Fro Minutes of an adjourned regular meeting.of the Common Council of the,City of Rochester,'Minnesota, held in the Council Chambers,in the City Hall, in said City on October 24th,1938. President-Lemmon called the meeting to order at 7:30 o'clock P.M.,. the following persons being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Absent: None. President Lemmon stated this as being the time set for hearings on the levying of special assessments for placing bituminous treatment on the following streets: Sixth Street Southeast from Third Avenue to Fourth Avenue Southeast; Third Avenue Southwest from Second Street Southwest to Third Street Southwest; Fourth Avenue Southwest and Northwest from .Second Street Southwest to First Street Northwest; Fourth Place Southwest from First Street Southwest to Second Street Southwest ; Seventh Avenue Southwest from Sixth Street Southwest to Eleventh Street Southwest ; Sixth Avenue Southwest from Second Street Southwest to Center Street West; and asked if any one present wished to ,be ,heard concern- ing the levying of said special assessments on either of said streets. No one present wished to be heard concerning the levying of said special assessments. Mr. Joe Bean was before the Council regarding a petition for the construc- tt.on of a sanitary sewer on a part of Seventh Avenue Northwest and Tenth Street Northwest, and. President Lemmon referred the matter to the Sewer Committee and the City Engineer., Thomas Fraser was before the Council representing property owners on the south side of Tenth Street Southeast near Eleventh Avenue Southeast regarding the cost of oiling that portion of Tenth St-reet Southeast, and President Lemmon referred the matter to the Sprinkling Committee of the Conimon Council and the City Engineer. The report of the Clerk of the Municipal Court for the week ending October 24th,1938, showing criminal fines and costs collected $396.4o, civil fees received $12.05, and Conciliation court •fees received $4-50, *was read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file: A"communication from the Finance Committee reporting that the accounts of the City Weighmaster and the Building,Electrical and Plumbing Inspector for the month of September had been checked and found to be correct, was read, and President Lemmon ordered that the aame be placed on file. A copy of a resolution passed and adopted by the Rochester Chamber of Commerce regarding the purchase of materials and supplies for the City of Rochester from merchants and citizens of the City of Rochester,- was read, and 46 Record of Official Proceedings of the Common Council of the City. of Rochester, Minn., October 2 4 , 19 3 s . President Lemmon ordered that the same be placed on file. A surety bond in the -sum of $4500.00 with the United States Guarrant,y i Company as surety covering the contract of the Graybar,Electric Company for furnishing .an,d installing -police radio equipment was read, and on motion by j Green second by Richman .the bond was approved, the surety thereon accepted, and it was ordered that the bond be placed on file. I; Applications signed by Melvin Lien, Leslie R.Baumharner, and Harry 0.$rown for drivers licenses were each separately read, and on motion by Green second r ' by Amundsen licenses were granted. An application signed by Anna Oesterreich for a soft drink dealers license at 15 Broadway_Street South, was read, and on motion by Fryer second by Richman, license was granted. A petition signed by Wm. Stensrud, et.al., asking that a sanitary sewer be li constructed on a part of Eighth Street 'Southwest and Fifth Avenue Sou\ west, in f r-ont of Lots g, 9, and 10, Block 9, and Lots 4 and 5, in Block S, Head & �McMahon's Addition, was read, and President Lemmon referred the same to the Sever Committee and the City Engineer. I An application signed by Anna Oesterreich, Theodore Paulios and James Miller, requesting that Off Sale license No.237 and On Sale license No.255, for i selling non -intoxicating malt liquor, issued to Theodore Paulios and James Miller at 15 South Broadway be transferred to Anna Oesterreich,, at the same 'address, were each read, and on motion by Moody second by Amundsen transfer was granted. The following communication was read, and President Lemmon ord.ered that the same be placed on file: "October 20,1939 To the Honorable Mayor and Common Council of the -City of Rochester !' it - - I have given iqy $ppointment to the office of City Clerk very earnest and serious thought. I have decided not to accept. I thank you for the consideration you have shown me. , Sincerely yours P.F. Common Council Gentlemen: - In the matter of the construction of a sidewalk on Sixth Street Southwest, from Tenth Ave. S.W.to Fourteenth Avenue Southwest, the Street & Alley Committee and City Engineer wish to report that the streat has to be graded to' an established grade before a sidewalk can be 'constructed. Smith, City Engineer--" Alderman Will,iams introduced a resolution granting public dance permit to Dale- Hess •for the Woodman Hall October 22nd_, 1939, and fixing the fee at $3.00, which was read. Upon motion by Moody second by Amuridsen,that the said resolution be adopted as -read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman William% introduced'a resolution granting public dance permit r to Edw. E.Bruger for the A.O.U.W.Hall for October 22nd,1938, and fixing the fee at $3.00,which was aread. Upon•moti'on by Amundsen second by Williams,that the said resolution be adopted. 'as read, and all voting in favor thereof, .President Lemmon deiclare-d the said resolution duly passed and adopted. , -Alderman Moody introduced a resolution authorizing the"Public Utility Board to -enter into contract with G. Schwartz & Company for the -furnishing of all labor and materials to build a pump house for the sum of $2690.0.O,in accordance with the resolution request of the Public Utility Board dated October 21st, 1938,which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced the following resolution which was read:, "A MOILMION ACCEPTING THE OFFER OF THE UNITED STATES OF AMERICA TO THE CITY OF ROCHESTER, MINNESOTA, TO AID IN FINANCING THE CONSTRUCTION OF A CITY WAREHOUSE INCLUD- ING CAR INSPECTION LANE. I Be it resolved by the Common Council of the City of Rochester, Minnesota: Section 1. That the offer of the United States of America to the City of Rochester, Minnesota, to aid by way of grant in financing the construction of ,a City Warehouse including car inspection lane, a copy of which offer reads as ifollows: I P.W. g4k4 -15 �i FEDERAL EMERGENCY ADMINISTRATION OF PUBLID WORKS _ Washington, D. Subject to the Terms and Co,nditions (PWA Form No.230,as amended to the date of this Offer), which are made a part hereof, the United States of America hereby offers to aid in financing the construction of a city warehouse ar;d car inspection land (herein called the "Project") by making a grant to the City of Rochester (herein called the "Applicant") in the amount of 45 percent of the cost' j of the Project upon completion, as determined by the Federal Emergency Adminis- trator of Public Works (herein called the "Administrator"), but not to exceed, in any event the sum of $17,955- 2. By acceptance of this Offer the Applicant covenants to begin work on the Project as early as possible but in no event later than g weeks,from the date of this offer and to complete such project with all practicable dispatch, and in any event within 6 months from the commencement of construction. 3: This Offer is made subj,eet to the express condition that,, if the Administrator shall determine at any time that the Applicant has paid or agreed to pay, whether directly or indirectly, a bonus, commission or fee to any person, firm or corporation for attempting to procure andapproval of the applicant's application, or for alleged services in procuring or in attempting to procure such approval, or for activities of the nature commonly known as lobbying performed or agreed. to be performed in connection with -the application, then the Administrator shall have the right, in his discretion, to rescind this Offer and any agreements resulting herefrom, and, in the event of such rescission, the United States of America shall be uuder no further obligation hereunder. Common Council of the City of Rochester, Minri., O c t o b e r 24 , 19 3 9 Section 34 That the President of the Common Council is hereby directed to sign, and the City Clerk to attest and seal with the corporate seal of the City of Rochester, Minnesota, the original offer made by the United States of America to the City of Rochester, Minnesota, as evidence of the acceptance of said offer by the City of Rochester, Minnesota. Section 4. That the City Clerk i's hereby authorized and directed to send to the Federal Emergency Administration of Public Works certified copies of the proceedings of this meeting and the action taken in connection with the adoption of this resolution, and such further documents or proofs in_conneetion with the acceptance of said offer as may be requested by the Federal Emergency Adminis- tration of Public Works." Upon motion by Green second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said s (resolution duly passed.and adopted. Alderman Green introduced a resolution adopting the specifications for decoratigeg Christmas street lighting, and ordering advertisement for bids for furnishing the same, said bids to be received and opened at 2:0.0 o'clock P.M. on November 7th,1939, which.was read. .Upon motion by Fryer second by Amundsen,that the said resolution be adopted as read, and all voting in favor thereof, "President Lemmon declared the sai d resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $39000.0.0 from the s Street and Alley Fund, and $1,000.00 from the Sewer Fund, for use of the Street and Alley Committee, which was read. Upon motion by Richman second by Williams,that the -said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $8,000.00 from the General Fund and ordering payment made to the Park Improvement Fund, as a permanent transfer, which was read. Upon motion by Green second by Moody that the said resolution be adopted' as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $2229.99 from Code 1 of the Street and Alley Fund and. ordering payment made to Code 4 of the Street and Alley Fund, for return of temporary transfer, which was read. Upon motion by Fryer second by Amundsen,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the sadd resolution duly passed and adopted.. Alderman Amundsen introduced a resolution appropriating $2909.12 from Code 1 of the Street and Alley Fuud and ordering payment made to Code 3 of the Street and Alley Fund for taking up overdraft in said Code 3, which was read. Upon motion by Amundsen second by Williams,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the Ilsaid resolution duly passed and adopted. 50 Record of Official Proceedin g s of the -Common Council of the City of Rochester, Minn., October 2 4 ,19 3 s Alderman Amundsen introduced a resolution appropriating $1170.00 from Code 1 of the General Fund and ordering payment made to Code 4 of the General { Fund, for salaries of at t enflant s at the . Dumping - Grounds paid out of Code 4 i instead of nl, which was read. Upon motion by Moody second by Richman that the said resolution be adopted ;as read; and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. I.L.Eckhold, City Attorney, presented recommendations of changes,made by the Board of Health and Welfare, and the`Building Electrical. and Plumbing`Inspe tor regarding the proposed Plumber's ordinance, and on motion by Fryer second iby Amundsen, said proposed ordinance was referred back to the local Plumbers Union and the City Clerk was instructed to furnish the said Union with copies • of said recommendations. ` Alderman Green brought up the matter of the construction of a sanitary sewer; in Eleventh Street Northeast from Br6adway Street North to Second Avenue North east, and President Lemmon referred the same to the Sewer Committee of the 9ommon Council and the City Engineer. Alderman Amundsen as Chairman of the Fire Department Committee of the Common Council reported that the Committee met with`a group`of the firemen- and that said group requested that the Council take some action regarding the matter of time off for the firemen and on motion by Fryer second by Amundsen C.E.Ginther, Chief of the Fire Department was given full authority to govern and regulate time off for all members of the Fire Department and the City Clerk I, was instructed to forward a copy of said motion to Elmer Lee, a member of said Department. r !
