PREPARED BY:
COMMENTS STB DEIS AND CORPS PERMIT PROCESS
G. NEUMANN
The Surface Transportation Board has provided for a 90-day comment period on the Draft Environmental
Impact Statement for the DM&E Coal Train project. The Corps of Engineers has provided for a 60-day
comment period on the DM&E's application for a 404 permit that is required relating to the impacts on water
bodies and waterways by the project. Given the scope of the DM&E project and the volume of information that
needs to be reviewed, the time frame for the City and citizens to submit continents is insufficient. We anticipate
at this time that the City will need to perform some detailed analysis of the traffic, noise, vibration, water
quality, and environmental justice impacts of this project. This will require the assistance of consultant
engineering firms and experts. A 90-day comment period will be insufficient to permit the City organization
and our citizens to address and respond to the issues raised in the DEIS. The DEIS as it now stands correctly
identifies that there will be significant noise, vibration, and environmental justice issues that will need to be
considered and addressed (if they can be addressed at all) in the City of Rochester. Even that recognition by the
STB and its consultants, we believe, understates the problems. The DEIS, at this time, provides no suggestions
on the specific measures that will need to be undertaken to correct or mitigate these problems. The City and the
community will need more than 90 days to review and analyze the information in the DEIS in detail and to
provide information that will lead to a reduction or mitigation of the significant environmental problems that the
DM&E Coal Train project will pose for the citizens of Rochester.
A total comment period of 180 days is required to adequately study, analyze, and develop solutions to the
environmental concerns raised in the DEIS and the Corps of Engineers 404 permit process. This is a request for
a 90 day extension for the DEIS process and a 120 day extension of the Corps 404 permit process.
COUNCIL ACTION REOUESTED:
Adopt prepared resolution requesting a total comment period of 180 days for the STB DEIS process and the
Corps 404 Permit process.

ITEM DESCRIPTION: Request for a Public Hearing to Consider the Issuance of an PREPARED E
Abatement Order for the Property at 509 9" Avenue NW R. Boose
The Rochester Building Safety Department desires to commence an abatement action against the property located at
509 9' Avenue NW in the City of Rochester. This property appears to have been abandoned and was placarded as
unfit for human habitation on August 4, 2000. The county records identify the owner to be Mrs. Ronald Klee with a
last known address of 1613 Hillside Drive NW, Cedar Rapids, IA 52405. Mrs. Klee has failed to respond to
letters from this department and the city attorney's office.
Minnesota Statutes, Chapter 463 provides a procedure by which the owners of property can be ordered to repair or
remove conditions or structures that are determined to be hazardous. By statute a hazardous building or hazardous
property means any building or property, which because of inadequate maintenance, dilapidation, physical damage,
unsanitary condition, or abandonment, constitutes a fire hazard or a hazard to public safety or health. This
department believes that the property currently meets this definition.
The first step in this process is a determination by the Council that the conditions amount to a hazardous building or
hazardous property. This determination can be made following a public hearing at which public comment can be
received. The public hearing process has been used by the Council in previous abatement matters. The council will
also have to consider what actions on the part of the owner will be sufficient to make the property non -hazardous
what time will be allowed the owner to take these actions.
COUNCIL ACTION REQUESTED-,
Schedule a public hearing for November 6, 2000, at which time the council will receive comment on the issue of
whether the property at 509 9' Avenue NW in the City of Rochester is hazardous as defined by state law. Direct
the City Clerk to publish notice of this hearing one time prior to the hearing and to send notice to the owner at her
address above.

A renewal of the Currency Exchange License for 2001 for Pawn America Minnesota LLC has
been received by the City Clerk. State Statute 53A.04 requires the City to render a decision
regardng the renewal of the license within 60 days. If the Council takes no action on the
application, State law presumes it to be approved.
On June 7, 1999, the Council held a hearing to consider approval of the Currency Exchange
License. Testimony was taken from Holly Haddad, Community Action Program, concerned
about consumer protection. Resolution No. 374-99 was approved denying the license on the basis
that the service was not needed for the community. No one representing Pawn America
Minnesota was present at the meeting.
On July 7, 1999, a rehearing of the application was held. Testimony was taken from Holly
Haddad, Community Action Program, again concerned about consumer protection. Testimony
was also taken from Carol Wolski, a representative for Pawn America Minnesota, stating that
there was no basis for denial under City of Rochester ordinances. The Council rescinded
Resolution No. 374-99 and adopted Resolution No. 438-99 approving the license and asked staff
to research other cities. Mayor Canfield vetoed the resolution approving the license.
On July 19, 1999, testimony was again presented in favor of the license by Carol Wolski,
representing Pawn America Minnesota. The Council adopted Resolution No. 472-99 rescinding
the July 7, 1999, approval and moved to take no action on the license.
As there is no City ordinance to base an objection on, it is recommend that the Council adopt the
prepared resolution taking no action on the renewal of the Currency Exchange License for Pawn
America Minnesota LLC.

involves a variety of functions requiring knowledge of state, regional, and

automated systems, and coordinating interlibrary loan services with reference

The cost of employing one FT Library Assistant I approximately equates to the
costs of employing four part-time hourly positions. Recruiting a full-time

Dear Mayor Canfield:
Recently there was information in the Rochester Post Bulletin indicating that within the next year
there are several openings coming up on the Rochester Public Utilities Governing Board for

I would like to volunteer for consideration as a candidate for one of the positions when they
become available. As the chief financial officer for Rochester Independent School District 535, I
am responsible for all the business and financial activities of a $125 million revenue per year

Regardless of who is ultimately selected, I'd like to thank you for your consideration of me as a
potential candidate for the positions and wish you the best of luck as you go about the process of

REPORT ON THE FEASIBILITY OF A PROPOSED
LOCAL IMPROVEMENT PROJECT FOR THE
WATER MAIN & SANITARY SEWER EXTENSION
TO SERVE VACANT LANDS OF THE SW 1/4 OF
SECTION 29 LYING ON THE SOUTH SIDE OF 19`"
STREET NW AND NORTH OF THE RAILROAD.
June 23, 2000
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution proposing the following project.
Extension of Water Main and Sanitary Sewer to serve vacant lands currently adjacent to, but outside the
City's Corporate Limits and within the Urban Serve Area known as that part of the Hanlon Parcel south of
19'" Street NW hereafter referred to as the "Property". A verbal Request for information on the extension
of water and sewer to serve the Hanlon Parcel has been filed with the Department of Public Works for
which this report was prepared.
Feasibility Report
We report that this project is feasible. The location of this project, is within an area proposed for
commercial development within the City's 25-year Urban Service Area. Development of the area will
require on site water and sewer faciliries or the public services proposed by this project. This project
would allow the properties to develop with public sewer and ware, main.
The City received a petition for annexation of approximately 240 acres of the Verna Badger Property
earlier this year. A General Development plan for 200 acres of the Badge. property was approved by the
City Council on March 6, 2000. The western 60 acres of the Badger GDP plus the remaining 40 acres of
the Badger property will be served in the next 5 years by City sewer extended along the same alignment
described in this report to serve the Hanlon Preoerry.
A
This project has not been budgeted for in the City's 2000 Capital improvement Program. The costs of this
project should be paid from connection and availability charges collected from the benefiting properties.
Currently hunk sanitary sewer is located along the south side of the DM&E Railroad immediately adjacent
to the southeast comer of the Property. The proposed sanitary sewer for this project consists of the
installation of an 18-inch sanitary sewer line from the existing trunk sewer to approximately 800 feet east
of the west ''A comer of Section 29 and an 8" sewer to the west'/. comer. The 18" sewer would be routed
north under the railroad to 19' Street NW along the property line common to the Hanlon and Coats
properties. The sewer line would be installed westerly along 19'" Street for a distance of approximately
ir00 feet. Approximately 800 feet east of 50'" Avenue NW, the elevation of 19' Street begins to rise. At
that point a fixture trunk sewer will continue northwesterly to serve the 100 acres of the Badger property
plus an additional 900 acres Sections I9 and 30. For this project, an 8" sewer will be routed westerly along
19' Street NW from the proposed 18" sewer to the west line of Section 29 (50" Avenue NW). The first
segment of this sewer trunk line requires a crossing under the railroad using boring or micro -tunneling
techniques. The total length of the sanitary sewer extension project is approximately 2,800 feet. The
sewer and water main along 19'" Street NW can be constructed within the right of way without removal and
reconstruction of the street pavement.
- 2 - JUNE 23, 2000
The proposed water main for this project consists of the installation of 12-inch water main from the
existing 12-inch water main at the west end of the Highway 14 North Frontage Road to the west'/. comer
of Section 29. Currently a 12-inch water main is located on the Highway 14 North Frontage Road. The
water main would be routed north under the railroad to 190 Street NW along the property line common to
the Hanlon and Coats properties. The water main would be installed westerly along 191 Street for a
distance of approximately 2,000 feet to the west line of Section 29 (500 Avenue NW). The first segment of
this water main requires a crossing under the railroad using a boring technique. The total length of the
water main extension project is approximately 3,330 feet.
The estimated costs of the project, made without completed plans or survey are as follows:

The approximately 1,100 areas that would ultimately be served by this sewer extension and additional
northerly extensions are (1) the 26-arce parcel for which the petition was submitted, (2) the westerly
portion of the Badger Parcel (a feasibiliry_study is in progress to serve the Badger Parcel), (3) ail of Section
19 except for the northerly 1000 feet, (4) the NW '/. of the SW ''/,, the SW '/. of the NW ''/., and
approximately 20 acres of the E '/ of SW 'A of Section 20, (3) the E '/: section 29 north of the DM&E
Railroad, and (5) approximately 200 acres of the N S4 of Section 30. See attached map. These areas to be
served by this proposed sewer are within the Rochester Urban Serve Area. Assuming 60% of this area is
developable and 80% of that area develops, the total buildable area is 528 acres. The petitioner requested
service for a 26-acre parcel. The sewer and the water main are proposed to be constructed abutting the
petitioner's property, therefore a connection charge of 540.42 per foot for sewer and 536.05 per foot for
water main would be applicable. For the petitioner's property, the estimated sewer connection charges are
540.42/L.F. for 2,000 feet or 530,340 plus the estimated water main connection charges are 536.05rL.F. for
2,000 feet or 572,100. The connection charges for the petitioned property are 530,340 (sewer) plus
572,100 (water) totaling 5152,940.
— 3 — JUNE 23, 2000
In addition to the petitioned property, two parcels receive direct service to water and sewer with the
installation of these extensions. Tie Coats property, which lies east of the'petitioned property, would have
estimated sewer connection charges at S40 42/L.F. for 600 feet or $24,252 plus the water main connection
charges at 536.05/L.F. for 600 feet or 321,630, totaling 545,882. A second Hanlon parcel, which lies
North across 19' Street NW of the petitioned property, would have estimated sewer connection charges at
540.42/L.F. for 2,000 feet or $30,340 plus the water main connection charges at 536,05/L.F. for 2,000 free
or 572,100, totaling S 132,940. The sum of connection charges for these three parcels is 5351,762.
The City's share of the project is estimated as 561,000 for the railroad crossings plus 526,103 for the
oversized water main plus S 19,000 for the oversized sewer main plus unrecoverable frontage charges of
53,773 totaling S 109,876.
Adding the petitioner's connection contribution of S 152,940 to the City's share of S 109,376, the initial
project costs recovered are $262,316 or 52% of the project cost. This is consistent with the City Council's
guidelines of 50%-60% of initial project costs being committed for determining project feasibility.
Overall, the connection charges from the three abutting parcels frontage totals $351,762. Adding the
City's share, the recovered costs are estimated at $461,633 or 91% of the estimates project costs. The
remaining project costs are of 545,382 should be recovered as an increase in the Sewer Availability Charge
(SAC) by 543.07/Acre and the Water Availability Charge CWAC) by 543.33/Acre for the 523-developable
acres of this Sewer Sub -district 6G.
Staff would recommend that this project is feasible if petitioner enters into an Agreement to pay the
frontage charges and the availability charges consistent with City policy and as outline in this report.

As part of the construction of the Cascade Creek Bike Trail the City inadvertently constructed the trail over
a parcel of land not owned by the City. The City was made aware of this fact several years after the
construction occurred. Since that date the City Staff and the Owner began preliminary discussions for the
needed acquisition. An offer was prepared for the portion of the property impacted by the bikepath. This
offer was rejected by the Owner. However, through additional discussions, the City and Owner have
avoided condemning the property and have reached a preliminary settlement in the amount of $26,000 for
the entire parcel. This settlement includes all costs associated with the acquisition. Staff would
recommend in favor of this settlement.

ITEM DESCRIPTION: Supplemental Agreement #1, #2 and # 3 Sanitary Sewer in
Watermain in Skyline Drive SW, J9535
PREPARED BY:
J. Loehr
The City previously entered into a contract with Swenke Company for the construction sanitary sewer
and watermain in- Skyline Drive SW in a project described as follows:
Protect No. 9828, J9535
"Sanitary Sewer and Watermain to Serve the 1100 Block of Skyline Drive S.W."
SA #1: The plans and specifications provide for the construction of sanitary sewer and watermain in
Skyline Drive SW. The construction of these utilities requires the removal and reconstruction of the
roadway. The roadway sub -grade from station 0+00 to 2+75 is very wet and unstable.
The Department of Public Works determined that the sub -grade should be sub -cut and breaker -run
placed to correct the wet and unstable conditions. Public Works negotiated an amount of $5,568.00 as
compensation to Swenke Company for this work.
SA #2: The plans and specifications also provide for salvaging the reinstalling an existing 24" storm
sewer culvert pipe located at station 0+00. This pipe is in poor condition.
The Department of Public Works determined that a new storm sewer culvert pipe should be installed in
lieu of reinstalling the existing storm sewer culvert pipe that is in poor condition. Public Works
negotiated an amount of $1,000.00 as compensation to Swenke Company for this work.
SA #3: The plans and specifications also provide for modifying the existing roadway elevations from
station 2+80 to 5+50 to provide drainage to a new catch basin. The modification of the roadway
elevations causes erosion along the soil embankment.
The Department of Public Works determined that a bituminous berm should be constructed to channel
the roadway surface drainage to the catch basin and prevent erosion to the soil embankment. Public
Works negotiated an amount of $3,452.64 as compensation to Swenke Company for this work.
COUNCIL ACTION REQUESTED:
1. Adopt a resolution authorizing payment of Supplemental Agreement #1 in the amount of
$5,568.00.
2. Adopt a resolution authorizing payment of Supplemental Agreement #2 in the amount of
$1,000.00,

ITEM DESCRIPTION: Supplemental Agreement #1 and #2 Sanitary Sewer and
PREPARED BY:
Watermain in the Pinewood Road Area, J9577
J. Loehr
The City previously entered into a contract with A-1 Excavating for the construct n of sanitary sewer
and watermain in the Pinewood Road Area in a project described as follows:
Project No. 9714-99, J9577
"Sanitary Sewer and Watermain Extension to Serve 22n' Avenue S.E., 23rd Avenue S.E., 25`h
Avenue S.E., and 2656 Avenue S.E. South of Pinewood Road S.E.; Fairview Court S.E. North of
Pinewood Road S.E.; and in Pinewood Road S.E. from Fairview Court S.E. to a Point East of 30"
Avenue S.E. to Serve a Residence Located at 3020 Pinewood Road S.E."
SA #1: The plans and specifications provide for the construction of sanitary sewer and watermain
within the project area. The construction of these utilities requires the removal and replacement of
existing roadways, and existing bituminous and concrete driveways. The project failed to provide
specific pay items for the restoration of 55 driveway approaches.
The Department of Public Works determined that it is appropriate to provide pay items for the driveway
restorations. Public Works negotiated an amount of $23,011.78 as compensation to A-1 Excavating for
this work.
SA #2: The plans and specifications requires the coordination of various items of restoration work
required for the project, including the City providing survey stakes for the restoration work. Coordination
of this work caused delays in the contractor's grading crew restoration activities. A-1 Excavating
determined that their grading crew should be relocated and remobilized when conditions were favorable
to operate in a cost-effective manner. A-1 Excavating seeks compensation of $5,371.00 for the
relocating and remobilizing of the grading crew.
The Department of Public Works determined that it is appropriate to provide some compensation to the
contractor. Public Works negotiated an amount of $2,865.50 (50% of request) as compensation to A-1
excavating for relocating and remobilizing their grading crew.
COUNCIL ACTION REQUESTED:
1. Adopt a resolution authorizing payment of Supplemental Agreement #1 in the amount of
$20,011.78.
2. Adopt a resolution authorizing payment of Supplemental Agreement #2 in the amount of
$2, 865.50.

ITEM DESCRIPTION: Utility Connection Agreements: 31st Street NE, J8487 and J9350
PREPARED BY:
J. Loehr
Six property owners on 31st Street N.E., in Morris' First Subdivision, have requested permission from
the City to connect their property to the public sanitary sewer and watermain system. The properties
are subject to Sanitary Sewer and Watermain Connection Charges, a Sewer Availability Charge and a
Water Availability Charge for the benefit received from the public sewer and water systems. The
amount of connection charges and availability charges for each property is shown on the attached
spreadsheet.
If the property owners along 31st Street NE sign Utility Connection Agreements by October 1, 2000
they are eligible to participate in the City of Rochester Water Quality Protection Program (WQPP)
adopted by the City Council on December 21, 1998. The six property owners will receive credits to the
amount that each owner owes the City. These credits for public and private improvements are made
consistent with the WQPP Policies.
Utility Connection Agreements have been prepared between the City and the property owners for the
connection charges and availability charges. The property owners have signed the Agreement for their
respective property by October 1, 2000 as required. Therefore, these properties are eligible to
participate in the WQPP.
Payment of the connection charges and availability charges were required by October 1, 2000. On
October 1, 2000 payment of the connection charges and availability charges were considered
delinquent and were levied against each property as "unpaid charges", and were assessed against
each property over a period not to exceed ten years. Interest is charged at 7.5% annually on the unpaid
balance from October 1, 2000, to the date the "unpaid charges" and accrued interest are paid in full.
Connection of a property to the public sewer and water systems is not required until December 1, 2001.
If connection is not made by that date the City will levy a supplemental assessment against that
property in the amount shown on the attached spreadsheet.
COUNCIL ACTION REQUESTED:
1. Authorize the Mayor and City Clerk to enter into the Utility Connection Agreements.
2. Order the City Clerk to record the Utility Connection Agreement with the Olmsted County Recorder.
3. Authorize the levying of "unpaid charges" against a property if payment of the connection
charges and availability fees relative to that property are not made by October 1, 2000.
4. Authorize the levying of a supplemental assessment against a property if that property is not
connected to the public sanitary sewer and watermain system by December 1, 2001,

Project Background:
The project funding is included in item #3, page 46 of the 2000 - 2005 Capital Improvement Program.
The Council authorized Engineering Services for Design at the June 19, 2000 City Council meeting.
This project will extend the 12" sanitary sewer line west from 2nd St NW to undeveloped properties
along 2nd St SW and connect to the existing sanitary sewer system at the east side of Avalon Cove
development. This will allow the City to abandon the sanitary sewer line running east west across the
future Cascade lake area. Work will consist of approximately 3300 linear feet of new sanitary sewer
and will be integrated with sanitary sewer across developing properties.
Protect Recommendation:
The Public Works Department recommends the City Council proceed with an award to the low bidder.
Public Works has reviewed the municipal client references provided by the low bidder and has
determined that Dick's Excavating of Delano, MN is qualified to perform the proposed work.

CONCRETE CURB & GUTTER AND OVERLAY IN
20TH STREET NW
FROM 13TH AVENUE NW TO TELEMARK LANE NW
October 12, 2000
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution proposing certain petition requesting the following project:
Reconstruct existing street with a Concrete Curb & Gutter and Overlay in 20th Street NW
from 13th Avenue NW to Telemark Lane NW, was referred to the Public Works
Department on January 19, 2000 for preparation of the Engineers Feasibility Report.
Feasibility Report
We report the project is feasible and recommend its construction in the year 2001 based
on the current condition of the street and participation by the abutting property owners.
The existing street was constructed with bituminous curbing in 1964 and additions were
made in 1977.
We recommend that the project be constructed and funded in accordance with the City's
Comprehensive Pavement Management Strategy (CPMS). The CPMS is an objective,
cost-effective program for the preservation, rehabilitation and reconstruction of the City's
infrastructure. The most cost-effective strategy at this time for this street, which has a
Pavement Condition Index (PQ rating of 49, is rehabilitation.
Work typically will include the following
1. Removal of existing edges of the roadway and gravel base, boulevard sod
2. Construction of concrete curb and gutter, and driveway aprons
3. Storm sewer design considerations
4. Resurfacing of the entire street with bituminous asphalt.
5. Sidewalk sections reviewed for replacement.
6. Boulevard areas re -sodded.
This report and the estimated costs for the project are prepared without the benefit of field
surveys, soils boring or completed plans and specifications:

ITEM AMENDMENT TO ROCHESTER CITY LINES CONTRACT
PREPARED BY:
A KNAUER c.
In 1999 Rochester City Lines retained a consultant to perform a Safety and Environmental
Compliance Assessment of their operations. This assessment included a review of the facility,
policies and procedures.
Rochester City Lines had included the cost of the study under shop expense. The City's auditor
and staff have concurred that a portion of this expense should be reimbursed. However, the
expense is not defined under shop expense or professional services per the existing contract
language. The City's interest is limited to ensuring procedures and policies compliant with OSHA
and EPA regulations are followed. It is recommended that the contract be amended to include
under expense category 1100 Professional Services "The Safety and Environmental Assessment
" dated July, 1999 as prepared by High Plains Consortium" the cost of which will be reimbursed
based on the percent of transit miles as a percent of all miles operated by the company.
The cost of the study was $8,946.33. The auditor has indicated that the City share under the
proposed formula would be 72.75 % or $6,508.00. The contract maximum will not be exceeded
with this amendment.
REQUESTED COUNCIL ACTION
Adopt the prepared resolution amending the 1999 City/ Rochester City Lines contract to include
reimbursement for "The Safety and Environmental Assessment" dated July, 1999 as prepared by
High Plains Consortium" the cost of which will be reimbursed based on the percent of transit miles
as a percent of all miles operated by the company under expense category 1100 Professional

ITEM DESCRIPTION: Resolution Authorizing a Tax Rate Increase for the 2000 Tax Levy,
Collectible in 2001
PREPARED BY:
Dale Martinson
State law requires cities with over 500 population intending to increase their levy to pass a council resolution
to authorize a "property tax rate increase" for payable 2001. This resolution must be passed after holding a
public hearing on the issue and must be submitted to the county by October 20`h. Failure to submit the
resolution will limit a city to its 2000 levy amount.
The definition of "property tax rate increase" in the law is quite confusing. The calculation requires a city to
apply the tax capacity for payable 2001 against the amount levied in 2000, adjusting for any increases in
HACA certified for payable 2001. This essentially means that any increase at all in actual dollar amount of
levy will require a resolution authorizing a "property tax rate increase" --- even if the final rate ends up being
less than last year.
The County is required to supply a calculation of the "levy certification tax rate" by October 151. That
calculation is attached and represents a rate of 27.40%. Utilizing the County's payable 2001 tax capacity
numbers against our preliminary levy, the preliminary payable 2001 tax rate would be 29.519%. This is
clearly over the "levy certification tax rate" of 27.40% , thereby requiring approval of the tax rate increase
resolution.
For the Council's information, it should be noted that the pay 2000 tax rate is actually 30.840%, and the
preliminary pay 2001 tax rate of 29.519% is actually less than the 2000 tax rate, but since the actual dollar
amount of property tax levy is proposed to increase and as stated above, necessitates the need for the hearing
and resolution.
It is important to note that no specific rate needs to be set at this time and that the adoption of this resolution
does not prohibit us from later certifying a final levy that results in no tax rate increase should someone find
a responsible way to do that.
COUNCIL ACTION REQUESTED:
Approval of resolution authorizing a tax rate increase for the 2000 tax levy, collectible in 2001.

improvement project:
The feasibility of providing public sanitary sewer and watermain to the Crocus Hills Area is dependent
on the property owners dedicating easements to the City, without cost, regardless of whether the
property owner chooses to participate in the Water Quality Protection Program.
The Crocus Hills Area sewer and water extension project is included in the proposed 2001 Capital
Budget. Therefore, the project will be designed in 2000 with construction in 2001.
The project funding is proposed from sewer and water connection charges (Utility Connection
Agreements), Sales Tax revenue (per Lot Cap), and Water Availability Charges.
The Crocus Hills Area is currently within the City of Rochester. Therefore, an Orderly Annexation
Agreement is not required for this Area.
COUNCIL ACTION REQUESTED:
If the Council wishes to proceed a resolution could be adopted ordering the project to be made. Since
the project was petitioned by 50% of the owners of property affected by the project a simple majority
vote of the City Council is required for adoption.
Council approval should be made contingent on:
1. The property owners dedicating easements to the City, without cost, for construction of
the project.
2. A minimum of 50% of the property owners affected by the project signing Utility
y% Connection Agreement prior to the award of a contract to construct the project.

REPORT ON THE FEASIBILITY OF PROPOSED
LOCAL IMPROVEMENT PROJECT
TO SERVE THE CROCUS HILLS AREA.
August 30, 2000
Honorable Mayor & Common Council
City of Rochester, Minnesota
A petition for sanitary sewer and watermain to serve the Crocus Hills Area was forwarded by the City
Council at their meeting of May 15, 2000 to the Public Works Department for the preparation of a
Feasibility Report. The petition was checked and found to be in proper form and was signed by 5 of 10
property owners of lots containing a single-family residential dwelling. This represents 50.0 percent of
the lots within the Crocus Hills Area that are eligible to participate in the City of Rochester, Water
Quality Protection Program adopted by the City Council on December 21, 1999. The Crocus Hills Area
petition includes one lot that previously connected to the public sewer and water systems. This property
owner paid sanitary sewer and watermain connection charges consistent with the City of Rochester
connection charge policies. This property owner is considered a petitioner for the project and included
with the 5 petitioners.
Feasibility Resort
We report that the above referenced project is feasible and recommend its construction. The location of
this project is within an area of existing single-family residential development that currently lacks public
sanitary sewer and watermain. A majority of the septic systems and wells within the Area were
constructed prior to the State of Minnesota and Olmsted County having any requirements or standards
for construction of septic systems and wells. There is an increasing threat of contamination to the City of
Rochester's ground water supply as the existing septic systems and wells begin to fail. This project
would allow property owners of lots containing existing single-family residential dwellings to connect to
public sanitary sewer and water systems rather than replacing their old systems when they fail.
The costs of this project are proposed to be recovered through sanitary sewer and watermain connection
charges (Utility Connection Agreements), sales tax revenue appropriated to the City of Rochester, Water
Quality Protection Program and sales tax supported Water Availability Charges.
The proposed project consists of the installation of an 8-inch sanitary sewer line and an 8-inch watermain
to serve the Crocus Hills Area. Public sanitary sewer is available on the north side of Salem Road S.W.
and within Salem Meadow Town homes development. Sanitary sewer will be extended from these
locations to serve the Area. The extension of trunk line sanitary sewer is not required.
The Crocus Hills Area lies within the high-level water service area. The extension of 800 feet of trunk
watermain from 23rd Avenue SW (lying east of Crocus Hills) and 600 feet of trunk watermain from
Foxcroft Subdivision (lying west of Crocus Hills) is required to serve the domestic and fire protection
needs of the Area.
The estimated construction costs and expenses of the project made without completed
plans or survey are
as follows:

We recommend that the necessary funding to construct sanitary sewer, watermain and service
connections in the Crocus Hills Area be done so in accordance with the City of Rochester's existing
sanitary sewer and watermain connection charge policies and the Water Quality Protection Program.
Property owners that desire to participate in the Water Quality Protection Program and the benefits
contained therein, are required to:
1. Enter into a Utility Connection Agreement with the City within three (3) years of the date the City
initiates the project.
2. Connect the existing single-family residential dwelling to the public sewer and water systems within
five (5) years of the date of project initiation.

comer. Storm Water Management must be provided
for the development of this property. A Storm Water
Management fee will apply to any areas that do not
drain to detention facilities constructed to serve this
subdivision.
Grading and drainage plans will need to be approved
by the City Public Works Department prior to the
submittal of the final plat.
Wetlands: The Soil Survey and National Wetland Indicator maps
were reviewed for the presence of wetlands. According
to the Soils Survey, hydric soils do not exist on this
property. The maps do not indicate the presence of
wetlands on this property.
Public Utilities: Sewer and water services can be extended to service
this area. All unused water services must be
abandoned properly at the main in the street per
requirements of Rochester Public Utilities Department -
Water Division.
Utility easements will be needed for electrical facilities
to serve the lots.

Location of Property:

Zoning
General Development Plan:
Access:
The property is located along the west side of the
TH 52 west frontage road, south of 55th Street NW,
north of the Eastwood Bank building.
SD-1 (Arboretum Special District)
North: The Kings Run Drainage way, and also the
Northwest Plaza property, all zoning SD-1
South: Eastwood Bank building zoned SD-1, and
also the Rochester Covenant Church zoned SD-1.
East: Across TH 52, commercial properties zoned
B-4 (General Business)
West: Northwest Plaza property commercial
property zoned SD-1.
The approved Arboretum General Development
Plan designates this property appropriate for
"commercial' development.
Access to the site would be from the north access
driveway of the Eastwood Bank building. This retail
store would share an access with Eastwood Bank.
Drainage: The property generally drains northwesterly across
the site. Runoff from the site will be conveyed into
the road ditch along the west frontage road, from
here it will flow northwesterly into the Kings Run
Drainage way.
Wetlands: The Soil Survey and National Wetland Indicator
maps do not indicate the presence of any wetlands
on this portion of the Arboretum property. Due to
the property s location in the landscape, the
property owner should examine the site for
wetlands. The property owner is responsible for
identifying wetlands.
Special District Summary:
In 1982, the City adopted a Special Zoning District
for The Arboretum (# 2247). The Special District
allows for a mixture of land uses guided by a
general development plan for the area. Land uses
conforming to the underlying R-1 district (at the time
of Special District adoption) only need be approved
through conventional zoning and subdivision
approval processes (such as Lincolnshire
Subdivisions). Other development projects in
accordance with the general development plan for
the property, but not conforming to the underlying
(3? Page 3 of 8 • /
R-1 zoning must be considered for approval
through a two step site plan review process set
forth in Ordinance # 2247.
This two step process includes the Project
Development Plan and the Final Site Plan.
Summary of Proposal:
The proposed development is subject to the provisions of Ordinance #2247, which establishes the
Arboretum Special District and provides for procedures for approval of projects within the Special
District. In this instance, A Type III, Phase 11 review procedure is necessary for both the project
development plan phase and the final development plan phase of the review. This requires public
hearings at both the Planning Commission and the City Council. According to the Rochester
Zoning Ordinance and Land Development Manual (LDM Sec. 60.327), this application will need to
be measured against the criteria applicable for conditional use permits (Sec, 61.146) and also for
a Restricted Development Preliminary Plan (62.708).
Staff has reviewed the proposed use based on the most closely related underlying zoning district
standards, which in this case, would be the general zoning district standards for the B-4 (General
Commercial) zoning district.
The applicant is proposing to construct a retail store for carpet sales (Carpet One) that will be
21,875 sq. ft. in sq. ft. in size. The site plan also identifies locations on the back side of the
building for future expansion that total 3,062 sq. ft. The building is proposed to have a colored
standing seam roof with exterior walls finished with colored E.I.F.S., steelox wall panels and single
score colored splifface block at the base. The front of the building is proposed to include a 42 sq.
ft. "Carpet One" sign. A free standing pylon sign is also proposed at the easterly property line and
is 12 sq. ft, in size and approximately 24 feet high. This sign will need to be located such that no
portion of the sign is located outside of the property boundaries or within any utility or drainage
easements.
Access to this site will be from the West Frontage Road for T.H. 52 and will be shared with
Eastwood Bank. Most of the parking required for the carpet store will be located on the Eastwood
Bank property in an area that has been designated for shared parking with this property. After
reviewing the approved site plan for Eastwood Bank, it appears that ample parking will be
provided for both uses.
This property is adjacent to Kings Run Creek and may be subject to flooding. Since this area was
not studied and mapped on the FEMA maps, the applicant will need to complete, and submit, a
flood study to determine flood elevations on the property. In addition, the applicant should
complete an on -site wetland investigation to determine whether wetlands are present. The flood
study, and any proposed filling or grading in areas determined to be subject to flooding, will need
to be reviewed by the City Public Works Department and MN DNR. In addition, this property may
be subject to Shoreland regulations. The site plan will need to be revised to identify the boundary
of Kings Run Creek and the top of bank (including elevations). Once the additional information is
submitted, staff can evaluate the site plan for conformance with the applicable regulations.
At this time, a site capacity calculation has not been submitted for this project. These calculations
will need to be included with the final development plan application.

Criteria & Findinas:
Sections 61.146 and 62.708 are attached for your review. These sections of the Rochester
Zoning Ordinance and Land Development Manual (LDM) include the criteria that must be
considered when reviewing this application. Staff suggests the following findings.
In regard to Section 61.146, if this application were approved subject to conditions or
modifications, staff suggests that findings within this Section could not be made to support denial
of this request.
In regard to Section 62.708 (1) of the LDM, staff suggest the following findings:
a) Capacity of Public Facilities: The existing or future planned utilities in the area appear
adequate to serve the proposed development.
b) Geologic Hazards: Floodplain and shoreland boundaries need to be identified for this
property. The applicant will need to provide information related to these two items.
c) Natural Features: Additional information is needed relevant to floodplain and shoreland
boundaries on the property. Staff will review the site plan for compatibility with these
features and conformance with the applicable regulations once additional information is
supplied by the applicant.
Residential Traffic Impact: This development is not expected to generate traffic within
residential areas.
d) Traffic Generation Impact: Anticipated traffic generated by the development is not
expected to exceed the capacity of adjacent streets.
e) Height Impacts: The proposed height of this structure is approximately 25 feet. This
height is not expected to result in adverse impacts to adjacent properties through
shadowing or interference with air movement.
f) Setbacks: For developments involving new construction, proposed setbacks are related
to building height and bulk in a manner consistent with that required for a B-4 (General
Commercial) zoning district.
g) Internal Site Design: For developments involving new construction, the preliminary site
layout indicates adequate building separation and desirable orientation of the buildings to
open spaces, street frontages or other focal points.
h) Screening and Buffering: If this property is subject to the Shoreland regulations,
additional plantings may be required along the north and western boundaries to re-
establish vegetation within the Shoreland area.
i) Ordinance Requirements: The proposed development includes adequate amounts of
off-street parking and loading areas and. The applicant will need to identify the total
amount of landscaped area on -site.
j) General Compatibility: The building orientation, height and size appear compatible with
the surrounding uses. Additional information will need to be submitted for review and
consideration.
110 Page 5 of 8 0
Staff Recommendation:
The Planning staff would recommend approval of the proposed Special District Project
Development Plan phase subject to the following conditions/modifications:
t. A grading plan shall be submitted for review and approval with the development plan
that addresses flood plain and shoreland issues. Separate grading approval and
permit are required.
2. The applicant shall grade a bike path within the property of this application along
Kings Run Drainage way. The applicant shall coordinate with the Park Department on
the location of the path. Prior to development, the Kings Run Corridor and bite trail
area shall be dedicated to the City.
3. Additional easements may be required for drainage or utility purposes. Any easements
necessary for the development of this property shall be executed prior to development.
4. The applicant dedicates a drainage easement covering the Kings Run corridor within
the property of this application. This easement is to be used for drainage and future
bike path purposes.
5. The pylon sign proposed at the easterly property line shall be located such that no part
of the sign hangs over the property line and no part of the sign is located within a
drainage or utility easement.
6. The Final Site Plan application shall include:
A completed flood study, approved by the MN DNR;
Flood Plain boundaries (floodway and 100 year) shall be delineated on the site
plan;
• Location of Kings Run Creek and Shoreland boundaries shall be delineated on
the site plan;
• Location of any existing easements or new easements that will be necessary
for the extension of utilities shall be identified on the site plan;
Explanation or demonstration of how stormwater will be handled from the
development;
• A completed site capacity calculation for the property and data Identifying the
total site area, proposed Floor Area Ratio and Landscape Area for the project
shall be noted on the site plan;
• Color scheme for the exterior of the building;
• The location of an additional fire hydrant along the south end of the building,
as required by the Fire Department;
M
EXCERPTS FROM THE LDM
61.146 Standards for Conditional Uses: The zoning administrator, Commission, or
Council shall approve a development permit authorizing a conditional use
unless one or more of the following findings with respect to the proposed
development is made:
1) provisions for vehicular loading, unloading, parking and for vehicular and
pedestrian circulation on the site and onto adjacent public streets and ways
will create hazards to safety, or will impose a significant burden upon public
facilities.
2) The intensity, location, operation, or height of proposed buildings and
structures will be detrimental to other private development in the
neighborhood or will impose undue burdens on the sewers, sanitary and
storm drains, water or similar public facilities.
3) The provision for on -site bufferyards and landscaping does not provide
adequate protection to neighboring properties from detrimental features of
the development.
4) The site plan fails to provide for the soil erosion and drainage problems that
may be created by the development.
5) The provisions for exterior lighting create undue hazards to motorists
traveling on adjacent public streets or are inadequate for the safety of
occupants or users of the site or such provisions damage the value and
diminish the usability of adjacent properties.
6) The proposed development will create undue fire safety hazards by not
providing adequate access to the site, or to the buildings on the site, for
emergency vehicles.
7) In cases where a Phase I plan has been approved, there is a substantial
change in the Phase 11 site plan from the approved Phase I site plan, such
that the revised plans will not meet the standards provided by this
paragraph.
8) The proposed conditional use does not comply with all the standards
applying to permitted uses within the underlying zoning district, or with
standards specifically applicable to the type of conditional use under
consideration, or with specific ordinance standards dealing with matters
such as signs which are part of the proposed development, and a variance
to allow such deviation has not been secured by the applicant.
iPage 7 of 8
62.708 Criteria for Type III Developments: In determining whether to approve, deny,
or approve with conditions an application, the Commission and Council shall be
guided by the following criteria:
2) Preliminary Development Plan Criteria:
a) Capacity of Public Facilities: The existing or future planned utilities in the area
are adequate to serve the proposed development.
b) Geologic Hazards: The existence of areas of natural or geologic hazard, such
as unstable slopes, sinkholes, floodplain, etc., have been identified and the
development of these areas has been taken into account or will be addressed in
the Phase II plans.
c) Natural Features: For developments involving new construction, the
arrangement of buildings, paved areas and open space has, to the extent
practical, utilized the existing topography and existing desirable vegetation of the
site.
d) Residential Traffic Impact: When located in a residential area, the proposed
development:
1) Will not cause traffic volumes to exceed planned capacities on local
residential streets;
2) Will not generate frequent truck traffic on local residential streets;
3) Will not create additional traffic during evening and nighttime hours on local
residential streets;
e) Traffic Generation Impact: Anticipated traffic generated by the development
will not cause the capacity of adjacent streets to be exceeded, and conceptual
improvements to reduce the impact of access points on the traffic flow of
adjacent streets have been identified where needed.
fj Height impacts: For developments involving new construction, the heights and
placement of proposed structures are compatible with the surrounding
development. Factors to consider include:
1) Will the structure block sunlight from reaching adjacent properties during a
majority of the day for over four (4) months out of the year;
2) Will siting of the structure substantially block vistas from the primary
exposures of adjacent residential dwellings created due to differences in
elevation.
0 (43
g) Setbacks: For developments involving new construction, proposed setbacks
are related to building height and bulk in a manner consistent with that required
for permitted uses in the underlying zoning district.
h) Internal Site Design: For developments involving new construction, the
preliminary site layout indicates adequate building separation and desirable
orientation of the buildings to open spaces, street frontages or other focal points.
Screening and Buffering: The conceptual screening and bufferyards proposed
are adequate to protect the privacy of residents in the development or
surrounding residential areas from the impact of interior traffic circulation and
parking areas, utility areas such as refuse storage, noise or glare exceeding
permissible standards, potential safety hazards, unwanted pedestrian/bicycle
access; or to subdue differences in architecture and bulk between adjacent land
uses.
j) Ordinance Requirements: The proposed development includes adequate
amounts of off-street parking and loading areas and, in the case of new
construction, there is adequate landscaped area to meet ordinance
requirements.
k) General Compatibility: The relationship of the actual appearance, general
density and overall site design of the proposed development should be
compared to the established pattern of zoning, the character of the surrounding
neighborhood and the existing land forms of the area to determine the general
compatibility of the development with its surroundings.

1. The property may be subject to the water availability fee, connection fees or assessments. The Land
Development Manager (507-281-6198) at the Public Works Department determines the applicability
of these fees.
2. The fire Prevention Bureau will need to comment on the location of the existing and the proposed fire
hydrants as they relate to protection of this building.
3. The existing water main located at the northeast comer of the site is a long dead end. To provide
adequate fire flows, reliability, and water quality to this site the water main must be looped to the
existing main, which is located approximately 80' south of this property.
4. Water mains connecting to and including any fire hydrant are considered public and need to be within
a 20' minimum public utility easement. The owner would be required to enter into a City Owner
Contract with the City of Rochester for the installation of the public water main. Contact the Land
Development Manager (507-281-6198) at the Public Works Department for details. Final water main
construction plans with profiles would need to be prepared by a civil engineer, approved by us and
conform to standard City of Rochester requirements.
5. We will work with the applicant's engineering firm to develop the necessary water system layout to
serve this area.
Please contact us at 507-280-1600 if you have questions.
Very truly yourss,IS"

Badger Ridge Subdivision
October 12, 2000
Proposed Development: This development consists of 82.79 acres of land to
be subdivided into 113 lots and 1 outlot. The majority
of the lots will be developed as single family
residential dwellings.
Streets: This plat dedicates right-of-way for a number of new
public roadways and also dedicates right-of-way for
Valleyhigh Road NW.
Controlled access will need to be dedicated along
roadways lying within 200 feet of the intersection of
any access point to Valleyhigh Drive NW.
Some of the roadway designations need to be
revised. See the referral comment dated October 6,
2000 from the Planning Department Addressing Staff.
Drainage: The applicant is proposing a detention pond on Outiot
A. The applicant also agrees to voluntarily participate
in the City's Regional Storm Water Management Plan
for those areas that do not directly drain to the
permanent onsite stormwater ponds or drain to
building site -specific, privately owned and maintained
stormwater management facilities.
Wetlands: Minnesota Statutes require that all developments be
reviewed for the presence of wetlands or hydric soils.
There do not appear to be hydric soils within this plat
however it does appear that wetlands exist on the
area immediately west of the plat. Prior to any
grading activity in this area, the applicant will need to
identify if wetlands are present in the area.
Public Utilities: Public utilities will need to be extended to serve this
property. The City has approved the construction
plans for the public utilities being installed for this
project.
Spillover Parking: As per Section 63.426 of the LDM, all residential
development must provide spillover parking for
service vehicles and visitorsat a rate of 1.2 spaces
per dwelling unit, in addition to the required off-street
parking. This additional parking may be provided
either off-street or on -street. This development
requires 124 spillover parking spaces. The right-of-
way and road widths appear adequate to meet this
requirement. Spillover parking requirements for the
R-3 zoned lots will need to be reviewed at the time
development is proposed for the individual lots
Parkland Dedication: The Rochester Park and Recreation Department
recommends that the parkland dedication
requirements for this plat be satisfied by the
combination of deferred cash and deferred land
dedication. The approved GDP indicated + 8 acres of
Page 3 /
Badger Ridge Subdivision
October 12, 2000
parkland to be graded to a slope of 4% or less. The
grading and dedication of the 8 acres plus the
matching dedication of the adjacent more steeply
sloped area around the storm water detention pond
above the elevation of 1068' will also qualify towards
the dedication requirements. The final determination
of the amount of graded land that will qualify as
meeting dedication requirements should be made
after the site is graded.
General Development Plan: The General Development Plan for this property was
approved in March of 2000. The plat is generally
consistent with the approved GDP.
Lots 1-67, Block 1; Lots 1-14, Block 2; Lots 1-15, Block 3 and Lots 1-7, Block 4 are zoned R-2
(Low Density Residential). Lots 8-13, Block 4; Lots 1-2, Block 5; Lot 1, Block 6 and Lot 1, Block 7
are zoned R-3 (Medium Density Residential). In the R-3 zoning district, detached single family
dwellings are permitted only on lots platted prior to 1992. This means single family detached
dwellings can not be built on Lots 8-13, Block 4. The R-3 zoning district does allow duplexes and
townhomes to be built on lots this size provided that the zoning district standards can be met.
Substantial Land Alteration:
This application includes a request for approval of land disturbing activities defined as Substantial
Land Alteration according to Section 62.1101, B of the Rochester Zoning Ordinance and Land
Development Manual. Section 62.1102 of the LDM allows the City to consider a request for
excavation or substantial land alternation as part of a Type III application, such as a final plat,
subject to making findings established in Sections 62.1105 and 61.146 of the LDM.
This development includes a proposal for cut and fill work which involves a grade change of 10-
feet or more from the pre-existing grades. See the attached maps for the locations where the
grade is proposed to be changed more than 10 feet.
Sections 61 .146;62.1102 and 62.1105 of the LDM are attached.
Staff Suaaested Findings:
If the City Council approves the proposed substantial land alternation, staff recommends
the following findings to Sections 62.1105 and 61.146 of the Rochester Zoning Ordinance &
Land Development Manual:
62.1105
1) The activity should not result in danger to life or property. The knobs of hills are being
proposed to cut down to allow to site to be leveled. The grading and drainage plans will need
to be approved by the Rochester Public Works Department.
2) The grading plan for this project needs to be approved by the Rochester Public Works
Department and it will document the extent of the work. All cut material will be used to fill in
the low areas of the site. Noise and dust control will need to comply with City standards.
t ` Page 4
Badger Ridge Subdivision
October 12, 2000
3) The equipment conducting the grading work on the property will also be the equipment utilized
to move the earth. All excess material will be used on the site so no trucks will be hauling
from the property.
4) The proposed excavation work should not affect air quality or ground water and surface water
quality.
5) The proposed grading work should not adversely affect the scenic quality of Rochester.
There will not be any steep slopes or exposed rock faces.
6) The result of the proposed activity will be compatible with existing development and
development anticipated in the future. The finished result of the grading work will allow for
development that is consistent with the land use plan.
7) The grading will be confined to the property and should not affect the use and enjoyment of
adjacent properties. The duration of the excavation activity is expected to be completed this
fall and/or next spring.
8) The grading activity will only take place during the construction of the roadways and buildings
pads that are planned for the site. The grading is expected to be completed this fall and/or
next spring.
9) The grading and drainage plan will need to provide the proper restoration and stabilization in
accordance with the adopted codes for the City of Rochester.
10) The grading and drainage plans will need to be reviewed and approved by the City.
Stormwater management will be provided for the development.
11) The areas of grading does not contain sinkholes or wetlands and should not effect the ground
water or surface quality once restoration and stabilization is completed.
12) The grading work is expected to be completed this fall and/or next spring. The duration
seems appropriate for this type of activity and the size of the project.
13) The Rochester Public Works Department will need to review and approve the grading and
drainage plan for this work. This plan must accommodate permanent and interim erosion and
sediment control.
14) Surety will need to be provided that guarantees the site will be fully restored after the
completion of the excavation activity. This surety can be provided through the owner contract
process for this development.
15) The grading and drainage plan will need to be approved by the Rochester Public Works
Department prior to any grading on the property.
The Planning Staff would suggest the fallowing findings for Section 61.146;

Final Plat Review
In response to the Final Plat application for the Badger Ridge Subdivision,
District staff found areas of noncompliance with the Grading Plan submitted for
the subdivision. The current land disturbing activity could cause the deposition of
sediment onto adjoining properties and into public waters.
District staff recommends that the developer and contractor work with the City of
Rochester Public Works staff to correct the erosion control practices on -site.

This letter is to serve as a request for substantial land alteration approval for the above
referenced plat. The existing agricultural land will be regraded to be suitable for
residential applications. Generally, the top of the existing hill will be cut down and be
used to level the site to more suitable grades. The materials will all stay on -site, except
that some excess topsoil will be moved to the parkland, which is adjacent to the site, and
some cut from the site may be used on the north end of the Circle Drive Business Center
Subdivision.
The grading would be completed this Fall and next Spring. A permanent pond in the
park will be graded as a part of the Business Center work. The street and utilities would
be completed this Fall and next Spring. Generally, the streets will be graded to 6% slopes
or less, except for 3:1 slopes as noted on the plan, which will be stabilized with wood
fiber blanket when seeded.
