City _of Rochester, Minn., February 6th,1939.: 1..3 IL Minutes of a regular meeting of the Common Council,of the City -of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on February,6th,1939- President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody,, Richman, Williams. Absent: None. Upon motion by Moody second by,Richman, the minutes of the.meeting of January..16th,1939, were approved. A communication -from R.A.Radf ord,Regional Director, PWA,stating,;:that.the PWA have ho objection to the suspension of work for the winter season on Docket No.1515-F Street Improvements was read and President Lemmon ordered that the same be placed on file. Requisitions by the Health Officer, upon Saint Mary,'s Hospital for the isolation of Ruth Glaspey,, diagnosed to be suffering from measles,. Roger Sherman, suffering -from measles, and Mrs. Henry J. Cochran diagnosed to be suffering from measles, were each read, and President Lemmon ordered that the same be placed on file. The City,Engineer submitted specifications and estimate of cost for.furnishing a one and and half ton truck with cab and dump box, said estimate of coat being $1475.00 after allowance for old 24 International truck to be traded in. ' The trial balance of the City Enginear's Department for the month of Januiry,,1939,' was read and President Lemmon ordered that th8 same be placed on file. .The following communication was reed'and President Lemmon referred the•same to the Police Committee, the Mayor and the Chief of Police: 1002 - 1st St.S.W., ' Rochester, Minnesota. . January 25,1937' To The Mayor & City, Council of the'City of Rochester: ' Gentlemen: The Altruistic Club respectfully submits the following resolution: Resolved that the Altruistic Club petition the Mayor and Council of the City, of Rochester to consider the appointment of a uniformed police woman; selection to be made by Civil Service examination and whose hours shall be from 6 p.m. to 2.A.M.- 1. We wish to make known our interest in cooperating in any way.possible. Sincerely. Miss Bertha Wilcox, President Mae Hammond Secretary.. 11 The statistiaal-report of the Public Library.for the year 1939 was -read and President (Lemmon ordered that the same be placed`on file. The report of the Building, Electrical and Plumbing Inspector for the month of January, 1939, showing building permits issued $78.00; Electrical Permits $19.75, and Plumbing Permits $22.50, was read, and President Lemmon referred the same to the Finance Committee. The report of the City.Engineer for the month of Ja.nuary,,1939, showing expenditures for labor from the General Fund in the sum of $52981, from the Street and Alley Fund 4488.30, from !the Sewer Fund $1739.69, was read and President Lemmon ordered that the same be placed on file. 132 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February 6th.1939. The report of the Clerk of the Municipal Court for the week ending January 23,1939, show- ing criminal' fines and costs collected $202.40, civil fees received $21.25, conciliation court fees $5.10; for the week ending January 30th,1939, showing criminal fines and costs collecte8 $160.80, civil fees received $9.05, and conciliation court fees received $4-50, were each rehd, and having been previously approved by the City.Attorney, President Lemmon ordered j tha t the same be placed on file. j The report from the Trustees of the Hurlbut Book Fund for the year 1938, showing I receipts in the amount of $580.65, and disbursements $590.65, including the check for $465.50 to the City Treasurer for'the Library Fund, was read, and upon motion by Green second by I - Amundsen, the report was accepted and ordered placed on file. i The following list of recommended changes in the names of streets now designated as Places, was submitted by the City Engineer and upon motion by Fryer second by Richman the j. said recommendation was referred to the City Attorney.to draft an ordina4 ce changing the names of said Places accordingly: "Names of Places to be changed to Streets and Avenues. 8 Place N.W. to be 82 Ave. N.W. 1'Place S.E. to be 1 Ave.S.E. j 9 Place S.E. to be 1 Street S.E. 10 Place S.E. to be 1 Street S.E. -10i Place S.E. to be 10- Street S.E. 11 11 Place S.E. to be 11? " The Chief of the Fire Department appeared before the Council and stated that they had j found buildings where there was no possible entrance to the basement from the outside of the building, and recommended that safety fire entrance plates be installed where no other entrance to the Building was available. He also presented a detail of the safety entrance j plate used in the City.of Winona. Upon motion by Fryer second by.Williams, this matter was referred to the Street and Alley -Committee the City. Attorney and the Chief Of the Fire I Department -with instructions to make an inspection of the plates as installed in the City of i Winona. i, An ordinance entitled, "An ordinance to regulate the production, transportation, Ii processing, handling, sampling, examination, grading, labeling, regrading, and sale of milk or r j milk products; the inspection of dairy herds, dairies, and milk plants;• the issuing and revocation of permits to milk producers and distributors; the plackrding of restaurants and other establishments serving milk or milk products; and the fixing of penalties",introduced and given given its second its first reading January 2nd,1939, was g reading. Applications signed by Claude L.Bogard, Clifford J.Carson, Roger Enderson, and Ray H.Reed, for drivers licenses were each read, and upon motion by Richman second by Green licenses were granted, i� Record of Official Proceedings of the. An application signed by Charles Wilkin for a soft drink dealers license at 1009 Second Avenue Northwest, was read, and -upon motion by.Amundsen second by Williams license was granted. The applications of Marie C.Tadens and - Leonard Lee for transfer of On Sale license 260 and Off Sale license No.445 for selling non -intoxicating malt liquors -at 1120 Fifteenth Avenue (Southeast, to Marie C.Tadens,,were each"read, and upon motion by.Amundsen second by Green transfer was granted. I , The applications of A.R.Marquardt and Mrs. Geo.W.Sears for transfer of off sale non-intoxicat t liquor license No.439 to A.R.Marquardt, was read, and upon motion by Moody,second by, chman transfer was granted. The.application of the Yellow Cab Company for a taxicab license covering a 5 passenger Cadillac sedan, was read, and upon motion'by,Richman second by.Moody license was granted. Applications signed by the Belmont Billiards, Merchants & Jobbers Credit Corporation, and (the Olmsted County,Implement Company far permits .to place and maintain signs were each read, Band upon motion by,Amundsen second by Green permits were granted. The application of the Maass & McAndrew Company.for a license to connect with sewers and ins, together with a surety.bond in the sum.of $1,000.00 with the National Surety Corporation surety thereon, were each read, and upon motion by,Moody,second by Green, the license was rated, the bond approved, the surety,thereon accepted and it was ordered that the said bond placed on file. The application of Harry. Belmont for a license to operate four pin ball machines at Broadway Street Southwas read, and upon motion by Green second by_Richman license was anted. r The surety bond of the Peterson Electric Company,in the sum of $1,000.00 with the New Amsterdam Casualty. Company, as surety, was read, and upon motion by Moody second by, Richman the bond was approved the surety thereon accepted, and it'was ordered that the same be placed Ion file. The contract bond of Wm. C.Fraser & Son, in the sum of $1218.30,covering contract for 0 struction of a sanitary.sewer in Seventh Avenue Northwest and Tenth Street Northwest, with the ted States Guarantee Company.as surety in the said sum, was read, and upon motion by,Richman econd by Moody the said bond was accepted, the surety thereon approved, and it was ordered that same be placed on file. .11 The application of Marie C.Tadens for a soft drink dealers license at 1120 Fifteenth Avenue Southeast,- was read, and upon motion by Moody second by Amundsen, license was granted. The applications of General Drivers Union Local 974, and Mrs. Lydia Schacht for transfer of On sale license 235 and off sale license 391 for selling non -intoxicating malt liquor at 410 rst Avenue Northwest, to the General Drivers Union, Local 874, were each read, and upon motion Fryer second by Green transfer was granted. 11 ing 134' Record of Official Proceedings of the Common Council of the City _of Rochester, Minn., February 6,1939 Alderman Williams introduced a resolution authorizing the Public Utility Board to enter into contract with the Westinghouse Electric Supply Company for furnishing 2770 feet American Steel and Wire Company 3. conductor 400,000 C.M. 7rx 4/64 inch V.C. 9f64 inch lead covered 5000 volt underground system cable at a price of $1732.00 pelt M. feet making a total price.of ' I $4909.76, said price including the amount of $318.00 for six reels and said price subject.to a I cash discount of a of 1 percent or a net contract price of $4469.31, in accordance with the resolution request of the said Public Utility Board dated January,31,1939, which-:wdo read. Upon motion by Richman second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced.a resolution adopting the City Engineers specifications and i estimate of cost for the furnishing to the City of Rochester of a one and one half ton truck with' cab and two yard dump box, for use in the City Engineer's Department, and ordering advertisement ;for bids for the furnishing of said truck in accordance with said specifications, said bids to be received and opened at a meeting of this Common Council, to be held at 7:30 o'clock P-M., on February 20th,1939, which was read. r. Upon motion by Amundsen second by Green that the said resolution be adopted as read,, and all voting in favor thereof, President Lemmon declared the said resolution duly,passed and adopted. Alderman Williams introduced the following resolution which was read: "WHEREAS, By resolution dated October 24th,1932, the Public Utility Board of the City of Rochester, Minnesota, was authorized to pay 10% of the gross income from the operation of the ;I Light and Water Departments of said City into the City Treasury for general taxation purposes, and WHEREAS, in determining the amount of the 1939 tax levy, the distribution of said income tax to the various funds of said City was taken into consideration; NOW THEREFORE, Be it and it is hereby resolved by the Common Council of the City.of Rochester, Minnesota: ` That b eginning with the January 318t,1939 payment of said income tax and continuing for a period of twelve months, the distribution of said tax shall be 60p thereof to be distributed in proportion to the taxes levied for the General -Fund, and 40% to Code 18 of the General Fund." - Upon motion by Amundsen second by Williams, that the said resolution be adopted as i read, and all voting in favor thereof, President Lemmon declared the said resolutf'on duly passed and adopted. Alderman Richman introduced the following resolution which was read: V "be it resolved by the Common Council of the City of Rochester, Minnesota: That the f ollowiiig designations of polling.places be and the same•are hereby effective upon the adoption and approval of this resolution; , The polling place for the Second District of the Second Ward shall be in the H.& H.Dairy building, located at 5-10 First Avenue Southeasto , The polling place for the Fourth District of the Third Ward shall be in the Northwest Novelty Company,building located at No.400 Fourth Avenue Northwest. Be it further resolved by the said Common Council: That all resolutions or parts of resolutions inconsistent herewith are hereby repealed. Alderman Richman introduced a resolution granting public dance permit to the Co -Operative-, Oil Credit Union, for the Armory,on Febrdary,9th,1939, and fining the fee at.$3.00; which was Upon motion by.Richman second by,Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody,introduced a resolution appropriating $317.70 from the General Fund and ordering payment made to the City.of Rochester Steam Heating Department for steam heat furnished at the City,Hall, in.accordance with the January,28th,1939,billing, which was read. Upon motion by. Amundsen second by, Williams, that the said resolution be adopted as read,.' and all voting in favor thereof, President Lemmon declared the said resolution duly.ppssed and adopted. Alderman Moody.introduced a resolution appropriating $5304.29 from the General Fund -and ordering payment made to Wm. C. Fraser & Son for estimate N0.2 on contract for construction of sewers under P.W.A.Docket NO.1516-F, which was read. Upon motion by,Green second by Richman that the said resolution be adopted as ready and 1 voting in favor thereof, President Lemmon declared the said resolutioni duly,passed and adopt Alderman Moody, introduced a resolution appropriating $494-77 from, the. Street and Alley, Fund and ordering payment made to the Street and Alley.Fund, for use of equipment during January,1939. which was read. Upon motion by.Richman second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, -President Lemmon declared the said resolution duly, passed and adopted. .Alderman Green introduced a resolution appropriating $3857.25 from the Lighting Fund and orde ing�payment made to the City,of Rochester Light Department for lighting of.public streets and. grounda, in accordance with the January 25th,1939,billings, which was read... Upon motion by.Green second by Richman that the said resolution be adopted as read,' and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $364,00 from the Sewer Fund and i ordering payment made to the Flexible Sewer, od Equipment Company for 321 ft. flexible roda i and couplings, etc.. (Root cutter - Sewer cleaning equipment) for use in the City Engineerls Department, which was read. Upon motion by Amundsen second by Fryer, that the said resolution be adopted as read; and all voting in favor thereof, -President Lemmon declared the said resolution duly passed and adopted. - Alderman Amundsen introduced a resolution appropriating $2659.79 from the -General Fund and ordering payment made to Martin Paulson, for estimate No.l on contract for construction of laterals under P.W.A.Docket NO.1515-F(B), which was read. Upon motion by.Richman second -by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President-Lemmon declared the said resolution duly passed and adopted.
