Minutes of a special meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council'Chambers, in the City Hall, in said City, on
December gth,1939. '

The meeting was called to order at 7:30 o'clock P.M.,, the following members

,being present: President Lemmon, Aldermen Amundsen, -.Green --Moody, Richman,

Williams. Absent: Fryer. <

The -call for the special meeting was read, and President Lemmon ordered. that;:
the same be .placed on file; said meeting having_ been called for the purpose of,
accepting plans, and ordering advertisement for bids for construction of
house connections on First Avenue .Southwest Sewer between Fifth Street Southwest
and Sixth Street Southwest and ckn. Sixth Street Southwest between ,Broadway .and
Second Avenue Southwest/, and any other businessthe said Common Council might
deem proper.
Alderman Amundsen introduced the following resolution.,which was read:
"WHEREAS, The Common Council of the City of Rochester, Minnesota, deem it
expedient and necessary that a local public improvement, a part of the cost and
expense of which shall be }laid by special assessments levied as provided. by law,
be made in said -City of Rochester, Minnesota, the said improvement being
described as follows:;
The laying of.latteral connections ,to the curb line on Sixth Street ,South-
west from Broadway Street South to Second Avenue Southwest, and on First Avenue
Southwest from Fifth Street Southwest -'to Sixth Street Southwest, in connection
with and as part of PWA Minn.Docket No. 1515-F Street Improvements.
SO THEREFORE, Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That a- public .hearing of all -persons and parties inte.rested in the said
improvement will be held at 7:30 o'clock -P.M:, on December 19th,1939, in the
Council Chambers, in the City Hall, in said City, at which time and place'the
persons and parties interested in the said improvement may appear and be heard
by said Common Council in relation to the said improvement or the.mode of the
assessment for the cost and expense thereof, or.any other matter or objection
relating to the said latterals upon which they may desire to be heard; and
WHEREAS, The City Enginser,of said City has prepared and sutmitted plans
and specifi cations and estimate of cost for the construction of said latteral
connections to the curb line on Sixth Street and First Avenue Southwest above
described;
SO THEREFORE, Be it further resolved by the Common Council of said City:
That the plans, prof-iles- and specifications for the said latteral connections
so filed by the said City Engineer in the office of the City Clerk, be and the
same are hereby adopted as the plans, profiles and specifications for the said

latteral connections and that the said estimate of cost of the said latteral
connections, reported to said Common Council, be and the same are hereby
accepted, and each are ordered filed in the office of the City Clerk.
Be it further resolved by the said Common Council: That a part of the
whole cost and. expense of the construction of -the said latteral connections
shall be assessed, as provided by law, against each lot, piece and parcel of
land benefited by the improvement,. to -wit: Against each and every lot, piece
and parcel of land abutting upon the said latteral connections without regard to
cash valuation, ratably and in proportion .t& the special benefits conferred:by
the said latteral connections, respectively upon each lot, piece and parcel of
land.
Be it further resolved by the said Common Council: That the City Clerk of
said City is hereby -ordered and directed to prepare a list which will contain
a description of each and all of the properties abutting upon the said latteral
connections above described, and the names of the owners of the said properties
so far as the same are known, which -list together with a notice of the time,
place and purpose of said meeting and hearing above mentioned, he shall cause to
be published once in the official newspaper of said City at least 10 days prior
to the date of said meeting and hearingl

Be it further resolved by' the said Common Council: That the City Clerk of
said City be and he is hereby ordered and directed. to advertise for bids, as pro-
vided .by law, for the furnishing of al.l materials,- and doing all of the work
.necessary for the construction of the said. latteral connections above 'described,
aaid bids to be received. --and opened --by said Common Council at a meeting thereof.
to -be held at 5:00 o'clock P.M., on December 19th,1939, in the Council Chambers,
in the.City Hall, in said City. Each bid must be accompanied by a certified
check for`'at' least 10% of the amount of the bid, and this Common Council reserves
the right to reject any and all bids. "
--Upon motion by Moody second by Williams, t.hiLt said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
r.esolution duly passed and adopted.
Upon motion by Moody -second. by Richman the City Clerk was authorized and
directed to .return the certified checks of the unsuccessful bidders on the
construction of curb and gutter and concrete paving on First Avenue. Southwest
and Sixth Street Southwest.
Upon motion by Moody second by green the Common Council adjourned.
