' February 20tri; 1939, 139 Minutes of .an adjourned regular meeting of. the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall,in said City, on February 20tTa, 1939. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being pf'esenti Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams.' Absent: None.. Upon motion by Moody second by Amundsen,the minutes of the meeting held February 6th,1939, were approved. President Lemmon announced this'as being the time ana'place 'set for a hear- ing on the vacation of the alley running south from Eighth Street Southwest between Fifth Avenue Southwest and Sixth Avenue Southwest to the northerly edge of Soldier Field, and asked if any one present wished to'be heard concerning said vacation. No one present wished to be heard. President Lemmon announced this as. being the time and place fixed for receiving and opening bids for the furnishing of a one and one half ton truck - with cab and dump box for -use of the City Engineer's Department. The following bids were received and opened at this time! International Harvester Compan;;TT $1305.06 Clements -Chevrolet Company $1245:00 - - Motor Sales.& Service Company $1265.00 W.L.Martin $1392.60 Ellis Motor Company $1360.00 President Lemmon referred the above bids to the City Engineer and Street. & Alley Commit.tee for tabulation and recommendation. Requisitions by the Health Officer upon St.Mary's Hospital for the isola tion of Marie Terese Plemling, diagnosed to be suffering.from chickenpox and complications, was read, and Presidenti:Lemmon ordered that the same be placed on file. Appointments by the Mayor of Irven Earl Dunford as a Special Policeman for duty at the A.O.U.W.Hall, Milford Benjamin as Special Policeman for duty at the Woodman Hall, and I.R..Green as Special Policeman for duty at the National Guard Armory, each to serve without pay and to hold office until the second Monday in Apri1,1939,unless sooner removed, were each read, and President Lemmon ordered that the same be `placed on file. The following communication was read and President Lemmon ordered thatthe same be placed on file: °February.17,1939. Common Council City of Rochester Rochester, Minnesota Gentlemen: The Board of Public Health and Welfare, in conformity to t.he, advertised request for bids, has received four bids for'trucke for the City Hog Farm. The -two lowest bids -were -for $600.00 each and, after studying the situat,i:on carefully,.. the Board decided to select 'the bid entered by the Ellis Motor Company. '4 140 Record of. Chief of Police, and Police Committee: " OLMSTED COUNTY WELFARE BOARD Court House Rochester,Minnesota February 16, 19 39 ' To the Common Council City of Rochester Rochester, Minnesota Dear Sirs: At the February 6,1939 me6ting of the Olmsted County Welfare Board a motion was made and carried that the Welfare Board respect- fully recommend to the City Council the appointment of a trained Policewoman. . ,Respectfully yours, O:W.Szhroeder Executive Secretary" An.emergency authorization by the Mayor to F.R.Finch,Ci-ty Clerk, for the purchase of approximately 6000 gallons of gasoline'at an approximate cost of $760.00, was read, and President Lemmon ordered that the same be placed on file. The following petition, signed by Walter F. Hansen, and thirteen others, !was read, and President Lemmon ordered that the same be placed on file: "To the Honorable Mr.W.A.Moore,Mayor, and Common Council of the City of Rochester: We the undersigned desire to have the 3.2 zone extended from Fourth Street and Broadway South to Sixth Street and Broadway South, due to the fact that this is entirely a business district and is well patrolled twenty four hours." The following petition was read and upon motion by Williams, second by Richman said petition was granted$ ` "We the undersigned owners of property on Eighth Place N.W., Rochester object to the changing of the name of said Eighth Place to Eighth and one-half Avenue Northwest and wo petition ar_d. request that if any change is made in the name of said street or place, that it be called Ninth Avenue Northwest and that the `present Ninth Avenue be called Tenth Avenue Northwest." The following communication was read and President Lemmon ordered that the same be placed'on file: "THE FIRST NATIONAL BANK Rochester,Minn.' Cegal, Ass't ..Cashier" T The following communication was read and upon motion by Fryer second by Amundsen, it was referred to the License Committee and the Park Board: "Rochester, Minnesota Feb.16, 1939 To the City Council Rochester, Minnesota Gentlemen:-" As members of the WOMEN'S CHRISTIAN TEi,PERANCE UNION, An organization that is pledged -to serve thebest interests of our community, we are writing to protest against the sale of beer in` SOLDIER'S FIELD. We understand that the sale of 3.2 beer has been licensed hitherto and we urge that during the 1939 season no license be gralt ed for such sale. SOLDIER'S FIELD is our city' -s playground. To it our chile-ren flock. There is grave inconsistency in providing,on the one hand, -a healthful recreational center for our youth and then, on the other, making it easy for them to obtain drink that will undermine their physical health. Isn't it inconsistent also to provide for the sale of beer and then provide policemen to arrest those who imbibe too freely? Isn't there danger that by permitting the sale of beer at Soldier's Field you are helping to make drunkards of our young folk? _The license fee can be of no importance to any treasury. The cost of additional policing and jail board too easily offsets the advantages of extra license fees. We want -to keep our city's playgroung danger -free and clean, from every point of view, and we ask your kind cooperation and under- standing. President Lemmon referred the said report to the Finance Committee. The report of the Clerk of the Municipal Court for the week ending February 6th,1939, showing criminal fines and costs collected. $195.20, Civil fees received $5.65, conciliation court fees $2.50, and for the week ending February 13th,1939, showing criminal fines and costs collected $192.90, civil fees received $5.10,- and conciliation court fees $1'.50, were each read, and Raving been previously approved by the City Attorney, President Lemmon ar&ered".that the,= same -be placed on file. 142 Record of Official Proceedings of the Common Council of the. The report of the Finance Committee stating thatthey had examined the P g January 1939 reports of the Building,Electrical and Plumbing Inspector, and the Weighmaster, and found the same to be correct, was read and President Lemmon ordered that the same be placed on file. Copies of resolutions passed and adopted by the Commissioners of the Sinking. Fund, appropriating $192.00 from Code 11 to Code 20 of the Sinking Fund, $1500.00, from Code 30 to 29 of the Sinking Fund, and $2,402.79 from Code 26 to Code 25 of the Sinking, and appropriating $19,000.00 from the Sinking Fund and ordering payment made to J.W.Feller, Postmaster, for United States Savings Bonds purchased for Sinking Fund investments; $2,000.00 for City Hall Bond Investments, $10,000.00 for Light Department Depreciation Reserve investments, $10,000.00 for Water Department Depreciation Reserve investments, and $2,000.00 for Warerhouse Investments, were each read, and upon motion by Green second by Richman the actions set -forth therein were approved. The application of W.L.Youmans for a pin ball machine license at 1137 Second, Street Southwest, was read, and upon motion by Richman second by Green, license was granted. The, application of N.D.Adams fora a- plumbers license,- toget-hey.with a surety bond in the sum of $1,,000.00 with the Fidelity & Casualty Company of New vork,as surety, were each read, and upon motion by Richman second by Amundsen, the license was granted, the bond approved, the surety thereon accepted and itwas ordered that the bond be placed on file. - The.appli.cation of Arthur A.Brown for an electrician's license was read, and upon motion b;y Fryer, second by Amundsen, license was granted,subject to his filing the required surety bond. The application of,Sam DeFosse for transfer of his non-intoxicatipg malt liquor license to 306 Twelfth Street Southeast was read, and upon motion by Williams, second by Fryer, the application was -referred to the License Committee and the Chief. of Police and City Attorney. Alderman Fryer introduced,an ordinance entitled, "An ordinance amending an ordinance entitled,'An ordinance regulating the license and sale of - non -intoxicating malt liquors; prohibiting the sale thereof at retail except .,in licensed premises and to any person under,the age ,of twenty one years of age, and repealing all ordinances or parts of ordinances inconsistant herewith," Which was given its, first reading.. upon roll call Upon motion by Fryer; second, by Moody, and/all voting in_ favor thereof, the rules were suspended•and the said ordinance was given its second reading. Upon motion by Fryer, second by Richman, and upon roll call all members voting in favor thereof, the rules were suspended and the said ordinance given its third and final reading... Upon motion by. Green second by Amundsen,that the said ordinance be adopted as read, and upon roll call all members voting in favor thereof, P2resident Lemmon declared the said ordinance duly passed and adopted. Alderman Amundsen introduced an ordinance entitled,"An ordinance changing the names of certain public streets, avenues and placed within the corporate limits of the -City of Rochester, Minnesota," which was given its first reading. Alderman Richman introduced a resolution granting public dance permit tot Mrs. Cecil Vernon for the National Guard:,Armory for February 4th, llth, l8ih, and 25th, 1939, and fixing the fee at $12.00, which was read. Upon motion by Amundsen second by ?dilliams', that the said resolution be adopted as read, °and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman -Moody introduced a resolution granting public dance permit to Plumbers & Steamfitters- Local 55`6, for the-A.0'.U.W.Hall9 February 275th,1939 , and fixing the fee at $3.00, which was read. Upon motion by Amundsen second by Williams, that the said resolution be' adopted as read, and'all voting'in favor thereof, President Lemmon declared the said resolution duly passed and adopted. ' Alderman Green introduced a resolution appropriating $996.66 from the Park Improvement 'fund and ordering payment made -to the Mayo Trust Fund, -for payrolls' for labor during the half month ending February 15th,1939, whitah was read. Upon motion by Moody second by Amundsen,that.the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Moody second by Amundsen,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Aldeman Fryer introduced a resolution appropriating •$4720.00 from the ,Fire Protection Fund and ordering payment made to the City of Rochester, Water Department for hydrant rental, which was read. Upon motion by Richman second by Moody that the said resolution_be adopted as read, and all voting in favor thereof, President Lemmon declared the said .resolution duly passed and adopted. _ Alderman Amundsen introduced a resolution appropriating $6725.00 from 'the General Fund and ordering payment made to the PWA Construction Account, 'Docket No.Minn.1516-F for transfer of funds into a special account for P.W.A. !Job under said docket No., being the city's 5591 share of the total estimated costs which was read. Upon motion by Fryer second by Green, tha t the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , Alderman Amundsen introduced a resolution appropriating $5,000.00 from the j General Fund and ordering payment made to PWA Construction Accoung, D.ockdt No. Minn.1515-F., for transfer of funds into a. special account for PWA job.under said docket No., 'said amount to apply on th.e City's 55% share of estimated cost, ;which was read. Upon motion by F'ryer second by Williams, that the said resolution be adopted' as read, and all voting in favor thereof, President Lemmon declared the said ,resolution duly passed and adopted. Alderman Amundsen introduced a resu�ution authorizing the City Treasurer to ,releasesecurities deposited as colleteral in lieu of a depository bond by the ,First National Bank, which was read. _ Upon motion by Fryer, second by Amundsen,that the said resolution be adopted.as read, and all voting in favor thereof, President Lemmon declared.th.e said resolution duly passed and adopted. Upon motion.'by Amundsen second by Moody the sum of $199.00 was appropriated from .the General Fund and ordered paid to W.A-.Moose, Mayo, for use in his Mayor's contingent fund, he to properly account for the expenditures therefrom. The matter of opening: Seventh Street Southwest from Fourth Avenue South- west to Second Avenue Sputhwest-was considered and upon motion by Fryer second by Richman it -was referred to the Street and Alley Committee, the .City Engineer - and Board of Park 'Commissioners for' inve•s,tigation and recommendation. Upon motion by -,Amundsen s.econd by 'Fryer the City Clerk was instructed to request the heads of various'City departments to,submit their inventories of supplies and equipment as at February .28th, 19.39.'• 4 Upon motion by Fryer second by Richman the City Clerk was authorized to return the checks of the unsuccessful bidders o,n furnishing a one and one-half, ton truck for the Engineer's department.
