Minutes of a special meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in said City, on
September' 12th, 193g.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman.
Absent: Williams.
The call for the special meeting was read and President-Lemmon ordered,that
the same be.placed on file; said meeting having been. called for the purpose of
acting upon a telegram from R.A.Radford. regarding W.P.A.application for sewage
, ,
disposal plant, and any other business the said Common Council might deem proper.
The City Clerk repo-rted. receipt of the following telegram which was read,
and President Lemmon ordered that the same be placed on file:

Mr. Joe Bean was. before the Council regarding the petition for a sanitary
sewer on Seventh Avenue Northwest from Seventh Street to Tenth Street Northwest
and President Lemmon informed him that said petition was now in the hands of
the Sewer Committee and the City Engineer,
Alderman Amundsen introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That under and in accordance with Section 354 Mason Statutes for 1927, the
following places and' locations are hereby designated as the places for the.hold-
ing of elections in each of the following described districts:
In the Garage building at the Northeast corner of the intersection of Third
Avenue and Tenth Street Southeast, known as No.952 Third Avenue Southeast, in
the' First Election District of the First Ward; -
In the Hawthorne School building between Fourth Avenue .Southeast and* Fifth
Avenue Southeast and Seventh Street Southeast and Eighth Street Southeast, in
said City, -in the Second Election District of the'First Ward;
In the Pumping station building of the City of Rochester, Water Department,
at 323 Fourth Street Southeast, in the Third Election District of the First. Ward;
In the New Central Fire Station at the Northwest comer of the intersection
of Broadway Street South and Sixth Street Southwest, in said City, in the Fourth
Election District of the First Ward; ,
In the Edison School building between'Sixth Street Sout.hwest and Seventh
Street Southwest and between Sixth Avenue Southwest and Seventh Avenue Southwest,
in said City, in the Fifth Election District of the First'War.d;
In the basement of that building known as the Holmes School Annex located
at No-7 Eleventh Avenue Southeast,in said City, in the First District of the
Second Ward;
In the Hotel Edward, located at Nos. 101-103 ¢enter Street East, in said
City, in the Second Di strict of the, Second. Ward;
In the so called Community roo;n in the new'City Hall,in said City, in the

In the lobby of the Olmsted County Courthouse, in said City,in the Fourth

Fifth District of the Second Ward;
In the building at the rear of No.203 Eleventh Avenue Northeast, in said
City, in the First District of the Third Ware;
In the building known as the Minnesota National Guard Armory located. at
.Nos. 119, to 123. Ero_adway Street North, in said. City, in the Second District of
the Third Ward;
In the garage building at the rear of 209 Seventh Avenue Northwest,in said

west, in said City, in the Sixth District of the Third Ward;
Be it further resolved by said"Common Council: That all resolutions and
parts of resolutions inconsistent herewith are hereby repealed. "
Upon motion by Fryer second. by Richman,that the said resolution be adopted I
as read, and upon roll call all members voting in favor thereof, President
Lemmon declared the. said resolution duly passed and adopted.
Alderman Fryer introduced the following resolution,vrhich was read:
"RESOL.UTION DETERMINING TO ESTABLISH AND BUILD A ,
SEWAGE DISPOSAL PLANT AND A TRUNK LINE SANITARY
SEWER CONNECTING THEREWITH FOR THE CITY OF
ROCHESTE R AND TO ISSUE CITY OF ROCHESTER SEWAGE
DISPOSAL PLANT BONDS OF' SAID CITY -FOR SUCH PUR-
POSE IN THE AGGREGATE AMOUNT OF $400,000.00
WHEREAS, The`preeent sewage disposal facilities of the City of Rochester,
Minnesota are wholly inadequate for the present needs of said City, and it is
necessary that immediate measures be taken to relieve the situation by provid-
ing adequate sewage disposal facilities for said City, and that funds in the
treasury of said City available therefor are not sufficient for said purpose,
-and it is necessary to issue the bonds of said City to obtain funds therefor;

`Section 1. That it is hereby- determined that it is necessary to establish
and build a sewage disposal plant and a trunk line sanitary sewer connecting
therewith for the City of Rochester and to borrow money therefor; said sewage
disposal plant to be established and constructed on a portion of that part of
the south half (S2); of the southeast quarter (SEW) of Section twenty --tree (23)
and the north half (N2-) of the northeast quarter (NE ) of Section Twenty six
�26) Township one hundred seven (107) north of'range fourteen (14) west, which
:lies west of the river.
Section 2.' That i-t is hereby determined to issue "City of Rochester
Sewage .Disposal Plant Bonds", of said City in the aggregate amount of four
hundred thousand dollars ($4009000.00) for the purpose of establishing and -
building such sewage disposal plant, and a trunk line sanitary sewer connecting
therewith; such bonds to bear interest at a rate not to exdeed three and one
half (321%) per cent per annum payable semi-annually on January first and July
first of each year during the life of said bonds; said bonds to be dated
January first 1939, to be in denominations of one thousand dollars ($1,000.00)
each, and to mature as to principal as follows:

Section 3. That this resolution shall take effect and be in force $pon the
the same being -adopted by a vote of five -sevenths of the members of this Common
Council and the approval of three --fifths of the votes cast at, a special election
called for that purpose to be held on 'Tuesday the 27th day of September, 1939.
Upon motion by Green second,by Amundsen,that the said resolution be adopted
as read, .and upon roll call all members voting in favor thereof, President
Lemmon declared the said resolution duly passed and adopted.
Alderman Amundsen introduced the following resolution,which was read:
"RESOLUTION"
CALLING.A SPECIAL ELECTION TO BE HELD ON TUESDAY,SEPTEMBER 27th,
1538, FOR SUBMISSION TO THE LEGAL VOTERS OF THE CITY OF ROCHESTER
FOR APPROVAL OR REJECTION OF THE RESOLUTION OF' THE COMMON COUNCIL
OF SEPTEMBER 12, 1939, AND THE ISSUANCE OF CITY OF ROCHESTER SEW-
AGE DISPOSAL PLANT BONDS .IN THE AGGREGATE AMOUNT OF FOUR HUNDRED
THOUSAND DOLLARS ($4o0,000.00),PRESCRIBING THE FORM OF NOTICE OF
ELECTION AND BALLOT TO BE USED AT SAID ELECTION.
--BE IT RESOLVED BY „THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA:
Section 1. There is hereby.called a special election to be held in this
City on Tuesday the 27th day of September, 19�9, for the purpose,of submitting
to the legal voters of the said City of Rochester, Minnesota, for their approval
or rejection, the resolution adopted by this Common Council, September 12th,
1939, entitled:

'Resolution determining to establish and build a
sewage disposal plant and a trunk line sanitary sewer
connecting therewith for the eity of Rochester and to
issue City of Rochester Sewage Disposal Plant Bonds
of said City for such purpose in the aggregate amount
of $400, 000.00'

that the polls shall be kept open from nine o'clock in the forenoon until seven
o1clock.in the afternoon of said day, at the regular polling places within said
City, as set forth in the Notice of Special Election to be duly given.
Section 2. That`the City,Clerk is hereby directed.to,give notice of said
Special Electioi; ' and cause a copy of., such resolution of this -Common Council,
together with such notice of the time of holding such electio'n,-to be published
and posted as required by the Charter of said City;,that the judges and clerks
of election -in eac� precinct at the last Charter election shall continue:to be
judges''and clerks of election* at such special election;- anc that the.:same shall
be conducted, and the votes canvassed, and return thereof made in th'e` sane manner
as prescribed by law for the election of the officers of the City at the annual
Charter election. ' ' t '
Section 3. That the notice of said special election shall b4 substantially

Section 4. That the ballo-ts to be used at said election shall be printed
under the direction of the .City Clerk on lavender paper, and a sufficient number
furnished in advance to -the judges of each election district or precinct for use
at said Special Election, which ballots shall be substantially in the following

Upon motion by Richman-_ second by Green, that the said resolution be -adopted
as read, and upon roll call all members voting in favor thereof, President Lemmon
declared the said resolution duly passed and adopted.
The following claims were read, and upon #btiongby Fryer second by Amundsen
and all voting in favor thereof, the same were allowed and the Mayor and City
Clerk were authorized and directed to draw warrants upon the City Treasurer and
make payments accordingly:
From the General Fund: Edna Stewart $14.8.0, Adolph Gruszynski $25.00,
Palter Nelson $25.00, Flora C.Anderson $29.00.
Alderman --Fryer, Chairman of the Fin m ce Committee, reported orally that a
tax levy had been previously made to provide funds for the purchase of a street
sweeper for the City Engineer's Department, and that sufficient funds were now
on hand for that -purpose.
The City Engineer submitted specifications and estimate of cost for a motor
pick-up sweeper for the. City Engineer's Department; said estimate of cost for the
large size being $6900.00 and for the small size $3700.00.
Alderman Green introduced a resolution deeming it necessary that a -street
sweeper be purchased for use in City Engineer's Department, adopting the City
Engineer's specifications and estimate of cost and ordering that the same be plat(
on file in the office of the City Clerk, and ordering advertisement for bids for
furnishing same, said bids to be received and opened at 2:00 o'clock P.Mi, on
October 3r4,1939, which was read.
