Council Chambers, in the City Hall, in said City, on January 9th,1939. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: Lemmon,.Amundsen, Fryer, Green, Moody, I Richman, Williams.. Absent: None. I Upon motion by Moody second by Green, the minutes of the meeting of I j, January•2nd,1939, were approved. President Lemmon announced this as being the time and place fixed for. a I' hearing on the vacation of Eighth Avenue Southwest from Tenth Street Southwest To -Eleventh Street Bouthwest, and the -alley in Block 3, Williams, Healy & Cornforth's Addition, and asked if there was any one.present who wished to - I be heard concerning the said.vacation. Jos. L. Plembling, Attorney, appeared in behalf of the Mayo Properties Association, to support the petition for said vacation., Mrs. E.E.Comarthn, i Mr. Walter E.Dodge, and Mrs. Herbert Drips also appeared before the Common Council and stated.that they used;Eighth Avenue Southwest considerably and were interested -in knowing just why the -street was being vacated, and to. protest its vacation. o Upon motion.by,Moody second by Fryer, the hearing -on the vacation of Eighth Avenue -and the Alley in Block 3, Williams,Healy & Cornforthts Addition was adjourned- and continued until 7:30 o'clock P.M., January 16th;1939.. Frank Satoris appeared before the Common Council and stated that due to t7ge fact that the water had undermined the sidewalk causing a settlement in front of his building, and also the basement had been flooded at several times, and.,requested that the sidewalk and pavement be repaired in order to .avoid the trouble he was now having. Upon motion by Fryer second by Moody the matter was referred to the Street and Alley Committee and the City Engineer for investigation and report at the meeting of this Council to be held January 16th,; 1939, ! !' A petition signed by Clarence Fischer and Wm. Stensrud, praying for ,the vacation of the alley running south from Eighth -Street Southwest between Fifth Avenue Southwest and Sixth Avenue Southwest to the northerly edge of Soldier Field, same being in Block S, Head & McMahon's Addition, was read. Alderman Amundsen introduced a resolution ordering that the above petition be filed of record in the City Clerk's Office, and ordering a hearing on the said petition for 7:30 o'clock P.M., on February 20th,1939. Upon motion by Green second by Amundsen,that the said resolution be j I adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. I i Record of Official Proceedings .of the Common Council of the. _City: of Rochester, Minn., ` January 9 t h , 1939 119 A communication from the executive secretary of the League of Minnesota Municipalities, calling attention to the biennial Legislative Conference of the League to be held January lSth at St -Paul, was read, and upon motion by Green second by Richman, any City official who could arrange to attend said conference, was authorized to do so at the expense of the City of Rochester. • A communication from Martin Paulson requesting permission to pay the men employed by him on PWA Docket 1515F by checks drawn on a local bank, was read. Alderman Williams introduced a resolution authorizing Martin Paulson to r a pay the men employed by him on PWA Docket 1515F by checks drawn on a local bank, subject, however to the approval of the Regional Direcbbn of the Public *o' rkQ Admini st ration, which was read.. Upon motion byRmundsen.second by Green, that the said resolution be adopted as read, and all voting.in favor thereof, President Lemmon declared the said resolution duly passed and adopted. The request of the .Rochester Firemen's Relief Association for approval of -:an additional loan of $1,000.00 to Frank Adair on his residence at 1020 Eighth .Avenue Southeast, was read, and President Lemmon referred the same to the Finmee Committee. The report of the City Engineer for the month of .December, 1938, showing s.., ,disbursements for laborfrom the General Fund $3. 62, from the Street and '-Alley Fund $1496.40, Sewer Fund $1171.19, and from the bridge fund $264.71, was re:a'&' "and President Lemmon ordered that the same be placed on file. The report of the Clerk of the Municipal Court "for the week ending January 2nd 1939, showing criminal fines -and costs collected $73..55, Civil fees $4.70 '' and conciliation court fees received $2.00', was read, and having been prevfously approved by the City. Attorney,.President Lemmon ordered that the same J�e placed on file. The report of the committee appointed by the President of the Council to_.." confer with -other orgainzations regarding the employment of a director of .>liesure time -activities. was read and.$pon'motion by Richman second by Moody said report was accepted and ordered placed on file. The appl"fcation of - 'Dale Hess for .a public dance permit at the Woodman Hall January 7th,1939, -and the application of Mrs. Cecil Vernon for a public dance • , permit at the..Armory, January 7th, 14th, 21st, and 29th,1939, were each read.. The application of Harry Belmont for a license to sell soft drinks at 324 South Broadway was read, and upon motion by Moody second by Amundsen, license was granted. The applications of Harry Belmont for on sale and off sale licenses to sell non -intoxicating malt liquor at 323 South Broadway were each read, and on motion by Richman second by Amundsen, licenses were granted. 120 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 9 ,19 39 . The application of Harry Belmont for a license to operate five ppol tables at 324 South Broadway was read, and on motion by Moody second by Richman license was granted. The applications of Ray Benedict, Donald V.Lukehart, Harold J.Waters, Vernon L.Wilkinson, and Leonard Lee for drivers licenses were each read, and I i on motion by Green second by Amundsen, licenses were granted. Alderman Williams introduced a resolution granting public dance permit to Dale Hess for the Woodman Hall, January 7th,1939, ah8 fixing the fee at $3.00, which was read._ Upon motion by Williams second by'Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution granting public dance permit to Mrs. Cecil Vernon for the Armory, January 7th, 14th, 219t, and 29th,1939, and fixing the fee at $12.00, which was read. Upon'.motioa by Fryer.seeond by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution du&y passed and` adopted. Alderman Richman introduced a resolution appropriating $,3399.00 from the Lighting Fund and ordering payment made to the City of Rochester, Light Depart- ment for electricity furnished for lighting public streets and grounds, which was read. Upon motion by Green second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. 122 Record of Official Proceedings of the Common Council of tfie"FCity of Rochester, Minn, January 9th, 1.939 . t4 I Alderman Moody introduced a resolution appropriating $259.00 from the General Fund and ordering payment made to the Rochester Post -Bulletin, for official publications and printing during December,1938,which was read. Upon motion by Fryer second by Green that the said resolution be adopted t as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $391.00 from the j' Street and Alley Fund and ordering payment made to Morse Brothers, for sand i and gravel furnished during December,1930, which was read. Upon motion by Richman second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $321.90 from the Light;- I . ing Fund, $33.75 from the GenerAl Fund, $20.70 from the Fire Protection Fund, j and $7.56 from the Street and Alley Eund, and ordering payment made to the City of Rochester, Light and water Departments, for Electricity and Water furnished at public buildings in accordance with the December 25th,1939,billings, which I was read. t Upon motion by Amundsen second by Moody that the said. resolution be adopted as read, and all voting in favor thereof,.President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $515.59 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund, for use of equipment during December,1938,which was read. Upon motion by Richman second by Green that the said resolution be adopted I as read, and all voting in favor thereof, President Lemmon declared the said. resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $940.1.4 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for I payrolls for labor during the half month ending December 31,1939, which was read. Upon motion by Moody second by Amundsen,that the said resolution be I adopted as read, and all voting in favor thereof, President Lemmon declared. the said resolution duly passed and adopted.. Alderman Amundsen introduced a resolution appropriating $314.55 from the General Fund and ordering payment made to the City of Rochester, Steam Depart- ment, for steam heat furnished at the City Hall, which was read. Upon motion by Fryer second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said I resolution duly passed and adopted.
