HomeMy WebLinkAbout03-20-1939168 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 20th,1939 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on March 20th,1939- President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: Lemmon, Amundsen, Green, moody, Richman,Williams. Absent: Fryer, Alderman Fryer being absent on account of the illness of himself. President Lemmon announced this as being the time and place fixed for a hearing on the donstruction of a sanitary sewer in 91 Avenue Southeast from Eleventh Street to Twelfth Street Southeast, alid asked if any one 'present wished to be heard concerning this improvement. There was no one present who wished to be heard concerning the construction of said sanitary sewer. The City Engineer submitted an estimate of the cost and a list of the streets and avenues to be sprinkled or treated with oil during the 1939 season, said estimate of cost being $7,000.00 for 140,000 gal. road oil, and $2800.00 for 40,000 gallons cutback asphalt. Alderman Richman introduced a resolution designating the streets, avenues and alleys to be sprinkled and/or flushed and sprinkled and/or oiled during the 1939 season, and ordering { a hearing on the"same to be held in the Council Chambers, in the City Hall at 7:30 o'clock P.14., on April 10th,19391 which was read. Upon motion by Amundsen second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. The following communications were each read, and Rpesident Lemmon referred the same to the License Committee and the Board of Park Commissioners for recommendation: "Rochester, Minn.Mar.15,1939 Gentlemen: At our regular meeting held on Mar.14,1939, our club voted unanimously to send the following comrlunication to the Rochester City Council: - We the members of the Altruistic Club of the City of Rochester, Minnesota respectfully petition that your honorable body refuse to grant licenses for the sale of liquor at the new Mayo Civic Auditorium or at Soldiers Field. Bertha E.Wilcox 'Pres. Altruistic Club." "To the Mayor and City Council of Rochester, !::inn. Gentlemen: - The Wide Awake Study Club wishes to protest against the issuing of a license, for the sale of beer in any form at the new Civic Auditorium and at Soldier's Field because of the many children using the facilities of both the Auditorium and Soldiers Field. The Wide Awake Club. " "Rochester,Minn.March 18th,1939 City Council: - Dear Sirs: Enclosed find a communication which I as Secretary of the Brotherhood of the Zumbro Lutheran Church of I.Rochester am directed to forward to you for your consideration. "At its regular monthly meeting held March 14, 1939, the Brotherhoodqof 'Zumbro Lutheran Church passed a resolution concurring in the effort led by the VI.C.T.U.of this city to prevent the sale.of beer and liquor at Soldiers Field. Since youth -welfare is a part of its four -point program; and since it believes that the sale of beer and liquor.at a public playground is subversive of the best interests of youth, the Brotherhood of Zumbro Lutheran Church asks the City Council of Rochester, Minnesota to deny permission for the sale of beer and liquor at Soldiers' Field. Dear Sirs: As a citizen of Rochester, and as one interested in the public interests of our city, and as a pastor representing four hundred and fifty members, four hundred of whom live in the city, I -am asking you to consider the wishes of these people and do your utmost to lift high the moral standard of our city. We understand there is a move on foot to permit the selling of liquor on Soldierts Field and in the new City Auditorium. We trust you will grant no such permit under any consideration whatsoever. Furthermore, we trust you will, at the earliest possible date eliminate slot machines from our city by refusing to license same, and by declaring them illegal. Vie admit that several institutions are making all their expenses thro these machines, and thereby reaping their profit from their regular business. But. you well know that these machines are nothing more or less than gambling machines and that a large stun of money is being lost every day to families that cannot afford it. Sincerely yours E.T.Aldrich Pastor First U.B.Church.'* A notice of claim for damages, signed by R.U.Williams, claiming $2500.00 for damages and injuries sustained by a fall upon the sidewalk on the north. side of the Botsford Lumber Company, was read and upon motion by Moody second by Green, it was referred to the City Attorney and the.Street and Alley.Committee. A communication from A.J.Osman, Secretary of the Police Civil Service Commission certifying O.L.Rowland as a patrolman with original appointment in the Police department, was read, and upon motion by Richman second by Amundsen said appointment was approved. A communication from the City Engineer requesting approval of extra work on the contract of Martin Paulson for lateral connections on PVIA Docket No.1515- , was read, and upon motion by Green second by Richman it was ordered that said communication be placed on file and the proper papers forwarded to the Public Works Administration office at Omaha,, Nebraska. The following petition from the Mayo Properties Association and the recommendation from the Zoning Board, vrere each separately read, and upon motion by Moody second by Williams it was ordered that the matter be referred to the,City Attorney to draft a resolution authori the permission requested in said petitions: "To the Honorable Mayor and Common Council of the City of Rochester, Rochester, Minnesota. 1 7 ®Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 20th,1939 . ' Gentlemen: Mayo Properties -Association, for its petition herein, alleges: 1. That the said Mayo Properties Association heretofore petitioned the Common Council of the City of Rochester, Minnesota, to establish the setbacks, building lines and yards for each and all of the Lots mentioned in said petition. 2. That Mayo Properties Association hereby petitions the Common Council of the City of Rochester, Minnesota, to amend Paragraph (d) of said petition so the same shall read as follows: (d) That in cases where a garage, to be accessible, is built nearer the street line than the dwelling to which it is appurtenant, the same shall be not less than 5 feet from the street line and when so situated the floor shall be not more than 2 feet below the curb line of said Lot, and the highest point of the roof there- on shall be not more than 1 foot above the natural grade line of said Lot at the center of the garage at the street lot line. A recommendation from the Sewer Committee and the City Engineer that a sanitary sewer be constructed in Eleventh Street Northeast from the alley between Broadway and First Avenue Northeast,east to Lot 3, Block 42, Northern Addition, was read, and upon motion by Moody second !by Amundsen, the recommendation was accepted and approved. The report of the Clerk of the Municipal Court for the week ending March 20th, 1939, , j'showing criminal fines and costs collected $197.80, civil fees received $.70, and conciliation court fees received $2.50, was read, and having been previously approved by -the City Attorney, President Lemmon ordered that the same be placed on file. The application of Reuben C.Kunerth for a drivers license was read, and upon motion by Richman second by Amundsen, license was granted. Alderman Richman introduced a resolution ordering2plans for a sanitary sewer in 92 Avenue Southeast from Eleventh Street to Twelfth Street Southeast, and ordering extimate of cost for 172 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 20,1939- for making said improvement, which was read. Upon motion by Green second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution authorizing a contract change on the Martin Paulson contract under n7A Docket 1515-F for a net total cost of $53.20, which was read. Upon motion by Moody second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution calling upon the State Comptroller to make an examination of the books and records of the City of Rochester,b,4innesota, for the period y April lst,1939, to March 31st,1939, which was read. Upon motion by Green second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution ordering advertisement for proposals for being designated City Depositories, said proposals to be received and opened at 2:00 otcloi'k P.M. April 3rd,1939, which was read. Upon motion by Moody second by Richman that the said resolution be adopted as read., and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution ordering advertisement for proposals for doing the official printing and puilications during the official year commencing April 3rd,1939, said proposals to be received and opened at 2:00 otclock P.M., on April 3rd,1939, which was read. Upon motion by Williams second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Aldermah Green introduced a resolution granting public dance permit to F.L.Schroeder and Paul Schroeder for the A.O.UJI.N.all March 25th,1929, and fixing the fee at $3.00, which was read. Upon motion by Green second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , i Alderman Green introduced a resolution granting public dance permit to Dale Hess for the 11 Woodman Hall March 18th,1939, and fixing the fee at 0.00, which was read. i Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , Record of Official Proceedings. of the Common Council of the. City_ of Rochester, Minn', March 20,1939 A Alderman Green introduced a resolution appropriating $410.00 from the Park Improvement Fund and ordering payment made to Wm. H. Ziegler Company for one Detroit sweeper and snow brush for 1-14 international tractor, which was read. Upon, motion, by Moody second by Green that the said -.Resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $4597.88 from the General Fund, Code.18 and ordering'p$yment made to Code 20 of the General Fund, for the city8s share of the sprinkling,flushigg, and oiling costs during.the 1938 season,'which was read. Upon motion by Richman second by Williams that the*said resolution be adopted as read,` and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $239.94 from the Street and - Alley Fund and ordering payment made to the Firestone Auto Supply & Service Stores; for retreading and repairs to 6,tires and 2 sections for the caterpillar, which was read. Upon motion by Green second'by-Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Com on Council of the City of Rochester, Minnesota: ' That the sum of $3,500.00 be and the said sum is hereby appropriated from Code 18 of the General Fund, for use of the Board of Park Commissioners of said City, for the purpose of constructing drive ways, curbs, gutter, and -sidewalks around the Mayo Civic Auditorium, and for removal and placing in a new location the log house now situated east of the Auditorium said $3,500.00 to be -transferred to the Park Improvement Fund when needed and upon the request of the said Board of Park Commissioners." Upon motion by Amundsen second by Richm m that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering a hearing on the construction of a sanitary sewer in Eleventh Street Northeast, from the alley between Broadway and First Avenue Northeast, east to Lot 3,Block 42, Northern Addition, said hearing to be held at 7:30 otclock P.M., on April 10th,1939, which was read. Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Leinmon.declared the said resolution duly passed and adopted. James T.Spillane appeared before the Council in behalf of the DeFosse application for transfer of his 3.2 beer license from 302 to 306 Twelfth Street Southeast, and Mr. Amundsen made an oral report for the License Committee that they recommended the transfer be not granted. 174 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 20,1939. Upon motion by Amundsen second by Green said transfer was not granted. The City Clerk presented the invoice received from the.State Highway Department for the city's share of the costs of repaving Broadway Street North and South from the Chicago 8c Northwestern tracks to Fourth Street Southeast and Southwest, in the sum of $27,708:569 w Upon motion by Moody second by Green the said invoice for repaving Broadway Street North and south was referred to the Finance Committee, the_Mayor, City Engineer and Public Utility Board., Upon motion by Moody second by Green the Board of Park Commissioners were requested to ,make report end.recommendation on theicommunications referred to them concerning the sale j of 3.2 beer in the Mayo Civic Auditorium and Soldier Field, at the next meeting of this Common Council. The Chief of the Fire Department, requested permission to send Frank Adair,the Assistant Chief to a convention of Fire Chiefs at Chicago, and upon motion by Richman second by Green the request was granted. Upon motion by Williams second by Richman the Common Council adjourhed to 7:30 otclock P.M., on March 31st,1939- City Clerk.
