Minutes of a regular meeting of the Common Council of -the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on November 7th,1938.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody,
Richman, Williams. Absent: None.
Upon motion by Williams, second by Amundsen, the minutes of the meeting
of October 318t, were approved.
President Lemmon stated this as being the time set for receiving and
opening bids for the furnishing of the necessary labor and material and
!' installation of decorative Christmas street lighting, the following proposals
were received and opened at this time: H. & H. Electric Company $979.00,
Peterson Electric Company $1150.00.
President Lemmon referred the above bids to the Street and Alley Committee
and the City Engineer for recommendation.
A short recess was taken at this time to allow the Committee time to
eensider the above bids.
The following committee report was read, and on motion by Richman second
by Moody, said report was accepted and ordered placed on file:

Gentlemen:
The Street and Alley Committee recommend that the contract for
Christmas Street Decorations be awarded to H.& H. Electric Co., in the
amount of $979.00. The City of Rochester to pay $750.00 and the balance
of the amount to be assumed3by the Rochester Chamber of Commerce.

Alderman Amundsen introduced a resolution accepting the bid and proposal
of
of the H. & H. Electric Company for the furnishing and installation of Christmas
street lighting in accordance with the specifications for the same which are on
file in the office of the City Clerk, for the sum of $979.00, which was read.
Upon motion by Moody second by Richman,th at the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Upon motion by Fryer second by Amundsen, the bid of Peterson Electric
Company was rejected and the City Clerk was authorised and directed to return
the certified check which accompanied the proposal.
Dr. Hamilton Montgomery and L.N.Ekstrand, representing the Rochester
Automobile Club, were before the Council regarding the construction of a
building for car inspection lane.

r. Ed.. Myers representing the Workers Aliance, was before the Counc:i'1
and gave a report of the trip to St -Paul for the, purpose of securing additional
working hours on W.P.A.Projects.
Mr. Joe Bean was.before the Council regarding the construction of a sani-
tary sewer, on 'Seventh Avenue Northwest, and also called attention to the sani-
tary conditions existing in said vicinity at the present time.
A petition signed, by F.R.Novotney, st.al., protesting the construction of
a sanitary sewer on Seventh Avenue Borthwest from Seventh Street Northwest to
Tenth Street Northwest, was read, and on motion by Green second by Fryer said
petition was ordered placed on file and the miter of the sanitary condition
was referred to the Health Board for investigation.
The report of the Clerk of the Municipal Court for the week ending
November 7th, showing criminal fines and costs collected $123.20, civil fees
received $11.95, and conciliatiop court fees received $1.00, was read, and
having been previously approved Py the City Attorney, President Lemmon ordered
that the same be placed on file.
The report of the City, Engineer for the month of October showing
_disbursements for labor from the General Fund $434.53, Street and Alley Fund
$2,293.57. Seger Fund $179.40, Bridge Fund $56.53, and Permanent Improvement
Revolving Fund $40.83, was read, and President Lemmon ordered that the same
be placed on file.
The report of the City Weighmaster for the month of October showing
296 private loads weighed, total'.receipts $29.60, was read and President Lemmon
referred the same to the Finm ce .Committee. I.
An application signed by James Miller,for an additional pin ball machine
license at No.11l First Avenue Northwest was read, and on motion by Moody
second by Fryer, license was granted.
An application signed by J.L.Mott and L.Mars$, for a roller skating rink
� icense a� the Woodman Hall commencing �iovember 9th,1939, was read, and on
motion by Fryer second by Amundsen, said,license was granted for a period of
one month with the provision that said roller skating rink be closed from
10:09 o'clock P.M., to 12:00 o'clock noon,of each day.
A communication signed by the Sprinkling Committee of the Common Council
recommending that no change be made in the assessment for oiling Sixth Avenue
Southeast near 1026, and that the complaint of S.J.McComb had been entirely
satisfied, and on motion by Green second by Fryer it was ordered that said
report be placed on file.
The following committee.report was read, and on motion by Fryer second

Gentlemen,
We, the following Committee, assigned for the consideration of a
parking space for th.e City Assessor, after a very careful investigation
of all possible locations in the City of Rochester, recommend that he
be granted a private parking space on the Witherstine property as soon
as the present building is razed. That the City Clerk be instructed
to mail a copy of this letter to the City Aesessor.

An ordinance entitled,"An ordinance amending an ordinance entitled,'An
Ordinance for the purpose of promoting health, safety, order, Convenience, and
general welfare by regulating the use of land, the location, size, use and
height of buildings and the arrangement of building on lots and the density of
population within the City of Rochester, Minnesota, all in accordance with a
comprehensive plan.'" the purpose of said amendment being to change the classi-
fication of Outlot 2. less the south 2 acres and, all of Outlot 3, Northern
Addition from a residential to an industrial district, introduced and given its
first reading on October 17th,1938. was given its third and final reading.
Upon motion by Green second by Richman to adopt said ordinance as read,
and upon roll call Aldermen Green and Richman voting -"Yes" and Aldermen
Amundsen, Fryer, Moody and Williams voting "No", where upon President Lemmon
declared said ordinance not adopted.
An ordinance entltled "An ordinance prohibiting the placing•on or throwing
in or on any public street, alley or sidewalk or in any motor vehicle in the
City of Rochester, Minnesota, except with the consent of the owner or person
in charge of said vehtcle,.,of any card, placard, hand -bill, pamphlet, booklet,
manuscript, or any advertising matter of any kind or description, except a'
single card not exceeding in size 2 inches by 4 inches, introduced and given
its first reading September 6th,1938, its second reading October 3rd.1938, was
given it w- third and final reading.
Upon motion by Fryer second by Amundsen to adopt said ordinance as read,
and upon roll call Aldermen•Amundsen. Fryer, Moody and Williams voting "Aye
and Aldermen Green and Richman voting "No", whereupon President Lemmon declared
the said ordinance duly passed and adopted.
An ordinance entitled; an ordinance for the formation and government of the
Fire Department',' introduced and given its first and second readings on
October 10th,1938, was given its third and final reading.

Upon motion by Amundsen second by Fryer to adopt said ordinance as'read,
and upon roll call all voting in favor thereof, President Lemmon declared the
said ordinance duly passed and adopted.
An ordinance entitled, "An ordinance regulating the construction, mainten-
ance and operation of public automobile trailer and tourist camps, introduced
and given its first reading on October 3rd,1938, was given its second reading.
The following claims were read, and on motion by Richman second by
Amundsen, and all voting in favor thereof, Tate same were allowed and the Mayor
`and City Clerk were authorised and directed to draw warrants upon the City
Treasurer and make payments accordingly:

Alderman Williams introduced a resolution deeming it expedient and
necessary that a sanitary sewer be constructed in Fifth Avenue Southwest from
the center line of Eighth Street Southwest to a point 165 feet north of the
north line of Eighth Street Southwest, and in Eighth Street Southwest from the
center of Fifth Avenue Southwest to a point 208 feet west of the west line of
Fifth Avenue Southwest, and fixing a hearing on the said improvement for
7:30 o'clock P.M., on November 14th,1938, which was read.
Upon motion by Moody second by Fryer, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the sad d
resolution duly passed and adopted.
Alderman Williams introduced a resolution granting public dance permit to
Ed. Kruger for the Woodman Hall, November 5th and 12th.1938, and fixing the
fee at $6.00, which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
-Alderman Richman introduced a resolution appropriating $309.49 from the
Lighting Fund and ordering payment made to the City of Rochester, Light
Department for lighting public buildings in accordance with the October 25th
billings, which was read.
Upon motion by Fryer second by Moody that the said resolution be adopted
as read, and all voting _ in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $444.00 from the
Street and Alley Fund and ordering payment made to Morse Brothers for sand and
gravel furnished during the period September 29th to October 26th,1938,inclusive,
which was read.
Upon.motion by Amundsen second by Richman that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $446..41 from the
General Fund and .orderi.ng payment ,made to the Rochester Post —Bulletin for
official publications .and printing during October,1938,which was read.
Upon motion by Green second .by Richman that the said resolution be
adopted as read, and all voting in favor thereof, President ,Lemmon declared -the
..said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $2,778.00 from the
Lighting Fund and ordering payment made to -the City of Rochester, Light
Department for lighting of public streets and grounds, which was read.
Upon motion by Richman second by Amundsen,that the,said resolution be
adopted as read, and all.voting in favor thereof, President Lemmon declared
the said resolution. duly passed and adopted.
Alderman Green introduced a resolution appropriating $350.00 from the
General Fund and -ordering payment made to Reuben Briske for full payment of
settlement in verdict of. jury in Reuben Briske vs. .City of Rochester,
whi-ch was read.
Upon motion by F.rye.r second. by Williams, that the said resolution be .
adopted as read, and all voting in favor -thereof, President Lemmon declared. the',
said resolution.duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $9.04.00 from.the
Street and Alley Fund -and. ordering payment made to the ,Street and Alley Fund,
for use of equipment during October,1938, which was .read._
Upon motion by Gr.een. second by Moody, that the. said resolution be
adopted as read, and all voting in.f avor thereof, President Lemmon declared
the said resolution duly passed and -adopted,
.Alderman Amundsen introduced a .resolution appropriating $726.1.5 from the
General Fund .and ordering payment made to .the Street and Alley Fund, .for- use
of equipment during Oct.ob.er,.1935, whi.ch was read..
Upon motion -by Richman second by Amun.deen,that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared.

Alderman Richman moved that Fred R.Finch be appointed Cit-y Clerk for the
City .of Rochester commencing Nov.embe.r 10th., 1.938, and for .the remainder of
official year. The motion was.seconded by Alderman Green,. and'upon roll call
al.l voting in favor thereof, President Lemmon declares the said motion carried
and Fred R.Finch duly appointed City Clerk of the City of Rochester.
Mr. G.P.Gentling was before the Council asking that $7,000.00-be placed
in the 1938 -band budget in order t.o provide a variation of concerts in Mayo
Park during the 1939-season.

Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council- Chambers, in the -City Hall, 'in said
City on November 7th,1938.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen; Fryer, Green, Moody, Richman,
Williams. Absent:�None.
The matter of the 1939 tax budget submitted by the Board -of Education of
School District No.o was up for consideration and the following Committee
report was read:

Honorable Mayor and Common Council,
City of Rochester, Minnesota.
Gentlemen:
The undersigned Finance Committee of the Common Council
met with the Board of Education relative to the tax budget for the
'year 1939, and while we realize that the Board of Education seriously
considered all matters pertaining to the budget we feel that in -
keeping with other departments that the budget for the School Board
'should be reduced $25,000.00 from t'he amount submitted by the Board.
We therefore recommend to the Common Council that the
budget of School District No.B be fixed at,the sum of $29s;`153.00t

Members of the Board of Education were before the Council and explained
the diffkbrent items as set forth in the proposed budget and urged that the
Counbil approve the same as submitted, and stated that any reduction in the
budget would have to be reflected in salaries -paid.
On motion by Green second by Amundsen that the report,of- said Committee be
on roll call I
accepted and/all voting in favor thereof, President Lemmon declared the,said
report accepted. -
Dr. Sanford, President of the Board of Education then asked the Council
if it was their intention that said reduction in the budget should all be taken
from salaried] paid to the teachers, and. on motion by Fryer, second by Richman,
that' the Common Council go on record asp lot favoring any salary reductions for
teachers but that other expenditures be curtailed in order that said budget may
be reduced accordingly. -
Alderman Amundsen introduced the following resolution,whieh was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the -resolution passed and adopted October llth, 1939, by the Board of
Education of School District No.B, levying the sum of $323,153.00 upon the
taxable property of said School District for the year 1939, be and the same is
hereby approved in the aggregate amount of $299,153.00. "
Upon motion by Fryer second by Green, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

The matter of a levy of $6,000.00 for the purpose of providing additional
funds for the construction of a new warehouse was considered. and Alderman
Amundsen expressed his disapproval of any lavy of this nature-.
Alderman Green introduced the following resolution, which was read:
"Be it and it is hereby resolved by the Common Council of. the City'of
Rochester, Minnesota:
That the"said Common Council does hereby assess and levy upon the taxable
property in said City of Rochester for taxes for the year 193g the following
sums of money for the several funds of said City, viz:

Upon motion by Fryer -second by Green, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the
said resolution suly passed and adopted.

'Ald.erma.n Green introduce4 the following resolution, which was read:
"WgEREAS, The Federal Administration of Public WorIgs has mad.e,a grant in
the sum of $17,995.00 to aid in'f.inancing the construction of a City Warehouse
including car inspection lane, and ,
WHEREAS, The amount:of City funds available is not sufficient to,complete
the construction of said building, and the time -set for commencement of -said
work is pot 8ufficient,to properly make arrangements for additional funds and
draw $he necessary plans and specifications.
NOW THEREFORE, Be it and it is hereby resolved by the Common Council of
the City of Rochester, Minnesota:
That said application filed with the Federal Emergency Public,Works
Administration, asking for a grant to aid in financing the construction of
said warehouse and car inspection lane, -be and the same is hereby -withdrawn.
Be it further resolved: That the City Clerk of said City be and`he is
hereby directed to send a certified - copy of this resolution to the Public
Works Administration. "
Upon -motion by Green second by Fryer; that the said resolution be
adopted as read, and:all voting in favor thereof. -President Lemmon declared the
.said resolution duly passed and adopted.
Upon motion by Williams second by Fryer,'the Common Council adjourned
