R--4 DIST'CiS::I_-- ---- — Pureose _of tle Report_: The Purpose of this report is to explain* the revisions made to the original zoning district proposal.. The land use research indicated a need for amending the zonin-- districts. to accomodite. the changes taking place in this area. After much discussion a boundary was selected which would open up a substantial area for increased land use intensity. This was done with the thought that the districting could be cutback, if desired, by the residents in the area.. On January 18, 1971 the original proposal received approval by the City Planning and Zoning Commission and was sent to the Council for action. During this time a certain amount of public opinion eras expressed in opposition to the proposed zone change. After further consideration by the Council at the _-Iarch 1, 3-971 hearing a proposed cutback of the 1:-4 District boundary and the including of a transitional R-3 District. was initiated by the Council and referred back* to -the Planning Con -.mission for further consideration and recommendation. The homaouners' have expressed an interest in cutting back the boundary and certain city officials have indicated that this alternative seems reasonable.. I I AVE. NW. 9 AVE. N. !;-AVE. NW 5 AVE. N. We find that this property is zoned a B-3 District and the maximum height of structure in.this district is 40 ft. We are unable to find that there is any exceptional -or unnecessary hardship involved in this application because of exceptional circumstances. Also, in the area of preservation of property rights we find that this applicant can do as much with his property as others in the B-3 District and in fact if the applicant is granted a variance he would then be able to do something on his property that no one else can do. In the matter of absence of detriment, the sign location'is substantially removed from any adjoining property so the height would not have a severe adverse effect. It should be noted, however, that a height variance.may have an impact on the overall effectiveness of the Zoning Ordinance. To vary the height requirement. is a matter of such widespread and. general nature that would be handled best by the formulation of a new regulation. Based on the above analysis, we are unable to find that this application meets the test for granting a variance as provided for in the Zoning Ordinance. .We therefore recommend that this application be denied. To Be Used As A Two Family Dwelling t., April 2, 1971 . City Planning and Zoning Commission Recommendation: On April 1, 1971 the City Planning and Zoning Commission met and considered the above described application. We find that when this building was constructed this, property was situated in the Residential District under Ordinance No. 558, the Zoning Ordinance. Two family dwellings were a permitted use in that district provided that the lot was of a certain area. A building permit was issued for the construction of this two family dwelling and it was used for this purpose for sometime. The last owner, however, used the property for a single family dwelling and he,has moved and the property is now up for'sA1e. The home has been vacant for the past several months: The property is now zoned as an R-1 District which limits.the use to one family dwellings.. We•feel that since this structure was built as a two family dwelling and a*permit was issued for its construction it should be allowed to be used again for a two family dwelling. To restrict the use of this structure to a single family dwelling would create an unnecessary hardship'on this owner. There appear to be no adverse effects on the adjoining properties. Based on these findings, we recommend that this variance be granted approval. (Motion by Gill, second by Tingley. Voting in favor were Gill, Tingley, Hasley, and'Zollman. Voting against, none. TO BE USED AS A TWO.FA?LILY DWELLING. -We have reviewed the above described application and find the following: 1.-Name,of Petitioners: Merlin L. Mason and Everall Mason 2.- Reason for Petition: Owner requests the right to retain this property as a twin -plea. (a) It was built as -a twin-plex by Ken Watkins :to whom a Permit for building; said twin-plex was issued Sept., 21, 1961. File #3895 B (b) This structure was used as a twin--plex until sold to present owner - - ?Ir. Merle Mason, now a resident of Florida. (c) Because of the size of his family- (five children and two parents), Mr. Mason used the dwelling in its entirety. However, he did not destroy the original features of this'twin-plea as such: ' 1. The dwelling is at present listed on the assessor's card at the Olmsted County Court house as a'twin-plex. 2. It is on the tax rolls as a train-plex. 3. The house still has two house numbers over the entrance - - 1424 and 1426. two door bells' two furnaces two hot water heaters . .two meters - - the owner paid two gas' and two utility bills two complete kitchens on the main floor .two completely separate living; quarters on the main floor 4. Because of its floor n.lan it is not satisfactory as a one family dwelling. The owner used'it as a one family dwelling on a temporary basis. lie did nothing to destroy its character as a twin-plex. (d) The Public health Denartment issued a REGISTRATION CERTI- FICATE on March 1, 196S valid until March 1, 1969 which states that this building•meets all the requirements of ROCIR'STER CITY ORDINIANCE NO. 1406, for the units in this building. 3. Departmental Review: No objections received. 4'. Ordinance Provisions: Article 21.00 attached in -entirety - attachment #1. 5. City Plannin,Department: Backgzround This application is. for a variance of Article 21 (R-1 Single Family Residence District). This variance is being sought to allow the property in question to be sold as a two-family dwelling. We find; that the property in question has 6,160 square feet of lot area. A two family dwelling in an R-1 District is required to.hr,ve 7,000 square feet of lot area. A shortage of 840 square feet of area exists. ' The surrounding land uses are: To the west and across the street an institu- tional use; to the south a non -conforming greenhouse, and to the north and east single family dwellings. he property is located on a cul-de-sac street. The dwelling in question, was originally built as a rwo family dwelling and has been used as, a single 'family dwelling for the past 18 months. Thus, under the present ordinance the dWL'llinb v.oul.d be considered non -conforming. However, a basic question does arise. The question for consideration is: Las this a legal or an illegal issuance of a building permit for a two family dwelling, and if so can a variance be granted? The property in question is located in ;athen's Woodside Addition. This addition was' platted after 1940.(plat dated November .1958.) After 10,40 7,000 square feet of lot area was required for a two -family dwelling. The•lot in question has 6,160 square feet. Thus, based on the re- quirement that 7,000 square feet of lot area be required.for two family dwelling after 1940 we can conclude that the building permit was issued illegally; and as such the property in question can be' considered a$ an illegal use prior to the adoption of the present Zoning Ordinance. Under the present Zoning, Ordinance the property would be classified as a nor.-conform,inng use. flo:•rever, the .provision re].aLi_ng to the i11e^al issuance of a buildin perriit also applies at the present time. This illegally issued hullding, permit does not preclude grantinci or a use variance if the four criteria for a variance are net to the satisfaction of the ' Planning Comipii.ssion'. The following paragraphs taken from th'e Zoning Ordinance are included to aid you in developing the necessary findings and conclusions necessary to make a re- commendation on this application. 4 227 - -ut , iona[ Dan% Dudiiin9 eRocES z:I innesota 55901 (507) 2SS-7665 - To: Member of the City Planning and Zoning Commission Thank you for letting me appear before you today. I am representing Mr. and Mrs. 'erle 2fason recent Rochester residents. In February Mr. Yason accepted an IBM transfer to Boca Roton, Florida. Before leaving Rochester, the Masons listed their property "For Sale" -with our office. , This property is a very good well-built twinplex. It was -constructed with full knor:led,ze of the Building Inspector that the lot lacked a few square feet for use as a twinplex--but the building permit was legally signed and filed. In show ng-the'property we have learned that it is not a suitable structure for a one family dwelling --except in most unusual circa.mstances. One.of these circumstances would be a shortage of four and five :edro"om _homes in the mid.$30,000.00 bracket. Such a condition ?id exist when the Masons purchased this property. They thought of this as.a "temporary expedient" an-? did nothing to destroy its character as a twihplex. As is shownrthe Variance Application; the Mason's are asking that the. property be agai4classed in the inspector's office as a twinplex.... so that it may be sold as a twinplex: It is'at the present time, presented as a twinplex on the Assessor's card, the property is taxed as a twinplex, the original permit dated Sept. 21,•1961--is for . a twinplex. The overa•11 physical plant is as it was in the original plan of 1961. As you can also see on the Variance Application, it received grocer Health Certificate inspection and passed the inspection with con_menaation. That certificate as in effect at the time the Mason's deed was registered on psi, 2 196,%. Special features suitable for twinplex use only are: two fine kitchens ' on the main floor, completely separate living quarters divided by a common stair and main hallway, two good living rooms and two dining areas. The one bedroom unit -has a laree bedroom, good bath and good closets. The other unit has three bedrooms and two baths. The area to' the west and north is all single family residential use. The property to tine east across t,.S. 63 is a vacant, ,steep hillside and is zoned an R-l.District except- for two. lots that .,were recently zoned as a B--la District. Land Use Plan: The Ci.ty's Adopted Land Use Plan has this area designated as being best suited for low deinisty residential use. Because of the highway and -its proximity to an established, si.ng.le family residential- area it would Lend itself more readily to a low to medium density residential use. Access: Access to this property can only be gained from the the south bound lane of U.S. 63. There is a median running in front of the full length of this property with no openings. Conclusion: The proposed B-3 District Would permit this. property to be used for a wide variety of'intense- commercial. uses. Some -of the more undesirable of these would be contractor's storage yards and Drive In Restaurants. Also, rather elaborate out- door advertising devices could be erected in this area if it were zoned a B-3 District. As an alternative to this petition we. -would sug;;est that ,consideration be. given to.,, possibly an R-2 or. R-3 District on this property. This would allc;✓ for so«e increase ,in intensity of use and give some consideration of co-mpatibi.l-ity to the ad4oining residential uses. Such a district would also prevent excessive outdoor advertising - on one of the principal approaches into the city from the north which is as yet fairly well uncluttered. f pp F pptt _ MEETING R!lmQ14,d'`ESO G"Ouy 0U.'s n fl® DALE: AGENDA SECTION:' ORIGINATING DEPT: Hearings Engineer's I ITEM DESCRIPTION. RADAR is the acronym for Rochester Area Drug Abuse Response. It is'a voluntary association of interested citizens concerned about _drug abuse and its affect on individuals and society.. Although its purpose is to promote the public good by providing a drug information program," it is not an agency of local or state government and there appears to be no statutory authority for the City to contribute funds to the association . Under these circumstances it is my opinion that in the absence of express legislative authority the City may not make a contribution to RADAR. If the services to be performed by RADAR are deemed. beneficial to the City and are the type of services that the City itself could provide as authorized by charter or state law, a contract with RADAR could be entered into providing for reasonable compensation to be paid by the City for such services. Our attention was called to the fact that the Commission had initiated an amendment to the Land Use Plan back in July 10,'1968 and had made a recommenda- tion to the City Council. The Council accepted this recommendation on July 15, 1968 and set a public hearing for August 5, 1968. We findthat the property owners in the area are very much interested indevelopinq their land for mufti —family use. The area already con— tains a neighborhood park and there aretwo elementary schools near by and a new junior high school is beinrl planned close by. Access to the property alonq the. east side of U.S. 52 is from a frontage. road which should -cause a minimum of increase on traffic loads in the interior of Allendale when it is developed. Streets will haveto be established and acquired for public use and improved. Also utilities will have to '-e installed to serve the area. J. Koskovich FThe H.V.A.C. Code Board of Review recommends that Section 94.080 of the Code be amended as follows for clarification purposes: 94.080 Room Heaters (1) Installation in Sleeping Quarters. Room heaters installed in bedrooms or sleeping quarters shall be of the direct. vented type having a sealed combustion chamber provided with outside air for combustion and vented directly to the atmosphere. Units with draft diverters, which open into the occupied space, thus making it possible for products of'combustion to enter the heated space, will not be allowed. The.present wording is as follows: (1) Installation in Sleeping Quarters: Room heaters shall not be'installed in bedrooms(or sleeping quarters when such heaters depend upon air for combustion from the room in which they are located. This rewording does not change the intent of the Code, nor.does it affect the present interpretation— It more clearly specifies the -type of unitthat is acceptable for installation in sleeping quarters. The Committee of the Thole, at their 4/12/71 meeting, recommended approval of the proposed amendment. G Yl Upper Zumbro Soil & Water Conservation District Requests J. Andre The Upper Zumbro Soil and Water Conservation District is requesting that the City of Rochester adopt the following resolutions: 1. Resolution requesting that special legislation be enacted making the City of Rochester and Villages in the Gounty of Olmsted a part of the Upper Zumbro Soil and Water Conservation District. The main advantage,of this is that the City of Rochester would then have representation on the district board of supervisors, which it does not now have. 2. Resolution whereby the City of Rochester and the Upper Zumbro Soil and Water Conservation District endorse a southeastern Minnesota Resource and Development project. Each unit of government is to assist in the preparation of a project application and the development of a project work plan. Each unit is to-appain't one of its members to assist in project development, administration, and as members of a project committee. A Resource Conservation and Development project is a means of obtaining additional technical and financial help for local groups in conserving and developing their natural resources, and in seeking development funds from other federal, state and develop- ment projects. This matter was considered by the Council at their 3-15-71 meeting and was referred to the City Attorney for further review. This matter was again brought up at the 4-5-71'Council meeting, at which time it was tabled and referred to the Committee of the Whole. The Committee of the Whole considered this matter at their 4-12-71 meeting at this meeting, representatives of the Upper Zumbro Soil and Fiater Conservation District indicated that the Soil Conservation planning funds have been reduced to zero for 1971. It was their contention that if Rochester'were a part of the district, this would increase the chances that planning activities would be funded. f G('` yHCUIL A fl4.1N: Motion by: Second by:_...a....r to: - The State office of the Soil Conservation Service indicated, by.a telephone 4 conversation 4-13-71, that their planning schedule for the South Zumbro Watershed called for concentrated planning efforts to begin 15 months from now, with the report completed by the end of..1974 based upon the present funding'levelo This study is expected to cost approximately $170,000-$200,000. It was also indicated that this schedule is coordinated with the schedule of the Army Corps of Engineers, and that during at least 5 months of this planning period the entire state staff will be concentrating on this project. - 2 - INFORMATION 1.
