December 12th,1939- i President Lemmon called the meeting to order at 1:00 o'clo'ck P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, I Richman, Williams. Absent: None. The call for the special meeting was read, said meeting having been' called for the purpose of appointment of a County Commissioner for" the Second Commissioner District;and any other business the said Common Council might deem proper, and President Lemmon ordered that said call for special meeting be placed on file. r The following communication was read and President Lemmon ordered that the same be placed on file: "December 12,1938. ;! To the Honorable -Common Council of the City of Rochester Gentlemen: Pursuant to Section 660 of Mason's Minnesota Statutes for 1927, you are hereby notified that there is a vacancy in the County Board.from the Second Commissioner's District of said County; that said District lies wholly within the corporate limits of said City and -that pursuant to said statute you are requested to fill such vacancy at your earliest i convenience. The vacagcy: was caused by the resignation of Commissioner O.W.Schroeder, dated November 23,1939, and which vacancy was accepted by the County Board, in regular session, this 12th day of December,and which resigna- tion was effective as of that date, to -Wit November 23,1939- Respectfully, Frances L.Underleak County Auditor and Ex-officio Clerk of the County Board. " I Alderman Amundsen introduced a resolution appointing Henry Vihstadt as County Commissioner of the Second Commissioner's District of said County, for the unexpired term of O.W.Schroeder,resigned, as such Commissioner,which was read. Upon motion by Fryer second by Green, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said I resolution duly passed and adopted. City of Rochester, Minn., D e e e,mb e r 12, 19 3 9 . 10L Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on December 12th,1938. President Lemmon called the meeting to order at 7:30 o'clock P.M1, the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Absent: None. Upon motion by Moody second by Richman the minutes of the meetings of November 28th, December 5th and December Sth, were each approved. President Lemmon announced this as the time and place fixed for a.hearing on the construction of a sanitary sewer in First Avenue Southwest from Fifth Street Southwest' to Sixth Street Southwest, and asked if any one present wished to be heard concerning the- said improvement. There was no one present who wished tp be heard. President Lemmon announced this as being the time and place fixed. for receiving and opening bids for the construction of a.12 inch sanitary sewer on First Avenue Southwest from Fifth Street to Sixth Street Southwest, a 13 inch 'sa4itary sewer in Sixteenth Avenue Southwest and Northwest ,from First Street Northwest to Second Street Southwest, an S inch sanitary sewer'in the alley in Block 4, lutaky's First Addition and a �1 inch storm sewer in'Soldier Field, (PWA.Docket NO.1516—F) and the following bids were opened and read at this time:. Martin Paulson $10,951.23, Wm..C.Fraser & Son $10,107.25,, L.M.Feller $10, 655..00'. Upon motion by Richman second by Amundsen the above bids were referred to;.the City Engineer and the Sewer Committee for tabulation and recommendation. The following communication was read, and President Lemmon ordered that the same be placed on file: "lochester, Minn 12/6/39 City Council Rochester,. Minn Dear Sirs: Some of my leading lay friends have expressed to me their disapproval of the H & H. Electric Company putting up Christmas i'Decorations on Sunday. It seems to me that such an act was absolutely unnecessary and hardly in keeping with the Christ whom such decorations are supposed to honor. We trust that next year; whoever receives the job of decorating the streets, will be given to understand that such work is not to be done on Sunday. Sincerely yours E.T. Aldrich Pastor First U.B.Church.a A communication from Arleigh C.Smith City Engineer reft mmending that the paving job PWA Docket No.1515-F be closed down, due to inclement weather, same to be reopened next spring wh6h weather conditions permit, was read and President Lemmon ordered that the same be placed on file. The City Engineer submitted estimate of cost, and specifications for the construction of laterals on Sixth Street Southwest from Broadway to Second Avenue Southwest and on First Avenue Southwest from Fifth Street South— west to Sixth Street Southwest, and upon motion by Green second by Richman it was ordered that the same be accepted and ordered placed on file. The bond of Frank Springer as Treasurer of the Rochester.Firemen's,Relief Association, in the sum of $14700.00 with the Maryland Casualty Company as surety was read, and upon motion by Richman second by Green the bond was accepted, the surety thereon approved and it was ordered that the same be placed on file. The bond of Sam Lumelsky in the.sum of $1000.00, with the United States Fidelity and Guarantee Company as surety, covering his license as a junk buyer and collector, was read, and upon motion by Richman second by Amundsen, the bond was accepted, the surety thereon approved and it was ordered that the same be placed. on file. r The report of the Clerk of the Municipal Court for the week ending December 5th,1939, showingcriminal fines and costs collected $139.00, civil fees received $10.240; and conciliation court fees received $5.75, and for the week ending December 12th,1938, showing criminal fines'and costs collected $195.30, civil fees received $12-50, and conciliation court fees $7.00, was read,, and having -been previously approved..by the City Attorney; President Lemmon ordered that the same be placed' on file* , Applications signed by Arthur. A.Beccue and Theo.D.Anderson for drivers licenses were each read, and upon motion by Richman second by Williams licenses were granted. The report of the Finance Committee that they.had checked and found to be correct the reports of the City Weighmaster and the Building,Electrical and Plumbing Inspector,for the month of November,1.938, to be correct,, was read and President Lemmon ordered that the same be placed on file. Public Utility Board dated November 29,1.938, which was read. Upon motion by Green second by Ric)iman that the said resolution be adopted as read, and all voting in favor thereof., President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution granting public dance permit to Dale Hess for the Woodman Hall December 10th-, 1.939, and fixing the fee at $3.00, which was read. Upon motion by Fryer second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green int.roduceda resolution providing for the issuance and sale of $5,000.00 City of Rochester, 2 Permanent Improvement Revolving Fund Bonds, which was read. 104 Record of Official Proceedings of the Common Council of the_ City of Rochester, Minn., December 12 , 19 3 S. Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. The following recommendation by the City Eng`��eer was read, and upon motion by Fryer.z- second by -.AR chman, the same was accepted and ordered placed on file: " Dec. 12, 1939 Hon.Mayor Common Council Gentlemen: I, Arleigh C.Smith,City Engineer, recommend that the Contract for construction of a 12" Sanitary Sewer on First Avenue -Southwest, a 15" Sanitary Sewer on- Sixteenth Avenue, an S" Sanitary Sewer in the alley in Block 4,Ruta.ky's First Addition, and a 21" Storm Sewer in Soldier Field., •(Minn.Docket No.1.516—F.) be - awarded to Wm.C.Fraser & Son, of 1957 University Avenue, St.Paul,Minnesota,for the amount of $10,•187•.25. The above mentioned Gont•ractors being low and responsible bidders. Respectfully, Arleigh C.Smith City Engineer." Alderman Green introduced -the following resolution•, which was read: "Be it resolved by- the -Common Council of the City. of- Rochester, -Minnes-ota: WHEREAS, The City of 'Rochester, Minnesota, has received• bids• fo•r the construction .of a sanitary sewer in Sixteenth Avenue Southwest and Northwest from First Street Northwest to Second- Street Southwest, and. in First Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest, also in the Alley, in B•lo-ck 4, Rutzky's First Addition, and- the construction- of a storm sewer in Soldier Field, and WHEREAS, The bid of Wm.C.Fraser & Son in the sum of $10, 197.25 is the lowest and best bid received for such work; NOW THEREFORE, Be it resolved, that the contract for such work be awarded to Wm.C.Fraser & Son, for the sum of $10,197.25, such amount being determined by the acceptance of the base bid. Provided, however, that this award shall not be effective until the Wm.C.Fraser & Son,shall have been notified in writing by the City Clerk - of the City of Rochester, Minnesota, of such award." Upon -motion by Fryer second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared. the said resolution duly passed and adopted. Upon motion by Fryer second by Williams the City Clerk was -instructed to return the certified checks of the unsuccessful bidders on the construction of the above sewers, at such time as the executed contract and documents are approved by the Public Works Adriinistration. Alderman Moody introduced a resolution appropriating $217.50 from the Fire Protection Fund and orddring payment made to the Graybar Electric Company for 5000 feet cable, etc., for, fire alarm system, which was read. Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor -thereof, President Lemmon declared i the said resolution duly passed and adopted. ; Record of Official Proceedings- of the. Common Council IN of _the__City _of Rochester, .Minn., December 12,1.939 Alddrman Richman introduced a resolution appropriating $541.06 from the Street and Alley Fund and ordering payment made to the General Fund f.or, gasoline furnished from the City -Filling Station during the period October 20th to November 28th,19399-inclusive, which was read. Upon motion by Moody second by Fryer, that the said -resolution be adopted as real and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $732.19 Irom the Street and Alley Fund and ordering payment made to the Street anci Alley Fund for use of equipment and stock used during November,1938, which was read. Upon motion by Williams second by Richman that the said resolution be adopted as read.,, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Green second by Richman the Common Council adjourned until 7:30 o'clock P.M., on December 19th,1.939. City Clerk.
