j. Minutes of a regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in -said City , on
December 5th,1939-
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
j following members being present: Lemmon, Amundsen, Fryer, Green, Moody,
Richman, Williams. Absent: None.

President Lemmon announced this as being the time fixed for a hearing on
ii ,

the application of L.A.Kepp for a permit to extend the size of his building
located on Outlot 2, less the south.2 acres, and also located on Outlot 3,
Northern Addition to the City of Rochester.
A petition signed by twenty five residents of the City of Rochester, asking
i
the Common Council and the Zoning Board of said City to grant the above request
of L.A.Kepp for the extension cf the size of his building on said lots, together'
with a statement of acquiescence signed by Wm.Wenzel, Ernest Buske, Otto W.Riess,; '

and J.C.Thompson, were each read,at this time and ordered placed on ile.

There was no one present who wished to be heard on the above/application
' of L.A.Kepp for permit to extend the size of his building.
j President Lemmon announced this as being the time fixed for a hearing on
j the application of the Episcopal Church for a permit to construct a garage
attached to the house on Lot 4.Block 26, Original Plat of the City of Rochester,
Minnesota. There was no one present who wished to be heard in regard to the
I' granting of said permit.
The following telegram was read and President Lemmon ordered that the
same be placed on file:

A request from the City Engineer for an appropriation of $3,000.001from
i the Street and Alley Fund for use of the Street and Alley Committee was read
and ordered placed on file.
A circular letter from -the League of Mi.nnesota Municipalities announcing
!:the League Regional Conference to be held in Owatonna Minnesota on December 9th,
;1939, was read, and on motion by Fryer second by Richman any City official
twho found it possible to arrange to attend said Conference should do so -.at the
jl expen.se of the City of Rochester.

Requisitions by the Health Officer upon St.Mary's Hospital for the
isolation of Beverly Miller diagnosed to be suffering from chickenpox, -'John
Engle diagnosed to be suffering from scarlet fever, and Frances Elaine French
diagnosed to be suffering from scarlet fever, were each read, and President
Lemmon ordered that the same be placed on file.
A copy of a resolution passed. and adopted by the Commissioners of the
Sinking Fund, appropriating $20,000.00 from the Sinking Fund 'and ordering,

paymebt made to Bigelow Webb & Company for $20,000.00 Independent School District
No.B, 1.9% bonds maturing December 1,1950, purchased at par for Light Department
Depreciation Reserve investments was read, and upon motion by Moody second by
Richman the action of the Sinking Fund Commission set forth therein was approved.
The report, of the City Weighmaster for the month of November, 193s, showing
272 private loads weighed and total receipts $27.20, was read,,and President
Lemmon referred the same to the Finance Committee.
The report of the City Engineer,for the month of November,1938, showing
payrolls for labor from the General Fund $5$.94,�Street and Alley Fund $2013.76
Sewer Fund $790.60, and Bridge Fund. $67.06, was read, and President Lemmon
ordered that the samebe placed on file.
The report of the Building,Electrical and Plumbing Inspector for the
month of November,1939, showing building permits issued $96.00, Electrical
permits $19.00, and Plumbing permits $107.25, was read, and President Lemmon
eeferred the same to the Finance Committee.
A report from the Sprinkling Committee and the City Engineer recommending
that the assessment for sprinkling or oiling Ninth Street Northwest from
Broadway Street to Second Avenue Northwest be left unchanged, was read and
upon motion by Green second by Moody said report was accepted and ordered
placed on file.
A report signed by the Sprinkling Committee and the City Engineer
recommending that the assessment for oiling against' the S.J.McComb property
at 1026 Sixth Avenue Southeast be left., unchanged, was read and upon motion
by Amundsen second by Green said report was accepted and ordered. placed on file.
A report signed by the St>reet and Alley Committee and the City Engineer
recommending that ljth Place Southeast be called 131 Avenue Southeast, First
®kace Southeast be called First Avenue Southeast, and Eighth Place Northwest
be called`91 Avenue Northwest, was read and President Lemmon ordered that the
same be placed on file.
After -further,-consideration of the above report and recommendation of the
Street and Alley Committee and City Engineer on the changing of the names of
certain streets and. avenues known as Places, it was informally decided,and. the
City Engineer and the Street and Alley Committee instructed,to investigate and

recommend the changing of the names of any other streets or avenues from Places
to Streets or avenues, and the City..Attorney was inforally instructed to
prepare an ordinance providing for such renaming of the Places to Streets or
Avenues in accordance with said recommendation from the Street and Alley
Committee and the City_Engineer.
The following communication was read, and upon motion by Richman second by
Green,

a Special Committee to make a study of revising the Zoning Ordinance
and make recommendations for future planning for the City of Rochester:

Upon motion by Fryer second by Richman it was ordered that the above
''membera of the Special Committee on Zoning matters be notified of their appoint-
ment to such Committee and also to request that said Special Committee make
,their report to the Common Council not later than May 1st, 1939.
The bond of the H. & H. Electric Company covering their contract for
decorative Christmas street lighting, with the Aetna Casualty and Surety Company
,as surety thereon in the sum of $979.00, together withGeneral Liability policy
written by the Hartford Accident and Indemnity Company, and a certificate of
insurance given by the Aetna Casualty_& Surety Company, covering the contract
.of said H.& H.Electric Company, were each read, and upon motion by Moody second

.by Green, the said bond was approved, the surety thereon accepted, and the
i
insurance policy and certificate of insurance were approved,and it was ordered
that the same be placed on file.
j, The surety bond of Martin Paulson in the sum of $1131.50, with the
iFidelity & Casualty Company of New York as surety thereon, was read, and
up6n motion by Fryer second by Williams, the surety thereon was accepted,
tithe bond approved and ordered placed on file.
Richard Manahan appeared before the Council as attorney for William A.
;Fitzgerald for the purpose of having the description of certain property in
''Block 107 Willson's Addition to the City of Rochester made more definite, and
;upon motion by Moody second by Fryer the matter was referred to the City Attorney,,
:the City Engineer and the Street and Alley Committee.

On motion'by Green second by Williams; the City Clerk was instructed to
prepare a resolution for the sale of Permanent Improvement Fund'Bonds.covering
the 1939 special assessments. `
Applications signed by J.S.Gray; Earl Huey; Wm.Friedell and W.T.Wendt,
Helen Mulvihill, Mrs. Geo.Williams, Harry Drosos, Carl Moydr, Mrs. Geo.Barbes,
Walter Hansen, Ralph B.Trainor, and Ross Phill, for pin ball machine licenses
were each read, and on motion by Richmazi second by Amundsen, licenses were
(granted.
. An -application of Mortensen Motor Company for a permit to'place and maintain
ja sign was read, and upon motion by Moody second by Amundsen, permit was granted.
The following claims were read, and upon motion by Richman second by Fryer
and all voting in favor thereof, the same were allowed and the Mayor and City
(Clerk were -authorized and directed to draw warrants upon the City .Treasurer and
jmake payments accordingly:

An Ordinance regulating the construction, maintenance and operation of
Public automobile, trailer and tourist camps, introduced and given its first
reading on October 3rd,1938, its second reading on November 7th,1938, aa� given
. its third and final reading.
Upon motion by Fryer second by Green, that the said ordinance be not
adopted as read, and all voting in favor thereof, President Lemmon declared the

said ordinance not adopted.
Upon motion by Fryer second by Moody the City Attorney was instructed to
draft a new ordinance to take the place of the one rejected.
Alderman Williams introduced a resolution appropriating $991.39 fromthe
1 Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for

payrolls for labor during the period of the half month ending November 30th,1939,
which was read.
I' Upon motion by Moody second by Richman that the said resolution be adopted

i as read, and all voting in favor thereof, President Lemmon declared the said
ji resolution duly passed and adopted.
Alderman Richman introduced a resolution appropriating $312.20 from the
!�F.E.Williams Estate Fund and ordering payment madd. to the Dodge Lumber & Fuel

l� Company for coal furnished during November to the Apartments, which was read.
Upon motion by Fryer sera nd by Amundsen, -that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared, the said
resolution duly passed and adopted
Alderman Richman introduced a resolution appropriating $978.025,fratm the
Lighting Fund and ordering payment made to the A.&'H. Electric Company for
installing festoons as per contract, which was read.
Upon motion by Green second by Fryer that said resolution be adopted as
, ,
j,read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $355.95 from the
Singhting Fund and ordering payment made to the City of Rochester,Light Department
for lighting public building in accordance with billings of November 25,1939,
(which was read.
Upon motion by Richman second by Amundsen,.that the said resolution be
adopted as read, and all voting in favor"thereof, President Lemmon declared

the said resolution duly passed and adopted.
Alderman Green introduced. a resolution appropriating $3091.50 from the
i'Lighting Fund and ordering payment made to the City of Rochester, Light Depart—

,, ment for lighting public streets and grounds, which was read.
j; Upon motion by Amundsen second by Moody that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Fryer introduced a resolution granting public dance permit to
Dale Hess for the Woodman Hall December 3rd,1939, and fixing the fe% at $3.00,
which was read.
Upon motion by Green second by'Williams,that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the -said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $3,000.00 from the
Street -and Alley Fund for use of the Street and Alley Committee, ,which was read.
Upon motion by Richman second by Williams, that the said resolution be
adopted as read, and all voting in favor thereof, President-Lemmon declared the
said -resolution duly passed and adopte T.
Alderman Williams introduced. a resolution granting the request of the
Episcopal Church for a permit to construct a garage attached to the house on
Lot 4,Block 26, Original Plat, and authorizing the Building Inspector to issue
a building permit to the Episcopal Church accordingly,which was read. '
Upon motion by Amundsen second by Fryer,that the said resolution be�idopted
as- read, and all voting in 'favor thereof, President Lemmon -declared the sadd
resolution duly passed and adopted. -
Alderman Amundsen introduced a resolution'granting the application of
L.A.Kepp for a permit to extend the size of his building on Outlot 2,less the'
south 2 acres and also located on Outlot 3, Northern Addition, and authorizing
the Building Inspector to issue ,a building permit to L.A.Kepp accordingly,
which was read.

Upon motion by Richman second by Green that the said resolution be'
adopted as read, and all voting in favor thereof, President 'Lemmon declared
the said resolution duly passed and adopted.
Alderman Williams intro'duc-ed a resolution appropriating '$340'.30' from the
General Fund- and ordering payment made to the Rochester Post —Bulletin fof
official publications' an-d printing, which 'was' read. `
Upon motion by Fryer second by .Green that' th-e said resolution bq adopted
as read, and all voting in favor thereof, President Lemmon declared the' said
resolution duly passed and' adopted. -
