TEM DESCRIPTION: REAPPROPRIATION OF FUNDING FOR STB EIS CONSULTANT PREPARED BY:
SERVICES I S. KVENVOLD
On December 20, 1999, the City Council approved the retention of Wilbur Smith and Associates to develop a
traffic simulation model to analyze the impact of the proposed DM&E coal trains on the City's street crossings.
The City's share of the consultant's expenses, $86,232, was to be appropriated from the 1999 Contingency
Account.
There is not a sufficient balance in the 1999 Contingency Account to fund this expense; therefore, we are
requesting that the funding for this project be appropriated from the 2000 Contingency Account.
COUNCIL ACTION REQUESTED:
Request a motion appropriating $86,232 from the 2000 Contingency Account to fund the Citys share of the

MITIGATION FUNDING REQUEST I G. NEUMANN
In 1999 the City adopted a resolution of support for a state bonding request that intended to secure $50 million
in State funding to assist all of the communities along the DM & E line in Minnesota in mitigating the impacts
of this project on their communities. The proposal has garnered resolutions of support from cities representing
over 901/6 of the city population along the line in Minnesota
This proposal was originally developed by the five largest cities along the DM & E line: Winona, Owatonna,
Mankato, New Ulm and Rochester. The administrative staff of those communities have discussed that it would
worthwhile and beneficial to retain legislative services to attempt to advance the proposal in the 2000 session.
We are recommending the retention of Flaherty and Associates for the sum of $30,000 to provide this service.
Rather than attempt to obtain concurrence from all the affected communities to share in the cost of the service
we have discussed funding this cost just from the five cities that were originally involved, based on the
proportionate share of the funding that those cities would receive if the proposal is funded. Based on that
approach the cost to the City of Rochester would be $12,870.
Council Action Requested.
Approval to participate in the legislative services for the DM & E bonding proposal in the amount of $12,870.

SUBJECT: Contract Tree Thmming
PREPARED BY: Mark Kotschevar ,-k
ITEM DESCRIPTION:
Meeting Date: 12/28/99
Bids were opened on December 21 for contract tree trimming services.
Bids were received for both lump sum trimming by feeder and an hourly
rate for two men and equipment. The hourly crew rate was requested for
a two-year time frame with the idea that there would be cost savings
for a longer -term contract. The current hourly contract with Asplundh
Tree Service has a rate of $55.09/hr. The 2000 bid from Hathaway Tree
Service was $52.95/hr. with no increase for 2001. This equates to a
$2.14/hr savings for two years over the current contract. The hourly
bid includes one crew full time for twelve months and a second crew for
five months starting in May. Hathaway's bid for the second crew has an
hourly rate of $54.95/hr. It is anticipated that the full time crew
will work 2000 hours and the second summer crew will work 800 hours.
The 2000 budget has $200,000 allotted for tree trimming services. With
the hourly crews totaling $149,860 this leaves $50,140 for lump sum
work. The lump sum work was prioritized and it is recommended to award
the following work: Feeder 901C,K; Feeder 901D,E,905A; Feeder 905B; and
Drawing 6011. The low bid total for this work is $49,413.14. The
remaining lump sum work will not be awarded and can be completed by the
hourly crews if required. This brings the total 2000 tree trimming work
to $199,273.14. The bids are summarized on the following page.
It is requested that the Utility board request the Common Council
approve a two year contact agreement with Hathaway Tree Service Inc.
for hourly rate trimming services not to exceed $149,860 in 2000 and
$149,860 in 2001.
It is recommended that the Utility board request the Common Council
approve a contract agreement with Hathaway Tree Service Inc. for lump
sum tree trimming in an amount not to exceed $38,647.14.
A contract agreement with Asplundh for lump sum work not to exceed
$10,766 can be executed by the general manager, as it is less than
$30,000.

Audit Engagement Letters for Fiscal Year Ending December 31, 1999
D. Martinson
On November 16 of 1998, the City Council accepted a proposal from Smith, Schafer
and Associates, Ltd. to provide audit services for the five fiscal periods ending
December 31, 1998, 1999, 2000, 2001, and 2002. That proposal provided for the
examination of financial records and controls for the City's financial statements, audits
of federal grant activity (single audit) as well as the separate financial statements of
the City's Department of Public Utilities (RPU). The attached five-year cost summary
outlining that proposal reflects total costs for the year-end 1999 audit of $42,350, up
just $1,050 from their fee for the previous year.
Additionally, the City annually requests examination of the financial statements of the
Rochester City Lines Company. The scope of the examination will include comments
on the accounting procedures and controls. The firm will also prepare and review the
mandatory reporting forms required by the Urban Mass Transportation Administration.
The fee for this service will be at the firm's regular per -diem rates also found on the
attached quote summary. These fees amounted to $24,876 for last year's program.
This fee is reimbursed through the state grant agreement.
Three separate letters found attached confirm the significant terms of engagement
for these audit examinations. One provides for the general audit, another for the
public utility audit and the third provides for the urban mass transit review.
COUNCIL ACTION REQUESTED:
Respectfully request a motion authorizing execution of the three letters of
engagement to audit both the City's general purpose financial statements, the public
utility's statements and the City's Urban Mass Transportation Program for the fiscal
year ending December 31, 1999.

Deputy Police Chief James Miller retired 10/31/99. Police Chief Roger Peterson and his command staff have
reviewed their staffing needs and have created a new job description titled Administrative Services Manager to
replace one of the Deputy Police Chief positions. The Police Civil Service Commission has reviewed the job
description and recommends approval of the position by the Council.
Initial review of the family and grade assignment indicates placement in RPEA Management I, Grade 7 (range
for 2000 is Minimum - $42,193, Midpoint - $52,742, Maximum - $63,291). The Deputy Chief of Police role is
covered by the Rochester Police Department Supervisors' Association agreement which indicates $80,802 as the
maximum salary to be paid in 2000 for a Deputy Chief.
The Administrative Services Manager will be primarily responsible for budget preparation, policy writing, risk
management, human resource coordination, and grant writing and grant administration.

MEMORANDUM
Rochester Police Department
Administration
DATE: November 29, 1999
TO: Linda Gilsrud
FROM: Roger Peterson
COPY: Stevan Kvenvold
SUBJECT Replacement of Deputy Chief's Position
The retirement of Deputy Chief Miller on October 31, 1999 has provided us the opportunity
to re-examine our command structure and to implement some changes that we believe
would enhance the Police Department's effectiveness and efficiency. To that end, the
command staff of the Police Department has met in a series of meetings over the past
months for the purpose of determining the present and future needs of the Department
from an administrative perspective. These needs were identified as:
• Tactical and strategic planning
• Policy development and risk management
• Administration of personnel issues specific to law enforcement
• Budget coordination
• Technical grant writing and administration
• Liaison with the City and County Attorney, Human Resources, City
Administration, and other agencies
Unfortunately, there is little in the traditional experience of police officers that prepares
them to perform many of these tasks. In addition, while these functions are critical to our
Department, none are supervisory in nature. As a result, we believe our administrative
structure should be changed in order to incorporate these tasks into a non -supervisory
position that would replace the existing Deputy Chief's position. While this proposal would
have a significant impact on our command staff, the resulting job responsibilities would be
much more consistent with our organizational structure and would subsequently enhance
our overall efficiency.
We have developed a job description for an Administrative Assistant to the Chief of Police
based on the needs indicated above. I have attached a copy of the proposed job
description for your review and would welcome your input.

ITEM DESCRIPTION: Rochester Marketplace Development Agreement PREPARED BY:
R. Freese
The Public Works Department staff and the developer, Ryan Companies, Inc., of the proposed commercial retail center to be
known as Rochester Marketplace have discussed and negotiated a Development Agreement that addresses the following
items;
♦ roadway capacity improvements to 41" Street NW
♦ resurfacing, re -striping and resigning 41" Street NW
♦ construction of new west frontage road south from 41" to 37' Streets NW
♦ realignment of existing west frontage road north of 41" Street NW
♦ relocation of access to Mortenson property
♦ acquisition of additional right-of-way from Mortenson for relocated west frontage road
♦ traffic signals on 41" Street NW at west frontage road
• future traffic signal on 41" Street NW at 31" Avenue NW
♦ pedestrian facility construction
♦ public and private stormwater management facility design and construction
♦ dedication of right-of-way
♦ dedication and construction of stormwater facilities
♦ construction of water, sewer and stonn sewer facilities to serve the property
♦ construction of westbound slip -ramp from 37' Street to new west frontage road
♦ cost -sharing for improvements to city infrastructure
The Minnesota Department of Transportation has participated in the review and approval of the Traffic Impact Report and
the Rochester Marketplace construction plans and specifications. MnDOT will require the relocation of the existing west
frontage road north of 41" Street a distance of 100 feet west. This is intended to provide longer stacking lengths for east
bound 41" Street traffic between the west frontage road and the TH 52 west ramps at 41" Street NW. Relocating the frontage
road 100 feet west will require the purchase of additional right-of-way from the property owner, Mortenson, on the
northwest comer of this intersection. The existing southem-most access from the Mortenson property to the frontage road
will need to be closed and the city has agreed to allow a new access to the Mortenson property off of 41" Street NW.
Mortenson representatives have participated in discussions involving the frontage road and appear willing to cooperate
provided their "damages" are paid. MnDOT has made no formal commitment to funding a share of this improvement. Since
MnDOT will require the realignment of the frontage road regardless of any development project south of 41" Street, the City
and MnDOT, and not Ryan will be responsible for the costs associated with this item.
The City will be responsible for the cost to design the regional stormwater facilities and the cost to design and install the two
traffic signals along 41" Street NW and costs associated with the west frontage road relocation.
Ryan is responsible for the design and construction of all the other public and private improvements to serve the development
of Rochester Marketplace as identified in the Development Agreement and as shown on the approved construction plans and
specifications.
REQUESTED COUNCIL ACTION:
The Public Works Department recommends that the City Council approve the Rochester Marketplace Traffic Impact Report
and authorize the Mayor and City Clerk to execute a Development Agreement with Ryan Companies, Inc. for the Rochester
Marketplace Project.

two conditions need to be modified to better define the intent of the permit conditions.
Condition #4
The permittee agrees to remove the private lift station from the right of way or City land at
its own cost should the City make such a request once the City deems the gravity now
sanitary sewer is available. Should the City remove the private lift station from the City's
land, permittee shall agree to reimburse the City for any costs it incurs; and
Condition #6
Except for the original permittee and as provided herein, this permit may not be assigned
without the City's approval. The City does agree to allow the one time assignment of
this permit to a new corporation, which is yet to be formed, provided the permiHee
and his spouse are the sole shareholders.

ITEM DESCRIPTION: Amend Parking Restriction 18"' Street SE from Broadway to 2nd PREPARED BY: ,. Jr
Avenue n- D. Rossman
The City has received a counter petition from the residents of this street to amend the recently adopted
parking resolution to eliminate the restriction on the section of 18'" Street SE from Broadway to 2nd
Avenue.
The main reason is that the residents signed the original petition thinking that the petition was for V
Avenue near the fairgrounds. They do not want any restrictions placed on 18' Street. The counter
petition has been signed by 100% of the residents. The pavements are 30 feet wide on a 50-Foot right-of-
way. The streets receive little parking except that which is generated during the County Fair and Gold
Rush Days. The residents would rather live with the parking during those few days than lose the parking
year round.
Staff has reviewed the request and agrees with the request.
COUNCIL ACTION REQUESTED:
Adopt the prepared resolution that deleting paragraph to (222.45) of section B "No Parking Zones".

Proposed Development:
Streets:
This development consists of approximately 53.63
acres to be subdivided into 12 lots for a
retail/commercial center and 3 outlots.
The plat proposes to dedicate the right-of-way for four
roadways.
A small amount of additional right -of way will be

eastern part of the property. The other two roads are
labeled "Market Street NW" and "Home Place NW"
and are short roads providing connections on the far

Drainage:
The proposed grading of the property is to direct
runoff into storm sewer collection pipes and conveyed
to the stormwater ponds. Two detention ponds are
proposed to be located on the property. One pond in
the northwest corner of the pond which is proposed to
remain private. The other detention pond, in the
northeast corner, is proposed to be a regional pond
maintained by the City.
Wetlands:
Minnesota Statutes require that all developments be
reviewed for the presence of wetlands or hydric soils.
There is an approved Wetland Delineation and
Replacement Plan for this property. According to the
replacement, the 2.69 acres of wetlands will be
replaced with 5.4 acres from a wetland bank located
in Dodge County in the Zumbro River Watershed

PUBLIC HEARINGS PLANNTNG
ITEM DESCRIPTION: Type Ill, Phase ll, Preliminary Plat N9947 by Younge Development to be known as PR
Eagle Ridge Fourth Subdivision. The Plat proposes to subdivide approximately 15.6 acres of land into n lots for Thsingle family development and one outlot for parkland. This plat also proposes to dedicate right-of-way for newpublic roads. The property is located west of Highland Court SNY, south of Country Club Road and south ofEagle
Ridge Lane SAY.
December 29, 1999
• Staff has received a REVISED referral from the Department of Public Works for this Preliminary Plat, dated
December 23, 1999. Upon further review, the Department of Public Works has requested the following
condition:
The section of 41" Street SW between the east line of this plat, and Highland Court (approximately 320 feet) is
a substandard street width. Connection of this plat to 41" Street SW, in its existing condition will create an
unsafe condition due to the narrow roadway widths. The development will be required to make a contribution
to the City to cover a portion of the cost to widen 4" Street SW from the east line of the plat to Highland Court.
City Planning and Zoning Commission Recommendation
The City Planning and Zoning Commission held a public hearing on December 15, 1999 to consider this preliminary plat.
The Planning Commission found that this preliminary plat conforms to the criteria listed in the Land Development Manual
and recommends approval of this preliminary plat with the following modifications or conditions:
1. Storm water management must be approved for this site. Storm water management will need to address the
impacts on the downstream residents. Any new ponds serving less than 50 developable acres are considered
private and will need ownership and maintenance agreements.
2. Drainage easements and conveyance methods must be provided for storm water runoff from the abutting property.
3. Revise the roadway name "Aspen Lane SW' to "Aspen Place SW" (also requiring existing Aspen Lane SW be
changed in the future) and name the platted cul-de-sac, which must include "Lane" and "SW".
4. Re -alignment of watermains must be done at the developers cost per the memo from Rochester Public Utilities,
dated November 29, 1999.
5. The parkland be labeled as an outlot on the plat.
Mr_ Scott Blouw of Yaggy Colby Associates, representing the applicant, stated they are in agreement with the conditions.
Motion by Petersson to approve Preliminary Plat #99-47, to be known as Eagle Ridge Fourth Subdivision,
with five conditions as stated by staff. Seconded by Slaver. The motion carried 8.0.
Planning Department Recommendation:
See attached staff report dated December 9, 1999.
Council Action Needed.
1. The Council may approve, approve with conditions, or deny the land subdivision permit. The Council must make
findings of fact based on the criteria included in the staff.report. A motion to deny must include supporting reasons for
a conclusion that at least one of the fifteen findings for denial in paragraph 61.225 can be made.

Eagle Ridge 4th
December 9, 1999
Proposed Development: This development consists of 9.64 acres of land to be
subdivided into 21 lots for single family development.
Roadways: This plat proposes to dedicate right-of-way for three
roadways.
The first would be a easterly extension of 4" Street SW
to the eastern border of this development. This
roadway is designed with a 60' right-of-way.
The second is a cul-de-sac, currently not name,
intersecting 41 Street SW and Aspen Lane SW. This
roadway is designed with a 50' right-of-way and a 52'
cul-de-sac radius.
The third roadway is a northerly extension of Aspen
Lane SW. This roadway is designed with a 50'
right-of-way.
The addressing staff of the Planning Department
related the following:
1. Aspen Lane SW: This roadway is platted as a
continuation of an existing roadway in "The
Aspens" Subdivision. the designation of "Lane" is
not appropriate for this roadway configuration.
It is recommended that Aspen Lane SW be
identified as Aspen Place SW.
Please note: The roadway in the existing
subdivision "The Aspens" to the east, is presently
identified as Aspen Lane SW". 1f the developer
changes the designation of Aspen Lane SW" to
Aspen Place SW" on this proposal, the existing
Aspen Lane SW" will need to be changed in the
future, to Aspen Place SW".
2. The platted cul-de-sac, south of 4'" Street SW
needs to be given a name. The cul-del-sac should
be given a name which will include "Lane" and
"SW".
The proposed roadways meets the minimum standards
as outlined in the Thoroughfare Plan and the Land
Development Manual.
Sidewalks: In accordance with current City policy, sidewalk is
required along both sides of all of the new streets in the
subdivision.
Construction of sidewalks abutting parkland shall be
part of the CitylOwner Contract for this development.
i
Page 3
1 Eagle Ridge 4th
December 9. 1999
Drainage: The elevations of this site range from 1,150' in the
southeast corner to 1,060' in the northwest portion of
the plat. Grading and drainage plans will need to be
approved prior to the submittal of the final plat.
Storm Water Management must be provided for this
development.
Wetlands:
The Soil Survey and National Wetland Indicator maps
were reviewed for the presence of wetlands. The maps
do not indicate the presence of wetlands on this
property.
Public Utilities:
Sanitary sewer and water lines will be extended from
their present ends to accommodate this development.
The property may be subject to the water availability
fee, connection fees or assessments.
The realignment of portions of the existing 8" and 12"
watermains must be done at the cost of the developer.
The Rochester Public Utilities, Water Department, have
provided the engineering firm with comments on the
proposed water system layout.
Spillover Parking:
As per Section 63.426 of the LDM, all residential
development must provide spillover parking for service
vehicles and visitors. This development requires 25
spillover parking stalls. It appears as though the
additional parking can be accommodated on the
roadways and most likely within private driveways, as
well.
Parkland Dedication:
The applicant has 1.84 acres of parkland dedication
credits established via the 1997 dedication of the 6.04
acre park site. Dedication requirements for this plat to
be met via reduction in the credits.
The 6.04 acre park site was deeded to the City in April,
1997. The Planning Department permitted the
recording of the deed with the stipulation that the park
was to be platted as an outlot.
The original preliminary plat plans submitted to the
Planning Department did not include the parkland as a
platted outlot. Upon discussion with Yaggy Colby
Associates, a revised preliminary plat was submitted
which includes the parkland as an outlot within this
Eagle Ridge 41^ Subdivision.
Page 4 + as
Eagle Ridge 4th t
December 9, 1999
General Development Plan: This property is included within the Eagle Ridge
General Development Plan.
The Eagle Ridge General Development Plan was
amended and approved in August of 1997 revising the
Plan by extending the Eagle Lane cul-de-sac and
removing a second cul-de-sac on the southeast portion
of the site.
This plat is consistent with the approved General
Development Plan.
Staff Review and Recommendation:
Section 61.225 of the Land Development Manual lists the findings which must be considered by
the Planning Commission and the Council when reviewing a land subdivision permit application.
This section is attached for your information.
The Planning staff has reviewed this preliminary plat request under the provisions of Section
61.225 of the LDM, effective May 15, 1999. The staff recommends that the following modifications
or conditions be imposed on this preliminary plat in order to insure compliance with the criteria of
Section 61.225:
1. Stone water management must be approved for this site. Stone water management
will need to address the impacts on the downstream residents. Any new ponds
serving less than 50 developable acres are considered private and will need ownership
and maintenance agreements.
2. Drainage easements and conveyance methods must be provided for stormwater runoff
from the abutting property.
3. Revise the roadway name "Aspen Lane SW" to "Aspen Place SW" (also requiring
existing Aspen Lane SW be changed in the future) and name the platted cul-de-sac
which will include "Lane" and "SW".
4. Re -alignment of watermains must be done at the developers cost per the attached
memo from Rochester Public Utilities, dated November 29, 1999.
Note: If this plat is approved, approved construction plans (street, sidewalk, grading,
storm water management) will be required when the final plat is submitted. A
Development Agreement is also required if the applicant intends to record the Final Plat
before completion of required improvements to stage development improvements or to
fund off -site Improvements.

RE: REVISED EAGLE RIDGE FOURTH SUBD. PP
A review of the preliminary plat has turned up the following address related issues:
Roadway designation:
1) Aspen Lane SW: This roadway is platted as a continuation of an exiting roadway in 'The
Aspens'. The designation of'Lane' is not appropriate for this roadway configuration.
A review of the plat for 'The Aspens' revealed the absence of any designation for the portion
of platted roadway west of Highland Court SW. The addressing of homes along this portion
of road use a designation of Aspens Lane SW.
RECOMMENDATION: Re -designate Aspen Lane SW as Aspen Place SW, both in this plat
and in the plat of 'The Aspens'. The designation would apply to the portion of roadway west
of Highland Court SW (in The Aspens) and north of platted 4 Street SW (in Eagle Ridge
Fourth).
2) Unnamed roadway south of 4 Street SW: The platted cul-de-sac, south of 4" Street SW, does
not indicate any roadway designation.
RECOMMENDATION: The cul-de-sac should be given a name and the rest of the
designation will include 'Lane' and 'SW'.
12-21-99 Talked with and made the verbal agreement with Scott Samuelson of Yaggy Colby
Associates, that the two recommendations stated above would be changed on the final plat

Amendment Summa
Proposed Use: The applicant is proposing an addition to Renning's
Flowers that would include 1,090 s.f. of design
space. This space is not intended for public use
but only for use by employees. A new atrium, 160
s.f. in size, is also proposed which would be open to
the public.
Parking: The Renning's building includes 960 s.f. of office
space that is rented to another business, If the B-1
parking standards were applied to the use, one
space would be required per 400 sq. ft. of office
space which equals 2.4 spaces. In the B-5 District,
the office space would require one stall per 200 sq.
ft., which equals 4.8 spaces.
The retail use, Renning's Flowers, would be
calculated at one space per 150 sq. ft. of floor area
used for display of merchandise that is open to the
public. In this case, 2,040 sq. ft. of floor area is
proposed to be open to the public. This area would
require 13.6 spaces, under the B-1 District
calculations.
Together, the office and retail uses would require
between 16 and 18 spaces under conventional
zoning. There are currently 15 spaces provided on -
site. No additional spaces are proposed.
Review Criteria and Suaaested Findings:
Amendments to an existing PUD are processed according to the regulations applicable to a
conditional use permit. Paragraph 61.146 lists the standards for conditional use permits as
follows:
61.146 Standard for Conditional Uses: The zoning administrator, Commission, or Council
shall approve a development permit authorizing a conditional use unless one or more of
the following findings with respect to the proposed development is made:
1) Provisions for vehicular loading, unloading, parking and for vehicular and pedestrian
circulation on the site and onto adjacent public streets and ways will create hazards
to safety, or will impose a significant burden upon public facilities.
No changes are proposed to the existing parking and loading areas. The additions
do not appear as though they would encroach on pedestrian walkways. Parking for
the facility would not be considered adequate within a B-5 district, but would only be
one stall short of meeting requirements within a 8-1 district.
2) The intensity, location, operation, or height of proposed buildings and structures will
be detrimental to other private development in the neighborhood or will impose
i
undue burdens on the sewers, sanitary and storm drains, water or similar public
facilities.
The additions to the existing building should not be detrimental to other private
development. The additions extend the building toward roadways, not privately
developed properties.
3) The provision for on -site bufferyards and landscaping does not provide adequate
protection to neighboring properties from detrimental features of the development.
Currently, there are mature shrubs along the south side of the building. The atrium
addition will result in the removal of those shrubs. Replacement of the landscaping
should be included in the plans for the addition. Shrubs shown along the northeast
comer of the building should be required to soften the appearance of the building
adjacent to the right-of-way.
4) The site plan fails to provide for the soil erosion and drainage problems that may be
created by the development.
A grading plan will be required prior to construction. The grading plan will need to
address drainage and soil erosion.
5) The provisions for exterior lighting create undue hazards to motorists traveling on
adjacent public streets or are inadequate for the safety of occupants or users of the
site or such provisions damage the value and diminish the usability of adjacent
properties.
The plans do not include an additional exterior lighting.
6) The proposed development will create undue fire safety hazards by not providing
adequate access to the site, or to the buildings on the site, for emergency vehicles.
The building is accessible from two roadways and the parking /of. Additions to the
building are not expected to create access problems.
7) In cases where a Phase I plan has been approved, there is a substantial change in
the Phase 11 site plan from the approved Phase I site plan, such that the revised
plans will not meet the standards provided by this paragraph.
Not applicable.
8) The proposed conditional use does not comply with all the standards applying to
permitted uses within the underlying zoning district, or with standards specifically
applicable to the type of conditional use under consideration, or with specific
ordinance standards dealing with matters such as signs which are part of the
proposed development, and a variance to allow such deviation has not been
secured by the applicant.
Parking and setbacks for Kenning's Flowers would not necessarily comply with
conventional zoning districts but would be close to what is required within the B-1
Zoning District. Since this property is a Planned Unit Development, the
development is not subject to strict application of the conventional zoning district
regulations. Staff finds the existing parking to be reasonable to serve the
development without adding parking. Since special occasions and holidays tend to
NO
be busy for floral retailers, parking may not be adequate to serve customers on
those days. Setbacks proposed are similar to those required within the B-1 District
and are considered reasonable for this property. The additions extend the building
toward right-of-way, not privately developed property.
61.147 Conditions on Approval: In considering an application for a development permit to
allow a Conditional Use, the designated hearing body shall consider and may impose
modifications or conditions to the extent that such modifications or conditions are
necessary to insure compliance with the criteria of paragraph 61.146,
Staff Review and Recommendation:
The Planning staff has reviewed this request based on the above criteria. The staff finds that this
proposal is generally consistent with the above criteria, and recommends approval subject to the
following conditions:
1. The shrubs shown adjacent to the northeast corner of the design space addition be
provided. In addition, shrubs shall be planted along the foundation of the south wall of
the building, adjacent to the atrium addition.
Z The site plan be revised to identify landscaping/shrubs along the south side of the
building, adjacent to the atrium addition, and also to correct information related to
signs and retaining walls on the site plan (the 91stone retaining wall Identified in the
SE corner and the 5' and 8' retaining walls identified near the parking lot entrance are
incorrectly labeled). Revised plans shall be riled with the Planning Department for
record prior to issuance of development permits.
Planning Commission Action Reouired:
The Planning Commission must make a motion to recommend approval, approval with conditions,
or denial of this request. This recommendation will then be forwarded to the Council. The
Council will hold a public hearing on this item at a later date.

16q REPORT ON THE FEASIBILITY OF PROPOSED
LOCAL IMPROVEMENT PROJECT
TO SERVE PINEWOOD ROAD AREA- PHASE II.
November 30, 1999
Honorable Mayor & Common Council
City of Rochester, Minnesota
Petitions for sanitary sewer and watermain to serve the Pinewood Road Area were forwarded by the City
Council at their March 15, 1999 and April 5, 1999 meetings to the Public Works Department for the
preparation of Feasibility Reports. The petitions were checked and found to be in proper form and were
signed by 37 of the 60 property owners of lots containing a single-family residential dwelling. This
represents 58.7 percent of the lots within Pinewood Road Area — Phase II that are eligible to participate
in the City of Rochester, Water Quality Protection Program adopted by the City Council on December
21, 1999.
Feasibility Report
We report that the above referenced project is feasible and recommend its construction. The location of
this project is within an area of existing single family residential development that currently lacks public
sanitary sewer and watermain. A majority of the septic systems and wells within the Phase II area were
constructed prior to the State of Minnesota and Olmsted County having any requirements or standards
for construction of septic systems and wells. The lots are typically under %x acre in size and are unable to
absorb the nitrates created from the septic systems. There is an increasing threat of contamination to the
City of Rochester's ground water supply as the existing septic systems and wells begin to fail. This
project would allow property owners of lots containing existing single-family residential dwellings to
connect to public sanitary sewer and water systems rather than replacing their old systems when they
fail.
The costs of this project are proposed tote recovered through sanitary sewer and watermain connection
charges (Utility Connection Agreements) and from sales tax revenue appropriated to the City of
Rochester, Water Quality Protection Program.
The proposed project consists of the installation of an 8-inch sanitary sewer line and an 8-inch watermain
in the following roadways:
1. 25th & 26th Avenue S.E. from Pinewood Road S.E. to approximately 2000 feet south
2. Fairview Court S.E.
3. Pinewood Road S.E. from Fairview Court S.E. to a point east of 30th Avenue S.E. to serve a
residence located at 3020 Pinewood Road S.E.
Public sanitary sewer and watermain are currently available in Pinewood Road S.E. Therefore; an
extension of a trunkline sanitary sewer main or trunk watermain is not required to serve Phase II of the
Pinewood Road Area.
The estimated construction costs and expenses for Phase II of the proiect made without completed plans
or survey are as follows:
Sanitary Sewer
4,870 feet x $93.00 per centerline foot
$
452,910
Watermain
5,550 feet x $82.00 per centerline foot

The estimated uroiect costs for Phase II are proposed to be funded as follows:
Utility Connection Agreements 9,710 feet x $66.30 per foot $ 643,773

Pinewood Road Area — Phase II
Estimated additional sales tax revenue required for work on private property
Of the 69 lots within the project area 60 lots contain a single-family residential dwelling. These lots are
eligible for allowances through the Water Quality Protection Program as follows:
Sewer Service Lateral 60 lots x $1,000 per lot $ 60,000
Water Service Lateral 60 lots x $1,000 per lot $ 60,000
Well Closure 60 lots x $1,100 per lot $ 60,000
Septic Closure 60 lots x S 500 per lot $ 30,000
Estimated Amount of Sales Tax Revenue Required for Allowances $ 210,000
For Work on Private Property
Sewer Availabilitv Charges (SAC) and Water Availabilitv Charges (WAC)
The lots within Phase II of the project are subject to a SAC of $1,500 per acre and a WAC of $2,000 per
acre. The Water Quality Protection Program requires that each lot be charged for a minimum of acre.
Each property owner of a lot that contains a single-family residential dwelling and participates in the
Program will have these charges paid with sales tax revenue if their lot is less than one (1) acre in size.
Lots in excess of one (1) acre in size will be charged a SAC and WAC for the acreage of the lot over one
(1) acre and up to one and one-half acres. The SAC and WAC not paid by the property owners are
recovered to the City by sales tax revenue.
Estimated sales tax revenue required for Allowances for Sewer Availability Charges (SAC) and Water
Availability Charges (WAC) are as follows:
Sewer Availability Charge 50 acres x $1,500 per acre $ 75,000
Water Availability Charge 50 acres x $2 000 per acre $ 100,000
Estimated Sales Tax Revenue Required for SAC and WAC $ 175,000
Estimated sales tax revenue required for construction of Phase II Allowances. and SAC & WAC
Estimated Amount Sales Tax Revenue for Construction of Phase II $ 363,237
Estimated Amount of Sales Tax Revenue Required for Allowances $ 210,000
Estimated Amount of Sales Tax Revenue for SAC & WAC $ 175,000
Estimated Amount of Sales Tax Revenue Required for Construction of Phase II $ 748,237
Allowances for Work on Private Property, and SAC & WAC
1 64•
We recommend that the necessary funding to construct sanitary sewer, watermain and service
connections in the Pinewood Road Area — Phase II be done so in accordance with the City of Rochester's
existing sanitary sewer and watermain connection charge policies and the Water Quality Protection
Program. Property owners that desire to participate in the Water Quality Protection Program and the
benefits contained therein, are required to:
I. Enter into a Utility Connection Agreement with the City within three (3) years of the date the City
initiates the project.
2. Connect the existing single family residential dwelling to the public sewer and water systems within
five (5) years of the date of project initiation.
3. Consent to annexation of their property no sooner than five (5) years from the date sanitary sewer and
watermain is available to serve their property.

Acquisition of parkland from Fenske
D Stotz I
Staff has met with George & Phoebe Fenske and negotiated the purchase of 17.0 acres of land located in the Rose
Harbour / Marvale area. A map showing the Fenske property is attached.
The property was appraised at $91,000. There are deferred sewer assessments estimated at $20,400. The owners are
willing to sell the property for $100,000. In addition, the City is to be responsible for the estimated $20,400 in deferred
sewer assessments.
The acquisition is on the master parkland acquisition plan. The Park Board has reviewed the acquisition and
recommends that the Council appropriate funds for the purchase of the property.
It should be noted that preliminary development plans for the site include approximately 7 acres of traditional
neighborhood park, an internal trail system and preservation of natural wooded areas. Staff at Public Works has
suggested the possibility of a regional storm water management pond and perhaps public street connections on the site.
Public Utilities has indicated the need to install a water main on the property at some time in the future. The Park Board
was made aware that portions of this site may be used for public purposes other than parkland.
the 2000 CIP budget includes $60,000 (2936 Rose Harbour Park Development) for the acquisition In order for the
irchase to proceed, Council will need to appropriate an additional $40,000 for the acquisition plus $20,400 for the
deferred assessments.
