally designated historic landmark; and  UDC Sections 60.500.010.B and 60.500.050B.3.b indicate that a public meeting of the Heritage Preservation Commission (HPC), which allows for a public comment period and not a public hearing, is required prior to their approval of a COA; and  The HPC held their regularly scheduled monthly meeting on July 28, 2026, and the Silver Lake Park & Dam project COA was on the agenda under Reports and Recommendations; and  The meeting started at 5:00 pm with an open public comment period at which time it was explained by the commission chair to all in attendance that public comments would be accepted for topics other than any listed under the Public Hearing section of the agenda; and  Both appellants spoke during the open public comment period and the HPC further suspended the rules and allowed for additional comment during the agenda; and  The HPC approved the COA, as detailed in the agenda packet, after hearing testimony the at the July 28 meeting; and  the public hearing occurring in front of the City Council on September 9, 2026 allowed for additional public comment, Now therefore, the City Council denies the appeal to overturn the certificate of appropriateness, approved for proposed alterations to Silver Lake Park, as the HPC followed UDC procedures and approved the alterations based on the findings of fact contained in their July 28, 2026, agenda packet.
