Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall,
in said City on December 19th,1938.
President Lemmon called the meeting t,� order at 7:30 o'clock P.M., the
follnwing members being present: Lemmon, Amundsen, Fryer, Green, Moody,
i, Richman, Williams, Absent: None.

President-Leinmon announced this as being the time and place set for a
hearing on the construction of lateral connections to the curb lines on Sixth
Street Southwest from Broadway Street south to Second Avenue Southwest and on
First Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest,
and asked if there was any one present who wished to be heard concerning this
improvement. There was no one present who wished to be heard.
- (8:00 o'clock P.M.)
President Lemmon announced this/ as the time and place set for receiving
and opening bids for the construction of lateral connections on Sixth Street
Southwest from Broadway to Second Avenue Southwest,. and on First Avenue
Southwest from Fifth Street. .Southwest to Sixth Street Southwest, and the
following bids were received and opened at this time: Wm. C.Fraser & Son
$4990.00�; Martin Paulson $4699.10. President Lemmon referred the above
bids to the City Engineer, for tabulation and recommendation.
Upon motion by Fryer second by Richman further action on the said bids
was deferred until word is received from Omaha,due to the fact that the
bid of Martin Paulson was not signed.
j. The following telegram was read and President Lemmon ordered that the
same be placed on file:

A copy of the summons and complaint in the matter of O.F..Nelson,plaintiff
vs the City of Rochester, Minnesota, aefendant, dated December 9th,193s, was
read, and upon motion by Moody second by Fryer it was referred to the City

Attorney.

The first and. final estimate, in the sum of $1094.76, submitted by the
City Engineer in favor of Martin Paulson on his contract for construction of
a sanitary sewer in parts of Fifth Avenue and Eighth Street Southwest, was
read and ordered placed on file.

The following communication was read -and President Lemmon ordered that
the same be placed on file:.

Gentlemen: '
We hereby request permission to pay all labor on our
Sewer Project - Minn. Docket No.1516-F by,checks on Olmsted County
Bank & Trust Co. of Rochester,' Minnesota.

We guarantee that all checks for labor will be cashed
at their face value.

The apvointment by•the Mayor of Martin Kulsrud as'.Special Policeman
for duty at the Holms School, and of John.Bray as Special Policeman for duty, at
the Woodman. Hall, each to serve without pay and to hold office until the second
Monday in April, 1.939,• unless sooner removed., were each read -and President
Lemmon ordered that the same be placed on file.

The request of the City Engineer for an appropriation of $500.00 from the
Bridge Fund. for use of the Street & Alley Committee, was read, and. President
Lemmon ordered that the same be placed on file.
A pet-ition for the corptr,iction of a sanitary sewer in Seventh Avenue
Northwest from Seventh Street to Tenth Street Northwest, and in Tenth Street
Northwest from Se-venth Avenue Northwest to Sixth Avenue Northwest, was read
and. President Lemmon eeferred the same to the City Engineer.
Applications signed by Richard L.Coon and Ray Neukom for,drivers licenses
were each read, and on motion by Moody second. by Amundsen, licenses were granted.
The application of Mark Baier for a permit to' pla.ce and mai•nts<in a 'sign
was real, and on motion by Amundsen second by Richman permit was granted.
The application of O.F;Kieren for a pinball machine license ,at •302 :S6cohd
Avenue Southwest was read, and on motion by Amundsen second by Richman license
was granted.
Th-e following claims were read, and on motion by Green second by Amundsen,
and all voting in favor thereof, the same were .allowed and the Mayor and City
Clerk were authorized and directed to draw warrants upon the City Treasurer and
make payments accordingly:

Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest, 'in
connection with and as part of -P.W.A.Project Docket No.Minn.1516-F, Street
Improvements, having been held;
NOW THEREFORE, Be it resolved by the Common Council of the City of

Alderman Williams introduced a resolution authorizing the Public Utility
Board to enter into a contract with the Clements Chevrolet Company for the
purchase of a 1939 Chevrolet 3/4 ton truck for the sum of•$997.0.0, in accordance
htth the resolution request of the Bublic Utility Board dated December 14th,
1939, which was rea3.
Upon mot';ion by Amundsen .second by Green that the said resolution be adopted.
as read, and voting in favor thereof, President Lemmon declarqt the said'

Alderman Richman introduced a resolution granting public dance permit to
Cecil Vernon for the Armory December 17th,1939, and. fixing the fee at $3.0.0,
which was read.
Upon motion by Green second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted. •
Alderman. Moody introduced a resolution granting public dance permit to
Dale Hess for the Woodman Hall December 17th','1938, and fixing the fee at $3.00,
which was read.
Upon motion by Williams second by Moody that the said resolution .be adopted.
as read, and ,all voting in favor thereaof, President Lemmon declared the said
resolution duly passed and adopted. `
Alderman Moody introduced a resolution appropriating $500.00 from the
Bridge Fund for use of the, Street and Alley Committee, which was read.
Upon motion by Williams second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said.
resolution duly passed and adopted.
Alderman'Green introduced a resolution appropriating $441.69 from the Sewer
Fund and ordering payment made`to the City of Rochester, Light and Water Depart-
ment for Electricity and water furnished at the Sewage Disposal Plant in accord-
ance with the December 15th billings, which was read.
Upon motion by -Ri•chman second by Moody that the said resolution be .ddopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Green introduced a resolut ion appropriating $94o - 97 from the
Park Improvement .Fund and ordering payment made to the Mayo Trust Fuud for .
payrolls for ieabor during the half month ending December 15th,.1939, which was
read.
Upon motion by Fryer second by Green .that the -said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Fryer introduced a resolution appropriating $172.40 from the
General Fuud and $193.20 from the Park Improvement Fund, and ordering payment
made to Morse Brothers for fill furnished at the Civic Auditorium and on the
south bank of the Zumbro River at Mayo Park, which was read.
i� Upon motion by Green second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said -

Alderman Fryer.introduced a resolution appropriating $400.62 from the

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $2312.64 from the
Firemen's Relief Fund and ordering payment made to Frank Springer, Treasurer,
for transfer of funds on hand from tax settlements for relief of firemen and.
their families, which was read.
Upon motion by Moody second by Green that the saia resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said

Alderman Amundsen introduced a resolution appropriating $in84.76 from the
Permanent Improvement Revolving Fund and ordering payment made to.Martin

Alderman Williams introduced tthe following resolution,which was read: i
'WHEREAS, Wm. C. Fraser & Son, in connection with the performance of
Sewer project NO.Minn.Docket NO.1516-F,-have requested permission to pay
labor. on said project by checks on the Olmsted County Bank.& Trust Company
of Rochester, Minnesota: `
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That, subject to the approval of th4t Public Works Administration in
connection with said project said Wm.C.Fraser & Son, contractor, is hereby
granted permission to pay all labor on said project by checks on the Olmsted
County Bank & Trust Company of Rochester, Minnesota. "
Upon motion by Richman second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted,.
Alderman Green introduced a resolutffion ordering a:hearing on the construction

partial payment due on contract for construction of Police Radio equipment,

Upon motion by Fryer second by Green that the said -resolution be adopted
as read, and -all voting in favor. thereof, President Lemmon declared the said
resolution duly passed and adopted.
Al-derman-'Moody brought up the question of a lease for the Barbee Cafe
in the WilliamsEstate business building, and upon motion by Fryer -second
by Moody the matter was referred to the City Attorney, the Public Grounds
Committee and the Custodian of the Williams properties.
Upon motion by Fryer second by Moody the Common Council adjourned.
