M DESCRIPTION: PERSONNEL ADVISORY COMMITTEE RECOMMENDATIONS
PREPARED BY:
S. KVENVOLD
The Personnel Advisory Committee met on 2/15/01 and forward the following recommendations for the
Council's consideration:
1. Reclassification of the Human Resources Assistant position from Management I, Grade 7 to
Management I, Grade 8 and renaming the position to Assistant Director of Human Resources.
2. The creation of a Supervisory Attorney/Criminal Division position in the City Attorney's Office
classified in Management I, Grade 8. If this position is approved, an existing employee may be
promoted to the position without filling the vacancy created by the promotion. This action will not result
in creating an additional Attorney position.
The PAC also recommends that the position of Assistant City Attorney be changed to Assistant City
Attorney I, and the position of Assistant City Attorney I be changed to Assistant City Attorney II. This
renaming does not result in a change in position classification.
3. Reclassification of a Clerk Typist position in the City Clerk's Office from Pay Grade I to Pay Grade lI in
the AFSCME contract and renaming the position to Parking Warrants and Violations Clerk.
4. To approve of the proposed reorganization of the Building Safety Department, which creates a new
position of Manager of Building Inspection Services and reclassifying the position of Plan Review
Engineer from Engineering, Grade 3 to Engineering, Grade 4 and renaming the position as Manager of
Plan Review and Permit Services.
Information concerting all of the above requests has been forwarded to the Council previously.

M DESCRIPTION: REQUEST TO ESTABLISH A ROCHESTER CHAPTER OF THE
PREPARED BY:
POLICE ATHLETIC ACTIVITIES LEAGUE
S. KVENVOLD
The Rochester Police Department is requesting authorization to establish a Rochester Chapter of the Police
Athletic Activities League (PAL). There are a minimum of 16 officers that have expressed interest in
participating in PAL and they would be allowed to participate, while on duty, for a specific amount of time per
week.
I recommend your authorization for the Police Department to establish a PAL and have Police Officers
participate on duty, with the understanding that such participation will not contribute to paid overtime for the
participating officers.
Chief Peterson did indicate that PAL will be staffed by officers on duty or that volunteer their time while off
duty; therefore, there will be no need for overtime.
COUNCIL ACTION REQUESTED:
Request a motion authorizing the Police Department to establish a Police Athletic Activities League with the
understanding that Police Officer involvement in PAL activities will not contribute to paid overtime for such
officers.

Date:

Subject:
Police Athletic League
Mr. Kvenvold:
It has been clear to me that one area that our Police Department could improve on is with
positive contacts with our young people, instead of the all to common, negative. About a
year and a half ago, I learned about the Police Athletic Activities League (PAL). PAL is
a nationwide, nonprofit crime prevention program. PAL has been very successful across
the country, primarily because of the positive one on one contact that young people have
with Police Officers. I researched PAL on the Internet and visited Minneapolis PAL. I
also attended the National PAL conference in Minneapolis last year. I was impressed
with the success of Minneapolis PAL, and feel that it can work in Rochester. For over a
year now, I have been working together with community leaders to start a Rochester
chapter of the Police Athletic Activities League. (PAL)
PAL's primary goal is to work with young people that may not have the opportunity to
participate in other organized activities, and are at high risk for criminal behavior, either
because of a lack of parental support, role models, or a host of other reasons. All of the
activities are organized, coached, and/or supervised by Police Officers.
We would like to start with boxing, basketball, and field trips (Minnesota Zoo, Mall of
America, etc). The activities would be expanded as children's interest and funding
expands. Some activities that other PAL's offer include, but are not limited to; football,
archery, camping, hiking, canoeing, automotive shop, computer labs, educational tutoring
(in conjunction with Sylvan Learning Centers) and the list goes on.
There are about 16 Police Officers from our department that have expressed interest in
participating . This does not include our newest Officers. I anticipate that several of
these Officers will want to participate as well. Police Officers would be allowed to
participate in PAL activities for a specific amount of time per week. The amount of
hours has not been determined as of yet, however, for example, Minneapolis allows its
Police Officers 4 hours per week.
The Officers would be on a "community service" status while coaching the kids. This is
similar to Police Officers that currently visit schools to read to the students, or play with
them on the playgrounds. The advantage with PAL is that there is National support, as
An'EqualOpportuniq Employer
well as insurance to cover the children, Police Officers, and members of the Board of
Directors.
Some of the community leaders that are currently involved are:
• Steve Browning
Rochester Park and Recreation Department
• Don Carlson
Retired FBI and Mayo Security
• Pat Lund
KTTC
• Tim Ryan
Brock White and the 4`h Street Youth Boxing Gym
• Sheila Bennett
Coldwell Banker Burnet
• Randy Ciresena
US Bank Corp
• Abukar Iman
IMMA
• Mike Tupper
IBEW #343
We are in the process have drawing up the Articles of Incorporation, Bylaws, and the
501(c).
We would like to seek the City Council's approval to proceed with this project. We
would be happy to provide to the City Council any additional information that they might
request. I am also available to come to a meeting to make a formal presentation if that is
their wish.
If you should have any questions, please feel free to contact me at 285-8323 x 5165.

Review of Police contract
Steve,
I reviewed the memo from Fred Fanning regarding the Police Athletic Activities League (PAL). It seems like a very
worthwhile endeavor. There are many advantages to such a program including, from a HR perspective, the chance that a
young person involved in PAL may decide to enter the law enforcement profession because of his/her interaction with an
officer whose behaviors and professionalism are worthy of emulation.
The present LELS agreement does not speak to any specific number of paid hours for community service for officers, but
there is nothing that would prevent the City from approving such a use of paid time. The City may want to indicate that
paid time spent in community service activities should not contribute to the need for overtime.
Sixteen officers (estimate at this point) at four (also an estimate) hours per week equals 64 hours per week or
approximately 1.5 full time equivalents (FTEs). The City's estimated annual investment for paid time would be
approximately $75,000 (salary only).
Thanks for the opportunity to comment.

M DESCRIPTION DECERTIFICATION OF LOT IN KINGSBURY HILLS TIF DISTRICT # 19-1
PREPARE
T. Spaeth
Recently an unfortunate circumstance arose in which a party who had originally qualified for participation in the First
Homes program, was apparently disqualified due to exceeding the income requirements because of overtime worked in
the later part of last year. The party involved was scheduled to close on a home located on Lot 20, Block 25
Kingsbury Hills Subdivision, being developed by Bigelow Enterprises. This particular lot was one that had been
selected and included as one of the lots eligible for tax increment financing assistance by the City of Rochester and
included in the approved TIF Plan document for TIF District # 19-1.
At this time, the staff would request that the Council adopt the prepared resolution to decertify this particular lot from
the TIF District. Our intent would then be to add a lot to the next phase of the Kingsbury Hills devlopment so that TIF
assistance will still be able to be provided to 50 lots within the development.
( I want to point out to the Council that I was disappointed that such a situation arose with the First Homes program, and
I also want the Council to know that the City staff and the builder did everything possible to try and assist the party in
this situation. Unfortunately, this incident has led to additional time and expense for all of the parties involved. I have
indicated to the First Homes staff, that we hope this situation does not occur again.). The good news is that the builder
has informed me that the party's lender was able to qualify her for a mortgage, and she is scheduled to close on the
home at the end of this month.

Re: Lot 20, Block 2. Kingsbury Hills Sub.
Michelle Jeffers
Michelle Jeffers made application to the First Homes Program in June 2000, at that time
her income qualified for the program. During the time period from June 2000 to January
2001 Michelle's income with the Mayo Clinic increased. This increase was due the
amount of overtime that she started working. This increase in overtime has placed her
over the First Homes income limits. Michelle's overtime status was not found until the
mortgage lenders did the required update of income prior to closing.
Significant changes in income that would disqualify an individual are not normal
occurrences when working with a home buyer.

Rochester Area Foundation
Attention: Al Tutland
21 Street SW
Rochester, MN 55902
Dear Mr. Tutland:
This letter is in regards to the First Homes Program. There are some concerns that I hope
will be addressed for future participants.
I met with First Homes on 06/02/00. During the approval process my income was
verified, a credit report was pulled, and I attended the three home buying classes that
were required for this program. At this point, I was told I was approved for First Homes.
I then received my confirmation papers from First Homes on 08/01/00, which were
signed by Judy Plank and myself.
The next step was to find a builder who was participating in the program. I then met with
the builder. Being a responsible individual, I then called and spoke with Judy Plank. I
wanted to ensure everything was correct to proceed forward with signing the purchase
agreement. At this point, I was given direction by Judy Plank that I was able to sign the
purchase agreement.
In January of 2001, I was notified that I no longer qualify for the First Homes program
because of the overtime hours I had worked. When first meeting with First Homes, I was
told that overtime hours & pay raises from that point going forward did not matter. First
Homes stated they were only looking at the income at your time of approval. The reason
why I was working the overtime hours was to save extra income as a safety net for my
new home. As I look back in the past months, I was so excited to learn that I was able to
finance a new home with the assistance of First Homes. As the building process begins,
the individual's emotional state is growing stronger every day as you get closer to the
closing date.
I
The emotional stress is overwhelming to a person when they are told they no longer
qualify for this program. My closing date was to be 2/28/01. There are others who are
also involved in this. The lender and builder who have put numerous hours into making
the loan and building process stand up to the First Homes Guidelines.
How can a program like First Homes be implemented without having the standards and
guidelines set in place from the beginning. Halfway into the program and one month
prior to Closing -First Homes is now telling participants who were first approved that they
no longer qualify for the program. Now I ask myself, what about First Homes living up to
the participants and to the business's donating large dollars to the program.
I am a professional and honest person who lives in this community. First Homes should
not be implemented under false pretenses. The First Homes Organization was misleading
and gave out false information. This is unethical and surely not how a professional
organization should be tun. There are many businesses's that have donated large dollars
to this program. The business' have been donating these dollars as First Homes was to be
a great opportunity for individual's who may need some assistance in purchasing their
first home.
I do hope there is a committee that will look into these issues, and to ensure in the future
this will not happen to others participating in the program. First Homes should be run as
an ethical and professional organization.
Sincerely,
Miche Jeffers

RE: 3rd Avenue & 16" Street SE (Terry Bowman Request for an
Intersection Study)
This intersection Study has been prepared to show existing conditions and proposed
improvement s at this intersection. Attached is a map of the area. Mr. Terry Bowman has
requested the study via an e-mail to the Mayor on 8-17-00.
1. Current Conditions: There is an All -Way Stop at the intersection. Both roadways are
within the City limits. 161" Street is under the City's jurisdiction and is designated as
MSA route # 123. The speed limit on 16" Street is 35 MPH. There are two lanes in both
directions with center left -turn lanes on both sides. There is No Parking allowed on 16'
Street on either of the approaches to the intersection.
3rd Avenue is a shared route between the City & the County. It is designated as MSA
route # 109 but is also County Road # 146.Thre speed limit on 3rd Avenue is 30 MPH. It
has two lanes in both directions, however south of the intersection it transitions back to
a 1-lane facility where parking is allowed. 3d Avenue is a Truck Route and a Bus
Route.
2. Traffic Volumes: The intersection has the following 24 hour traffic volumes:

Observation Notes:
Based on the 1996 traffic volumes, the intersection met Traffic Signal Warrants #1 & #2.
3. Accident History: The following is a 3-year accident summary at this intersection. The
intersection does meet the "Accident Warrant" based upon the accident records for the last
12 months.
1998 7 accidents of which 3 may have been prevented with traffic signals
1999 9 accidents of which 4 may have been preventable.
2000 5 accidents thru 8-17-00, of which 3 may have been preventable.
4. Other Items Reviewed:
a) Visibility: There are no visibility obstructions on any of the approaches to the
intersection.
b) Streetlights: There are two streetlights provided, one each on the NW & SE
comers. This is adequate to meet the City of Rochester's street light standards.
c) Crosswalks: Painted crosswalks & stop bars are inplace on all approaches.
5. Planned Improvements: The installation of a traffic signal is not in the City's current
5-year Construction Plan. The Installation of a traffic signal has not been considered at this
intersection since the intersection has operated at a satisfactory level of service without a
serious accident record.
Recommendations
1. Consider the removal of additional parking on 3`d Avenue south of the intersection to
balance the south bound traffic in the two lanes.
2. Closely monitor the accident rate at this intersection.

Dear Mr. Hanson,
Just over a month ago, my wife Jill was involved in a serious traffic accident at the
intersection of 16'h St. and 3rtl Ave. S.E. Although nothing was broken, she was cut up
and severely bruised, and is still recovering. We are very thankful that she was alone
and did not have our two small children with her. The accident was caused by a garbage
truck running the stop sign. As you know, this is a four-way stop intersection, and I
believe that traffic signals may have prevented this accident. Everyday I see people
"sneaking" through without ever stopping or sometimes even slowing down. This is a
heavily used intersection; especially when school is in session. With all the new
development in the Pinewood area and the eventual extensions of 161h and 20`h streets,
traffic volumes will only increase. Pedestrians have a very tough time crossing the street
during peak hours also. I_ believe that putting traffic signals at this intersection would
greatly increase the safety of motorists and pedestrians. In talking briefly with Traffic
Engineer Dave Rossman, he tells me that this intersection does meet at least three
warrants for installing a signalized system. Traffic signal warrants #1 and #2, both based
on traffic volumes, and the accident warrant based upon accident records for the last 12
months. I urge you to strongly consider installing a signal system at this dangerous
intersection. I would greatly appreciate a response to this request.

EPARED BY:
a Gilsrud and
A grievance resolution has been reached between Law Enforcement Labor Services, Inc. (LELS) and the Rochester
Police Department (RPD), City of Rochester regarding overtime compensation for officers scheduled for court on
their days off. The concern arises when an officer is notified of a court date requiring his/her presence on a day off
from duty and the court appearance is cancelled and rescheduled for the next day. RPD leadership understood the
fiustration experienced by the officers to whom this happened.
The following language is mutually acceptable to the RPD and the LELS to resolve the grievance and will be in effect
until the expiration of the present LELS collective bargaining agreement on 12/31/01.
Section IX shall be understood to have the following meaning:
An officer may request four hours of compensation at the agreed upon rate of pay or compensatory
time off when he/she is notified that his/her presence is necessary for a jury trial during a given week,
the officer is bumped/cancelled twice for the trial during that week and this situation occurs on an
officer's scheduled day(s) off. Officers are limited to a maximum of four hours of such compensation per
week. The court case for which an officer is called must be related to an incident arising from the officer's
RPD employment or from acting in a law enforcement capacity.

RE: Lighted Ski Trail at Eastwood Golf Course
Dear Roy,
This letter is to offer the strong support ofRochester Active Sports Club to the proposed development of
lighted ski trail at Eastwood Golf Course. Nordic skiing is a great way to keep active over the long cold
winter months in Minnesota and hence it is not surprising that many communities in the state have developed
lighted ski trails. I know of20 such trails within the state. Most cities and large towns in the state have one
or more lighted trails. For example, Minneapolis / St Paul has 5, Duluth has 2, and St Cloud, Hibbing,
Savage, Brainerd, Two Harbors, Bemidji, Cloquet, Grand Rapids and Grand Marais all offer lighted trails
for night skiing. Southern Minnesota is the only part ofthe state where no such facilities exist.
One of the primary goals of RochesterActive Sports Club is to promote silent sports such as skiing, biking
etc. We have found that attempts to promote skiing in this area are severely hampered by the lack of
appropriate facilities. The Parks and Recreation Department currently maintain excellent ski trails in
Eastwood Golf course, however fewpeople are willing to utilize these trails after dark which essentially
limits their use to weekends. Alighted ski trail system would greatly expand the use ofthese facilities and
provide the public with a wonderful facility for getting out and active in the dark winter nights. This facility
could be used by Community Education classes and opens up the possibility ofnordic ski clubs in the high
schools. It would be an excellent alternate use of facilities that otherwise remain unused throughout the
winter months.
We would like to offer our support for this proj ect in a number of ways. We would we very willing to work
with you on trail layout to optimize the location ofthe trail, both to minimize its impact on the golf course and
to make best use of areas that historically have good snow retention. We will commit to the installation and
removal of the lighting system (poles and lights) each fall and spring, and we will fund the lighting costs each
year. If there are any other areas in which we can assist in this project, please let me know. I look forward
to working with you on this project.

Re: Lighted Ski Trail at Eastwood Golf Course
Dear Roy:
I am writing as Project Director of CardioVision 2020 to enthusiastically
support the lighting of the ski trail system at Eastwood Golf Course.
CardioVision 2020 has the vision that by the year 2020 all residents of
Olmsted County will have access to affordable and safe facilities where they
can exercise throughout the year. Lighting -the ski trail at Eastwood Golf
Course would contribute to that vision to a very significant extent. The
Rochester Active Sports Club has taken an active role in defining the trail,
arranging to install and remove the lighting system, and to cover the lighting
costs each year. This is a perfect example of citizen and government
cooperation to improve the community environment.
Please let me know if there is anything else I can do personally to support this
very important and much needed project.

Dear Mr. Sutherland,
Michael O'Connor, President of the Rochester Active Sports Club recently informed me of an exciting
potential future project for the cross-country skiers in the Rochester area. The lighting of the Eastwood
Golf Course cross-country ski trails will be a large asset to the cross-country ski community.
I am President of the North Star Ski Touring Club, a cross-country ski club based in the Twin Cities with
over 1500 members from 13 states. We have been active in the promotion of cross-country skiing for over
30 years. In the past, our club has been actively involved with the development of the lighting for the
cross-country ski trails at Hyland Park Reserve in Bloomington, MN, Theodore Wirth Park in
Minneapolis, and Battle Creek Regional Park in St. Paul, MN.
We would like to offer our support for the lighting of the trails at Eastwood Golf Course in Rochester. A
fair number of skiers from our club live near the Rochester area. I can offer support in the form of
advertising, networking, electrical consultation and soliciting of funds if needed. I work for one of the
largest electrical contractors in the region and I personally helped budget and design the lighting of the
trails at Battle Creek Park in St. Paul. Our club is one of the largest in North America and we have many
resources for special needs. Our club also has a trail clearing and maintenance division. I will offer their
services for work on the trails, which might be needed after the electrical work and underground
trenching is done.
Thanks for your time in considering our support for this project.

M DESCRIPTION: Sanitary Sewer Oversize Reimbursement
PREPARED BY:
M. Nigburn'%
Over the years, consistent with the Code of Ordinances, the Owner/Developer of
property has been responsible for the construction of small diameter sanitary sewer
pipes that are extended through developments to serve abutting lands. The City has
typically constructed and paid for the sewer lines that are considered to be "trunk
sewers". These trunk lines are typically constructed under a City Project and are paid
for through the Sanitary Sewer Availability Charge or a specific area assessment.
However, there is not an official policy on record that establishes what portions of the
trunk sewer project cost the City does or does not pay for.
There may also be times where a "trunk sewer' facility may be constructed by the
Owner/Developer through a development to not only meet the needs for the
development but to also serve a significantly larger future service area. The City has
put language in the Development Agreements that require the City to reimburse
developers for this oversize cost if the oversize is required by the City Engineer.
Therefore, it seems prudent that the City establishes a formal written policy that
addresses this issue. The purpose for this policy is to assure consistency and
uniformity of the oversize requirements and reimbursement.
Staff would request the City Council adopt the following policy as it relates to Sanitary
Trunk Sewer oversizing.
"The City shall reimburse the Owner/Developer for the incremental cost of the materials to
increase the size of the sanitary sewer above a 12" diameter pipe if requested by the City
Engineer. The City shall also reimburse the incremental cost of the increase in the width
of the manhole size if it is solely required for the oversize sanitary trunk sewer pipe. The
' 0 Public Works Department shall establish the reimbursement amount for each item
concurrent with the adjustments in the City's standard rates which occur August I" of
each year."

Adopt the Sanitary Trunk Sewer Oversize Policy as noted above.

REPORT ON THE FEASIBILITY OF A PROPOSED
LOCAL IMPROVEMENT PROJECT FOR:
PROJECT NO. 7104-99 J9541
CURB, GUTTER & OVERLAY ON GREEN VIEW DRIVE
SW, GREEN VIEW PLACE SW, AND GREEN FIELD
LANE SW
February 14, 2001
Honorable Mayor & Common Council
City of Rochester, Minnesota
A resolution requesting the following project: Curb, Gutter & Overlay on Green View
Drive SW, Green View Place SW, and Green Field Lane SW, was referred to the Public
Works Department in November, 1998 for preparation of the Engineers Feasibility
Report.
Feasibility Report
We report the project is feasible and recommend its construction in the year 2001 based
on the current condition of the street and participation by the abutting property owners.
The existing street was constructed with bituminous curbing in 1971,77, &78.
We recommend that the project be constructed and funded in accordance with the City's
Comprehensive Pavement Management Strategy (CPMS). The CPMS is an objective,
cost-effective program for the preservation, rehabilitation and reconstruction of the City's
infrastructure. The most cost-effective strategy at this time for this street, which has a
Pavement Condition Index (PCI) rating of 29, is rehabilitation.
Work typically will include the following
1. Removal of existing edges of the roadway and gravel base, boulevard sod
2. Construction of concrete curb and gutter, and driveway aprons
3. Storm sewer design considerations
4. Resurfacing of the entire street with bituminous asphalt.
5. Sidewalk sections reviewed for replacement.
6. Boulevard areas re -sodded.
This report and the estimated costs for the project are prepared without the benefit of field
surveys, soils boring or completed plans and specifications:

PREPARED BY:
This is a recommendation for City Council approval of three items for this traffic signal
1. City -County Cooperative Agreement:
A City -County Cooperative Agreement has been prepared that includes funding at 50% for both agencies,
and adds the intersection to the standing City -County Signal Maintenance Agreement.
2. Parking restriction on 24" Street from 18" Avenue to CSAH 1:
A parking restriction is needed for a distance of one block on the east approach. The street width is 32 feet
wide. There are two homeowners affected. Both have been contacted and both homeowners agree that the
signal is needed and removal of parking is warranted to operate the signal efficiently.
3. Authorization to spend MSA Funds on a CSAH;
1 Ph Avenue is County State Aid Highway 1 (CSAH 1). The City may use its MSA funs on a CSAH if
authorized by a City Council resolution. The City share of this project is estimated at $70,000 and staff
recommends use of MSA Funds for this purpose.
Recommendations:
Approval of all three items is recommended.
COUNCIL ACTION REQUESTED:
1. Approve the City County Cooperative Agreement for City Project J-6325
2. Adopt the prepared resolution adding paragraph ( 230.2 ) to Section B "No Parking " of Comprehensive

This is a recommendation to restrict parking on a majority of Superior Drive NW from 28' Street to
Valleyhigh Drive, and on 28" Street NW from CSAH 22 to Superior Drive NW. These are new
roadways with a width of 44 feet, which will allow 1 lane in each direction, a center two-way left turn
lane, and along with a right turn lanes at Valleyhigh Drive NW and at CSAH 22. The project has been
developed without parking with the concurrence of the developer.
The exception to the No Parking is the frontage along the new City Park called Badger Ridge Park. This
park will serve the new neighborhood and will have playground equipment, a soccer field and a ball
diamond. On -street parking is needed for the families that drive to the park.
COUNCIL ACTION REQUESTED:

M DESCRIPTION: Parking Restriction on 32"tl Avenue NW / 2200 block
EPREPAREDY:an
The City has received a request from Mr. Tim Shea of the North Distributing Company (358-7432) to
restrict parking along the entire frontage of his property located at 2222 32Id Avenue NW. The reason
being is that the street is filled with parked cars daily from the Crenlo Plant. The parked cars are
causing a visibility hazard for the commercial vehicles entering and exiting the driveways of his
business.
32ntl Avenue is the main entrance into the industrial subdivisions of Heinricks and GF First Subdivisions.
It is built 44 feet wide, which is normally wide enough for parking on both sides. However, due to the
level of traffic volumes and the amount of large vehicles using the roadway and the curvature of the
road staff recommendation is to proceed with the parking removal.
The request has been discussed with Mr. Tom Ness of Crenlo Corporation. He has no objection. The
parkers are mainly Crenlo employees, and space is available for them elsewhere.
COUNCIL ACTION REQUESTED:
Adopt the prepared resolution amending paragraph (240.5) of section B %o Parking Zones" to read;
(240.5) 32Id Avenue NW, on the south side of the street, from Valleyhigh Drive NW to a point 1200 feet
west of Valleyhigh Drive NW, at all times.

for Digester Gas Piping (J-4382) and Hot Water Loop Piping (J-4388)
PREPARED BY: p
Lyle J. Zimmermann
The Water Reclamation Plant will be making modifications to the piping handling digester gas produced at the
Water Reclamation Plant. These modifications will allow for more efficient use of the gas. Modifications will
also be made to the hot water loop piping to Digesters No. 5 and No. 6 which will allow waste heat produced by
the engine generators to be used in the digesters. In the future the engine generators will be turbo -charged and
some preliminary work on the exhaust system will be included with these projects.
These projects will have a long term cost savings affect on the WRP operating budget and were included in the
2001-2006 Capital Improvements budget under the following projects.
Extend hot water loop to digesters Project No. 4388
Digester gas line replacement Project No. 4382
Turbo charge engine generators Most of this work is scheduled for the year 2002
Black & Veatch Corporation, consulting engineers, have prepared a report which evaluated alternatives and
made recommendations to complete these improvements.
Council Action Requested:
Approval to enter into an Engineering Services Agreement with Black & Veatch Corporation to prepare
construction contract documents for modifications to the digester gas piping, hat water loop piping, and the
engine generator exhaust at the Water Reclamation Plant for a cost not to exceed $132,000.

February 15, 2001
NOTE : After the Planning and Zoning Commission meeting, Planning and Public Works staff discussed recommended condition #7,
related to contribution towards a tragic study and also discussed the alignment of the north/south collector road (4ib bullet under
condition #I). It appears as though condition #7 could be deleted, if condition #8 is re -worded to include preparation of a traffic study
or contribution towards a study as part of the Development Agreement. Staff recommended modifications to these conditions are
identified as strikethrough text for text to be deleted, and underlined text for text to be added.
Also, Official Map #12 does delineate the alignment for the north/south collector roadway to be located between 40'" St. SW and 48" St.
SW. This GDP identifies an alignment consistent with the Ogcial Map. There may be some benefit in realigning this roadway, which
could require an additional amendment to Official Map #12. At this time, the applicant requests approval of the alignment shown on the
GDP. Planning staff contacted John Arnold, representing the property owner to the north, to determine whether that property owner
prefers the proposed alignment or an alignment that would shift the road to the west to allow for buildable land on both sides. Mr.
Arnold informed us they are not in a position to identify a preference at this time. The Council may wish to discuss this alignment
further. The requirement to realign the roadway (4`" bullet under condition #1) could be removed, with the understanding the alignment
could change in the future, if further communication supports realignment.
City Planning and Zoning Commission Recommendation:
The Planning and Zoning Commission held a public hearing on this item on December 27, 2000 and recommends approval
:ct to conditions and modifications. Schultze moved to recommend approval of GDP 159 with staff suggested findings
conditions and modifications, with #7 to be clarified prior to the Council meeting and with #1 modified to require
va,ignment of the north/south collector road. McGowan seconded the motion. The motion carried 7-1, with Mr. Werven
voting nay.
1. The General Development Plan shall be revised as follows, and a revised Plan shall be riled with the Planning
Department.,
.• Additional right-of-way shall be identified along 11 t8 Ave. SW consistent with the requirements for a
collector road, including pedestrian facilities.
Access openings on the roadway labeled "Commercial Drive SW" shall be corrected to line up across
from other openings.
d• The southerly access to 11th Ave. SW shall be eliminated.
The north/south collector road shall be realigned to provide for buildable land on both sides of the road
and to better work with the topography.
2. At the time of platting, controlled access will need to be dedicated along TH 63, 48th St. SW and 11th Ave. SW and
the frontage road, except fore the street/driveway openings approved with the plat(s). In addition, right-of-way
shall be dedicated for IIth Avenue and 48th St. SW consistent with the requirements for those roadways. Any
right-of-way in excess of dedication requirements shall be reserved as right-of-way.
3. At the time of platting, the developer shall dedicate their proportional amount of right-of-way for the 48th St.
SW/TH 63 interchange. Any right-of-way needed in addition to the area dedicated shall be platted and reserved
with the first phase of this development. Terms of the conveyance shall be outlined in the Development
Agreement.

SD Final Site Plan #00-03
J
General Development Plan:
The proposed addition to the Econo Foods store is
in an area designated for a strip mall on the
approved final site plan for Northwest Plaza
Shopping Center.
Access:
Access to the site is consistent with the accesses
shown on the approved project development plan.
Access to 55r' Street/Circle Drive will be from
existing, in -place access points.
Wetlands:
The Soil Survey and National Wetland Indicator
maps do not indicate the presence of any wetlands
on this portion of the site.
Special District Summary:
In 1982, the City adopted a Special Zoning District
for The Arboretum (# 2247). The Special District
allows for a mixture of land uses guided by a
general development plan for the area. Land uses
conforming to the underlying R-1 district (at the time
of Special District adoption) only need be approved
through conventional zoning and subdivision
approval processes (such as Lincolnshire
Subdivisions). Other development projects in
accordance with the general development plan for
the property, but not conforming to the underlying
R-1 zoning must be considered for approval
through a two step (project development plan and
final site plan) review process set forth in Ordinance
# 2247.
Analysis:
The proposed development is subject to the provisions of Ordinance #2247, which establishes the
Arboretum Special District and provides for procedures for approval of projects within the Special
District. The final site plan known as "Northwest Plaza Shopping Center" went the through the
project development plan and final site plan process and was approved in 1992. A copy of the
final site plan is attached. The plan shows a shopping center and seven outlots which abut Circle
Drive.
In 1999, the City Council approved an amendment by the Nash Fish Company to amend the
configuration and size of the strip mall on the west end of the property that was previously
approved. At that time the amendment changed the total size of the strip mall by adding 23,850
sq. ft. of retail space and modified the size and shape of the retail stores. The approved site plan
shows a 16,000 sq. ft. retail building south of Econo Foods. Only the size and configuration of the
16,000 sq. ft. building was approved with the amendment in 1999. A condition placed on the
amendment in 1999 requires that the development of the 16,000 sq. ft. building needs to go
through final site plan review.
The applicant is now proposing to amend the approved final site in order to construct an 11,600
sq. ft. addition instead of the 16,000 sq. ft. building. This building is 4,400 sq. ft. less than the
building configuration approved in the 1999 amendment. The amendment proposes building
materials and colors that are identical to the Econo Foods building.
January 18, 2001
SD Final Site Plan #00-03
q9
No signage is shown on the building elevations. Signage will be limited to 20% of the building
facade, which is applicable to a business center in a B-4 District (the standards which apply to this
site).
Note: A Traffic Impact Report (TIR) has already been approved for Northwest Plaza. This
amendment will not require a revision to the TIR. Also the landscaping and parking lot are already
in place.
Criteria & Findings:
Sections 61.146 and 62.708 are attached for your review. These sections of the Rochester
Zoning Ordinance and Land Development Manual (LDM) include the criteria that must be

modifications, staff suggests that findings within this Section could not be made to support denial
of this request.
In regard to Section 62.708 (2) of the LDM (see attached), staff suggest the following findings:
Final Development Plan Criteria:
a) Public Facility Design: Approved construction plans and an executed Owner Contract
are required if the extension of Public Watermain and/or addition of hydrant(s) is required
for this project. If the site grading involves more than 50 cubic yards of material, an
approved grading plan is also required prior to construction.
b) Geologic Hazard: This site is not known to contain any of the listed geologic hazards.
c) Access Effect: Access to the site is consistent with the accesses shown on the
approved project development plan. Access to 55fb StreetlCircle Drive will be from

pedestrian sidewalk was also included when the Econo Foods store was constructed last
year.
e) Foundation and Site Plantings: Landscaping has been completed for this portion of the
site.
fJ Site Status: installation of public infrastructure will require approved construction plans
and an executed Owner Contract if the extension of Public Watermain andlor addition of
hydrant(s) is required for this project..
g) Screening and Bufferyards: The landscaping for this area was completed when the
Econo Foods store was constructed last year.
h) Final Building Design: The proposed building design is consistent with the principles
identified in final development plan relative to Height Impact, Setbacks, and internal Site
Design.
i) Internal Circulation Areas: The parking areas are already completed and paved.
January 18, 2001
SD Final Site Plan #00-03
j} Ordinance Requirements: The proposed amendment meets the requirements of the
Rochester Zoning Ordinance and Land Development Manual.
Staff Recommendation:
The Planning staff would recommend approval of the propose amendment, subject to the
following conditions and/or modifications:
1. If site grading involves more than 50 cubic yards of material, a grading plan shall be
submitted to review and approval by the Rochester Public Works Department prior to
zoning certificate approval.
2. Signage on the building shall be limited to each tenant permitted one wall sign not
exceeding 20 percent of the area of the exterior facade.

SD Final Site Plan #00-03
EXCERPTS FROM THE LDM
61,146 Standards for Conditional Uses: The zoning administrator, Commission, or Council
shall approve a development permit authorizing a conditional use unless one or more of
the following findings with respect to the proposed development is made:
1) provisions for vehicular loading, unloading, parking and for vehicular and pedestrian
circulation on the site and onto adjacent public streets and ways will create hazards
to safety, or will impose a significant burden upon public facilities.
2) The intensity, location, operation, or height of proposed buildings and structures will
be detrimental to other private development in the neighborhood or will impose
undue burdens on the sewers, sanitary and storm drains, water or similar public
facilities.
3) The provision for on -site bufferyards and landscaping does not provide adequate
protection to neighboring properties from detrimental features of the development.
4) The site plan fails to provide for the soil erosion and drainage problems that may be
created by the development.
5) The provisions for exterior lighting create undue hazards to motorists traveling on
adjacent public streets or are inadequate for the safety of occupants or users of the
site or such provisions damage the value and diminish the usability of adjacent
properties.
6) The proposed development will create undue fire safety hazards by not providing
adequate access to the site, or to the buildings on the site, for emergency vehicles.
7) In cases where a Phase I plan has been approved, there is a substantial change in
the Phase II site plan from the approved Phase I site plan, such that the revised
plans will not meet the standards provided by this paragraph.
8) The proposed conditional use does not comply with all the standards applying to
permitted uses within the underlying zoning district, or with standards specifically
applicable to the type of conditional use under consideration, or with specific
ordinance standards dealing with matters such as signs which are part of the
proposed development, and a variance to allow such deviation has not been
secured by the applicant.
62.708 Criteria for Type III Developments: In determining whether to approve, deny, or
approve with conditions an application, the Commission and Council shall be guided by
the following criteria:
2) Final Development Plan Criteria:
a) Public Facility Design: The design of private and public utility facilities meet the
requirements and specifications which the applicable utility has adopted.
b) Geologic Hazard: Engineering means to deal with areas of geologic hazard have been
incorporated into the development plan or such areas have been set aside from
development.
January 18, 2001 • •
SD Final Site Plan #00-03
c) Access Effect: Ingress and egress points have been designed and located so as to:
1) Provide adequate separation from existing street intersections and adjacent private
driveways so that traffic circulation problems in public right-of-ways are minimized;
2) Not adversely impact adjacent residential properties with factors such as noise from
accelerating or idling vehicles or the glare of headlights from vehicles entering or
leaving the site.
In addition, where the preliminary development plan identified potential problems in
the operation of access points, plans for private improvements or evidence of planned
public improvements which will alleviate the problems have been provided.
d) Pedestrian Circulation: The plan includes elements to assure that pedestrians can
move safely both within the site and across the site between properties and activities
within the neighborhood area, and, where appropriate, accommodations for transit access
are provided.
e) Foundation and Site Plantings: A landscape plan for the site has been prepared which
indicates the finished site will be consistent with the landscape character of the
surrounding area.
f) Site Status: Adequate measures have been taken to insure the future maintenance and
ownership pattern of the project, including common areas, the completion of any platting
activities, and the provision of adequate assurance to guarantee the installation of
required public improvements, screening and landscaping.
g) Screening and Bufferyards: The final screening and bufferyard design contains earth
forms, structures and plant materials which are adequate to satisfy the needs identified in
Phase I for the project.
h) Final Building Design: The final building design is consistent with the principles
identified in preliminary development plan relative to Height Impact, Setbacks, and
Internal Site Design.
i) Internal Circulation Areas: Plans for off-street parking and loading areas and circulation
aisles to serve these areas meet ordinance requirements in terms of design.
j) Ordinance Requirements: The proposed development is consistent with the
requirements of the underlying zoning district for similar uses in regards to signage and
other appearance controls, and with general standards such as traffic visibility and
emergency access.

Site Plan 04
A Traffic Impact Study for the Northwest Plaza Shopping Center was completed
Merchant's
in 1992 and that study included consideration of development on the outlets that
National Bank
have been platted. Due to the changes in floor areas that have occurred as areas of
the center have been develycd or redeveloped, staff has requested updated traffic
data be provided for the 55 St intersection in order to allow staff to monitor
whether the assumptions in the initial TIR are still valid.
A Circle Drive Traffic and Access Management Study is underway which is
looking at future capacity and traffic flow issues on the Circle Drive corridor. One
issue that study is addressing is the number and spacing of intersections that exist
or will be developed between the Douglas Trail overpass and the East Frontage
Road of TH 52 and how these intersections will affect capacity, traffic flow and
average travel speeds along Circle Drive over a 20-25 year planning horizon.
Preliminary analysis suggests that this section of Circle Drive will suffer from
highly congested conditions in the future as development continues to occur west
of the North Park area, north of 55" St on the east side of TH 52, and along West
Circle Drive south of the Douglas Trail overpass.
To address this issue the Circle Drive Traffic Study will be looking at options for
minimizing the number of signalized intersections needed as well as redesign
options for the TH 52/Circle Drive interchange to provide for higher capacity
operations. One concept that may be considered is the consolidation of the 55" St
intersection with the next intersection planned to the southwest (481° St) at a single
location. An alternative such as this may result in the existing access being
converted to right -in, right -out operation or may result in closure of the
intersection at the current location. If this relocation were to occur, access would
be shifted to the southwest along Circle Drive a short distance and a public
roadway would be provided to connect the northwest area of the Northwest Plaza
Shoppine Center with the new consolidated access location.

East: Commercial uses and vacant land in SD-1,
the Arboretum Special District.
West: To the west of CR 22 is undeveloped land
zoned R-1 (Mixed Single Family Residential).
The approved Arboretum General Development
Plan designates this property appropriate for
"commercial' development. This property is
included in an overall plan for Northwest Plaza
approved by the City in 1992.
Access to the site would be from an internal
roadway that provides access to other uses within
the Northwest Plaza center.
The applicant is proposing a storm water quality
pond on -site. An approved grading and drainage
plan will be required prior to construction.
This area was previously graded, prior to WCA
rules.
In 1982, the City adopted a Special Zoning District
for The Arboretum (# 2247). The Special District
allows for a mixture of land uses guided by a
general development plan for the area. Land uses
conforming to the underlying R-1 district (at the time
of Special District adoption) only need be approved
through conventional zoning and subdivision
approval processes (such as Lincolnshire
Subdivisions). Other development projects in
accordance with the general development plan for
the property, but not conforming to the underlying
R-1 zoning must be considered for approval
through a two step site plan review process set
forth in Ordinance # 2247.
This two step process includes the Project
Development Plan and the Final Site Plan. A
Project Development Plan was approved in 1992
for this property.

Analysis:
Review Procedure:
The proposed development is subject to the provisions of Ordinance #2247, which establishes the
Arboretum Special District and provides for procedures for approval of projects within the Special
District. In this instance, a Type III, Phase II review procedure is necessary for both the project
development plan phase and the final development plan phase of the review. This requires public
hearings at both the Planning Commission and the City Council. According to the Rochester
Zoning Ordinance and Land Development Manual (LDM Sec. 60.327), this application will need to
be measured against the criteria applicable for conditional use permits (Sec. 61.146) and also for
a Restricted Development Final Plan (62.708).
Background & Summary of Proposal:
A Project Development Plan was approved for Northwest Plaza in the early 1990-s and a Final
Site Plan was approved in 1992. The 1992 Final Site Plan included approved building details for
Wal-Mart, Sam's Club and the attached retail buildings along the western portion of the shopping
center. That Plan identified 5,000 s.f, of building area on each of the outlots adjacent to CR 22,
but did not include additional details. The file notes that outlots are not buildable until a final site
plan is approved. The applicant is now requesting Final Site Plan approval to facilitate the
development of a drive-thru bank facility on one of the outlots adjacent to CR 22.
Shoreland District and Variance:
Shoreland District regulations are designed to protect water resources and shoreland areas by
regulating development density and intensity, stormwater management and water quality, and
grading and vegetation alterations. Shoreland District regulations are found in Section 62.1000 et.
seq. of the Rochester Zoning Ordinance and Land Development Manual.
The applicant has filed a request for a Variance from Section 62.1008 of the Rochester Zoning
Ordinance and Land Development Manual, to permit 63% of impervious surface on this lot.
Section 62.1008 restricts the impervious coverage within the Shoreland Overlay District to 25% of
the lot.

EXCEPTIONAL CIRCUMSTANCES: A Project Development Plan was approved for
Northwest Plaza in the early 1990-s and a Final Site Plan was approved in 1992. The 1992
Final Site Plan included approved building details for Wal-Mart, Sam's Club and the attached

retail buildings along the western portion of the shopping center. That Plan identified 5,000 s.f.
of building area on each of the outlots adjacent to CR 22, but did not include additional details.
The file notes that outlots are not buildable until a final site plan is approved.
In 1995, the City adopted Shoreland regulations, as required by the State. These regulations
apply to lands within a certain proximity of a protected water body. Kings Run Creek, which
boarders the southern side of Northwest Plaza is listed as a tributary stream and is now
subject to Shoreland District regulations. Since the outlots did not have final approval for
specific development, staff concluded that the Shoreland regulations must apply if a lot is
within the Shoreland Overlay District as defined by the Ordinance. This appears to be the
only outlot within Northwest Plaza that is within the Shoreland Overlay District and subject to
the Shoreland regulations.
REASONABLE USE: The granting of this variance request does not appear to be necessary
to allow for the reasonable use of the applicant's property. In order to develop the proposed
use, the variance would be needed.
ABSENCE OF DETRIMENT: The granting of this variance request may not be materially
detrimental to the public welfare or to other property in the area. The applicant is proposing to
construct a stormwater quality pond to provide treatment of the water prior to discharge to
Kings Run Creek.
MINIMUM VARIANCE: The applicant is requesting a variance of 38% in order to proceed
with developing this site with a drive-thru bank facility.
Criteria & Findings:
Sections 61.146 and 62.708 are attached for your review. These sections of the Rochester
Zoning Ordinance and Land Development Manual (LDM) include the criteria that must be
considered when reviewing this application. Staff suggests the following findings.
In regard to Section 61.146, if this application were approved subject to conditions or
modifications, staff suggests that findings within this Section could not be made to support denial
of this request.
In regard to Section 62.708 (2) of the LDM (see attached), staff suggest the following findings
Final Development Plan Criteria:
a) Public Facility Design: An approved grading/drainage plan is required prior to
construction. Extension of any public utilities will require approved construction plans,
easements and execution of a City -Owner Contract.
b) Geologic Hazard: This property is within the Shoreland Overlay District. The applicant
is proposing a stormwater quality pond on -site.
c) Access Effect: It appears as though the proposed access location is acceptable.
d) Pedestrian Circulation: There is an existing pedestrian trail within the right-of-way of
CR 22.
e) Foundation and Site Plantings: A landscape plan for the site has been prepared which
identifies turf, shrubs, and trees on -site.
liqPage 5of8
f} Site Status: Installation of public infrastructure will require approved construction plans
and an executed Owner Contract. The applicant will need to work with the City to obtain
an approved grading and drainage plan.
g) Screening and Bufferyards: The landscape plan includes turf, trees and shrubs.
Additional details are needed to identify proposed screening for the trash bin.
h) Final Building Design: The preliminary plan did not include building elevations to use as
a comparison.
i) Internal Circulation Areas: Plans for off-street parking and loading areas and circulation
aisles appear to meet ordinance requirements in terms of design.
j) Ordinance Requirements: The applicant has tiled a request for a Variance from Section
62.1008 of the Rochester Zoning Ordinance and Land Development Manual, to permit
63% of impervious surface on this lot. Section 62.1008 restricts the impervious coverage
within the Shoreland Overlay District to 25% of the lot.
Staff Recommendation:
At this time, additional information needs to be fled prior to taking final action on this Final Site Plan
application.
• The applicant will need to provide clarification regarding the proposed floor area of the
building. The site plan identifies two different numbers, 6,000 sq. ft and 12,000 sq. ft Also,
from the building elevations it appears as though there is a second story to the proposed
building. No floor plans were submitted for a second story, however.
• The applicant will need to fle elevations and details identifying screening for the trash
enclosure.
• An auxiliary sign is identified near the driveway, though no details were filed for this proposed
sign. The applicant will need to provide details for this proposed sign, including elevations and
dimensions.
If the applicant agrees to file this additional informational least two weeks prior to the City Council
meeting for which this item would be scheduled, staff would agree to forwarding this application to the
City Council with a recommendation.
Variance: The Planning Commission will need to consider the Variance request to Section
62.1 D08 and determine whether the Variance should be approved or denied, as part of this
application. The Commission makes a decision on the Variance and adopt findings. The City
Council will only hear the Variance request if the Commission's decision is appealed to the
Council.
Final Site Plan: The Commission will need to make a recommendation to the City Council
regarding this application.
Staff recommends approval subject to the following modifications or conditions:
1. An approved grading/drainage plan is required prior to construction. Storm Water
Management must be provided, and a fee will apply for voluntary participation in the
City's regional Storm Water Management Plan if the proposed on -site water quality
pond is not sized to address the stormwater volume for the entire site.
Page 6 of S
Z An additional fire hydrant shall be installed on -site, per the requirements of the
Rochester Fire Department. Extension of any public utilities will require approved
construction plans, easements and execution of a City -Owner Contract.
3. Prior to development, the applicant shall execute a Maintenance and Ownership
Agreement for the private storm water quality pond.

EXCERPTS FROM THE LDM
61.146 Standards for Conditional Uses: The zoning administrator, Commission, or Council
shall approve a development permit authorizing a conditional use unless one or more of
the following findings with respect to the proposed development is made:
7) In cases where a Phase 1 plan has been approved, there is a substantial change in
the Phase II site plan from the approved Phase I site plan, such that the revised
plans will not meet the standards provided by this paragraph.
Page 8 of 8 ! f
b) Geologic Hazard: Engineering means to deal with areas of geologic hazard have been
incorporated into the development plan or such areas have been set aside from
development.
c) Access Effect: Ingress and egress points have been designed and located so as to:
1) Provide adequate separation from existing street intersections and adjacent private
driveways so that traffic circulation problems in public right-of-ways are minimized;
2) Not adversely impact adjacent residential properties with factors such as noise from
accelerating or idling vehicles or the glare of headlights from vehicles entering or
leaving the site.
In addition, where the preliminary development plan identified potential
problems in the operation of access points, plans for private improvements or
evidence of planned public improvements which will alleviate the problems
have been provided.
d) Pedestrian Circulation: The plan includes elements to assure that pedestrians can
move safely both within the site and across the site between properties and activities
within the neighborhood area, and, where appropriate, accommodations for transit access
are provided.
e) Foundation and Site Plantings: A landscape plan for the site has been prepared which
indicates the finished site will be consistent with the landscape character of the
surrounding area.
f) Site Status: Adequate measures have been taken to insure the future maintenance and
ownership pattern of the project, including common areas, the completion of any platting
activities, and the provision of adequate assurance to guarantee the installation of
required public improvements, screening and landscaping.
g) Screening and Bufferyards: The final screening and bufferyard design contains earth
forms, structures and plant materials which are adequate to satisfy the needs identified in
Phase I for the project.
h) Final Building Design: The final building design is consistent with the principles
identified in preliminary development plan relative to Height Impact, Setbacks, and
Internal Site Design.
i) Internal Circulation Areas: Plans for off-street parking and loading areas and circulation
aisles to serve these areas meet ordinance requirements in terms of design.
j) Ordinance Requirements: The proposed development is consistent with the
requirements of the underlying zoning district for similar uses in regards to signage and
other appearance controls, and with general standards such as traffic visibility and
emergency access.

Dear Ms. Garness:
Our review of the referenced application is complete and our comments follow:
1. The property may be subject to the water availability fee, connection fees or assessments.
The Land Development Manager (507-281-6198) at the Public Works Department
determines the applicability of these fees.
2. The proposed water service(s) and any public water system improvements that maybe
required must be shown on this plan.
The fire Prevention Bureau will need to comment on the location of the existing fire hydrants
as they relate to protection of this building. If they require additional on -site fire hydrant(s),
water mains connecting to and including any fire hydrant are considered public and need to
be centered within a 20' minimum public utility easement. The owner would be required to
enter into a City Owner Contract with the City of Rochester for the installation of the public
water main. Contact the Land Development Manager (507-281-6198) at the Public Works
Department for details. Final water main construction plans with profiles would need to be
prepared by a civil engineer and conform to standard City of Rochester requirements.

Re: Variance Request
Merchants National Bank— NW Plaza
Rochester, Minnesota
Dear Mitzi:
LANDSCAPE ARCHITECTS
As part of our final site plan application for the Merchants National Bank site in the
Northwest Plaza we are requesting a variance to the shoreland district regulation which
affects this property.
PLANNERS
Approximately 85% to 90% of this site lies within 300' of the Kings Run stream which is
designated as a protected water by the Protected Waters Inventory Map of Olmsted
County. The shoreland district states that impervious surface coverage of the area of the ROCHMER OFFIC
lot and/or lots within this district must not exceed 25% of the area.
717 Third Avenue'.
Our site currently proposes approximately 63% (37,982 s.f.) of the total lot area as
impervious surface. We believe a variance should be granted to allow this increase in
impervious area based on the following information: Rochester, MN ss9c
1) This lot was conceived as part of a Special District which was approved in
1992. The approved final site plan for the Northwest Plaza indicated a
5,000 s.f commercial building on a 1 acre +/- lot. The bank site proposes
a 6,000 s.f. building on a 1.38 acre lot.
507-288-646
Fax 507-288-505
The shoreland district was adopted in January of 1995. The adoption of
the shoreland district, and its' 25% impervious restriction, essentially
made the lot undevelopable for many of the permitted uses established for
in the Special District (B-4 permitted uses). MASON clry oFFIc
2) In June, prior to closing on a loan to purchase the property, Merchant's 51 s-424-634
National Bank requested a reliance letter relating to the status of the
property's zoning. The letter the bank received indicated that the property Fax 515-424-035
was subject to the regulations of the special zoning district of which it is a
_ Equal Opportunity Emplol
part. The letter also indicated that the property was partially within the
100 yr. flood zone.
The letter did not however, mention that the property was subject to the
shoreland district regulations, a separate overlay district similar to that of a
floodplain zoning district. Given the information that the letter did put
forth it would seem appropriate to have mentioned the shoreland zoning.
Consequently the potential owner purchased the land without full
knowledge of the status of the zoning on the property, which in this case
significantly affected the buildability of the site.
3) The spirit of the shoreland district is to protect the quality of our
communities' public waters. We are proposing a water quality pond on
the site to mitigate silt and other pollutants generated by human use that
the development of this property might generate. The capacity of the pond
is summarized on the plan sheets which are part of the final site plan
submittal.
It is our belief that items #1 and #2 above have created unnecessary hardships unique to
this property and that we are meeting the spirit of the ordinance by installing a water
quality pond. We are therefore requesting a variance to the 25% maximum impervious
area to allow for 64% (38,400 s.f.) impervious area on this site.

Re: Variance and Final Plan Amendment Review
Merchants National Bank - NW Plaza
Rochester, Minnesota LANDSCAPE ARCHITECTS
PLANNERS
Dear Mitzi:
We have the following clarifications and/or responses to your review comments on the
Merchant's Bank project.
Item 41 The building has a 6,000 square foot main level "footprint" and a full ROCHESTER OFF[
lower level. Thus, the entire finished building will consists of 12,000
square feet of gross building area. This should not affect any F.A.R. 717 Third Avenue
restrictions, since the allowable floor area in the guideline B-4 Zoning
District will allow up to 30,000 square feet of building area. Rochester, MN 55s
Item #2 Trash area screening will be accomplished by an 8' high brick masonry 507-288-64
enclosure to match the building and screen if from public view. A copy of
our preliminary design is enclosed for your review. Fax 68-5C
Item 93 An auxiliary ground level sign consistent with the building design is -
anticipated. The sign face will be double sided, approximately 36" high x
10' long and internally illuminated. The base will be of brick masonry and
will be surrounded by low-level ground cover landscape material. A copy
of our preliminary design is enclosed for your review.
MASON CITY OFFII
Hopefully, Mitzi, these items answer your concerns on these design issues. Please let me.
know if you have any questions. In the meantime, we look forward to seeing you at 641424-63
tonight's Planning Commission meeting.

Type III. Phase II Final Site Plan Amendment #00-04 by Merchants National Bank to allow
the construction of bank facility on part of Lot 4 Block 1 Northwest Plaza Subdivision_
The applicant is also requesting a variance to Section 62.1008 of the Rochester Zoning
Ordinance and Land Development Manual on the amount of impervious surface
coverage. The property is in the Arboretum Special District and is located south of 55'
Street NW north of the Econo Foods store.
Ms. Mitzi Baker presented the staff report, dated January 19, 2001, to the Commission. The
staff report is on file at the Rochester -Olmsted Planning Department.
Ms. Baker stated that the property is located in the Shoreland District and is subject to
shoreland regulations. She explained that the Oppidan site previously had a final site plan
approved for the entire center. Therefore, that is the difference between that request and
Merchants National Bank's.
Ms. Baker handed out a letter from Yaggy Colby Associates. She indicated that the letter was
prepared to address questions by staff. The letter is on file at the Rochester -Olmsted Planning
Department.
Ms. Baker stated that the findings prepared by staff did not give support to approving the
variance for impervious surface coverage. Therefore, if the Commission were to approve the
variance, they would need to modify the findings in support of their decision.
Ms. Baker stated that, after receiving the letter from Yaggy Colby Associates addressing staffs
questions, staff would recommend approval of the final site plan amendment subject to the
conditions listed in the staff report.
Mr. Werven questioned the difference between granting the current variance request from the
request by Carpet One a few weeks ago.
Ms. Baker stated that Carpet One proposed to insert a storm water quality pond to mitigate their
additional impervious surface. They were trying to treat some of the existing runoff that was
coming across that site. However, the variance was not necessary to improve the water quality.
Mr. Werven stated that it was not his interpretation, otherwise, he would not have voted to grant
the variance.
Ms. Baker stated that the Northwest Plaza Center includes a vast area of impervious surface
that exceeds the 25 percent that is allowed in the Shoreland District. She indicated that there
are driveways and roadways that drain across the road and discharge into the creek. She
indicated that the applicant would only be treating drainage from their own site.
Mr. Werven asked where the 25 percent regulation came from.
Mr. Harford stated that, when the regulation was adopted, the State did not have an NPDES
permit process for smaller developments. Since there is a stormwater plan for the City and new
%f Page 4
City Planning and Zoning Commission Minutes
Hearing Date: January 24, 2001
rules being accepted, he questioned if it was still the most appropriate way to address
stormwater runoff.
Ms. Wiesner asked if the 25 percent was based on the special arboretum or Shoreland District.
Ms. Baker responded it is a requirement of the Shoreland District.
Discussion ensued regarding what area the 25 percent regulation included.
Ms. Baker stated that the City of Rochester developed an overall Stormwater Management Plan
for the City. However, the City has not adopted the Plan. She indicated that Bob Bezek, of the
DNR, stated that, if the City were to adopt the Plan as a formal document, the DNR would be
willing to look modifying some of the shoreland regulations.
Ms. Petersson asked if the City made any plans to adopt the Stormwater Management Plan.
Ms. Baker responded that she was not aware of plans to do so but that Ms. Petersson might
want to speak with the Council members.
Ms. Petersson stated that she would follow up with the Council.
Mr. Werven asked staff to comment on Mr. Feece's letter on pages B28 and B29 of the staff
report. He indicated that the letter responds to staff's findings regarding reasonable use,
absence of detriment, and minimum variance.
Ms. Baker made the following comments with regard to Mr. Feece's letter:
She stated that comment #1 summarized that the special district was approved in 1992.
She indicated that there were some approvals for the overall project that occurred before
the Shoreland Ordinance was adopted. She explained that it was the only parcel, within
the Northwest Plaza Shopping Center, that is subject to the Shoreland District
regulations. The other parcels are either too far outside the shoreland boundary or they
are properties for which final site plans were approved.
2. She explained that comment #2 was in response to a letter received by staff providing
information about the property. She explained that the letter is prepared to highlight the
things they may need brought to their attention. She stated that staff might have
overlooked, in the staff letter, that the property was subject to Shoreland District
regulations. She explained that, by not disclosing that the Shoreland Overlay District
applies to the property, it does not mean that it does not apply. She stated that the
entire Land Development Manual and Zoning Ordinance applies to the property.
3. The purpose of the Shoreland District is primarily to protect water quality. By putting a
stormwater quality pond on the site and by mitigating the impacts of the increased
impervious surface, the applicant seemed to be addressing that goal.
Mr. Chris Colby, of Yaggy Colby Associates, addressed the Commission. He indicated that
John Doyle, President of Merchants National Bank, and Todd Cortus and Charlie Brown, were
present to represent the bank.
Page 5 . •
City Planning and Zoning Commission Minutes
Hearing Date: January 24, 2001
Mr. Colby stated that the building is a 6,000 square foot building. It is a one-story building. He
explained that the upper portion is open space to give the bank lobby larger volume. He stated
that the building would also have a basement.
Mr. Colby stated that the trash area and signage were intended to match the building and
design.
Mr. Colby stated that he was under the belief that the site plan approved in 1992 included a
building in the development. He indicated that four to five years later the City did an overlay
district on something they believe was grandfathered in.
Mr. Colby stated that the seller of the land requested an explanatory letter from the Planning
Department, which missed a significant issue. He indicated that the land is virtually
undevelopable without being able to put a parking lot and building on it.
Mr. Colby explained that it is their belief that the pond meets the same intent of the Shoreland
requirements.
Ms. Wiesner asked what the parking requirements were.
Mr. Colby responded that they might have a couple additional spaces over the requirement.
Ms. Petersson asked if the applicant would be willing to plant additional canopy trees.
Mr. Colby responded that it is negotiable. He explained what the present landscaping plan was.
With no one else wishing to be heard, Ms. Petersson closed the public hearing.
Ms. Baker stated that the reasonable use finding was not drafted to be in support of the
variance.
Mr. Staver moved to approve a variance to Section 62.1008 on the amount of impervious
surface coverage to 63 percent with staff findings regarding exceptional circumstances,
absence of detriment, and with the finding that there appears to be a reasonable use for
the parcel of property, given that, without granting the variance, the lot is undevelopable.
Mr. Ohly seconded the motion.
EXCEPTIONAL CIRCUMSTANCES. A Project Development Plan was approved for
Northwest Plaza in the early 1990-s and a Final Site Plan was approved in 1992. The 1992
Final Site Plan included approved building details for Wal-Mart, Sam's Club and the
attached retail buildings along the western portion of the shopping center. That Plan
identified 5,000 s.f. of building area on each of the outiots adjacent to CR 22, but did not
include additional details. The file notes that outiots are not buildable until a final site
plan is approved.
In 1995, the City adopted Shoreland regulations, as required by the State.. These
regulations apply to lands within a certain proximity of a protected water body. Kings
Run Creek, which boarders the southern side of Northwest Plaza is listed as a tributary
stream and is now subject to Shoreland District regulations. Since the outlots did not
have final approval for specific development, staff concluded that the Shoreland
Page 6 9 •

regulations must apply if a lot is within the Shoreland Overlay District as defined by thr
Ordinance. This appears to be the only outlot within Northwest Plaza that is within the
Shoreland Overlay District and subject to the Shoreland regulations.
REASONABLE USE: There appears to be a reasonable use for the parcel of property,
given that, without granting the variance, the lot is undevelopable.
ABSENCE OF DETRIMENT: The granting of this variance request may not be materially
detrimental to the public welfare or to other property in the area. The applicant is
proposing to construct a stormwater quality pond to provide treatment of the water prior
to discharge to Kings Run Creek. -
MINIMUM VARIANCE: The applicant is requesting a variance of 38% in order to proceed
Mr. Werven expressed concern with regard to the Commission not receiving appropriate
information to make important decisions. He expressed confusion with following State laws
and/or a policy the City may adopt as a formal Stormwater Management Plan.
Ms. Petersson responded that she would contact the City Council to discuss adopting the
Stormwater Management Plan.
The motion carried 7-0.
Mr. Ohly moved to recommend approval of Type III, Phase 11 Final Site Plan Amendment
#00-04 by Merchants National Bank with staff findings and conditions. Mr. Staver
seconded the motion.
Ms. Petersson asked if the motion included the addition of more canopy trees. If not, she asked
that the motion be amended.
Ms. Baker explained that the motion would need to be amended by the person who made the
motion.
Discussion ensued regarding where present landscaping is planned and where additional
canopy trees could be located.
Mr. Slaver stated that the Ordinance states what the standards are for landscaping. Therefore,
he questioned if the Commission had the ability to arbitrarily place them where they want them.
Ms. Baker stated that staff has encouraged a higher standard of vegetation for certain
developments.
Mr. Ohly moved to reopen the public hearing. Mr. Staver seconded the motion. The
motion carried unanimously.
Mr. Chris Colby addressed the Commission. He indicated that he would be in agreement with
the condition of adding five additional overstory trees, with the location to be determined by the
designer of the property on the landscaping plan.
Page 7 , .
City Planning and Zoning Commission Minutes
Hearing Date: January 24, 2001
With no one else wishing to be heard, Ms. Petersson closed the public hearing.
Mr. Adkins explained that the Commission could amend the original motion by general
consensus.
By general consensus, the Commission agreed to amend the original motion to add —a
condition that five additional overstory trees be added to the landscaping plan. The
location to be determined by the designer of the property.
The motion carried 7-0.
CONDITIONS:
1. An approved grading/drainage plan is required prior to construction. Storm Water
Management must be provided, and a fee will apply for voluntary participation in the
City's regional Storm Water Management Plan if the proposed on -site water quality
pond is not sized to address the stormwater volume for the entire site.
2. An additional fire hydrant shall be installed on -site, per the requirements of the
Rochester Fire Department. Extension of any public utilities will require approved
construction plans, easements and execution of a City -Owner Contract.
3. Prior to development, the applicant shall execute a Maintenance and Ownership

Substantial Land Alteration:
This application includes a request for approval of land disturbing activities defined as Substantial
Land Alteration according to Section 62.1101, B of the Rochester Zoning Ordinance and Land
Development Manual. Section 62.1102 of the LDM allows the City to consider a request for
excavation or substantial land alternation as part of a Type III application, such as a final plat,
subject to making findings established in Sections 62.1105 and 61.146 of the LDM.
This development includes a proposal for cut and fill work which involves a grade change of 10-
feet or more from the pre-existing grades.. The areas where the grade is proposed to be
changed more than 10 feet is found on Lots 6 — 10, Block 1 and Lots 9 —15, Block 5.
Sections 61.146, 62.1102 and 62.1105 of the LDM are attached.
Staff Suggested Findings:
If the City Council approves the proposed substantial land alternation, staff recommends
the following findings to Sections 62.1105 and 61.146 of the Rochester Zoning Ordinance &
Land Development Manual:
62.1105
1) The activity should not result in danger to life or property. The slopes on the west edge of the
development will be designed with a maximum slope of 3:1. The grading and drainage plans
will need to comply with City standards and be approved by the Rochester Public Works
Department.
2) The grading plan for this project needs to be approved by the Rochester Public Works
Department and it will document the extent of the work. All cut material will be used to fill in
the low area of the site. Noise and dust control will need to comply with City standards.
3) The equipment conducting the grading work on the property will also be the equipment utilized
to move the earth. All excess material will be used on the site so no additional trucks will be
necessary for the excavation work.
Page 4
Wedgewood Hills 41h Subdivision
February 14, 2001
4) The proposed excavation work should not affect air quality or ground and surface water
quality.
5) The proposed grading work should not adversely affect the scenic quality of Rochester.
There will not be any steep slopes or exposed rock faces. The natural topography of the area
will be re -graded to provide adequate slopes for dwellings.
6) The result of the proposed activity will be compatible with existing development and
development anticipated in the future. The finished result of the grading work will allow for
development that is consistent with the land use plan.
7) The grading will be confined to the property and should not affect the use and enjoyment of
adjacent properties. The duration of the excavation activity is expected to be completed in
phase 1 of the project taking approximately 6 weeks.
8) The grading activity will only take place during the construction of the roadways and buildings
pads that are planned for the site. The grading is expected to be completed in approximately
6 weeks.
9) The grading and drainage plan will need to provide the proper restoration and stabilization in
accordance with the adopted codes for the City of Rochester.
10) The grading and drainage plans will need to be reviewed and approved by the City.
Stormwater management will be provided for the development.
11) The areas of grading does not contain sinkholes or wetlands and should not effect the ground
water or surface quality once restoration and stabilization is completed.
12) The grading work is expected to be completed in approximately 6 weeks. The duration
seems appropriate for this type of activity and the size of the project.
13) The Rochester Public Works Department will need to review and approve the grading and
drainage plan for this work. This plan must accommodate permanent and interim erosion and
sediment control.
14) Surety will need to be provided that guarantees the site will be fully restored after the
completion of the excavation activity. This surety can be provided through the owner contract
process for this development. If grading is to happen prior to the Owner Contract, a separate
means of surety will need to be provided.
15) The grading and drainage plan will need to be approved by the Rochester Public Works
Department prior to any grading on the property
The Planning Staff would suggest the following findings for Section 61.146:
1) Not applicable
2) Not applicable
3) Not applicable
4) The Rochester Public Works Department will need to review and approve the grading and
drainage plan for this work. This plan must accommodate permanent and interim erosion and

Desiqn Modification:
The applicant is also requesting a design modification to the requirement of Chapter 64
(specifically 64.227) of the Rochester Zoning Ordinance and Land Development Manual. Section
64.227 requires mid -block pedestrian connections across any block exceeding 800 feet in length.
Section 64.227 Trail Thoroughfares and Sidewalks:
Trail thoroughfares and sidewalks are a vital element of the Citys transportation system —
providing access throughout the City for pedestrians and bicyclists, reducing traffic congestion,
facilitating access to the transit system, and reducing emissions from automobiles. Unless
otherwise exempted by these regulations, all new development shall provide sidewalk and trail
thoroughfare improvements that are consistent with the City's adopted Thoroughfare and
Sidewalk, Bike Path and Pedestrian Facilities Plan.
A. In addition to trails designated in the City's adopted Plans, the City shall require dedication
of trails needed to maintain connectivity between and through subdivisions under each of
the following circumstances, except where unique topographical conditions make the
trails unfeasible:
1. Across any block exceeding 800 feet in length;
2. Between lots on a cul-de-sac or dead end street that abut a collector or arterial
road. No more than one trail shall be required per cul-de-sac; or
3. Across any block exceeding 600 feet in length which abuts a school or park site.
The applicant's consultant has stated that the land to the south is not planned for residential
development or active /passive open space. The area to the south is proposed to become a
regional detention pond. Both the City Public Works Department and Park and Recreation
Department have no concerns with waiving the requirement for the mid -block pedestrian
connection for this subdivision Staff would recommend approval of the design modification.

61.147 Conditions on Approval: In considering an application for a development permit to allow a Conditional
Use, the designated hearing body shall consider and may impose modifications or conditions to the extent
that such modifications or conditions are necessary to insure compliance with the criteria of Paragraph
61.146.
60.420 DESIGN MODIFICATIONS:
It is the intent of this ordinance to recognize that in certain instances it may be in the
public interest to provide an expedient method to modify the site design and public
facility standards of this ordinance as applied to certain types of development.
60.421 Purpose: The purpose of the design modification is to permit relief from the strict
application of ordinance standards where there is no defined hardship, the proposed
modifications will not result in identifiable loss of protection to adjacent properties, or
where the proposed development results in an improved design solution to a site design
problem and in doing so, still meets the intent of the site design or public facility
standards. Guidelines are provided for the approval authority to assess the impact of
the proposed design modification.
This ordinance also provides for certain types of development identified as incentive
development and restricted development which, though not consistent with normal
zoning district standards, will be permitted in certain instances. These developments
are supported by the Land Use Plan, but may necessitate relaxation of certain design
standards in order to meet site constraints. Design modifications will be considered as
part of the normal review of these developments, subject to standards established in
this section.
60.422 Review of Design Modifications: Design modifications will be processed through
either the Type I or Type II review procedures, according to the guidelines established
in this section. Where a design modification request accompanies a permit or
certificate request that requires processing through a Type III review procedure, the
request shall be considered by the Commission and Council as part of the Type III
review.
60.423 Guidelines for Approval: The following paragraphs identify specific policies or
standards for each type of design modification permitted by the Ordinance. The
approval authority shall consider these policies or standards in making the findings to
approve or deny a request for a design modification. In addition, the following
standards shall apply to all requests for Type II Design Modifications:
1) The burden shall be upon the applicant to show the design solution will result in an
improved use of land while preserving the purposes for which the original regulation
was enacted.
2) Any such modification shall consider the relationship of the development to its
surroundings and shall avoid creating any adverse effects due to noise, traffic
circulation, building height or bulk or lack of screening.
Page 10
Wedgewood Hills 4th Subdivision

60.424 Specific Policies: The following paragraphs contain the guidelines applicable to
specific types of design modifications which shall be considered by the approval
authority.
9) Public Facility Standards:
a) Modification to the requirements of Chapter 64 may be approved as part of the
review of any General Development Plan, land subdivision permit or final plat
where the applicant can show by reason of exceptional topography or any other
physical condition that strict compliance with these regulations would cause
undue hardship or that such relief would not be a detriment to the public welfare
and would not impair the intent and purpose of the regulations.

RE: Exemption from Section 62.1101.2 (a) for Wedgewood Hills Fourth
Consulting - Civil Engineering
Dear Ms. Baker.
Geotechnical Engineering
Section 62.1101 of the Rochester Land Development Manual and Zoning Ordinance
contains new standards for substantial land alteration projects. The grading of the
Wedgewood Hills Fourth site will result in exceeding a 10-foot vertical
Construction Material Testing
cut and a 10-
foot vertical fill over various portions of the site. This project meets the definition of
Section 62.1101.2.a.1(d) where the cut/fill involves a grade change of 10-feet
Landscape Architecture
or more
from the pre-existing grades. The enclosed grading plan indicates the cut and fill
areas on the site. The maximum extreme cut would be approximately 16', which will
occur on the southeastern portion of the site and also on the north side in the middle of
the site. (See grading plan.)
Section 62.1102. LF provides for an exemption provided there are sufficient findings
made as contained in 62.1105. The following are suggested findings in support of the
request:
62.11050-15).
1. The activity necessary to grade the portions in excess of 16-foot vertical
cut/fill will not result in unstable slopes or unsafe access. The slopes on the
site will be a maximum of 3:1 and only a small portion of the grading would
involve a 16-foot cut. The cut/fill areas are not adjacent to a planned park
area.
2. The environmental impacts of grading on this site to adjacent properties will
be minimal because there is vacant land on the south side of the property.
3. There is access to the site from the west and the east. It will not be necessary
to truck in fill or haul fill off of the site, so that will minimize the impact on
the surrounding roads.
4. The additional grading will not adversely affect air quality, the ground water,
or surface water quality.
5. The natural topography of the area will be re -graded to provide adequate
slopes for single - family dwellings for this development and future -single- —
family developments planned in the General Development Plan, by[ - I' Vj Lc
overall scenic quality will be maintained. - - - -

6. The grading is compatible with the proposed adjacent neighborhood
developments.
7. The grading will be confined to the Wedgewood Hills site, and will not
unduly affect the use and enjoyment of adjacent properties.
8. The grading activity will take place in 1 phase taking approximately 6 weeks.
There are homes in the immediate area that will be visually affected by the
grading activity for only a short time during the grading process.
9. The grading plan will provide for proper restoration stabilization in
accordance with the codes for the City of Rochester.
10. The grading will not result in negative impacts on the drainage patterns. The
grading of the site is such that run-off is directed to appropriate locations in
the street and handled through the City storm water plan.
11. The area of grading does not contain sinkholes or wetlands and will not affect
the groundwater or the subsurface water quality once restoration and
stabilization is completed.
12. The grading of the site will take place in 1 phase taking approximately 6
weeks. This time frame is appropriate for the size and location of this
activity.
13. Permanent and interim (during construction) erosion/sedimentation control
will be provided for in the grading plan. The city will review and approve
this grading plan.
14. A performance and payment bond is required for all work associated with the
construction of the public improvements. This bond will be submitted with
the owner/contractor.
15. This development will comply with the standards in the Land Development
Manual and on file with Public Works.

Land Surveying RE: Design Modification for Wedgewood Hills Fourth
Urban - Land Planning Dear Mr. Svenby,
Consulting - Civil Engineering On behalf of our client, Leslie A. Lurken, we are requesting a design modification to the
requirement of a mid -block connection for the Wedgewood Hills Fourth Subdivision.
Geotechnical Engineering
The following reasons are given to support the request for the design modification:
Construction Material Testing
1. Due to the slopes and potential wetlands that occur on the property to the south, it
Landscape Architecture does not lend itself to become an affordable residential development. Servicing
this property with public utilities for any future development is also a problem
due the change in grade. The only location that may have a very short cul-de-sac
to the south is the end of 52°d Avenue N.W.
2. The property to south is proposed to become a regional storm water detention
facility for the city of Rochester. After talking to Mr. Mike Nigbur from
Rochester Public Works, it was decided that they do not require the mid -block
connection leading to this facility.
3. The property to the south will not become an open recreation space for the
residents of the surrounding subdivisions. At the intersection of 52"' Avenue
N.W. and 51" Street N.W., there is a sixty -foot park access, which leads to a six -
acre park for the residents of the Wedgewood Hills Subdivision and other
adjacent subdivisions.
Because the property to the south is not planned for residential development nor active/
passive open space, we do not feel that there is a need for a mid -block connection for the
Wedgewood Hills Fourth Subdivision or future Wedgewood Hills additions.

Location of Property:
The property is located along the east side of 4e
Avenue SE, east of Eastwood Hills Second
Subdivision.
Zoning: The property is currently zoned R-2 (Low Density
Residential) District on the City of Rochester Zoning
Map.
Proposed Development: This development consists of 5.6 acres of land to be
subdivided into 2 lots to be developed with
townhomes. The plat is a replat of Outlot A of Valley
Side Estates.

Streets: This plat dedicates right-of-way for one new roadway
"Mallard Court". The right-of-way being dedicated
has a width of 56 feet with a roadway surface of 32
feet. The roadway type is incorrect and will need to
be changed to "Place". The directional of "SE" is also
needed for the roadway name.
The roadway designation should be Mallard Place
SE.
Sidewalks:
In accordance with current City policy, sidewalk is
required along both sides of all of the new streets in
the subdivision and a 10 foot bituminous trail is
required along the east side of 401" Avenue SE.
Drainage:
The elevations of this site range from 1,080' in the
southeastern portion of the plat to 1,094' in the
northeast portion of the plat. The property drains in a
southerly direction.
Stormwater will be directed toward the existing
stormwater detention pond for the Valley Side Estates
Development (Outlot D).
Wetlands:
The Soil Survey and National Wetland Indicator maps
were reviewed for the presence of wetlands. The
maps do not indicate the presence of wetlands on this
property.
Public Utilities:
Water and sewer services will need to be extended to
serve this development. The public improvements
construction plans have been approved for this
development.
Spillover Parking:
The proposed roadway is adequate to accommodate
some of the required spillover spaces. Additional
spillover spaces will likely be accommodated within
the driveways and the parking bays for the
development.
Parkland Dedication:
This replatting does not required additional dedication
of parkland. Parkland was dedicated when Valley
Side Estates was platted. The applicant will need to
provide private recreation space for the townhomes.
General Development Plan:
The Council approved a General Development Plan
for this property on April 3, 2000. On September 6,
2000 the Council approved an amendment to the
GDP which is consistent with the layout of this final
plat.

Preliminary Plat.
A preliminary plat for this property was approved by the City Council on October 2, 2000 with the
following conditions:
The following revisions be made to the plat:
The roadway being dedicated be named. The Planning Department Addressing
Staff will need to be contacted regarding an appropriate name.
The controlled access be labeled along 40" Avenue SE.
➢ Easements be dedicated for the public utilities located outside of the public street
right of way. The minimum width of these easements shall be 20 feet
2. The roadway intersection near the east edge of the plat must intersect perpendicular to
the intersecting street.
3. The applicant is required to provide a watermain extension to the adjoining property to
the north through Outlot B.
Final Plat.
Planning Staff Recommendation:
The Planning Staff has reviewed the submitted final plat and finds that it is consistent with
the approved preliminary plat. The staff would then recommend approval subject to the

RE: THE VILLAS OF VALLEY SIDE
A review of the final plat has turned up the following address related issues:
1. Mallard Court is using the incorrect roadway type and the directional is missing.
RECOMMENDATION: Change Mallard Court to MALLARD PLACE, (as was agreed to during work
on the Performance Residential Development #00.33) and add the directional of SE. So the final roadway
designation should read MALLARD PLACE SE.

February 13, 2001
City Planning and Zoning Commission Recommendation:
The City Planning and Zoning Commission reviewed this annexation request on January 24, 2001 and found that the area proposed for
annexation is 100% surrounded by the City of Rochester. Minnesota Statutes 414.033, Subdivision 2(2) allows a municipality to
annex, by Ordinance, lands that are 100% surrounded by the municipality. The Planning Commission therefore recommends approval
of this request.
Ms. Wiesner moved to recommend approval of the City Council initiated Annexation #01-01, as
recommended by staff. Mr. Hodgson seconded the motion. The motion carried 7-0.
Planning Department Recommendation:
See attached staff report, dated January 18, 2001.
Minnesota Statutes now specify that the property taxes payable in the year an annexation is effective shall be paid to the Township.
For the five years following the annexation, the City must make a cash payment to the Township equaling 90%, 70%, 50%, 30% and
10% of the Townships share of the taxes in the year the property was annexed. The Township Taxes on the property for 2000 are
$202.44.

A Traffic Impact Study for the Northwest Plaza Shopping Center was completed

National Hank
have been platted. Due to the changes in floor areas that have occurred as areas of
the center have been developed or redeveloped, staff has requested updated traffic
data be provided for the 55`h St intersection in order to allow staff to monitor
whether the assumptions in the initial TIR are still valid.
Preliminary analysis suggests that this section of Circle Drive will suffer from
highly congested conditions in the future as development continues to occur west
of the North Park area, north of 55'h St on the east side of TH 52, and along West
Circle Drive south of the Douglas Trail overpass.
To address this issue the Circle Drive Traffic Study will be looking at options for
minimising the number of signalized intersections needed as well as redesign
options for the TH 52/Circle Drive interchange to provide for higher capacity
operations. One concept that may be considered is the consolidation of the 55ih St
intersection with the next intersection planned to the southwest (48d' St) at a single
Showing Center with the new consolidated access location.
