KVENVOLD The City Council has previously established an open comment period on the Council agenda where any person may address the City Council on any subject of their choosing. The open comment period is at the beginning of the meeting period and is not part of the meeting which is televised. Councilmember McConnell is requesting that this portion of the meeting be televised (see attached). COUNCIL ACTION: Motion by: second by: to: TO FROM: Mayor Members of the City Council Jean S. McConnell P ( SUBJECT: Citizen Input Several years ago the Council, at my urging (based on observations in other parts of the country) instituted a policy of allowing citizens to speak on any subject they wished --four minute limit. This was instituted with the provision that the testimony be given prior to the official opening of the evening session and not be recorded for future viewing on Channel 19. I objected strenuously to this provision, but was outvoted. Now it is time to reexamine this policy. We have had numerous people testify. All of them have been well-mannered, even if sometimes telling us things we did not wish to hear --democracy in action. I will reintroduce this subject after the first of the year. It is long past time that we stopped treating our constituents as unreliable citizens who cannot be trusted to give us the polite and agreeable views we would like to hear. It is a rebuff, at best, and an insult, at worst, to believe that our neighbors are not as circumspect as we are. Censorship is bad, but this is worse than censorship. . .it is prior restraint. It is telling folks "we can't trust you; therefore, we will not give you the forum of the television audience," such as it is. Give this your best thinking. Ask your neighbors. I have broached this matter to scores of people who are appalled by our present policy. ' City of Rochester City Administrator's Office Memo To: Mayor and City Council From: Stevan E. Kvenvold//-i Date: December 21, 2000 Subject: City Council Meeting Policy RE: Citizen Input The attached memo from Councilmember McConnell indicates that he will request that the Council reverse their decision not to televise the Open Comment portion of the City Council meeting. Since I provided some input on this matter previously, I wish to again provide some comments. I am opposed to reversing the Council policy on this matter for the following reasons: i. Citizens have a right to come to the City Council and speak to the City Council; however, I do not believe that they have a right to come to a City Council meeting for the purpose of getting on television in order to speak to the television audience. 2. During the Open Comment period, a citizen can address any subject he or she wants to discuss. The subject presented may not have anything to do with the responsibilities carried out by the City Council. If the open comment period is televised, there may be more of an incentive for individuals to use this opportunity to get on television to express their viewpoints, which may have no relevancy to City Council issues, thereby extending the City Council meeting and making other citizens wait to have their City business addressed by the Council. 3. If a citizen wishes to address the City Council on an issue related to the City governments business, he or she can contact the Administrator's Office and be scheduled to address the City Council under the Letters and Petitions portion of the agenda and these comments are televised. Therefore, citizens are not denied the opportunity to appear before the City Council and have their comments included in the televised portion of the proceedings. c: G. Neumann T. Spaeth T. Adkins D. CONSENT AGENDA CITY ADMINISTRATOR D-o2 ITEM DESCRIPTION: HIGHWAY 52 CONSTRUCTION STAGING PLAN PREPARED BY: S. KVENVOLD The Minnesota Department of Transportation (MnDOT) prepared four different construction staging alternatives for T.H. 52 (see attached). The City Council has reviewed these alternatives with MnDOT representatives and has agreed to recommend that MnDOT pursue the 5 year construction alternative. COUNCIL ACTION REQUESTED: Request a motion adopting the prepared resolution requesting MnDOT to proceed with the reconstruction of the T.H. 52 corridor using the 5 year reconstruction alternative. COUNCIL ACTION: Motion by: Second by: to: p1NE5pT4 ,° Highway 52 Construction Staging a Economic Analysis Summary OF T.Or Purpose An eleven -year construction -staging plan was selected in the 1996 Highway 52 Final Environmental Impact Statement (EIS). This staging was based on the amount of funding available for the project in each year. The City of Rochester (with the support of the local business community) asked the Minnesota Department of Transportation (Mn/DOT) to accelerate the reconstruction of Highway 52. Mn/DOT agreed to look at alternative ways of scheduling the reconstruction of the highway. The Highway 52 Construction Staging Economic Analysis was initiated to examine alternative construction staging plans and compare the impacts of each alternative. Mn/DOT Commissioner Elwyn Tinklenberg demonstrated support for accelerating the reconstruction by funding the Economic Analysis, and by pledging to provide additional financial resources to complete the project in a timely manner. Project Description The decision to reconstruct Highway 52 between Highway 63 (South Broadway) and 75'h Street NW was made in 1996 and is documented in the EIS. When complete, an additional (third) lane will have been added in each direction on Highway 52 through the city. The highway pavement will be completely replaced from Highway 63 to 751h Street NW. Additionally, the interchanges at 61h Street SW, 2nd Street SW, Highway 14 West/Civic Center Drive and 191h Street NW will be completely rebuilt. Improvements to the highway frontage roads will also be made. The preliminary cost estimate for the project is $150 million, including construction and right- of-way. This cost estimate is currently being updated to include recent changes to the project. The revised estimate should be available in early 2001. The majority of the project will be paid for with Federal and State highway funds, but the City of Rochester will be responsible for a portion of the project cost. The City's portion may vary substantially depending on the level of enhancements added to the project. Olmsted County's portion of the project cost is expected to be minimal. Business and Economic Analysis The EIS determined the need for the project; the Economic Analysis will help determine how to build it. The Economic Analysis estimates the costs incurred by the traveling public and change in corridor businesses' retail sales for four different construction -staging alternatives with durations of 11 years, 7 years, 4 years, and 5 years. Highway 52 Economic Analysis Pagel of 3 1/8101 )3 All alternatives were compared to the same base condition, which assumed no physical changes to the roadway network. Expected growth in traffic volumes and retail sales were included. Construction Staging Alternatives Alternative I — Eleven Year Plan The first reconstruction alternative studied in the Economic Analysis was described in the EIS. This alternative maintained two through lanes of traffic in each direction on Highway 52 throughout the entire eleven -year construction period. Traffic would be maintained on the major east -west roadways crossing the highway. Access to the highway would be maintained throughout the construction period. Alternative 2 — Seven Year Plan Work in the first year of this alternative is limited to the frontage roads. In the second and third years Highway 52 is closed south of Highway 14 West. The fourth and fifth years consist of more frontage road work. The highway pavement north of 37'h Street NW would be replaced in the fourth year. In the sixth and seventh years Highway 52 is closed north of TH 14 West. The highway pavement south of 121h Street SW would be replaced in the seventh year: Alternative 3 — Four Year Plan Activities in the first year would include frontage road work in the heart of the project and replacement of the highway pavement on the north and south ends of the project. In the second and third years Highway 52 would be closed between 12`h Street SW and 37`h Street NW. Construction in the fourth year would complete the frontage roads. Alternative 4 — Five Year Plan The fourth alternative maintains two through lanes of traffic on Highway 52 and maintains local access to the highway throughout the entire construction period. East -west traffic crossing the highway is also maintained. Additionally, phases of construction affecting local access would be completed in November whenever possible to minimize retail impacts during the holiday season. The Rochester Olmsted Council of Governments traffic model was used to estimate the change in miles and hours of travel for the different alternatives. Crash data for the City of Rochester and Olmsted County obtained from the Minnesota Department of Public Safety was used to estimate the changes in crashes for the different alternatives. The retail impacts were estimated based on the change in traffic volume, accessibility and congestion in the vicinity of businesses. Impacts to travelers are real economic losses (or gains). The cost incurred to drive an additional mile, an additional hour, or in more crashes is a loss in productivity. Highway 52 Economic Analysis Page 2 of 3 1/8/01 By contrast, impacts to retail activity in the condor are generally primarily transfers because most retail activity will shift within the Rochester area. The impacts of Alternative 1, with an eleven -year construction period were estimated to be the lowest, while Alternative 2 resulted in the highest overall impacts. The four-year construction period in Alternative 3 reduces the overall impacts, primarily due to the reduced time that the highway is closed. Alternative 4, which maintains traffic on the highway and maintains local access, reduces the impacts when compared to Alternative 2 and 3, but not as low as Alternative 1. In Alternative 4 shortening the time to reconstruct the corridor requires larger areas to be under construction at any given time, which causes higher traffic diversion and congestion when compared to Alternative 1. Figure 1. shows the relative traveler and retail impacts of the four construction staging alternatives. $250 $200 S1so CN O E $loo $so so Conclusion Figure 1. Traveler Cost and Retail Transfer Alt 1-Eleven Year AIt2-Seven Year Alt 3-Four Year Alto -Five Year ■Traveler Cosl ❑Relall Treraler The EIS determined the need for the Highway 52 reconstruction project but the Economic Analysis will help determine how to build it. Not only will the Economic Analysis supply the information to make a better decision from several potential construction -staging scenarios, but it also will help minimize construction impacts to businesses and motorists after construction begins. This is the first time a study of this magnitude has been done to measure the economic impacts to businesses and motorists of several construction staging scenarios. Mn/DOT is concerned about balancing the need to complete the project in a timely manner with the economic impacts the reconstruction will have on businesses and motorists. Mn/DOT (Commissioner Tinklenberg) demonstrated support for accelerating the reconstruction by funding the Economic Analysis and by pledging to provide additional financial resources to finish the project in a timely manner. The Economic Analysis resulted from the city of Rochester's request to accelerate the reconstruction time frame from the original eleven -year plan. Now that the analysis has been completed, the city needs to decide which reconstruction schedule it will support. Martinson On November 16 of 1998, the City Council accepted a proposal from Smith, Schafer and Associates, Ltd. to provide audit services for the five fiscal periods ending December 31, 1998, 1999, 2000, 2001, and 2002. That proposal provided for the examination of financial records and controls for the City's financial statements, audits of federal grant activity (single audit) as well as the separate financial statements of the City's Department of Public Utilities (RPU). The attached five-year cost summary outlining that proposal reflects total costs for the year-end 2000 audit of $43,550, up just $1,200 from their fee for the previous year. Additionally, the City annually requests examination of the financial statements of the Rochester City Lines Company. The scope of the examination will include comments on the accounting procedures and controls. The firm will also prepare and review the mandatory reporting forms required bythe Urban Mass Transportation Administration. The fee for this service will be at the firm's regular per -diem rates also found on the attached quote summary. These fees amounted to $29,950 for last year's program. This fee is reimbursed through the state grant agreement. Three separate letters found attached confirm the significant terms of engagement for these audit examinations. One provides for the general audit, another for the public utility audit and the third provides for the urban mass transit review. COUNCIL ACTION REQUESTED: Respectfully request a motion authorizing execution of the three letters of engagement to audit both the City's general purpose financial statements, the public utility's statements and the City's Urban Mass Transportation Program for the fiscal year ending December 31, 2000. CONSENT AGENDA Public Works D -1 S ITEM DESCRIPTION: Permission to Advertise: Installation of Sanitary Sewer Flow and PARED BY: Rainfall Monitoring Facilities and Equipment. 17 D. Nelsons In March 1999, the City entered into a Professional Services Agreement for an analysis of its sanitary sewer system. The initial focus of this study was to determine the sources of infiltration and inflow of water into the sanitary sewer collection system and identify cost effective solutions to reduce I & I. As a part of this study, it has become necessary to conduct long-term monitoring of sanitary sewer flow data and rainfall data for periodic updating of system hydraulic modeling. This will enable city staff to determine when pipe capacities are being exceeded or about to be exceeded and to determine remedies to correct these situations. Remedies could include construction of parallel sewer mains, increased maintenance efforts, lining of pipe, or other courses of action. The Public Works Department has identified the need to construct and install 6 permanent sites for sanitary sewer flow monitoring, 4 permanent rainfall -monitoring sites, and a main data storage and analysis site at the Water Reclamation Plant. The Public Works staff request permission to advertise to obtain the necessary equipment and services to setup these monitoring locations. Estimated costs is $158,000.00. The project has been included and approved in the 2001 Capital Improvement Program, Sewer and Water, Project #1, J-2179 and is funded by retained earnings from the Sewer Utility--4330. "UNCIL ACTION: Motion by: second by: to: REQUEST FOR COUNCIL ACTION MEETING ei3 DATE: 1/17101 AGENDA SECTION: CONSENT AGENDA ORIGINATING DEPT: Public Works ITEM NO. i i EM DESCRIPTION: Amendment to Water Quality Protection Program to Provide PREPARED BY: Additional Allowances for Private Improvements, J8205 J. Loehr The Water Quality Protection Program (WQPP) was adopted by the City Council on December 21, 1998. The WQPP is intended to provide safe, reliable and affordable public water supply and sewage disposal to existing homes within the City of Rochester and in the surrounding townships. The WQPP provides Sales Tax revenues to fund improvements on private property to connect a property to the public sanitary sewer and water systems, and for well and septic tank closures. In all cases attempts are made to design projects that provide gravity flow sanitary sewer service to the lowest elevation of each home within a subdivision. However, in spite of these efforts there are instances that the elevations of some properties are too low to provide gravity flow sewer service. These properties were developed and the homes built a number of years ago when it was unknown whether the property would ever be served by the public sewer system or what the elevation of the sanitary sewer mains would be if the subdivision were served. In these cases a property owner must incur additional costs for the installation of a private sewage disposal system that will pump the sewage (once it leaves the lowest elevation by gravity flow) to the public sewer mains. The estimated cost for these systems based on an average installation is as follows: 1000 gallon tank $ 630 Risers 100 1-1/2" grinder pump or 2" sewage injection pump 800 Excavation, installation, hook up and backfill 800 Electrical service 350 Estimated Cost to Provide Gravity Flow Sewage Service $2,680 Since the estimated cost of $2,680 is based on"an average installation, and knowing that the cost will vary from one property to another, the Department of Public Works feels that a property could be faced with a cost of up to $4,000 to have gravity flow sewage from the lowest elevation of their home until it is pumped. The Department of Public Works recommends that the City Council consider amending the WQPP to provide an Allowance for the installation of a private sewage disposal system, if gravity flow sewer service cannot be provided to a property. COUNCIL ACTION REQUESTED: 1. Adopt a resolution amending the previously adopted Water Quality Protection Program to include Allowances for private tank, risers, 1-1/2" grinder or 2" sewage injection pumps, excavation, installation, hookup, backfill and electrical service in an amount equal to the actual cost not to exceed $4,000 per property. JUNCIL ACTION: Motion by: Second by: to: REQUEST FOR COUNCIL ACTION MEETING 5 DATE: 1-17-01 AGENDA SECTION: ORIGINATING DEPT: ITEM NO. The reason for this request is that the volume of mail and packages to be delivered to Pavilion, Lanmark, and Massey Buildings. The exact location being requested is the meter adjacent to and west of the alley between Lanmark and Massey on Second St SW. The delivery vehicle is a Mini van. The vehicle is at the building periodically throughout the day, concluding at 3pm. The van would take 20-30 minutes load/unload. The Mayo staff has attempted to use the Skyways to reach their destination. Edwards, IBM, and Sirius Computer Solutions implementation consultants. One aspect of this implementation is the maintenance of payroll tax rates within the payroll software. J.D. Edwards requires clients to utilize a third -party software product to update and maintain these rates for their clients worldwide. License fees for this software on our configuration and employment base are: $9,2000 for the initial year, and $3,565 for each year thereafter. In the earlier negotiations on the J.D. Edwards contract, they agreed to reduce their already -discounted price by the cost of the first year of the annual license fee for this tax rate software. The existing project budget (J#1971) should therefore be sufficient to fund this first contract year fee. The contracts have been reviewed and approved as to form by the City Attorney's office. RECOMMENDED ACTION: Authorize Mayor and City Clerk to execute software license agreement with Vertex, Inc. for Quantum Payroll System tax rate software. Consent Agenda/Organizational Business Finance Department 24 ITEM DESCRIPTION: Authroize Mayor and City Clerk to Execute Current and Future PREPARED BY: Guaranteed Investment Contracts (GICS) Dale Martinson At the December 18, 2000 regular meeting, council authorized an amendment to the City's investment policy that made guaranteed investment contracts, or "GICS," an authorized investment for the City when structured as specified in Minnesota Statutes 18A.05 subdivision 5. The City received bids on its first such GIC offering for bond proceeds received on the recent RPU bond issue. From a practical standpoint, these GICS are just another investment vehicle like any other security our treasury might purchase. However, due to the contractual nature of this investment type, the City Attorney's office is recommending we request council authorization for the Mayor and City Clerk to execute this investment contract. Staff is recommending acceptance of MBIA's bid of 5.6% and execution of the GIC for both the construction and debt service reserve monies. Additionally, we requesting the council to authorize the Mayor and City Clerk to execute any and all future guaranteed investment contracts (GICs) purchased by the City. For this offering, we were fortunate to have a council meeting occurring the day before the scheduled close date for this investment contract. Future bids may not be able to be timed so well, however. We believe the statute governs these contracts to minimize risk to local governments and our financial consultants are used in these large offerings to assure compliance with those statutes. We therefore believe it both prudent and efficient to authorize execution of future possible GIC agreements. RECOMMENDED ACTION: 1. Authorize the Mayor and City Clerk to execute guaranteed investment contract documents with MBIA for the RPU bond proceeds, and 2. Authorize the Mayor and City Clerk to execute all future guaranteed investment contracts under MN statutes 118A.05, subdivision 5 as recommended by City staff and City financial consultant. This roadway is a continuation of "Leslie Lane SW" from the south-east (Southern Hills 2nd). The second roadway labeled "Southern Hills Lane SW" is designed with a 50' right-of-way and a 51' cul-de-sac radius. This roadway is a continuation of "Southern Hills Lane SW" from the east (Southern Hills Subdivision). Pedestrian Facilities: In accordance with current City policy Pedestrian Facilities are required for this development along both sides of all new public roads including along the road frontages of Outlot A and Outlot B. Outlot A shall not be dedicated to the City, but shall be managed and maintained by a homeowners association. The Care and Maintenance / Homeowners Association agreement shall be reviewed and approved by the Planning Department, prior to recording of the final plat. Outlot B shall be dedicated to the City and the developer shall grade and establish the Outlot B to turf prior to deeding the outlot to the City. Drainage: The elevations of this property range from about 1190' / 1120' along the northern portion of the plat to about 1150' / 1160' along the southern portion. Grading and drainage plans will need to be approved by the City Public Works Department prior to the submittal of the final plat. The grading and construction of the bituminous bike path on "Outlot A" pedestrian connection on "Outlot B", is required to be concurrent with the site grading and street paving for this development, at the owners / developers expense. Page 3 Preliminary Plat #00-49 Southern Hills 3rd December 21, 2000 Storm Water Management must be provided for this development. Wetlands: Minnesota Statutes now requires that all developments be reviewed for the presence of wetlands or hydric soils. The site was studied for wetlands and no wetlands were found . Public Utilities: Sanitary sewer and water lines will need to be extended from their present ends to accommodate this development. The 20' utility easement shown between Lots 7 & 8, Block 1 will need to be widened to provide for a minimum of 10' of easement north of the proposed water main and south of the storm sewer. The easement serving the storm sewer in Lots 1 & 2, Block 5 needs to be a minimum of 20' wide. The easement serving the sanitary sewer between Lots 3 & 4, Block 5 needs to be a minimum of 20' wide. Rochester Public Utilities records indicate an existing 30' utility easement that crosses Lots 7 & 8, Block 1, and Lots 1 & 2 , Block 5 - only a portion of this water main is shown. The entire easement shall be shown on the plat. Spillover Parking: As per Section 63.426 of the LDM, all residential development must provide spillover parking for service vehicles and visitors. This development requires 44 spillover parking stalls. It appears as though the additional parking can be accommodated on the roadways and most likely within private driveways, as well. Parkland Dedication: The City Park and Recreation Department recommends that dedication requirements be met via: A reduction in previously established credits resulting from the dedication of 3,87 acre neighborhood park to serve this subdivision. General Development Plan: This property is included within the Gerlach General Development Plan (GDP), revised and approved, November, 1997. Staff Review and Recommendation: Section 61.225 of the Land Development Manual lists the findings which must be considered by the Planning Commission and the Council when reviewing a land subdivision permit application. Dear Ms. Gamess: Our review of the referenced preliminary plat is complete and our comments follow: 1. The property may be subject to the water availability fee, connection fees or assessments. The Land Development Manager (507-281-6198) at the Public Works Department determines the applicability of these fees. 2. The 20' utility easement shown along the south line of Lot 7, Block 1 should be widened to provide for a minimum of 10' of easement north of the proposed water main. 3. Our records indicate that there should be an existing 30' utility easement for the existing 12" water main that crosses lots 7 & 8, Block:1 and Lots 1 & 2, Block 5 (only a portion of this water main is shown). This easement should be shown on the plat. If this easement was never recorded last year with the installation of the 12" water main it should be now. 4. Minor revisions to the proposed water system layout are required. We have provided the applicant's engineering firm with these comments. Please contact us at 507-280-1600 if you have questions. At the GDP approval it was decided that the outlots and paths would not be publicly owned but managed and maintained by a homeowners association. Outlot B provides pedestrian access to the neighborhood park. The Park Department would support acceptance of this outlot by the City. The outlot could then be maintained by the Park Department as part of the park. The applicant should be required to grade and establish the outlot to turf prior to deeding the outlot to the City. The staff report is on file at the Rochester -Olmsted Planning Department. Ms. Baker handed out revised proposed conditions and revised referral from Mike Nigbur, Rochester Public Works. She indicated that she provided those documents to Mr. Ratzloff prior to the meeting, Ms. Schultze asked if the handout listing the new conditions included Mike Nigbur's comments. Ms. Baker responded yes. Mr. Slaver stated that the Fire Department recommended that the developer give consideration to residential fire sprinklers to reduce the distribution and number of fire hydrants. He questioned if that practice is being done. Ms. Petersson stated that the issue is going before the State next year. She indicated that it would be recommended that the urbanized and rural areas be required to have fire sprinkler systems. The applicant's representative, Mr. Harvey Ratzloff, addressed the Commission. He explained that they are looking into addressing the Fire Department's suggestion. He stated that it is reasonable to put the sprinkler systems in the mechanical room, since that is where most fires begin. However, he explained that there are some aesthetic problems with putting an entire sprinkler system throughout the home. Mr. Ratzloff stated that he plans on using the same language from the Southern Hills First and Second covenants because they would be using the outlots in Southern Hills Third for paths. Mr. Ratzloff stated that he agreed with Ms. Baker's revised conditions. Mr. Mark Wulf, of 1118 Southern Hills Lane, addressed the Commission. He stated that there is an cutlot that runs along the edge of the property. He asked if the outlot would stay. Ms. Baker responded that it is not identified on the map. However, nothing has been proposed to alter that part of the existing development. Mr. Wulf he questioned if the covenants would be modified for the existing landowners. Mr. Ratzloff responded that he is trying to adopt covenants for the new subdivision to be harmonious with the present covenants. Page 11 City Planning and Zoning Commission Minutes Hearing Date: December 27, 2000 Mr. Wulf asked if the association that would maintain Outlot A and B would include just the residents of Southern Hills Third or also the current landowners. Mr. Ratzloff responded that he was unsure. Mr. Burke asked if Southern Hills First and Second would utilize Outlot A as a trail. Mr. Ratzloff responded yes. Ms. Schultze stated that, the reason staff may have recommended that Outlot A be public, is to utilize it as an access that can be used by other people. Mr. Ratzloff stated that Outlot A was originally planned to be public. However, Mr. Nigbur requested that it be private. He indicated that Outlot B is planned to be public. Mr. Dave Pickett, of 1209 Lone Pine Drive, addressed the Commission. He asked how the applicant could include him in the association to maintain Outlot A. Ms. Baker stated that staffs recommended condition does not specify who had to be in the homeowner's association. She explained that, how the association is created, is up to the applicant. Ms. Petersson closed the public hearing. Page 12 City Planning and Zoning Commission Minutes Hearing Date: December 27, 2000 site grading for this subdivision, at the ownerideveloper's expense. 4. Heights Dr to 22nd St NE and 2 1 " Street, was referred to the Public Works Department on April 28, 2000 and November 10, 2000 for preparation of the Engineers Feasibility Report. Feasibility Report We report the project is feasible and recommend its construction in the year 2001 based on the current condition of the street and participation by the abutting property owners. The existing street was constructed with bituminous curbing in 1962-68. We recommend that the project be constructed and funded in accordance with the City's Comprehensive Pavement Management Strategy (CPMS). The CPMS is an objective, cost-effective program for the preservation, rehabilitation and reconstruction of the City's infrastructure.
