Minutes of an adjourned regular"meeting of the Common Council of the City of ?Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in said City, on March 15th,1939-
President Lemmon called -the meeting to ordef at 7:30 otclock P.M., the following members bet
present: Lemmon,'Amundsen, Green, Moody, $ichman, Williams. Absent: Fryer. Alderman Fryer
being absent on.gccount of the illness of himself.
Upon motion by Amundsen second by Richman, the minutes of the meetings of February 6th, Marc;
1st,' and Marbh 6th,1939, were each approved.
A communication from Edgar Buenger, representative of the Mayo Properties Association,
asking that the Council defer further action and consideration of the petition for certain
setback's, building lines, etc., for Belmont Slope, until the meeting of Marcia 20th,1939, and
upon motion by -Amundsen second by Green, the request was granted.
The following communications were read, and President Lemmon referred the same to the
License Committee and the Board of Park Commissioners:

beer or liquor -license be granted at the new auditorium. A civic place like
it should be free from such influence. Our children and public should be -

At a meeting held Tuesday, March 7, The "Live and Learn Study Club,"
a group with a membership of twenty-five, went on record as opposed to the
i8suance of licenses for the sale of beer at Soldiers Field and at the Mayo
Civic Auditorium. The vote was unanimous.
We ask that you give due consideration to this matter.

A copy of a requisition by the Health Officer, upon St.Mary's Hospital for the isolation
of William Miller, diagnosed to be suffering from suspected diphtheria, was read and President
Lemon ordered that the same be placed on file.

The appointment by the Mayor of Willard Hutchins as a Special Policeman for duty in
all parks, to serve without pay and to hold office until the second Monday in April,1939,
unless sooner removed, was read and President Lemmon ordered that the same be placed on file.
A communication from the Police Civil Service Commission stating that Edward J. Siem
had been removed from Police Civil Service on act of violation of Section 1 of Rule 22 of
the Police Rules and Regulations, effective March 31st,1939, was read, and upon motion by
Moody second by Williams the action of the Police Civil Service Commission was approved.
A communication from the Police Civil Service Commission recommending; that Harry IL
Tompkins be authorized to act as Chief of Police until such time as the Commission will need
to hold an examination for said office, was read, and upon motion by Green second by
Richman said recommendation was approved.
The request of Leslie R. Bamgarner for permission to close the dance in the Woodman
Hall March 17th,1939, at 1:00 o'clock A.I.i.instead of 12:00 o'clock midnight, and upon motion
by Moody second by Amundsen, the request was granted.
The application of Mrs. Sophia Anderson for a soft drink dealers license at 1150 Third

Avenue Southeast, was read, and upon motion by Amundsen second by Richman license was granted.

The application of the Vim. T. IVIcCoy Post No.92 for transfer of their 3.2 beer license
No.454 and No.266 from the Club rooms at 104 Second -Street Southeast to the Legion Club Rooms
in the Mayo Civic Auditorium, was read, and Alderman Amundsen moved that the transfer be granted.
There was no second to Alderman Amundsen's motion,whereupon President Lemmon declared the
motion out of order.

The application of John Bray business Agent for the General Drivers Union Local P74,
and Phil Sternberg, for transfer of non -intoxicating malt liquor licenses No.391 and 235 for .
transfer of said licenses to Phil Sternberg was read, and upon motion by Green second by
Amundsen, transfer was granted.
The application of Phil sternberg, for transfer to him of Pin Ball machine license
No.1337 at 410 First Avenue Northwest to him at the same -location, was read, and upon motion

by Richman second by Williams, transfer was granted.
The report of the City Weighmaster for the month of February,1939, was read, and
President Lemmon ordered that the same be placed on file.

The report of the Clerk of the Municipal Court for the week ending; March 16th,1939,
showing criminal fines and costs collected $199.40, civil fees received $7.80, conciliation
court fees received $4.00, was read, and having been previously approved by the City Attorney
President Lemmon ordered that the same be placed on file.
The following petition signed by 23 persons, was read, and President Lemmon
referred the same to the License Committee, the City Attorney, the Police Committee and the
Chief of Police;

"WE, the undersigned, members of the Retiil 3.2 Malt Dealers Beverage Assn., for the
betterment of the city, citizens, and for more convenience to the Police Dept., do hereby
petition your honorable council to establisha more favorable 3.2 regulation by combining
the On and Off Sale licenses - that is, no dealer should be allowed to sell 3.2 beer off sale
unless he also possesses an on sale license.- We believe such an ordinance would make for better
co-operation between our organization and our city government.ft
F. J. O'Brien and Lloyd Joachim spoke for an organization of grocers in opposition to the
above petition.
A petition for a sanitary sewer in Eleventh Street Northeast from the alley between
Broadway and First Avenue Northeast, east as far as possible, was read, and President Lemmon
referred the same to the Sewer Committee and the City Engineer and requested that a.report
be made thereon at a meeting to be held March 20th,1939.
The following claims were read, and upon motion by Williams second by Richman, and all
voting in favor thereof, the same were allowed and the Mayor and City Clerk were authorized
and directed to draw warrants upon the City. Treasurer and make payments accordingly:*

Alderman Amundsen introduced a resolution appropriating $1698.16 from the Park Improvement
Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the half
month ending March 15th,1939, which was read.
Upon motion by Green second by Williams, that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.

jThe Common Council canvassed the returns from the Charter Election held March 14th,1939;
members of the Board of Education of School Dist.No.8 were also present during this canvass.
Alderman Williams introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the following is a tabulated statement and list of the number of votes cast for each
person at the Charter Election held March 14th,1939, in the City of Rochester, Minnesota, as
determined by said Common Council, on the canvass of the returns of said election made the
15th day of March, 1939; the said statement is hereby declared to show the result of said
election.

SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota%
That Paul Grassle is hereby declared to be elected to the office of Mayor of said City,
at the Charter Election held March 14th,1939, to hold office for two years and until his

successor is elected and qualified;
That J. T. Lemmon is hereby declared to be elected to the office of Alderman at Large of
said City, at the Charter Election held March 14th,1939, to hold office for one year (unexpired.
term) and until his successor is elected and qualified;
That Theo. H. Tollefson is hereby declared to be elected to the office of City Treasurer
of said City, at the Charter Election held March 14th,1939, to hold office for one year and
until his successor is elected and qualified;
That R.I.LaPlant is hereby declared to be elected to the office of City Assessor of said
City, at the Charter Election held March 14th,1939, to hold office for two years and until his
successor is elected and qualified;
That Ben Amundsen is hereby declared to be elected to the office of Alderman of the First
Ward of said City, at the Charter Election held March 14th,1939, to hold office for two years
and until his successor is elected and qualified;
That Fred R.Witzke is hereby declared to be elected to the office of Constable of the First'
Ward of said City, at the Charter Election held March 14th,1939, to hold office for two years
and until his successor is elected and qualified;
That `Tom moody is hereby declared to be elected to the office of Alderman of the Second
Ward of said City, at the Charter Election held March 14th,1939, to hold office for two years -
and until his successor is elected and qualified;
That D.L.Williams is hereby declared to be elected to the office of Alderman of the Second.
Ward of said City, at the Charter Election held March 14th,1939, to hold office for one year
(unexpired term) and until his successor is elected and qualified;
That Carl Nichols is hereby declared to be elected Justice of the Peace of the Second Ward
of said City, at the Charter Election held I+garc h 14th,1939, to hold office for one year
(9Lnexpired term) and until his successor is elected and qualified;
That Geo. Richman is hereby declared to be elected to the office of Alderman of the Third
Ward of said City, at the Charter Election held March 14th,1939, to hold office for two years
and until his successor is elected and qualified;
That James Cochran is hereby declared to be elected to the office of Constable of the
Third 7111ard of said City, at the Charter Election held March 14th,1939, to hold office for two
years and until his successor is elected and qualified;
That R.W.Chadwick is hereby declared to be elected to the office of School Commissioner at
Large of said City, at the Charter Election held March 14th,1939, to hold office for two years
and until his successor is elected and qualified;
That Edmund L.Schweppe is hereby declared to be elected to the office of School Commissioner
df the First Ward of said City, at the Charter Election March 14th,1939, to hold office for two
years and until his successor is elected and qualified;

That E. H. Raetz, is hereby declared to be elected to the office of School Commissioner
of the Second Ward of said City, at the Charter Election held March 14th,1939, to hold office
for two years and until his successor is elected and qualified.
Upon motion by Richman second by Williams, that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
A delegation from the American Legion appeared before the Common Council, in behalf of
their application for transfer of their 3.2 beer license to their new quarters in the Mayo
Civic Auditorium. The spokesmen for this delegation were, F.G.Yanser, D.B.Hunt, J.W.Feller,
and Frank Roth.
After considerable discussion on the matter of said transfer, a motion was made!::by
Alderman Green second by Alderman Moody, that the Board of Park Commissioners be requested to
make a recommendation to the Council on the various communications referred to them concerning
the sale of 3.2 beer in the Mayo Civic Auditorium and Soldier Field.
Upon motion by Amundsen second by Richman the 3.2 beer licenses of the American Legion
were transferred to their new club rooms in the Mayo Civic Auditorium.
The application of Sam DeFosse for transfer of his 3.2 beer license from 302 to 302 50,G
Twelfth Street Southeast, came up for consideration, and the Acting.Chief of Police requested
that the Common Council to defer action thereon until the meeting to be held March 20th,1939,
at which a motion by Williams second by Green.carried that action be deferred thereon until
March 20th,1939-
Mr. Oscar C.Ronken appeared before the Common Council and called their attention to a
condition existing south of Seventh Street Southwest and East of Fourteenth Avenue Southwest,
caused by changes made to property outside the city limits and lying next west of an alley
running north and south from Seventh Street Southwest. Mr. Ronken stated there was a possi-
bility of the washing away of said alley if proper steps of precaution are not taken soon.
President Lemmon referred the matter to the Street and Alley Committee the City Engineer,
City Attorney and neighboring residents.
Upon motion by Willianis second by Richman the City Clerk was instructed to prepare a
resolution calling upon the State Comptroller for an examination of the books and records of
the City of Rochester for the fiscal year ending March 31st,1939.
Upon motion by Moody second by Williams, the Common Council adjourned to 7:30 o'clock P.m.,
on March 20th,1939-
