RESOLUTION
Approving Final Plat No. CD2026-024PLAT, To Be Known As Pebble Creek Seventh,
A Project Consisting Of 100 Residential Lots and 8 Outlots On 14.98 Acres, Located
at the Southwest Corner of 55th St. NW and 60th Ave NW.
WHEREAS, DRP MN 3, LLC., has requested from the City of Rochester Final Plat
approval for a subdivision to be known as Pebble Creek Seventh.
WHEREAS, the Final Plat proposes 100 Residential Lots and 8 Outlots, on 14.98 acres
of land located at the southwest corner of 55th St. NW and 60th Ave NW.
WHEREAS, on September 30, 2026, the City of Rochester Planning and Zoning
Commission considered the Final Plat application for the development, adopted the
findings of fact, and recommended approval the Final Plat, subject to two conditions.
WHEREAS, the Council adopts the findings as described within Community Development
memo dated September 30, 2026, and finds the proposal meets the criteria in R.C.O §
60.500.040 (subd. H) Final Plat.
WHEREAS, on October 19, the City of Rochester Common Council held a public hearing
to consider a Final Plat application for the development, adopted the findings of fact, and
approved the Final Plat subject to two conditions.
NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester,
at a public hearing duly noticed and held on October 19, 2026, the following plat of lands in
Olmsted County, Minnesota is to be known and designated as follows:
That part of the East One-Half of Section 13, Township 107 North, Range 15 West,
Olm hat part of the Northeast Quarter of the Northeast Quarter of Section 13, Township
107 North, Range 15 West, Olmsted County, Minnesota, described as follows:
Commencing at the northeast corner of the Northeast Quarter of said Section 13;
thence South 89 degrees 50 minutes 41 seconds West (NOTE: All Bearings are in
relationship with the Olmsted County Coordinate System NAD '83, Adjusted 1996),
along the north line of said Northeast Quarter, 100.00 feet to the northwest corner of
Outlot ‘A’, PEBBLE CREEK, according to the recorded plat thereof, for the point of
beginning; thence South 00 degrees 08 minutes 24 seconds West, along the west line
of said Outlot ‘A’, 796.09 feet to the northeast corner of PEBBLE CREEK FIFTH,
according to the recorded plat thereof; thence North 89 degrees 51 minutes 36 seconds
West, along the north line of said PEBBLE CREEK FIFTH, and along the north line of
said PEBBLE CREEK, 596.00 feet to the east line of Outlot B, PEBBLE CREEK
FOURTH, according to the recorded plat thereof; thence North 00 degrees 08 minutes
24 seconds East, along the east line of said Outlot B, 133.50 feet to the northeast
corner thereof; thence North 89 degrees 51 minutes 36 seconds West, along the north
line of said Outlot B, 202.00 feet; thence North 00 degrees 08 minutes 24 seconds
East, 68.55 feet; thence North 04 degrees 08 minutes 24 seconds West, 67.38 feet;
thence North 06 degrees 51 minutes 36 seconds West, 67.98 feet; thence
southwesterly, 17.64 feet along a non-tangential curve, concave northwesterly, having
a central angle of 03 degrees 21 minutes 29 seconds, a radius of 301.00 feet, and the
chord of said curve bears South 68 degrees 35 minutes 52 seconds West, 17.64 feet;
thence North 19 degrees 43 minutes 24 seconds West, not tangent to said curve,
219.27 feet; thence North 46 degrees 43 minutes 15 seconds East, 95.29 feet; thence
North 13 degrees 55 minutes 37 seconds East, 50.43 feet; thence North 00 degrees
08 minutes 24 seconds East, 140.90 feet to the north line of the Northeast Quarter of
said Section 13; thence North 89 degrees 50 minutes 41 seconds East, along said
north line, 821.00 feet to the point of beginning.
ALSO:
That part of Outlot B, PEBBLE CREEK FOURTH, according to the recorded plat
thereof, Olmsted County, Minnesota, described as follows:
Beginning at the intersection of the east line of said Outlot B and the north line of
PEBBLE CREEK, according to the recorded plat thereof; thence North 00 degrees 08
minutes 24 seconds East, along the east line of said Outlot B, 133.50 feet to the
northeast corner thereof; thence North 89 degrees 51 minutes 36 seconds West, along
the north line of said Outlot B, 202.00 feet; thence South 00 degrees 08 minutes 24
seconds West, 37.31 feet; thence South 44 degrees 48 minutes 07 seconds East,
135.90 feet to a line which bearsNorth 89 degrees 51 minutes 36 seconds West from
the point of beginning; thence South 89 degrees 51 minutes 36 seconds East, 106.00
feet to the point of beginning.
Containing, in all, 14.98 acres, more or less
TO BE KNOWN as “Pebble Creek Seventh”, by DRP MN 3, LLC., Applicant, is hereby
approved, and all dedications of land or interests in land for public purposes as shown on
said plat are hereby accepted, subject to the follow conditions:
1. Prior to execution and recordation of the final plat mylars, execution of a City
prepared Maintenance Declaration is required as specified in the Development
Agreement.
2. Prior to execution and recordation of the final plat mylars, the applicant shall
dedicate land or a park easement (or easements) totaling 6.89 acres as identified
in the Parks and Recreation Department Memo to the satisfaction of the Parks &
Recreation Department.
