Minutes of a special. meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers,in the City Hall, in said City, on September 28th,1939- President Lemmon called the meeting to order at 7:30 o'clock P.M., the _following members being present: Lemmon, Amundsen, Fryer, Bloody, Richman, Williams. Absent: Green. The call for the special meeting was read and President Lemmon ordered that the same be placed on file; said meeting having been called -for the purpose of canvassing the results of the special election held September 27th,1938, and any other business the said. Common Council might deem -proper. The Street & Traffic Committee of the Rochester Chamber of Commerce were .. before the Common -Council requesting that the tract of land at the entrance of Mayo Park at Second Street Southwest be made available for,parking lot, and on motion by Moody second by Amundsen,the matter was referred to the Park Board, Street & Alloy Committee, Chief of Police and City Engineer. REGIONAL DIRECTOR PWA" The reports of the Clerk of the Municipal Court for the week ending September 5th,1938,showing criminal fines and costs collected $140.00, civil fees received $25.00, conciliation court fees $7.00; for the week ending September 12th,1938,showing criminal fines and costs collected $127.7.0. Civil fees received $7.Z5, conciliation court fees $1.5.0; for the week ending September 19th,1938,showing criminal fines and costs collected $ 91.95, civil fees received $6.95, conciliation court fees received $5.0.0; and for the week ending September 26th,1939,81,owing criminal fines and costs collected $129.40, civil fees received $5.30, c.onciliat ion court fees received $4,75, were each read, and having been previously approved by the City Attorney, President Lemmon,ordered that -the-same be placed on file. Petit ions signed by Chris T. Lund, adking that curb and gutter be constructed and bituminous paving be placed on Ninth Street Northwest from Second Avenue Northwest to Fourth Avenue Northwest, was read, and President Lemmon referred the same to the Street and Alley Committee and the City Engineer. . r A report from the Sewer Committee and the City Engineer recommending that $2.25 Iser front foot be assessed to the property owners for the construction of a sanitary sewer on Sixth Street Southwest from Broadwer Street South to Second Record of Official Proceedings of the. A committee report from the Sewer Committee and the City Engineer recommend— ing that $2:60 per front foot be assed against Lots 13 to 22 in Block 3,Cascade I, Manor, and $1. 30 per front foot , on Lot 23 ' Block 3, ' Cascade Manor, for the const ruc- Lion of a sanitary sewer in First Street Northwest, from -Thirteenth Avenue Northwest to Sixteenth Avenue Northwest, was read, and on motion by Moody second by Amundsen,said report was accepted and ordered placed on file. I I' A committee report from the Street & Alley Committee and the City Engineer recommending that a foot bridge be constructed across Cascade Creek at Ninth Avenue Northwest, was read, and on motion by Fryer second by Amv.ndeen, the said l report was accepted and the City Engineer instructed to make said improvement as soon,as possible. A communication from Peter S. Mackey, Secret ary of the Rochester Firements I' jiRelief Association,asking for approval of an additional loan of $300.00 on i; the property of Chas. Shields, located at 16 Fourteenth Avenue Northeast, was I• 'read, and President Lemmon referred the same to the Finance Committee. A notice of claim of Louis Biltgen,guardian for Harold Biltgen, for �I injuries from damages in the sum of $200.00 alleged to have been caused by a ;hole in Second Street Southwest near Eleventh Avenue, was read, and President is Lemmon referred the same to the City Attorney. it A communication from Esther H.Myrow,requesting a release on the liquor i license bond furnished by said Esther H.Myrow to cover Liquor license No. 63 issued April 1,1938,was read.,and on motion by Fryer second by Richman, said !1 request was granted and the City Attorney was instructed to draw the proper jrelease to be signed by the City Clerk. A communication from R.A. Moore, Mayor, announc ing the appointment of W.A. Hutchins as a Special Policeman from September 29th to October 4th,was read, and ;!President Lemmon ordered that the same be placed on file. The following communication from the Board of Zoning was read and President 1; Lemmon ordered that the same be placed on file: • a Sept ember 29, 1939. Honorabley Mayor and Common Council City of Rochester; Minnesota. i� Gentlemen: At a meeting of the Board of Zoning held in the City Hall on September 14th,1939, at 7:30 o'clock P.M. -,the matter of the applica— tion of Louis A.Kepp for a change in the classification of Outlot 2,lese the South 2 acres,and all of Outlot 3,Northern Addition,from a residen— tial to an industrial district,was considered by the Board. j! After duly considering said petition and all matters pertain- ing thereto,a motion was made-,seconded,and duly carried,that the Board recommend to the Common Council that the said petition be not granted. Upon motion by Moody second by Fryer a hearing on the application of Louis A.Bepp for akchange in the classification of� Outlot 2 less .the south 2 acres and all of Outlot 3, Northern Addition,from a residential to .an industrial district was set for October 17th,1939,at 7:30 o'clock P.M. An application signed by Melvin Ferber for a drivers license was read, and on motion by Richman second by Amundsen,*li-cense was granted. An application signed by Geo.H.Popple fora plumbers license, together with a surety bond in the sum of $1,000.00 with the National Surety Corporation as surety, were each separately read, and on motion by Moody second by Richman the license was granted, the bond accepted, the surety thereon approved and itwas ordered that the bond be placed on file. Applications for pin ball machine licenses signed by L.Golod,at 12 South Broadway, Gus Hargesheimer at 25 Nest Center Street, and Henri Bakker at 17 First Avenue Southwest,were each separately read, and on motion by Amundsen second by Moody, licenses were granted.' Applications signed by Dale Hess for permits to conduct -public dances in the Woodman Hall on September loth, 17th, and 24th,1.938, were read. Applications signed by Ed.gruger for permits to conduct public dances in the A.O.U.W.Hall on September loth and 24th,were read. An application signed by C.C.Pagenhart for a House movers license was read, and on motion by Moody second by Amundsen the license was granted. A report from the Lighting, Committee of the Common Council recommending that street lights be placed,in the following locations: at the end of Third Avenue Southwest near 6th' Street Southwest; 3 lights each on First Street Northwest and Sedond Street Northwest, between Eleventh Avenue Northwest and. Sixteenth Avenue Northwest:. at. the alley on the east side of Fifth Avenue Southwest between Third Street Southwest and Fourth Street Southwest; and on Eighth Avenue Southeas- t between Eleventh -Street Southeast and Twelfth Street Southeast,was read,and on motion by Moody second by Richman,said report was accepted, and the City,Clerk instructed to notify the Utility Board to install said lights accordingly. A communication from the Finance Committee reporting that the accounts of the City Weighmaster and the Building, Electrical and Plu$bing Inspector for the < month of August had been checked and found to be correct,was read and President Lemmon ordered. that- the same be_placed on file. A communication from the Finance Committee recommending that the applica— tion of Chas.Shields for an additional loan of $300.00 from the Rochester Firemen's Relief Association,on,his property at 16 Fourteenth Avenue Northeast be granted,was read,and on motion by Amundsen second by Richman the report was accepted and ordered placed on file. ' City of Rochester, Minnesota. j; Gentlemen, ' I' We, the following Committee, report on the pop -corn wagon situated on Fourth Street Southeast. We find that this wagoh is located on City property and we recommend that he be notified to discontinue paying any -rent to private parties and that he be licensed by the City the same as other pep -corn stands on other City property -at the same rate. So Therefore, the question of .the issuance of said bonds in the aggregate sum of-$400,000-.00 was -approved by the voters at the- said School District- Election.-" Upon motion by Moody second by Fryer,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester. Minnesota: That the folllwing is a tabulated list and statement of the votes cast for asd against the approval of the resolution o,f t-he Common Council and the, issu- ance of the bonds of said City of Rochester in the aggregate amount of $400,000.00, for the purpose of 'establishing and building a -Sewage- Di•spo•sal Plant and a trunk line sanitary sewer, connecting therewith for the City of Rochester, at the special Election held in said City on September 27th-,1939, as determined by the said Common Council on their canvass of the returns of said Election made on the 29th day of September, 1939. and that -said- statement is hereby declared to show the results of the said Special Election; said tabulated statement= being and is as- follows: - First Ward Se-con-d Ward Third Ward District No. District No. District No. 1 2 3 4 5 1 2 3 4 5 1 2 3 4- 5 6 Total . Be 'it further resolved by said Common Council: That the number of persons ,!present and voting at this said Special Election on the question of the approval i' of the resolution and the issuance of the said bonds was as follows: 3392 persona voting; that the number of the voters voting in favor of the said proposed reso- l`lution and issue of bonds was 2002; number of persons voting against the pro- il posed issue of the said bonds was 1359; and that based on the 3392 total number of persons present and voting at' said Special Election, less than three - fifths (3/5) of the said total number of votes cast were in favor of the approval of the resolution and issuance of said bonds, so therefore, the question of the !;approval of the resolution and the issuance of the said bonds was not approved ''by the voters' at the said Special Election. " Upon motion by Amundsen second by Richman,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the !said resolution duly passed and adopted. Alderman Williams introduced the following resolution,whdch was read: " A resolution authorizing the Mayor and City Clerk of the City of Rochester to file an application to the United States of America through the Federal Emergency' Administration of Public Works for a grant to aid in financing the construction of curb and gutter, bituminous surfacing, and storm sewer in the City of Rochester, Minnesota. Be it resolved by the Common Council of -the City of Rochester, Minnesota: i j, Section 1. That W.A.Moore and Amiel L.G1abe,Mayor and City Clerk respectively of the City of Rochester, Minnesota, be and they are hereby authorized to execute and file. an application on behalf of the City of Rochester, Minnesota to the ! United States of America for a grant to aid in financing the construction of l� curb and. gutter, bituminous durface and storm sewer in the City of Rochester, Minnesota. Section 2, That W.A.Moore and Amiel L.G1abe,Mayor and City Clerk respec- tively of the City of Rochester, be and they are hereby authorized and directed i to furnish such information as the United States of America through the Federal j'Emergency Administration of Public Works ifay reasonably request in connection !'with the application which is herein authorized to be filed.
