Minutes of a. regular meeting of the Common Council of the City of Rochester,
Minnesota, held in- the Council Chambers, in the City Hall in -said City on
March 6th,1939.
President Lemmon called the meeting to Order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody,
Richman, Williams. Absent: None.
A petition signed by Harold Steuart, et.al., regarding 'the_ continuation
of Tenth Street Southwest, agreeing to accept -without opposition the opening of.
said Tenth Street in accordance -.with the plat attached to the petition, was
read, and upon motion by Richman sedond by Green, the petition and plat were
ordered placed on file, and the opening,of Tenth Street Southwest was authorized
under the supervision of the City Engineer.

"To the City Council.
Dear Sirs:
The Woman's Foreign Missionary Society of the Methodist
Church wish to go on record as opposing the sale of beers or liquors of
any kind in the new Auditorium or in Soldiers Field.
We have a membership of 75 -members, who are a .part of .an
international organization of many thousands, which is celebrating
its 70th anniversary this year.
Hoping this receives favorable consideration - yours truly

The petition of Emil Krolow for the construction of a sanitary sewer on
91 Avenue Southeast from Eleventh Street to Twelfth Street Southeast, was read
and. President Lemmon referred the same to the Sewer -Committee and City Engineer.
A notice of claim for damages by the Clements Chevrolet Company for damages
to two automobiles in a collision with the car owned and driven -by Francis
Sheets, said damages amounting to $91.50, was read, and President Lemmon referred'.
the same to the City Attorney, City Engineer and -the Street & Alley Committee.
A communication from the Social Service Club of Rochester, Minnesota,
recommending the appointment of a police woman, was read -and President Lemmon
ordered that the same be placed on file. <
The trial balance of the City Engineer's Department far February,1939,
was read and President Lemmon ordered that,.the same be placed on file.
The annual report of the Rochester Firemen's Relief Association showing
a balance on hand December 31st,1935 of $3695.00, was read and President Lemmon
ordered that the same be placed on file.

The foldowing communication was read, and upon motion by Green second by
Fryer, the, request therein wasgranted, and it was ordered that the same, b•e -

"Honorable Mayor and Common Council
City of Rochester,.Minnesota
Gentlemen:.
The members of the Police Department of,the Pity of Rochester, Minn-
esota have formed a corporation known as 'THE ROCHESTER POLICE RELIEF ASSOCIATION
under and in accordance with the provisions of Chapter 152 of the 1919 Session
Laws of the State of Minnesota as the same has been amended by Chapter 31 of
t•he-1929 Session Laws. The purpose of the forming of the corporation is -.to
provide funds to be obtained from annual contributions of the members and from
the proceeds of an annual tax levy of three sevenths of one mill upon each dollar
of all of the taxable property of the City of Rochester for the purpose of paying
disability and/or retirement pensions to members of the Association and their.,
widows. The by-laws of the Association -provide for an annual deduction from the
pay of each member out of its first pay check in March.of each year in the sum
of $3.00. It is the desire of all of the members of the Association that that
sum be deducted from each pay check of each member of the Police Department
of the City of Rochester for the first half of March, 1939 as all of the members
of this Department are eligible to and have joined the Association. Attached
hereto, for your information and guidance in transacting business with this
Association, are certified copies of the Articles of Incoporation and of the
By -Laws, which I believe are self-explanatory. Will you kindly, therefore,
by motion, direct the City Treasurer to make the necessary deductions in
accordance herewith.

Attached �o the above communication were certified copies of the Certificate
of incorporation and the by-laws of the Rochester Police Relief Association, whic]
were read, and upon motion by Green second by Fryer it was ordered that the'same
be -placed on file.
The report of the Finance Committee ptating that they had checked the
reports of the Building,Electrical and Plumbing Inspector, and the City Weigh -
master for -the month of February,1939, and found the same to be correct.. Upon
motion by Fryer second by Amundsen the said report was accepted and it was
ordered that the same be placed on file.
The report of the Clerk of the Municipal Court, for the week ending
March 6th,1939, showing Criminal fines and costs collected $21-7.90, civil fees
received $6.60, and conciliation court fees $2.50, was read,- and having been
previously approved by the City,Attorney, President Lemmon ordered that the same
be placed on file.
The application of Sam Lumelsky for a junk buyer anti collectors license
was read, and upon motion by Amundsen second by Fryer, license was granted.
The application of Foster-Mrachek Electric Company for an electrician's
license, together with a surety bond in the sum of $1,000.00 with the Fidelity
& Depos-it Company as surety, were each read, and upon motion by Green second
by Moody,the license was granted, the bond approved, the surety thereon accepted,
and it was ordered that the same be placed on file.

An ordinance entitled, "An ordinance to regulate the production, transpor-
tation, processing, handling, sampling., examination, grading, labeling, regrad-
ing, and sale of milk or milk products; the inspection of -dairy herds, dairies,
and milk plants, -the issuing and revocation of permits -to milk producers and
distri,butors, the placarding of restaurants -and other establish#ients serving
milk or milk products, and the fixing of penalties-" introduced and given its
first reading January 2nd, 1939; its second reading February 6th, 1939, aad given
its third and final reading.

Upon motion by Amundsen second by Fryer that said ordinance be adopted as
read, and all voting in favor thereof-, President Lennon declared the said
lordinance duly passed and adopted.
An ordinance entitled, "An ordinance changing the names of certain public
steets, avenues and places within the corporate limits of the City of Rochester,
i Minnesota. ° introduced and givei3 its first reading February 20th, 1939, was
given its second reading. ,
The following recommendation from the Board of Zoning was read, and upon
motion by Amundsep second by Richman, action thereon was deferred until the
meeting of this Common Council, to be hall at 7:30 o'clock P.M., on March 15th,

Honorable Mayor and Common Council,
City of Rochester, Minnesota.
Gentlemen:
We, the Board of Zoning of said City, after full. and
complete investigation of all matters contained in the petition
of the Mayo Properties Association, relative to the matter of
location of buildings in Belmont Slope, do hereby recommend that
::said petition be in all things granted, except that part thereof
m reading as follows:
°(d) That in cases where a garage, to be accessible, is
built nearer the street line than the dwelling to which it is
appurtenant, the same shall be not less than 5 feet from the
street line and when so situated the.floor shall be not more
than 2 feet below the curb line of said lot, and the roof there-
on shall be not more than 3feet`'above the natural grade line
of said lot at that point."

According to present plans the Mayo Civic Auditorium
will '�e turne.d over to the city of.Roghestor on March Sth,1939. Will
you please take the necessary action to provide fire and extended
coverage insurance for this ,property on and after that date. It is
suggested that this insurance be written with'the ninety percent
co-insurance clause as provided,in,the general form,used by the city.
There she.uld.also be included under this coverage
office equipment and supplies valued at $370.and ice cleaning
machinery valued at $410 purchased by this department.

Alderman Williams introduced a resolution ordering a hearing on the
construction of a sanitary sewer in 91 Avenue Southeast from Eleventh Street
to Twelfth Street Southeast, -said hearing to be held at 7:30 o'clock P.M., on
March 20th,1939, which was read.
Upon motion by.Amur_dsen second by Fryer, that the said=resolution be
adopted as -read,

Alderman Willizams introduced a resolution authorizing the Public Utility
Board to enter into a contract -with C.C.Pagenhart for the<construction of a
regulator station building for the sum -of $2200.00 in accordance with resolution

Upon motion by Fryer, second by Richman that the said resolution be

Alderman Fryer introduced a resolution granting public dance permit to
Dale Hess for the Woodman Hall March 4th,1939, and fixing the fee at $3.00,
which was read.
Upon motion by Moody second by Amundsen,that the said resolution be adopted

Alderman Moody introduced a resolution appropriating $1199:,92.from the PIA
Construction Account, Docket No-1515-F, and {ordering payment made to Martin
Paulson, for Estimate No-2 on contract for construction of laterals under said
Docket No-1515-F, which was read.
Upon motion by Green second by Richman, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared -the said
resolution duly passed and edopted.
Alderman Moody introduced a resolution appropriating $243.65 from the
General Fund and ordering payment made to the State of Minnesota, Oil, Inspec-
tion Division, for Inspection fee $2.17, and State tax on 6037 gallons
gasoline furnished in car No.-SWLX 6002, which was read.
Upon motion by Richman second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating $529.50 from the
Street and Alley Fund and ordering payment madeto the Street and Alley Fund,
for Use of equipment during February,1939, which was read.
Upon motion by Green second by moody that the said resolution be adopted as
read, and all voting -in -favor thereof, President Lemmon declared the said
resolution duly passed and adopted:
Alderman Green introduced a resolution appropriating $906#79 from the Park
Improvement Fund'And ordering payment made to the Mayo Trust Fund, for payrolls
for labor during the -half month ending February 29th,1939, which was read.
Up6n-motion by Fryer, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and ad6pted.
Alderman Fryer introduced a resolution appropriating $?35.79 from the Genera]
Fund and ordering payment m&de to the Phillips Petroleum Company for 6125 gallons
gasoline furnished in car No:SWLX 6002, which was read.'
Upon motion by Williams second by Green that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared'the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution granting public dance permit to
F.L.Schroeder,Paul Schroeder and Lawrence Bernard, for the'A.O.U.W-Hall,
March llth,1939, and fixing the fee at $3.00, which was read.
Upon motion by -Amundsen second by Richman, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon'declared the
said res6lution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $204.24 from the

Alderman Moody called the attention,of
the Common Council to the Sewer
School to be conducted in Saint Paul, March
9ta, 10th, and llth, and upon -
motion by Green second by Fryer, the City
Engineer and such other members of
the Council,trho can go, were authorised to do so at the expense of the City
of Rochester.
Upon motion by Richman second by Williams, the Common Council adjourned
to 7:30 o'clock P.M., on March 15th,1939.
