Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
11 said City, on November 14th,1939.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody,
Richman, Williams. Absent: None.
Upon motion by Williams second by Richman; the minutes of the meetingsof
November 7th, were approved.
President Lemmon stated this as being the time set for- a hearing on the
construction of a sanitary sewer in Fifth Avenue Southwest from -the center line
i of Eighth Street Southwest to a point 165 feet north of the north line of Eighth:
Street Southwest, and in Fj!ebth Street Southwest from the center of Fifth Avenuel�i
Southwest to a •point 209 feet west of the west line of Fifth Avenue Southwest,
and asked if any one present wished to be heard concerning the said improvement.
Clarence Fischer and Francis Toomey were before the Council and discussed the
fact that Mr. Toomey had paid for the sewer on which this new. sewer would
be connected and stated that the property owhers benefitted by this connection
could.. ;•--•reimbuirse Mr. Toomey independent of the City.
The City Attorney reported that the -Chicago Great Western Railroad
Company had. inquired. as to whether or not the City of Rochester expected to
purchase a tract of land under an offer previously submitted by said Railroad
Company, and upon motion by Fryer second. by Green the City Attorney was
Instructed to noti�`y the Railroad officials that they would be notified if and
when the Council made further plans.
n The report of the Clerk of the Municipal Court for the week ending
November 14th,1938, showing Criminal fines and costs collected. $206.20, Civil
fees received $12.75, and Conciliation Court Fees received $2.25, was read,
and having been previously approved by the City Attorney,, President Lemmon
ordered that the same be placed on file.
The report of the Finance Committee that they had checked the reports of
the BUilding,Electrical and Plumbing Inspector Andhthe City Weighmaster for the
month of Motreber and found the same to be correct,was read, and upon motion by
Green second by Richman, the said report was accepted and ordered placed on
file.
The report of the Lighting Committee recommending that street lights be
installed on Third Street Southwest between Fourth Avenue Southwest and
Fifth Avenue Southwest and. on First Avenue Northwest between Fifth Street
Northwest and Sixth Street Northwest, was read, and on motion by Richman second
by Amundsen the said repommendation was accepted, and the City Clerk to
request the Public Utility Board to make street light installations accordingly.'!

Alderman Amundsen introduced a resolution levying spegial assassroents for
scavenger service during the year 1939, which was read.
Upon motion.by Moody second by Amundsen,that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Fryer introduced a resolution sevying special assessments for
sidewalks constructed during the season of the year 1939, which was read.
Upon Motion by Richman second by Green,that the said resolution be adopted
as read, and all voting in favor thereof.- President Lemmon declared the said
resolution duly passed and adopted..
Alderman -Williams introduced. a resolution ordering plans, specifications
and `estimate of cost for the construction of a sanitary sewer in parts of
and,
Fifth Avenue Southwest and Eighth Street Southwest,/ordering that -the whole
co$t and expense. thereof be paid by special assessments levied as provided
by lar, which was read -
Upon motign by Moody second by Amundson,that the a dd resolution be,
adopted as read, and all vot ing, in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
_ The City Engineer submitted plans, profiles, specifications -and estimate
of cost for the egnstruct-ion of a sanitary sewer in Fifth Avenue and. -Eighth
'.Street Southwest, said estimate of cost bAing $1359.42•
Alderman Amundsen introduced a resolution adopting the plans, specifications
and estimate ;of cost for the construction of a sanitary sewer in Fifth Avenue
Southwest from the center line of Eighth Street Southwest to a point 165 feet
north of the north line of Eighth Street Southwest, and in Eighth Street South--
west from the, ;:Center of Fifth Avenue Southwest to a point 209 feet'west of the
rest line of Fifth Avenue Southwest, ordering a hearing on the said improvement

Alderman Green introduced the following resolution,which was read:
"A 4ESOLUTION ACCEPTING THE OF1= OF THE UNITED STATES
OF AMERICA TO THE; CITY OF ROCHESTER, MINNESOTA, TO AID
IN FINANCING THE CONSTRUCTION OF SANITARY SEWERS IN
FIRST AVENUE SOUTHWEST FROM FIFTH STREET TO SIXTH
STREET, IN SI4TEENTH AVENUE SOUTHWEST AND NORTHWEST
FROM FIRST STREET NORTHWEST TO SECOND STREET SOUTHWEST, ,
IN THE ALLEY IN BLOCK FOUR KUTZKY' S FIRST ADDITION,AND
A STORM SEWER IN SOLDIER FIELD.
Be it resolved by the Common Council of the City of Rochester, Minnesota;
Section 1. That the offer of the United States of America to the City of
Rochester; Minnesota, to aid by way of grant in financing the construction of
sanitary sewers in First Avenue Southwest from Fifth Street to Sixth Street,
in Sixteenth Avenue Southwest and Northwest from First Street Northwest to Second
Street Southwest, in the Alley in Block 4, Yut zky's First Addition and a storm
sewer in Soldier Field, a copy of which offer reads as follows:

11. Subject to the Terms and conditions (PWA Form No.230, as amended to
the date of this Offer), which are made a part hereof, the United States of
America hereby offers to aid in financing the construction of additions and
improvements to the sewerage system (herein called the "Project") by making
a grant to the City of Rochester (herein called the "Applicant")- in the amount
of 45 percent of the cost of the project upon completion, as determined by the
Federal Emergency Administrator of Public Works (herein called the "Administra-
tor"), but not to exceed in any event, the sum of $4,5gl.
2. By acceptance of this Offer the Applicant covenants to begin work on
the Project as early as p6ssible but in no event later than December 31,1939,
and to complete such Project with all practicable dispatch, and in any event
within 6 months from the commencement of the construction.
3. This Offer is made subject.to the express condition that, if the
Administrator shall determine at any time that the applicant has paid or agreed
to pay, whether directly:or indirectly, a bonus, commission or fee to any
person, firm or corporation for attempting to procure an approval of the
Applicant's application, or for alleged -services in procuring or in attempting
to procure such approval, or for activities of the nature commonly known as
lobbying performed or agreed to be .performed in connection with the applica-
tion, then the Administrator shall have the right, in his diAcretion, to
rescind this Offer and any agreements resulting herefrom, -and, in the event- nf
such rescission, the United States of America shall be under no further obli-
gation hereunder.

Alderman Moody introduced a resolution granting public dance Permit, to
Dale Hess for the Woodman Hall November 12th,1939, and fixing the'fde at $3.00,''

Upon motion by Green second by Moody that the said resolution be adopted
as read, and all voting i'n favor thereof, President Lemmon declared the said
resolution duly passed and adopted. _
Alderman.Willi'ams introduced a resolution levying special assessments for.
removal of garbage and filthy materials from lots and parcels, of land., as'
authorized and provided for in Ordinance No.392, and in accordance with the
cart i f i ca,t e , of Public Health Department under date of November gt h,1939,
which was read.
Upon motion by Green second by,Williams, that the said-resolution.be
adopted as read, and all voting.in favor thereof, President Lemmon declared the
said resolution duly.passed and adopted.
Alderman Richman introduced a resolution appropriating $1012.32 from the
Park Improvement Fund and ordering payment made'to the Mayo Trust Fund, for-..
payrolls for labor during the half month ending November 15th,1939, which was
read.
Upon motion by Fryer second' --by Richman that the said resolution be,ado,pted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
