Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers,in the City Hall, in said .City, on October 3rd,1939- President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members' being. �teseat: Lemmoa, .Amundsen, Fryer, Green, Moody, Richman, Williams. - Absent: Ndrie. J Upon motion by Moody *bcond by Richman,t;he minutes of the meetings of September 2nd, 6th, 7th, 12th and 28th were approved. President Lemmon stated this as being the time set for hearing on the levying ,of special assessments for a part of the cost of the construction of a trunk line sanitary sewer in Sixth Street Southwest from Broadway :Street South t o Sewer Lift st at ion in , Soldi er Field, and ,qn Pi rst 1 St rest Northwest from _ Thirteenth Avenue Northwest to Sixteenth Avenue Northwest, and asked if 4ny one present wished to be heard concerning the levying of special assessments on either of said streets. No one present wished to be heard. President Lemmon stated this as being the time set for receiving and opening bids for the furnishing of a motor pick-up'sweeper for use of the City Engineer's Department. The following proposals.were received and opened at this time: The Hough Company: Hough Motor.Pick-up $3900.00; A-IL.Company,Inc.: Austin Western Patrol sweeper $3750.00. President Lemmon referred the above bids to the Street and Alley Committee and the City Engineer for recommgndation. President-Lemmon stated this as being the time set for receiving and open- ing bids for the furnishing and installation of a public address system for the Council Chambers. - The following proposals were received and opened at this time: United Sound and Engineering Company, $915.00; A,S. Pitkin Jr., $990.00t . President Lemmon referred the above bids to the Chief of Police and Police Committee for recommendation. Alderman Richman stated that Louis J.Claude, Chief of Police, was temporar- illy out of the City, and moved that action on the above bids be deferred until October 10th,1939, at 7:30 o'clock P.M. The motion was seconded by Williams and all present voting in favor thereof. President Lemmon stated this as being the time set for receiving and opening bids for the purchase of the Witherstine property. The following bids were received and' opened at this time:, I , . G.A.Berg: For remozal of the building only $102,50; Bemel Brothers: For removing the building only $105.00; Proposals from Alvin Hoeft and A.H.Witzke were also opened but said pro-. posals were not accompanied by a certified chsck and for that reason could not 2o Record of Official Proceedings of the . President Lemmon referred the above_.bids to the Public Grounds Committee I for recommendation. j A short -recess was then taken for the purpose of permitting the Public I Grounds Committee to consider said bids.. Alderman Richman, Chairman of the Public Grounds Committee, reported orally that the Committee recommend that all bids for the purchase of the Witherstine Property be rejected and that the City Clerk be authorized to .return the checks which accompanied the bids. Upon motion by Green second by Williams, the City Clerk was instructed to readvertise for bids for the purchase of said Witherstine, said bids to be re- ceived and opened at 7:30 o'clock P.M., on October 17th,1939. Mr. F.F.Hilmer presented a sketch of a plat of Lot 105 Auditor's Plat "A" I. with the request that the Council approve the location of streets as designated. r Alderman Green as Chairman of the Street and Alley Committee requested that the Council recess later in the day in order that the full Council may have an opportunity to make a personal investigation of the proposed plat. A petition signed by Jess W. Buetzer, et.al., asking that angle parking be permitted on Third Avenue Northwest from Center Street to Second Street Northwest' was read, and President Lemmon ordered that said petition'be placed on file and the matter referred to the Chief of Police and Police Committee -of the Common �! Coumci 1. A communication from C.C. Capps and -Clara B. Ca.pps calling attention to a 'violation of the zoning ordinance relative to the number of families living in a 1 certain house located next to 516 First Avenue Northwest, and President Lemmon I referred the matter to the City Attorney and the Board of Public Health and I: Welfare. i' A petition signed by William Thompson, et.al.; requesting that a street light be placed in the alley between First Avenue Northeast and Second Avenue �IVortheast in Block 38 Northern Addition of the City.of Rochester, was read and I �I referred to the Lighting Committee of the Common Council. 'i A communication from the Public Grounds Committee of the Common Council I� reporting that said Committee had a personal interview with Simon Stenerud regarding a lease on a part.of the Williams property to the Community Oil Company and were unable to secure his signature on said lease was read, and II President Lemmon ordered that the same be placed on file. A communication from Dr. W.A.Moore, Mayor,' announcing the appointment of I !I John Ploof as Special Policeman at the Woodman Hall, he to serve without pay and to hold office until the second Monday in Apri1,1938., unless sooner removed i; was -read, and President Lemmon ordered that the same be placed on file. Common Council of the City of Rochester, Minn., October 3,1939 21 The report -of the City Engineer for the month of August 1939 showing disbursements for labor from the General,Fund in the sum of$711.17, from the Street and Alley Fund $1386.34,•Sewer Fund $545.69, Bridge -Fund $57..31, and from the Permanent Improvement Revolving Fund $323.91, was read and President Lemmon ordered that the same be placed on file. The following communication from the Board of,Public Health and Welfare was read, and President Lemmon ordered that the same be placedon file: It September 30, 1938 Common Council City of Rochester Rochester, Minnesota Gentlemen: When the highway was put in by the side of the city hog farm it was run through a point which resulted in cutting off a small tract of land from the rest of the property. This land contains a. little over two acres and is located on the north side of the road. We have just received an offer of $250.00 from the State Highway' Department for this tract of land and the Board recommends that the Council sell it. The sale of this land will in no wise interfere with the proper functioning of the city hog farm, and it is of value to the Highway Department in the completion of their road system. Upon motion by Frger second by Richman, the City Attorney was instructed to prepare a resolution accepting the offer of the State of Minnesota for thb purchase of a tract of land belonging to the City Hog Farm, and- lying north of the Highway. A surety bond in the sum of $5,.000.00 with the Aetna Casualty & Surety Company of Hartford as surety, covering house movers license issued to C.C. Pagenhart,.was read, and on motion by Moody second by Richman,the bond was accepted, the surety thereon accepted, and it was ordered that the bond be placed on file. The report of the State 'Comptroller on the examination of the books and affairs of the City of Rochester for the fiscal year ending March 31',1939, was ~ presented and on motion by Moody second by Green said report was ordered placed on file. An application signed by Joe, Angelici for a pin 'ball machine license at 601 Broadway Street North, was read, and on motion by Green second by Moody - license wa's granted. I; An application signed by Peter Brown for a plumbers license, together iiwith a surety,bond in the sum of $1,000.00 with the Fidelity & Casualty Company of New York qs surety, were each,separately read, and on motion by Green second by Amuudsen, license was granted, the bond approved, the surety thereon accepted and it was ordered that the bond be placed on file. I Applications signed by O.H.Oleson, and vern Kunz, requesting that off sale j non -intoxicating malt liquor license No.399, and on sale non -intoxicating malt liqu&r license No.238, issued to O.H.Oleson at 323 South Broadway, be transferredf I' to Vern Kunz at the same address, were each read, and on motion by Richman j: second by Amundsen, transfer was granted. h i. Applications signed by O.H.Oleson and Vern Kunz, requesting that pool table license No.203 issued to O.H.Oleson at 323 South Broadway be transferred to Vern Kunz, were each read, and on motion by Richman -second by Amundsen, transfer was granted. An application signed by Glen C.Peterson for a plumbers license, was read, and on motion by.Moody second by Amundsen, license was granted. An application signed by Vern Kunz for a soft drink dealers license at 323 South Broadway was read, and on motion by Fryer second by Richman,license was granted. An application signed by Melvin O.Lein for a drivers license was read, and on motion by Moody second by Williams license was granted. The report of the Building, Electrical and Plumbing Inspector for the month of September, showing building permits issued $96.00, plumbing permits $62.00, j' and electrical permits $36,75, was read, and Prebident Lemmon referred the same to the Finance Committee. Tho surety bond of Tim J.Daly in the sum of $1,000.00 with the Western Surety Company as surety.covering plumbers license issued to said Tim Daly, was read and on motion bg Richman second by Moody the bond was approved, the surety thereon accepted and it was ordered that the bond be placed on file. The following communication from the Board of Park Commissioners was read, and President Lemmon ordered that the same be placed on file: " October 3,1939- Honorable Mayor & Common Council City of Rochester Rochester, Minnesota Gentlemen: At a meeting of the Board of Park Commissioners held .September 29,1939, the following resolution was adopted: 'BE IT RESOLVED, that Don D. Murray be appointed to the position of manager of the Mayo Civic Auditorium effective on and after November 1,1939 - .BE IT FURTHER RESOLVED, that the salary of the manager of the Mayo Civic Auditorium be fixed at $300.00 per month to be paid semi-monthly from the Mayo Trust Fund for such time as his servicee are required.' It is respectfully requested that your honorable body approve the above salary as set by this board. Respectfully submitted BOARD OF PARK SOMMISSIONERS Harold Thompson, President " Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the following quoted resolution request of the Park Board be and the same is hereby approved: 'BI IT RESOLVED, that Don D.Murray be appointed to the position of Manager of the Mayo Civic Auditorium effective on and after November l,. 1938. ` BE IT FURTHER RESOLVED, that the salary of the manager.of the Mayo Civic Audi.torium be fixed at �$300.00 per- month to be pail• semi-monthly from the Mayo Trust Fund for such time as his services are required." City -A commun-ication signed by the Street and Alley Committee and the Engineer recommending that the propbsa'l of the A-W Company, Inc. for 'furnishing one Austin Western Patrol 'sweeper for the' sum of $3750.00 be accepted, was read, and -on motion by Richman see-ond•by'Green that said report be accepted, and upon roll call all - voting in favor thereof except Alderman Williams who voted "No", .I ii President Lemmon declared the said recommendation accepted. Alderman Amundsen introduced the following resolution,which was read: i� "Be it resolved by the Common Council of the City of Rochester,, Minnesota: That the bid and proposal• of the A-W Company, Inc., for the' furnishing of a motor pack -up sweeper for use of the City Engineers Department, in accordaneei, with the specifications for the same which are on file in the- office of the'City Clerk, viz: An Austin Western Patrol Sweeper for the sum of $3750.00 be and the said bid and proposal is hereby accepted." Upon motion by Richman second by Green,that the said resolution be adopted i . as read, and upon roll call all members voting in favor thereof except Alderman Williams,who voted passed and adopted. "No", President Lemmon declared the said resolution duly Alderman Green introduced a resolution levying special assessments for a part of the cost of the construction of a trunk line sanitary sewer in First Street Northwest from Thirteenth Avenue Northwest to Sixteenth Avenue Northwest, which was read. Upon motion by Moody second by Richman,that the said resolution be adopted as read, and all voting in favor thereof,, President Lemmon declared the said irresolution duly passed and adopted. Alderman Amundsen introduced a resolution levying special assessments for ! part of the cost of the construction of a trunk line sanitary sewer in Sixth I! Street Southwest from Bro adweV Street South to the sewage lift. station in Soldier Field, which was read. Upon motion by Fryer second by Green that the said resolution be adopted as read, and upon roll call all members voting in favor thereof, President Lemmon !'declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution granting public dance permit to, Dale �, Hess for the Woodman Hall October let, 1939, and fixing the fee at $3.00, which :was read. Upon motion by Amundsen second by Riohman,that the said resolution be ',adopted as read, and all voting in favor.thereof, President Lemmon declared the ,,said resolution duly passed and adopted. Alderman Moody introduced a resolution granting public dance permit to I, ! ,Ed. Kruger for the A.O.U.W.Hall for October let, Sth, and 15th,1939, and i ;fixing the fee at $ 9.00, which was read. Alderman Williams introduced a resolution appropriating $310.90 from the deneral Fund and ordering payment made to the State of Minnesota, Oil.Inspection Division for inspection fee $2.78, and state tax $309.12 on 7703 gallons gasoline furnished in Car NATX 5971, which was read. Upon motion by Fryer second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $145.20 from the General Fund and `$330.7,5 from the Street and Alley Fund and ordering payment made to Morse Brothers, for'gravel and sand furnished during September 1939, which was read. Upon motion by Green second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $1364, 24 from the Park Improvement Fund and ordering payment. made to the Mayo Trust Fund for payrolls for labor during the half month ending September 30th,1938,whiBh was read. Upon motion by Amundsen second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $1409.44 from the General. Fund and ordering payment made to the State of Minnesota for examination (per diem and expenses) of the books and records of the City of Rochester foil, the fiscal year ending March 31,1938,which was read. Upon motion by Green second by Richman,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon decl ared`the said resolution duly passed and adopted. An ordinance entitled, "An ordinance prohibiting the placing on or throwing in or on any public street,a.11ey or sidewalk or in any motor vehicle in the City of Rochester, Minnesota, except with the consent of the owner or person in charge of said vehicle,of any card, plackard, hand -bill, pamphlet,booklet, manu- script, or any advertising matter of any kind or description,except a single card not exceeding in size 2 inches by 4 inches," introduced and given its first reading on September 6th,1938, was given its second reading. Mayor•& Common Council Gentlemen: The Street & Alley Committee & City Engineer recommend that 2 driveways be allowed on 1st Avenue Southwest, also 2 driveways on 1 Street Southwest on the property known as the Old Post Office Build- ing. Size and location to be determined later. _ Respectfully, THE STREET & ALLEY COMMITTEE - By Benj. S.Green, Chairman Tom Moody Arleigh,C.Smith,City Engineer.N I Upon motion by Fryer second by Richman to accept the report of said Committee I' ! and upon roll call all voting in favor thereof except Alderman Amundsen who voted "No", President Lemmon declared the said report accepted. L Alderman Fryer introduced an ordinance entitled,"An ordinance regulating the construction, maintenance -and operation of pttt<lic automobile trailor and i tourist camps" was given its first reading. i li Resolutions levying special assessments for sprinkling, flushing, and oiling, during the 1939 season were introduced, duly adopted, ordered placed on file, an&. made a part hereof, reference to which for more particulars are hereby made. i (! The Common Council then recessed for the purpose of making a personal investigation of the plat of Lot 105 Auditors Plat "A". IIThe Council -then returned to the Council Chambers and upon roll call all jl members were present.
