Home My WebLink AboutResolution No. 186-26 - Resolution - Ordinances Updates Resolution for SWQT Credit transfer program RESOLUTION Adopting a resolution establishing amendments to Title 6 – Environment, Chapter 6-4.– Stormwater Discharges, Section 6-4-12. – Stormwater management criteria. WHEREAS, the proposed amendments to Section 6-4-12 establish that all off-site stormwater water quality treatment projects required or approved under the section must be implemented through the City's adopted Stormwater Water Quality Treatment Credit Transfer Program and comply with the Council-adopted Stormwater Water Quality Treatment Credit Transfer Policy, applicable implementation procedures, and state and federal regulatory requirements; and WHEREAS, the proposed amendments require stormwater water quality treatment credit transfers to use the transfer ratios established in the Council-adopted Policy, which account for the location of the credit-generating site relative to the site receiving the treatment credit and are intended to provide a net water quality benefit; and WHEREAS, the proposed amendments provide that stormwater water quality treatment agreements and associated credit transfers approved before January 1, 2027, may continue under their original terms and conditions, including applicable transfer ratios, unless redevelopment or modifications require new or amended stormwater approvals; and NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester, Minnesota, that the City Attorney is authorized and directed to conduct the first reading of the proposed amendments to Section 6-4-12 at the November 2, 2026, City Council meeting and the second reading at the December 2, 2026, City Council meeting.
