This project would terminate at the east side of the Park property which is 220-feet east of Bear Creek. This -improvement was petitioned ini.1969 by Carlton Penz; and a hearing'was held on March 17; 1969. No one was heard and.6 motion was passed to proceed with the project; Because the -preliminary cost estimate in 1969 was grossly inade- quate and that more than a -year has.lapsed since the hearing, the City Engineer recommended that another hearing -be held on this improvement. At the Public Works Committee June 29, 1970, Carlton. Penz indicated that he would like to have the improvement project abandoned and the street vacated instead. The committee would favor a petition to vacate this portion of 10th'-Street S. E. if Penz would assure permanent access to -the Water Dept°s— well house and park property. The Committee.further recommended that the hearing on July 8, 1970, be continued to August 3, 1970. By this time, Penz will know if he is going to pursue this vacation. On July 8, 1970, the Council voted to continue the hearing until Auc"ust 3, 1970. Mr. Penz has indicated that he will appear at the 8-3-70 Council meeting and request that this improvement project be. abandoned. The proposed roadvay is :only sixty feet in width, due- to petitioners - ".917ning only a sixty foot lot fronting- on 19th Street N.Wd Although we would like to see all catty streets be at ].east 66.feet in- width, -time conditions under which this particular street WOL.1..1d be developed, limit . it -to sixty feet -and we find this'to be acceptable. No :9l)j-ections or request for utility. easement-s have been received from .any' of: the public or. private utility .dep.;r.tmerits, however, due to the ,fact'that .the exact loc.jt:ions for all the .uti.lit.y services have. If such needs do arise, we feel the City should make provisions for diem to be added at a later- time. Conclusion:* I•Ie find that all three of these -applications are in order- to be recommended for approval., subject to the three problems associated with the co :muni.ty development project plan being, resolved and subject to provision being made for -additional easements on the final plat -if such easements are later determined to be heeded. -GENERAL PRACTICE' ft\ 1y yp !p '!f 1fy: (e` p(q9 11, (p 1p/ SURGERY .. APPLICATION FOR A VARIANCE TO USE A RESIDENCE AS A REAL ESTATE OFF ICE LOCATED ON LOT > BLOC_{ 2, VALHALLA FOURTH SUBDIVISION We have reviewed that above petition and find the following: I. Name of Applicant: G. L. Pierce, Metro Development Company 2. Reason for Application: I am requesting -permission to build a house with a double car garage attached'to the house -for the purpose of an office until such time all of the lots are sold in the Valhalla Third Subdivision...We feel 1 - we need an office in this location because this is where the -traffic will be 'to get to our Third Subdivision. This also will then eliminate our -Valhalla. temporary building on the corner of Elton Hills Drive & Viking Drive. 3. City Plannim, DeUartment: General: The property in question is presently vacant but the applicant desires to construct a new residence on the lot and use the double garage for a real estate office. Colic 1 sign -Based on .tile- above - findings the Planning DeparUnent is of the opinion .that a - variance `is warranted.andjustifi'ed in this case primarily.on the basis .of the steep- ness of ti-ie terrain and the. excessive earthwork that would be iiecess`ary to "develop this offs.treGt parking area,b"ack of -the 25 feet setback' line. Name'of Petitioner: People's Cooperative Power Association 2.. Reason for Petition: To provide sewer and water to new headquarters building to be constructed on this site. 3. De2artmental-Review: July 2-; 1970. C.A. Armstrong, City Engineer This tract, is approximately one mile from the east end of the present City sanitary sewer and water, main. -It is ;physically possible to extend the sanitary sewer main to serve the West 1000-feet only of the proposed annexation, but the expense would be around $50,000. T.o,provide adequate water service -to this tract.and any further development. - in Section 5 will require the construction of another water reservoir and well. 4. City Planning Department General: This property is located just to the north -and. east of the east line of Eastwood*. Golf course. The east line of the golf course; if'extended- north, is the west line'of the property to be annexed. -The right-of-way of U.S. 14 separates this parcel from the city limits, but from previous interpretations this may not pose a legal problem..The legallity of this petition should be checked on by the City Attorney. The property is used for agricultural purposes and there are farm buildings situated on .the land. There is a large billboard located along the -highway on the. west- edge of this parcel. "Immediately to the north is the -residential ' subdivision,.of Sunnydale and the Skyline School is immediately to the west-. , Rural'Service District: This property meets the qualifications to be designated as a Rural Service District within the City of Rochester. Land Use Plan: The C ty's adopted Land Use Plan does not extend east far enough to.include" this property. The R.O.T.P.S. plan does include this area and shows it as being'best suited for general residential use. Just recently the County changed the, zoning on this property to an industrial district. Conclusion: -- Assuming that this petition is legal the Planning Department recommends that it be annexed to the Ci ty. There is already a major suburban subdivision immediately to the north of this, property that is experiencing probleris with its septic tanks and wells. A new municipal sewer line and water system in this area may serve as a calayst to encourage the future annexation of this development and eventually eliminate a population problem, n rti MEETIN' E^ nf G) l DATE 'Au;ust 3, — — _ 1970 AGES DA _SECTIGN: ORIGINATING D E r''T REPORTS AND RECOINNE,NDATIONS PLANNING ITEnt: ITEM DESCRIPTION: Petition To Annex Baihly Property.Bounded By PREPARED BY. e- T.H. 52, 16th Street S,.W. J". Name ;of Petitioners: Margaret E: , Baihly and.'G.eorge. A.' Baihly of R.-F.D: 12, Salem Road .2. -_Reason for Petition.: To provide the -city services necessary to complete .7 the..development of this area. , 3. D.epartmental Review: July 2, 1970 C.A: ;Armstron.g, City Engineer SaniEary sewer mains and water, mains can be extended to this annexation. fir.. City ,Planning Department: General: _ The property to be annexed' is vacant and undeveloped land. It• is currently. _ being, used for-.agriculturai purposes and sand, and gravel mining to form a . private lake. The -land is contiguous to the city limits so it satisfies the basic legal standard for annexation. -A sanitary sewer line has, been.stubbed .. under Highway 52 to serve this area. Flood Potential: County Zoning Ordinance -:- The Olmsted -County Zoning, Ordinance has zoned .the property lying .along the Zumbro River as a.Flood Plain District. Most of the property is zoned as agricultural. . Intermediate Regional Flood: High water from an'intermediate regional flood would inundate.this•entire property, exceot for a shallow strip, along the south side'of the Salem . Road (C.S.A.H. 8). [dater levees would range from 1020.-on the west end „ of the property to about -1012 61i the east end. The highest known water level recorded in 1962 had.elevations of.101-4 on the west end to 1010' on the east- end.. From this, information i't is evident that the development potential of, this'_ land is tied very closely to the flood control program that is being 'planned by tiie Corps of,Enginee'rs. In the 'interium period, cognizance will'_ ;have to be. taken of these potential high water' -levels in any prospective development and the land will either have to be raised or adequate flood proofing measures taken to protect the property from excessive damage. Rura1,Service District: This:aproperty qualifies to be designated as a rural service. -district within the City of Rochester. Land ;Use Plan: The.City's adopted Land Use Plan shows -this. general =area as being. best' suited for -commercial user'multi-family useend the land along the Zumbro River for recreation use. -All of these developmentsof course hinge bn the. implementation of -"the flood control project.. Conclusion:. In orderlto begin to make metning'ful and orderly plans'for the future develop- ment of this property--the-Plann'ing Department recommends that this. land be annexed to -.the city. We further_ recommend that the.land be designated as a Rural Service. Dxst-7-iet o The legal: description does not'take-in land to the centerline of 16th Street S.T-). or to the centerline of C,S.A.H.'No; 8'. -The annzxing ordinance should contain these additions. ,AGENDA 5'ECTION: ORIGINATING DEPT:. These. yards wou.ld.,have left a buildable .depth- of. about 43'-ft. which was ,ample. In 1965 a-riew,Zoning Ordinance went.into effec-t thatestablishedin the. R-1 District a minimum.front.yard_ of 25 ft. and a minimum rear yard of 40 ft.f' Th- minimum rear yard could be modified .if the lot depth was less than 100 ft. deep. In.this.case the mini.mum.required rear yard would-be 20 ft.i thus leaving a buildable..depth of about:29:ft. that isadequate -enoughto build a contemporary size home. The problem arises now in further subdividing. these-. lots'., In this.case new lots are. -being created under .the._protisions.cf a,Zoning-Ordinance that establishes certain minimum lot frontage, .lot area and -setback requirements.. -Since these new.lots.are--be-ing created under .the provisions of 'this ordinance the provisions for modification of- the, rear - yard: depth do not apply --and the full rear -yard depth of:40.ft. is required and a --condition is created where there is not adequate buildable area. If -this plat is approved with these -lot sizes, even though they -meet the minimum lot area .and lot frontage requirements, the Zoning Inspector will not be able to issuea permit to -build on them. because nts. A condition."of self -imposed -hardship of the open space requireme will.: eki.st,- since the Plarin'ing Department bas. ,f.ully explained this matter to the; applicants and _Chet' .are aware of the Problem..- Before .any action is taken on this plat, the. matter off_ the effect -.of the lot =. depth should be resolved from a legal.standpoint. - 2® 1'U . ) ' ` ` i r 1 ;: i' i r M "E c T I N CAU LIS t. .tr .... c_.t.. .
