RE: Curb and Gutter Overlay
9th Avenue NE
From Northern Heights Drive to 22nd St. NE
Dear Russ;
Attached find a petition with resident signatures for the subject project. There are 17
properties on this one block stretch. Two of those properties are facing Northern Heights
Drive. We did not attempt to get their signatures as they couldn't be assessed for this
project since they were already assessed for the Northern Heights Drive project. That
leaves 15 affected properties. Two of the 15 either have their house currently on the
market or will soon. Those two owners both would like C & G, if they were staying, but
were hesitant to sign because of the uncertain impact on their home sales. In addition,
one neighbor is simply not interested in the project.
So, of the 15 affected properties we have 12 signatures on the petition. At least one of
the other three said they would sign if needed. Hopefully having 12 out of 15 signatures
is enough to move this project forward
If you drive the block you will notice that most people have new driveways and well
kept yards. Many of us really want to get the C & G and will appreciate your efforts to
make this project go if at all possible.
Please let us know if there is any problem with the petition. Also, at some point in the
near future I will call you to see if you have any information regarding the project.
Thanks for sending out the information and we'll keep our fingers crossed for good news
concerning this project.
Sincerely,
t-,,

A few weeks ago we met to discuss the Arboretum Special District. Land uses within this District
are determined by the approved General Development Plan (GDP). We specifically discussed an
area located north of 41" St. NW, east of Arboretum Drive NW, which is planned for
"Commercial" uses on the approved GDP.
As a result of our meeting, you asked Planning staff to provide you with options for addressing
concerns with the "Commercial" use designation, north of 41" St. NW. Options, which maybe
considered, include:
• Initiate a study of the Arboretum GDP to determine what land use is best for the area
lying north of 41" St., east of Arboretum Drive NW and south of the single family
homes along the southern portion of the Arboretum. if the conclusion of the study
were to amend the GDP, then an amendment would need to be initiated.
• Initiate an amendment to the Arboretum GDP.
Leave the GDP as is and allow the property owner to either propose a "Commercial"
development or an amendment to the GDP.
Any development proposed on this property would be reviewed though the public hearing process
with both the Planning Commission and City Council.
If you have any questions, you may contact me at 285.8232.

ITEM DESCRIPTION: CALL PUBLIC HEARING FOR HOUSING REVENUE BONDS PREPARED BY:
FOR WEATHERSTONE TOWNHOMES PROJECT I T. SPAETH
Weatherstone Townhomes is a proposed 100 unit townhome rental housing facility with approximately 40 two
bedroom townhomes and 60 three bedrom townhomes to be located along the west side of 50th Avenue NW and
61" Street NW. The project meets the requirements for Revenue Bond assistance by committing to rent 75% of
the units to individuals whose income is at or below 50% of the median income and by renting 25% of the units
to individuals whose income is at or below 60% of the median income. .
Weatherstone is requesting approval for the issuance of not to exceed $7,500,000 in Housing Revenue bonds for
this project. The name of the City would be utilized in the issuance of the bonds. The bonds would be
repayable solely from the revenues of the facility and the City will bear no responsibility, legal or otherwise, for
the repayment to the bonds. The City's policy with regards to revenue bonds has been to require either an "A"
rated bond or that the bonds be issued in minimum denominations of $100,000. The rating of the bonds would
meet the City's requirements.
The Council is requested to call a public hearing on the issuance of the bonds for February 7, 2000. At that time
it is also expected that Weatherstone will be requesting the Council to initiate the proceedings to establish a TIF
District on the development property.
COUNCIL ACTION REQUESTED:
Approval to call a public hearing for the issuance of up to $7,500,000 in housing revenue bonds for the

ITEM DESCRIPTION: Bear Creek Development Assistant Agreement Amendment No. I
Doug Knott fir -
On August 16, 1999, the City Council entered into a Development Assistance Agreement with 30-EL
Properties for the Bear Creek Apartment project. The City is providing TIF assistance to the project in
exchange for the developer agreeing to rent the units at a below market rental rate. The Development
Assistance Agreement required the developer to start construction by September 1, 1999 and to
complete the project by March 31, 2000. 30-EL was not able to complete the design and obtain a
building permit in time to start fall construction. The tight labor market was also a factor in postponing
the construction start.
The attached letter from Joel Bigelow requests an amendment to the Agreement that would change the
start date to March 5, 2000 and the completion date to September 15, 2000. All other terms of the
Agreement would remain the same.
CounciiAction Requested:
Approval of the amended start and completion dates and authorization for the Mayor and Clerk to sign

Dear Mr. Knott:
Due to the time period it took to get blueprints, bids, plot plan, etc. completed for the proposed
building of the 24 unit apartment complex at 1405 Marion Rd. SE, Rochester, Bear Creek, we
would like to ask for an amendment to the development agreement changing the date of"start of

September 15, 2000.
Let us know if this change is alright. We appreciate your cooperation on this matter.

ITEM DESCRIPTION: Amend RCO 125A.21 subd 2( c ) - Removing Restriction of Hours for
On -Sale Liquor
Judy Scheer
Our current liquor ordinance is inconsistent with state law restricting the hours of sale for on -sale
intoxicating liquor. State law requires that if a restriction is imposed, it must be consistent with
sales of all liquor. Our current ordinance prohibits the sale of intoxicating liquor on December
20 after 8:00 P.M. but does not restrict the sale of 3.2% malt liquor.
Under State law the City can impose the 8:00 P.M. restriction on both intoxicating liquor and
3.2% malt liquor on December 24 b or allow for the sale of both until 1:00 A.M.
I would recommend that the restriction be removed and allow for the sale of all liquor on
December 24t' after 8:00 P.M.
COUNCIL ACTION REQUESTED
A motion to amend RCO 125A.21 subd. 2( c ) allowing for the sale of on -sale intoxicating liquor
after 8:00 P.M. on December 24 h and instruct the City Attorney to prepare the required ordinance
for adoption.

OFFICE OF THE CITY ATTORNEY
MEMORANDUM
DATE: December 28, 1999
TO: Judy Scharr — City Clerk
FROM: David M. Goslee — Deputy City Attorney )w_C7
SUBJECT: RCO Section 125A.21 — Incompatibility With State law
You may recall that in early 1998 we amended the days of sale for off -sale liquor sales as a
result of an appellate court case that stated that Cities may not regulate the days of sale
inconsistent with state law. This case arose from a contest to the liquor ordinance in Faribault.
As you are now aware our ordinance, as it relates to on -sale hours, is inconsistent with state
law. I have provided two proposed ordinances that resolve the inconsistency. I recommend
that you either submit the choice of ordinances to the City Council for consideration, or get
further direction from the City Administrator on how he would like to proceed.
Minn. Stat. Section 340A.504 establishes the days and hours of liquor sales subject to limited
restrictions that may be imposed by municipalities. Municipalities may not further restrict days
of sales, but may further restrict hours of sales if the restriction applies to sales of all alcoholic
beverages (intoxicating liquor and 3.2 % malt liquor).
RCO section 125A.21, subd. 2(c), prohibits the "on -sale" of intoxicating liquor after 8:00 p.m.
on December 24'". There is no similar restriction on the sale of 3.2% malt liquor on December
24th. Thus the on -sale restriction on intoxicating liquor fails.
One option is to delete RCO section 125A.21, subd. 2(c) that imposes the 8:00 p.m. restriction
on the on -sale of intoxicating liquor. The second option is to amend 125A.21 to make the
December 240 restriction apply to the sale of both intoxicating liquor and 3.2% malt liquor.
This would result in a restriction on hours that is within the City's authority as it would then be
consistent for all on -sale licensees.
Please let me know if you have any additional questions.

Lease of digital recording equipment
Police
D-►4
PREPARED BY:
Steve Johnston
The Police Department would like the City to enter into a five-year lease agreement to lease digital recording
equipment for the Public Safety Communications Center.
The Police Department Communications Unit records all critical communications in the unit. At the present
time, these communications are recorded on a 40 channel dual -deck analog recording system. This system was
purchased in 1993 at a cost of about $50.000. That equipment has been fairly reliable but recovering
information from that equipment is quite labor intensive.
The Police Department recently received an invoice from the vendor that maintains this equipment for us. The
im oice amount was for $14,617. This is a 14% increase over last years expense. We have tried dropping
sen ice levels from 24 X 7 to 8 X 5 in anticipation of a 20% decrease on certain items but the cost went up in
spite of this.
Looking for alternative solutions, we found a vendor that will provide us with state-of-the-art magneto -optical
recording equipment for $13,570 per year on a five-year lease. There will be maintenance costs of $3,900 per
year for the second through fifth years. The total cost of the lease over five years will be about $83,451.
Staying with our present vendor will cost about $84,058.
The equipment we propose to lease is network compatible and will offer the Police Department improved
capabilities in terms of making effective use of this information in investigations and prosecutions along with
reduced effort to recover data.
This equipment is also available for purchase but since this problem arose unexpectedly, we have no budgeted
fund to pay for this equipment except our current allocations under 4112-11260. Entering into this lease will
cause us to spend $570 more than allocated for this specific purpose. Remaining with our current vendor will
cause us to spend $1,617 more than allocated. We should be able to cover this cost with current appropriations,
however, due to an unanticipated reduction in the cost of 9-1-1 maintenance for FY 2000. This reduction also
impacts 4112-11260.
Council Action Requested:
The Police Department would like the Mayor and City Clerk to be authorized to enter into the lease agreement
subject to the approval of the terms and conditions by the City Attorney.

PREPARED BY:

Mn/Dot is again seeking candidate road and bridge projects for the State Transportation Improvement Program.
(STIP) This request is for projects to be let during Fiscal Year 2003. (October 1, 2002 to September 30, 2003).
These projects are funded thru the Federal Transportation Bill, TEA-2 1.
The application deadline is February 1, 1999. The applications must include prioritizing projects if more than one
is submitted. Local agencies submitting a project must also commit to funding a minimum of 20% of the
construction costs, all the design & inspection costs, and all the ROW costs. Mn/Dot normally receives
application for more projects than can be funded. Applications are reviewed and ranked by the Southeastern
Minnesota Area Transportation Partnership. Agencies that have successful project applications will be notified in
about three months.
Public Works staff has identified the following projects the we feel would compete well for the federal funding,
and we recommend the applications be submitted for these in the priority listed;
1) Grade Separation on TH 63 at the DM&E Mainline Tracks. This project involves an underpass for the
center two lanes on Broadway. The outside two lanes would remain at grade and would still intersect Civic
Center Drive. The local share would qualify for MSA funding. The project limits would extend from 2nd
Street NW to 5'" Street NW.
2) 65" Street NW from 18'h Avenue to the West Frontage Rd of TH 52. This new roadway would be a four -
lane divided roadway with tumlanes at major intersections, and an overpass at TH52. Annexation of most of
the alignment is needed. The local share would qualify for MSA funding.
3) 201° Street SE from CRl (11" Avenue SE) to CR 34 (Marion Road). This project includes abridge over
Bear Creek, and wetland mitigation. An official street map is inplace for the alignment. Annexation of most
of the alignment is needed. The local share would qualify for MSA funding. This project was previously
submitted for funding in FY 2001 and 2002.
4) 50" Avenue NW from 19" Street to 75" Street. This new roadway would be a four -lane divided roadway
with tumlanes at major intersections, and major drainage structures at three locations. Annexation of most of
the alignment is needed. The local share would qualify for MSA funding.
In addition, staff would recommend that the Council authorize an application to MN/DOT for a Transportation
Revolving Loan Fund (TRLF) loan to assist the City in funding the Municipal State Aid Street Projects
enumerated in the 2000-2005 CIP. The application should be in the amount of $5,000,000 with future Municipal
State Aid Street Funds as the source of the loan repayment over a 10-year period. Application for the TRLF loan
at this time does not obligate the City to accept the loan if awarded.
COUNCIL ACTION REQUESTED:
Adopt the prepared resolution acknowledging the City's support, sponsorship and priority of the STIP highway
projects, including a commitment to secure and guarantee the local share of the project costs including the
construction costs, all the design & inspection costs, and all the ROW costs.
Authorize an TRLF loan application for $5,000 000 for year 2000 — 2005 MSA Street Projects.

Re: Revised ATP Project List Solicitation and Priority for FY 2001-2003
I have prepared a revised RCA for Item D-15 on the Council Agenda of 1/19/00 and request
the City Council's consideration and approval. The original list of the four transportation
projects that appears in the Council Meeting packet only includes projects defined as
Expansion Projects by the Area Transportation Partnership (ATP).
The ATP annual considers and prioritizes projects in three categories; Expansion,
Reconstruction, and Preservation. I would be remiss if I did not recommend and advise the
City Council to submit at least one city project in each of the three categories. The
following projects are recommended to the City Council for inclusion on the list of
candidate projects that is submitted by the City to the ATP.

I . Construct Grade Separation on TH 63 at the DM&E Mainline Tracks.
2. Construct 65'h Street NW from 18'h Avenue NW to the West Frontage Road of TH 52.

The City entered into Development Agreement with Ryan Companies US, Inc. on January 3, 2000 for the
development of Rochester Marketplace. The City has certain obligations under the Development Agreement for
the design and construction of traffic signals on 41st Street NW at the TH 52 West Frontage Road and also at 31 st
Avenue NW when warrants are met. The estimated cast of the two traffic signals, without the benefit of
approved plans and specifications is $310,000.
Ryan Companies US, inc. has utilized the professional engineering services of RLK Kuusisto, Ltd. of
Minnetonka, MN for all of the municipal engineering aspects of the Rochester Marketplace project. The City
staff has reviewed the qualifications and work products of RLK and has determined that they are qualified to
design the traffic control signals required for the 41st Street NW corridor.
The Public Works Department would recommend that the City Council enter into a professional services
agreement with RLK Kuusisto, Ltd. for the design of traffic control signals at the intersections of 41 St Street NW
and the TH 52 West Frontage Road and at 41st Street and 3 1 A Avenue NW for an amount not to exceed $27,500.
Funding for this work is available in J-6397, 41st Street NW Signal Improvements, and was authorized in the

ITEM DESCRIPTION: Professional Services Agreement for Official Map Revisions
PREPARED BY-e
R. Freese r
In 1995 ROCOG completed the TH 63 South Corridor Study which analyzed the roadway system needs along the
TH 63 corridor from TH 52 South to Interstate 90. The Study recommended that the TH 63 South corridor
should be upgraded from expressway to freeway status and that interchanges should be constructed at 40th Street
and 48th Street South. In an effort to protect the corridor from development within the contemplated right-of-
way needed to construct the two interchanges, the City retained the professional engineering services of Yaggy
Colby Associates to prepare an official street map of the area immediately adjacent to the proposed TH 63
interchanges at 40th Street and 48th Street South. The City Council approved Official Street Map No. 12 on
February 3, 1997.
In 1998, the City, County and MnDOT jointly contracted with Yaggy Colby to prepare an Environmental
Assessment, Preliminary Design and Layout Plan for the TH 63 / North Willow Creek Study Area improvements
between TH 52 and 48th Street South. This work is nearing completion and the Technical Advisory Committee
has agreed upon a preferred alternative for the Layout Plan. The preferred alternative requires refinements to the
Official Street Map No. 12. Several property owner's land will be less affected by the changes to the Official
Map while others will see slightly greater impacts to their property as a result of the map refinements.
The Public Works and Planning Department staff feel that the Official Map is a valuable community planning
tool and the accuracy of the map enhances its value to both the city and the property owners. It is our
recommendation that the City Council authorize the retention of Yaggy Colby Associates, for a lump sum amount
of $6,500, to revise the Official Street Map No. 12 to be consistent with the preferred TH 63 / North Willow
Creek Study Area alternative layout that includes the following street segments:
♦ TH 63, including the frontage roads, from TH 52 to 0.5 miles south of 48th Street
♦ 40th Street, from 1 lth Avenue SW to the proposed intersection with St. Bridget Road
♦ 48th Street, from 1 jib Avenue SW to St. Bridget Road
♦ St. Bridget Road from 48th Street SE to 40th Street SE.
Funding for this work is available in J-2264, TH 63 Layout Plan.

PR7PARED BY: ;1'
r M. Nigbur^0
During the plat referral process for the preliminary plat of North Park Tenth Subdivision a concern has
been expressed by staff responsible for street name and addressing review. Due to potential conflict in
house numbering the roadway designation should not reflect 61 Street NW.
To resolve the problems associated with 61" Street NW street designation a change in the street name
should occur. In looking at the three plats the roadway affects, it would make sense to name the
roadway consistently throughout them. The name agreed on is Savannah Drive NW. This designation
has already been implemented within White Oaks Fourth Subdivision and will be the designation in
North Park Tenth Subdivision, upon plat approval. However, the existing North Park Ninth Plat needs
to be modified to reflect the proposed changes. There are 6 different property owners that will require
an address change.
Staff would recommend that an ordinance be adopted that changes the 61" Street NW. street name in
North Park Ninth Subdivision to Savannah Drive NW.

The City received a petition for the extension of High Level Watermain to link the Northwest water

construction activity in the area only a portion of the requested extension would need to be constructed
as a public project. Therefore, staff analyzed the cost of a project to link the High Level Watermain
located at the Easterly edge of Orchard Ridge (which is proposed for construction in 2000) to the East
side of HWY 52 to connect to a watermain that was recently installed.
Based on the feasibility, Staff has determined the project is feasible only if the petitioner provides a

LOCAL IMPROVEMENT PROJECT FOR THE
WATERMAIN EXTENSION
TO SERVE VACANT LANDS LYING SOUTH OF 65TH
STREET NW. SURROUNDING THE TH 52 AREA.
January 13, 2000
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution proposing the following project:
Extension of watermain to serve vacant lands within the City's Corporate Limits lying South of 65'h Street
NW surrounding the TH 52 cooridor. A petition has been filed with the City Clerk and approved by the
City Council on October l8, 1999.
Feasibility Report
We report that this project is feasible and recommend its construction provided the petitioner makes an
upfront contribution to the project. The project is within the City's Urban Service Area and is within an
area proposed for residential and commercial development. Development of the area has been very slow
due to the large expenditures needed to provide public services to these vacant parcels. This project would
allow the properties to develop on City water.
This project has not been budgeted for in the City's Capital Improvement Program, but is a necessary and
planned project. The costs of this project should be paid from connection charges collected from the
benefiting properties and the Water Utility.
The proposed project consists of the installation of 12 inch watermain extending from the Orchard Ridge
subdivision on the West to the East side of TH 52 right of way. The total potential length of the watermain
extension project is approximately 2250 linear feet. The area served by the watermain extension is
estimated at 120 buildable acres.
This report and the estimated costs for the project are prepared without the benefit of field survey, soil
borings, or completed plans and specifications.

The total assessable frontage for the project is estimated at 2,880 front feet. However, according to the
City's Alternative Water and Sewer Connection Charge Policy there may be certain maximum payments,
which would apply to some of the parcels.
The City's share of the project is estimated to be $75,000 (40%) which includes the cost of watermain
oversizing, unassessable frontage, the TH52 roadway crossing, and the corresponding share of the
engineering & contingencies. The petitioner's share of the project will need to be $36,000 (20%) in order
for the project to be feasible at this time. The City share (40%) and the petitioner's contribution (20%)
equals the required 60% upfront funding commitment expected by the City Council.
Before this project proceeds, the petitioner should be required to enter into a Contribution Agreement for
20% of the project costs, estimated to be $36,000. The project should pay for itself. The City should be
able to collect $104,000 in water connection charges as land adjacent to the project develops in the future.

Center Dr NW to 7th St NW (J2261). D. Nelson"
Based on the Feasibility Report, the Department of Public Works recommends the construction of 16"
Ave NW from Civic Center Drive to 7" St NW. Staff has determined the project is feasible only if the
abutting property owners are assessed a portion of the project costs.
Construction of 16" Ave NW from Civic Center Dr to 7" St NW has been included in the Capital
Improvement Program since 1996. The 1996 CIP approved a $1,376,000 City cost which included
construction costs, engineering and contingency costs, and ROW reimbursement for the Northgate and
Mattison parcels. The balance of the ROW was to be dedicated by those owner(s).
Since that time, Project cost and ROW costs have significantly increased. Additionally, we've received
Federal funding commitments of $700,000. Therefore, to make this a viable project, one similar in cost
to the original (1996) CIP project, we recommend that the abutting property owners be assessed a
portion of the street costs. We based their assessment on a typical 36 ft wide, 9 ton commercial street
and not the proposed 52 - 66 foot wide collector street.
Based on the assessable footage and a street assessment rate for the 36 foot wide commercial street
section of $297.70, the total assessable costs equals $380,000, together with the $700,000 in Federal
funds, this represents 46% of the total project costs.
The remaining balance (54%) of $1,262,856 becomes the City share (an amount similar to $1,376,000
the 1996 CIP). The City share would be funded from the City's Municipal State Aid account.

The original project was included / approved as part of the City of Rochester's 1996 Capital Improvement
Program at a cost of $1,376,000. This cost included construction cost, engineering and contingency cost
and ROW reimbursement for the Northgate and Mattison parcels. The balance of ROW was to be
dedicated by those owner(s). Project funding was to come from the City's Municipal State Aid account.
The proposed project consists of the construction of a 52' - 66' wide, multi -lane street, 950 feet in length,
with a new traffic signal at 7i° St NW and modifications to the existing signal at Civic Center Dr.
Additionally, work will include a Railroad crossing and signal system at the DM&E tracks. Watermain
and storm sewer improvements are included as a part of this project.

Since the original project was approved as part of the 1996 CIP, construction costs and right-of-way cost
have significantly increased.
In 1999, we received a commitment for Federal funding for a share of the construction costs. Federal
funding is approved at $700,000.
To make this a viable project, the watermian and storm drainage costs and a portion of the street costs
should be assessed to the abutting property owners.
There is approximately, 1276.44 feet of assessable frontage. The full cost to build a standard 36 ft wide, 9
ton commercial street is $380,000 which equates to an assessment rate of $297.70 per assessable foot of
frontage.
RP- 3 - JAtNUARY 14, 2000
Additionally, service connection charges are funded directly from the benefiting owner
Assessments ($380,000) together with Federal Funding ($700,000) totals $1,080,000. This represents
46% of the total project costs.
The remaining 54% ($1,262,856) represents the City Share of the project. This would be funded from the
City's MSAS funds. This number is similar to the 1996 C1P project funding previously approved by the
City Council.
As such we recommend this project moves forward as a feasible, special assessment project

This is a recommendation to restrict parking on the south & west side Hampton Rhodes Court NW, at
all times. The reason being is to provide adequate traffic lane width to meet the current City of
Rochester Standards for residential streets.
At one time this was a private street. The residents petitioned the City to take over the street as a public
street. Their petition was approved. The City Council required that the parking should be removed on
one side due to the narrow pavement width. This department conducted a survey of the residents to
determine which side they preferred. The results of the survey are:
Post No Parking on the South & West side.....4 in favor.
Post No Parking on the North & East side .... 4 in favor
1 resident responded neither side, and 14 did not respond at all.
Staff recommends that the south & west side be restricted to improve the visibility on the curve.

ITEM DESCRIPTION: Wetland Delineation and Replacement Plan — City of Rochester Public Works
PREPARED BY:
Department
John Harford, Senior
Planner
January 12, 2000 t
Wetland Delineation and Replacement Plan:
In 1996 the City of Rochester identified 5.34 acres of jurisdictional Type 1 wetlands in a drainageway that is parallel
to the DM&E railroad bed north of Barlow Plaza. The total wetland area that is proposed to be filled for the
construction of river bank stabilization and erosion control on a natural drainageway is 0.48 acres. A wetland area of
2000 square feet is not included in the replacement acreage because it has been included under the "De minimis".
With the allowable deduction of 2000 square feet the total fill area is 0.44 acres and the total replacement required is
0.88 acres. The city plans to replace the filled wetlands through the state Board of Water and Soil Resources
transportation program for new public road replacement.
The Technical Evaluation Panel met and reviewed this application in 1998 and recommended approval. Other referral
agencies have not made any comments.
anning Staff Recommendation%

It is my understanding that you require a statement for sequencing indicating what
afternative the City considered to avoid or minimize the wetland impacts. This letter
serves that purpose.
The Department of Public Works has performed a study in 1995 relating to the
proposed alignment of 16th Avenue NW. As part of this preliminary study, several
alignments were reviewed. Together with the knowledge of the impending
reconstruction of Highway 52 in this area and the need to provide a link between
Civic Center Drive and 7th Street at 16th Avenue, options became very limited.
It was very apparent that there were only two basic options:
A no build option
A build option (which had several slight alternatives) which crosses
the wetland/drainage way.
An Equal opportunity Employer
Page 2
May 29, 1998
Due to the needs for the linking of transportation routes and the reconstruction of
HWY 52, the Build Option was chosen.
As part of the City's responsibility for mitigation for the loss of 0.48 acres of wetlands
in conjunction with this project, we will be acquiring banking credits through BWSR.
Our consultant, Yaggy/Colby Associates, will be coordinating the details for the
wetland mitigation.
If you have any questions relating to this project please let me know.
Sincerely,
Michael J. Nigbur

with the future installation of a signal that adequate gaps will be created in the
through traffic flow to allow the median opening on CSAH 22 to remain to serve
the Woodland Drive traffic If operational problems did occur in the future,
however, consideration to closing the median or limiting it to inbound left turns
only would need to be considered, since the location would be too close to the
future signal at Bamber Valley Drive, and the approach volumes would be too
low, to warrant installation of the signal. Under this scenario, more traffic would
need to be routed down the frontage road to the signalized intersection at Fox
Valley Drive in order to access CSAH 22. Our estimate of the resultant traffic on
the frontage road under this scenario is a total volume of approximately 1100
vehicles per day, which would be within the range of acceptable traffic flow on a
local residential street.
City

City

The level of development north of 55m St along 50 Ave will require upgrading of
Graves
the road to collector or arterial street standards in order to accommodate the
projected level of traffic that will originate in this area. Until a financing plan for

total amount of traffic generated west of 50" Ave to approximately 3000 trips per

County
Final Plat 99-5
At the preliminary plat stage the transportation staff commented on the need for
Coventry Hills
the following three items:
• Establish access control along the frontage on TH 52
• Contribution toward the construction of a nght turn lane off of southbound
TH 52 at 55" St SE
• Accommodate extension of one of the cul-de-sacs to the south property line
to allow for future interconnection of streets if the area south and west of this
plat should ever be developed.
It appears from review of the final plat and information submitted that these three
conditions have been satisfied. A street easement has been shown between lots 4
and 5 in Block 1 that provides the ability to construct a street at a future date
should the desire arise to do so. (It should be noted that this would only happen at
the initiative of the township and most likely at township expense if it was to be
done at some time in the future). From a review of the topography and wet areas
within the plat and on surrounding lands it appears that the more logical
connection would be to the west rather than to the south as had been suggested at
the preliminary plat stage.

• Establish access control along the frontage on TH 52
• Contribution toward the construction of a right rum lane off of southbound

• Accommodate extension of one of the cul-de-sacs to the south property line
to allow for future interconnection of streets if the area south and west of this

It appears from review of the final plat and information submitted that these three
conditions have been sarisfied. A street easement has been shown between lots 4

A
REPORT ON THE FEASIBILITY
OF
PROPOSED LOCAL IMPROVEMENT PROJECT
Project No. 6207-4-00
J No. 9594
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution proposing the following project :
'Reconstruct 7" Street NW from 4611 Avenue NW west approximately 1300 feet"
Public Works prepared the Engineers Feasibility Report.
Feasibility Report
We report the project is technically feasible and recommend it be constructed contingent
on participation by the requesting developers (at least 60% is required). Property in the
vicinity of this section of 7" St NW is being developed. Diamond Ridge development lies
to the north and Manorwoods West to the south. In addition, there are three properties
that contain a single-family dwelling with 903 feet of street frontage along this section
that currently lie outside the corporate limits of the city.
The project would upgrade a narrow road with a poor pavement section in an area
where traffic volumes are increasing due to development. The Project as proposed
would involve the construction of a 44-foot wide bituminous street with a structural
design thickness adequate for the existing soils and projected traffic. Concrete curb and
gutter would be constructed on both sides of the street and the boulevard would be
graded to the full width of the right of way. Construction would also include sanitary
sewer, watermain, storm sewer and subdrain.
Sewer and water services will be stubbed to future parcels to the extent that the
locations can be determined. The three existing residential dwellings would be eligible
for connection consistent with the Water Quality Protection Program.
The estimated costs of the Project, made without completed plans or survey are as
follows:
Grading, paving, curb & gutter,
$118,700
Storm sewer, subdrain
$ 32,000
Sanitary sewer
32,000
Watermain
43,160
Service Connections
10,000
Sub -total
$235,860
Engineering, Interest & Contingency
70,750
Total $306,610
rub
The estimated revenues of the Project are as follows:
Street Reconstruction
Assessable frontage = 2158 ft X $30.00 per foot = $64,740
Initially recoverable = 1277 ft X $30.00 per foot = $38,310
Sewer and Water Connection Charges
Initially recoverable = 738 ft X $71,00 per foot = $52,398
Potential connection charges = 903 ft
Water Connection Charges
Initially recoverable = 420 X $36.05 per foot = $15,141
Service Connections
Initially recoverable (estimated) = $13,000
Total of Costs Initially Recoverable = $118,849
This amount is 38.8% of the total project cost. This is under the 60% required by past
policy of the City to not construct a project until 60% of the costs are initially
recoverable.
The Public Works Department reports that the project is NOT feasible at this time
without additional private financing.
We recommend the developers petitioning for this project support 60% of the street
construction cost ($195,910 X .60 = $117,546) and the sanitary sewer and watermain
charges reflected above ($52,398 + $15,141 + $13,000 = $80,539).
The developers contribution of $198,086 represents 64.6% of the total project costs. As
such, this makes this a viable project.
If the Council wishes to proceed, the Developers of Diamond Ridge and Manorwoods
West are required to execute Contribution Agreements that provide a 60% initial
recovery of the project costs prior to the City Council authorization to Advertise for Bids
for the construction of this public improvement project.

ITEM DESCRIPTION: A Plan For
REQUEST FOR COUNCIL ACTION
Finance Department
Merger of the Rochester Police and Fire Consolidated Pension Accounts with PERA
MEETING /
DATE: 1/19/00
ITEM NO.
$,--5
PREPARED BY:
Dale Martinson
This is a public hearing to accept input on a plan of expenditure of residual pension plan assets. Said plan is to be
adopted by the City Council according to Minnesota Session Laws 1999, Chapter 222, Article 4, Section 10,
subdivision 7.
Background:
We received notice of final calculation of residual pension assets that are to be returned to the City due to the
merger of the police and fire consolidation pension accounts with the PERA police and fire fund. The numbers
have improved somewhat.Council supported this merger law with the other 21 cities. Residual asset amounts to be
returned to the City of Rochester include:
1. Fire Consolidation Account $3,616,916
2. Police Consolidation Account $ 367,420
Total Residual Assets $3,984,336 *
• Plus interest from July 1, 1999 to date of payment.
Requirements to Receive Payment:
In order to receive the residual assets the session law authorizing this merger specifies four important points:
l . The municipality, following a public hearing on the issue, must formulate and adopt a plan for the expenditure
of the residual amount and must file that plan in the form of a municipal resolution with the state auditor.
2. The residual asset amount must be used by the municipality to defray fire department expenditure items if the
residual asset amount was from the fire consolidation account, or to defray police department expenditure
items if. ... from police consolidation account.
3. The residual asset must be deposited into a special fund or account, invested, and interest earnings must be
credited to that account with its disbursement similarly restricted.
4. The special account must be audited periodically by the state auditor until disbursed.
Recommendations:
In order to receive payment and most expeditiously meet the requirements of the law, we are recommending
adoption of the plan in the attached resolution whereby we utilize residual assets from the fire plan for current
operating expenditures of the fire department and those from the police plan to fund current operating expenditures
of the police department. Under this plan, we estimate all residual assets would be fully disbursed within
approximately six or seven months.
Separate from the expenditure plan, but related to it, we recommend the Council amend the 2000 budget and
reallocate $4.0 million of tax levy for 2000 from the general fund to the capital improvement fund to be allocated
towards public safety projects including the LEC dispatch system, the Opticon Emergency Stoplight Control
System, Relocation of Fire Stations 3 and 2, and Fire St ton 5 Construction.

expenditure items if the residual asset amount was derived from a police consolidation account."
1.3 The Merger Law further requires that the municipality hold a public hearing on
this issue and, following the hearing, formally adopt a plan for the expenditure of the residual
amount.
1.4 At a public hearing duly held on January 19, 2000 on the proposed plan for the
expenditure of the residual amount, all parties who appeared at the hearing were given an
opportunity to express their views with respect to the proposal and all interested persons were

REPORT ON THE FEASIBILITY OF A PROPOSED
LOCAL IMPROVEMENT PROJECT FOR THE
SANITARY SEWER, WATERMAIN AND

TO SERVE VACANT LANDS LYING IN ROSE
HARBOR
January 14, 2000
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution proposing the following project:
Sanitary Sewer, Watermain, and Roadway to serve vacant lands within Rose Harbor. A petition has been
filed with the City Clerk and approved by the City Council on January 3, 2000.
Feasibilitv Report
We report that this project is feasible and recommend its construction. The location of this project is
within an area proposed for residential development. Development of the area has been very slow due to
number of different owners of land within the project area. This project would allow the vacant properties
to develop on public sewer, watermain and a new roadway.
This project has not been budgeted for in the City's Capital Improvement Program. The costs of this
project should be paid from assessments collected from the benefiting properties.
The project consists of the construction of sanitary sewer, watermain, storm sewer, subdrain and an urban
bituminous roadway with concrete curb & gutter to serve the vacant lots within a portion of Rose Harbor.
As part of the cost estimates we have anticipated the presence of subsurface rock, which may increase the
cost of construction.

The total assessable frontage for the project is estimated at 2700 front feet. We recommend that the
necessary costs to be collected for this project be done so in accordance with the existing assessment and
connection charge policies. There is not any City share for this project. This project is well short of the
desired 60% guideline the Council desires for an economically feasible project. However, considering the
number of different land owners in the area and the amount of construction needed, a City assessment
project is the logical method to construct the needed infrastructure.
For this project to proceed the petitioner should enter into an agreement for the proportionate share of the
costs applicable for their property. Staff would recommend that the petitioner's costs be assessed over a 2
year period. The assessment term for the remaining parcels should be consistent with the current policies
in effect.
