AN ORDINANCE CREATING AND ENACTING SECTIONS 42.12, 42.13 AND 42.14, AMENDING AND REENACTING SUBDIVISIONS 2 AND 3 OF SECTION 42.01, AND SECTIONS 42.02, 42.03, AND 42.04, AND REPEALING SECTIONS 42.05 AND 42.06 OF THE ROCHESTER CODE OF ORDINANCES, RELATING TO GROUND TRANSPORTATION AT THE ROCHESTER INTERNATIONAL AIRPORT. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Section 42.12 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: 42.12. Registration of Ground Transportation Carriers. No business or person shall provide ground transportation services to the Airport without first registering with the Airport Executive Director and providing the following: A. Identify whether the registrant is an individual, corporation, partnership or other form of organization. B. Provide the name of a contact person and the address, phone number, and email address for that person. C. Identify registrant's vehicles that will be used to provide ground transportation carrier service by year, make, model, and license number. D. Execution of an airport transportation provider agreement if deemed necessary by the Rochester Airport Company. Section 2. Section 42.13 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: 42.13. Airport Access Fee. Every business or person providing ground transportation carrier service to the Airport shall pay a per trip airport access fee each time one of its vehicles is driven to the Airport to pick up or drop off a passenger. This fee may be collected from the passenger. The Council shall establish the amount of fee by resolution. For taxicabs charging a flat rate fee for service between the Airport and the Downtown District as defined in 95A.16, the airport access fee shall be included within that flat rate fee. It shall be the responsibility of the business or person providing ground transportation carrier services to keep a daily manifest upon which shall be recorded each time that business or person arrived at the Airport to pick up or drop off a passenger. All trip fees shall be paid monthly and not later than the fifth day of the following month. A copy of the manifest shall be presented with payment. Section 3. Section 42.14 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: 42.14. Violations; Registration Revocation. It shall be a misdemeanor for any business or person to provide ground transportation carrier services without first being registered, except that the first violation shall be a warning. It shall be a misdemeanor for any business or person providing ground transportation carrier services to fail to pay the monthly per trip access fees in a timely manner. Section 4. Subdivision 2 of Section 42.01 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: Subd. 2. "Airport" means the Rochester International Airport in High Forest Township, Olmsted County, approximately 9 miles south of the city. Section 5. Subdivision 3 of Section 42.01 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: Subd. 3. "Airport Executive Director" means the person authorized by the city to manage the airport. Section 6. Section 42.02 of the Rochester Code of Ordinances is hereby amended and reenacted to read as follows: 42.02. Regulation of Parking. The council by written resolution may regulate parking on the airport; establish, locate and relocate loading zones for ground transportation carriers, trucks, and for use by the general public; provide special parking areas for vehicles available for hire on a rental basis; and impose parking fees. In regulating parking on the airport the council shall take into consideration the needs, conveniences, safety and welfare of the traveling public; the amount of public ground transportation needed to meet the requirements of the public; the needs and regulations of the airlines operating through the terminal buildings; the efficient and orderly operation of the terminal building and the airport; the safe, orderly and efficient movement of the public into, through, and out of the terminal building and the airport; traffic hazards involved; and such other considerations as relate to the matter of parking. Section 7. Section 42.03 of the Rochester Code of Ordinances is hereby amended and reenacted to read as follows: 42.03. Regulation and Procedure. The following provisions of the code shall apply to the airport and shall govern the parking of vehicles and conduct of persons on the airport, and any references in said sections to streets or parts of streets shall be deemed also to refer to the airport or any part thereof: 134.29 (limited parking zones), 134.31 (removing marks), 134.40 (collections), 134.43 (impounding), 134.44 (tampering with vehicles), 134.47 (prima facie evidence of violation), and 134.48 (council to designate zones). Section 8. Section 42.04 of the Rochester Code of Ordinances is hereby amended and reenacted to read as follows: 42.04. General Parking Limitations. It is unlawful for any person, except for drivers of authorized airport operations/maintenance vehicles and emergency vehicles, to park a vehicle on the airport in any place where such parking is prohibited, or for a longer consecutive period of time than is designated for such space on the signs or markings posted, painted or erected in the area, or in any place regulated by a parking meter except in accordance with the parking instructions set forth on the parking meter instruction plate or on signs erected or painted in the area. Section 9. Repeal. Sections 42.05 and 42.06 of the Rochester Code of Ordinances are hereby repealed. Section 10. Effective Date.
