Absent: None. Upon motion by Green second -by Rachman the minutes of -the meetings of November 14th, 16th, and lSth, were each approved. Street -Southwest from the center" of Fifth Avenue Southwest to, a point 209 feet west of the west line of Fifth Avenue :Southwest.- The following bids were• received anal opened at•this time: W.A.Patt•erson Co. $1491.70, Wm.C.Fraser & Son $1352.10. Maitin Paulson $1131.50. President Lemmon referred the said bids to the Sewer Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as. being,the time se•t--for receiving and opening bids for the construction of curb and guttex-.and concrete paving on 'Sixth Street Southwest from Broadway Street South -to Second Avenue Southwest, ani on First Avenue Southwest from Fifth Street Southwest to Sixth -Street Southwest. The following. bids weee received and opened ,at this time: Anderson'& Sons,Inc., - $199045.99. L. M. Feller Co., 19.325.97. W.A.Patterson Co.,. 21,201.25. President Lemmon referred the above bids to.the .Street &•°.Alley Committee and the City`.Engineer for'' tabulation and recommendation. 872 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 29, 1939. Dr. Montgomery addressed .the Council in regard to the importance of constructing a safety lane in the new proposed City garage, and the Mayor explained that this project had been temporartlly dropped due to the f act that the -Council did note wish to increase the tax levy to cover the cost of the construction of the building. No further action was taken by the Council. Mr. Chas. Brown was before the Council and requested information regarding the .cost of street improvements assessed to his property on Third Avenue i Northwest and President Lemmon referred the matter to the City ng E ineer for ; I complete information in regard to the assessments made to said property. I A communication from B.F. Parsons, Traffic Manager of the Chicago . Great Western Railroad Company, stating that the said Company would hold open for a reasonable time the offer tendered in their letter of November 3rd, regarding the sale to the City of Rochester of Lots 1, 2, 3, and 4 in Block 96, in Willson's Addition. A communication from the Rochester Chamber of Commerce transmitting to the Council copies of two resolutions passed by said Chamber of Commerce j' regarding zoning matters, was read, and President Lemmon ordered that the same be placed on file. Upon motion by Green second by Moody the Chair was requested to appoint a committee of nine, members, said Committee to assist the Zoning Board in investigating the extension of the industrial zone to include territory in Northwest Rochester and to consider other changes in the boundries of zones and the improving of the phrasiology of the zonibg ordinance in the interest of greater clarity in order that the best interests of the City might be served and orderly development promoted. A communication from S.J.McComb regarding a sprinkling assessment was read and President •Lemmon ordered that- t-he same' be placed on file. A communication from the Fidelity & Casualty Company &f New York -to the City Attorney, in regard to -the position and liability of said Company in the law suits of Sadie S.Armstrong and T.B.Armstrong against the City of Rochester, was read, and upon -motion by Moody second by Richman it was ordered that the same be placed on file. The following communication was read, and upon motion by Fryer second by Amundsen the request made therein was granted: November 29,1938 The Common Council City of Rochester Rochester, Minnesota Gentlemen: The Board of Public Health and Welfare requests that expendi— tures from the William's Estate be made .to cover that part of expenses incurred for play and recreational _activities at the Civic Center for Children 'under fifteen years of age. i Record of Official Proceedings of the _Common. A copy of a resolution passed and adopted by 'the Commissioners of 't,he Sinking'Fund of the City of Rochester, Minnesota, appropriating $30,000.00 from the Sinking Fund and ordering payment made to the First National Bank for the December Tst,1939 maturity of principal on Sewage Disposal Plant Bonds Nos.217 to 2�2 inclusive $16,,0.00.00, 4�% Improvement Bonds, Central Fire Station,Nos.36 to-40, $5,000.00 and 4j% Improvement Bonds, City Hall, Nas.55 to 63,inclusive $9,000.00, was read and upon motion by Moody second by Williams. the action set forth therein was approved. Requisitions by the Health Officer upon St.Mary's Hospital for the isolation of Mrs. Jennie Healey diagnosed to be suffering f rbm erysipelas, Vera Jean'Thbmpson diagnosed to be suffering from meningb encephalitis, John Elden Sutton diagnosed to be suffering from meningo encephalitis, and' George Solberg, diagnosed to be suffering from erysipelas, were each read, and President Lemmon ordered that the same be placed on file. The official bond in the sum of $500..00, of Fred R.Finch as City Clerk, with the Hartford Accident and Indemnity Company as surety t'hereofi, was read, and upon motl-6n by Moody second by Williams, the bond was approved, the surety thereon accepted, and it was ordered that the same be placed on file. .The application of Walter F.Hansen for an off sale non -intoxicating malt liquor license at 419 Broadway Street South, was read, and upon motion by Fryer second by Amundsen, license was granted. The' application' bf' L.`Golod for' a' pin' ball machine license at No.12 South Broadway was read, and upon motion by Richman second by Green 1'icense was granted. 'Applications signed by the Rochester Radio Service and Geo.A.Hormal & Company, for permits to place and maintain signs,`were each read, and upon motion by Moody second_by.Richman permits were granted. Applications signed by. Walter F.Hansen and Earling W.glagstad, for Soft Drink dealers licenses were -each read, and upon motion by Fryer second by ' Richman licenses were granted. s. Klagstad, were each read, and upon motion by Fryer second by Richman , transfer was granted. The reports of the Clerk of the Municipal Court for the week,ending. November 14th,1939, showing criminal fines and costs collected $176.30, civil fees received $4.10, Conciliation Court Fees received $3.50, and for the week I ending November 21,1939, showing criminal fines and costs collected $269.20, civil fees received $3.20, and conciliation court fees received $4.00, were each read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be - placed on file. The following petition was read. I' "To the Common Council of the City of Rochester, Minnesota: r The undersigned, being the owner of all of the property on the line of the street and.alley hereinafter described and proposed to be vacated, respectfully request you to vacate all of Eighth Avenue Southwest in said city lying between the south line of Tenth Street Southwest and the northerly line of Eleventh Street Southwest, and all of the alley running north and south thru Block No. three (3) of Williams, Healy. & Cornforth's Addition lying between the south line of said Tenth Street Southwest and the northerly line of said Eleventh. Alderman Amundsen introduced a resolution ordering that the above petition for the vacation of part of Eighth Avenue Southwest and the alley in Block 3, Williams, Healy and Cornforth's Addition be placed on file in the office of the .City Clerk, and 'ordering a hearing on the said petition to be held at 7:30 o'clock P.M., on January 9th,1939, in the Council Chambers in the City Hall in said City, and authorizing and directing the City Clerk go give notice of said hearing as required by the Charter of said City, which was read. Upon motion by Amundsen second by Fryer that said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. A communication signed by the Sewer Committee and the City Engineer recommending that the contract for the construction of a sanitary sewer in Fifth Avenue Southwest from the center line of Eighth Street Southwest to a point 165 feet north of the north line of Eighth Street Southwest, and in Eighth Street Southwest from the center of Fifth Avenue Southwest to a point 209 feet west of the west line of Fifth Avenue Southwest be awarded to Martin Paulson,under his proposal to construct the same for the sum of $1131.50, was read, and President Lemmon ordered that the same be placed on file. Alderman Moody introduced a resolution accepting the bid of Martin Paulson in the sum of $1131.50 for the construction of a sanitary sewer 'in parts of Fifth Avenue Southwest and Eighth Street Southwest,as above described, which was read., and President Lemmon ordered that the same be placed.on file. Upon motion by Iteen second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said reso- lution duly passed and Ad.opted. The City Engineersubmitted tabulation of bids and the following recommendation, which were read and ordered placed on file: "Nov.29, 1438 Hon.Mayor & Common Council Gentlemen: I,Arleigh C.Smith,City Engineer, recommend that the contract for the Paving, Curb and Gutter and Grading on 6th Street Southwest, from Broadway go 2nd,"Avenue Southwest, and on 1 Avenue ' Southwest, from •5th Street Southwest to 6th Street Southwest, (Minn.Docket No.1515-F) be awarded to Anderson & Sons, Inc.,200 North 7th Street, Minneapolis, Minnesota, for the amount of $19, o45.89. The above mentioned Contractors being low and responsible bidders. Alderman Green introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: WHEREAS, The City of Rochester, Minnesota, has received bids.for the con- struction of curb and .gutter and reinforced concrete p4vement on Sixth Street•' Southwest from Broadway Street South to Second Avenue Southwest and on First Avenue Southwest from.Fifth Street Southwest to Sixth Street Southwest, and i • WHEREAS, The.bid of Anderson & Son, Inc.,for the sum of $19,045.99, is the lowest and best bid received for such work; NOW THEREFORE,. Be it resolved, that the contract for such work be awarded to Anderson & Son, Inc., for the sum of $19,045.99, such amount being determined by the acceptance of the base bid. Provided, however, that this award shall l not be effective until the Anderson & Son, Inc., shall have been notified in writing by the City .Clerk ,of .the City of Rochester, Minnesota, for such award." Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, The City of Rochester did on -the ll day of April, 1939, by a resolution of its Common Council adopt a minimum wage,scale in accordance with the provision of Ordinance No.415 of said City; AND WHEREAS, said City is about to undertake certain street improvements and the United States Government, through its Public .Works Administration has agreed to furnish certain money to be used in connection with said improve- ments, (Said project being known as Docket No.'Minn-1515 F.) and has requested that the said Wage Scale be modified and amended for" -use in the carrying out and performing. of said project. AND WHEREAS, said City did by resolution dated November 19,1939, modify and amend said Resolution; AND WHEREAS, further deletion should be made in said resolution as here- tofore amended: 'NOW THEREFORE, Pursuant to said "request, be and it is hereby resolved by the Common Couucil of the City of Rochester, Minnesota; That the resolution of the C00mdn Council of the City of Rochester, Minnesota, duly adopted on April 11,1938; as amended November 19,1939, i'n--so far as the carrying out and 15erformance of the -said project, being known as Docket No. 4inn-1515 F, Street Improvements, Rochester, .Minnesota, be modified and amended so as to read as follows, viz: That in connection with the carrying out and. performing all work, labor - and services to be done under all contracts,to be entered into -for the purpose of carrying out` -and performing Project known as Docket, Minn-1515 F, Street. Alderman Williams introduced the following resolution, which was read: "WHEREAS, the City of Rochester did on the 11 day of April, 1938, by a resolution of its Common Council adopt a minimum wage scale in accordance with the provision of Ordinance No.415 of said City; AND WHEREAS, said City ie about to undertake certain Improvements in the construction of Sewers and the IInited Stated Government through its Public l Works Administration has agreed .to furnish certain money to b,e used in connec- tion with said Improvements,. said Project being known as Docket No.Minn-1516-F Sewers), and has requested that the said Wage Scale be modified and amended for use in the carrying out •and perf.ormi.ng of said Project. The City Engineer stated that it had.been brought to his attention that there had been condiderable difficulty -in locating people living on 131Place Southeast recommended that the name of said street be changed to 132 Avenue Southeast,and President Lemmon referred the matter to"the City Engineer and.the Street- and Alley Committee.
