HomeMy WebLinkAbout04-03-1939184 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 3, 1939 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in. the City Hall, in said City on April 3rd,1939. President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Absent: None. President Lemmon addressed the Council and those present and introduced Mayor Paul A.Grassle who responded with a short address which included the announcement of his appointment of the following persons to the various Boards of the City of Rochester, Minnesota: Carl Oesterreich as a member of the Public.Utility Board; Arthur Reiter -as Park Commissioner at Large, T.M.McDonnell as Park Commissioner of the Second Ward; C.O.Brown as a member of the Police Civil Service Commission; Mrs. H.F.Helmholz and Mrs. R.V.Schenach as members of the Board of Public Health and Welfare; James Matheson to the Music and Band Committee; Carlton Wagoner to the Zoning Board. Upon motion by Fryer second by Green, and all voting in favor thereof, the Mayor's appointment o.f Carl Oesterreich to the Public Utility Board for a term of three years ending on the second Monday in April, 1941, was approved. Upon motion by Richman second by Green, the Mayor's appointment of Arthur Reiter as Park Commissioner at Large, and T.M.McDonnell as Park Commissioner from the Second Ward,/each for a two year term, were approved. Upon motion by Green second by Amundsen, the Mayor's appointment of Clarence O.Brown as a member of the Police Civil Service Commission for a term of three years, was approved. Upon motion. by Green second .by Richman the Mayor's appointment of Mrs. H.F.Helmholz and. Mrs.. R.V.Schenach as members of the Board of Public Health and Welfare for three year terms, was approved. Upon motion by Moody second by Williams, the Mayor's appointment of James Matheson as a member of the Music and Band':Committee for a term of three years, was approved. Upon motion by Green second by Amundsen, the Mayor's appointment of Carlton Wagoner as a member of the Board of Zoning for a term of five years ending on the second Xprnd.ay in April, 1944, was approved. Alderman Fryer introduced a resolution adopting Robert's Rules of Order (revised) of the 1915 Copyright, as rules of order for the conduct of the business of the Common Council, which was read. Upon motion by Green second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Roll Call.. The roll call of the Common Council shall be had and taken in its alphabetical. .order according to the names of the members, except that the name of the President 'of the' Comton Council shall be called' only at the first roll call of each meeting and then after that, at that meeting, only in case of a tie vbte when his name shall be called and the vote -taken after the expression of each of the other members of said Common Council. 2. The application of Arleigh C.Smith for reappointment as City Engineer for the ensuing official year was read, and upon motion by Richman second by Fryer Arleigh C.Smith was appointed' City Engineer for the ensuing official year. The applications of Irving L.Eckholdt and Samuel P.Allen for appointment" as City Attorney were each read, and upon motion by Williams second by Richman Irving L.Eckholdtwas appointe.d."City Attorney during the ensuing official year. The application of F.R.Finch for reappointment as City C].erk was read, and upon motion by Green second by Moody F".R.Finch was appointed City Clerk during the ensuing official year. The applications of Edw. E.Zuehlke and Herbert H.Fordham for appointment as Building, Electrical and Plumbing Ins`pector;<< were each read, an-d upon motion by Fryer second, by Amundsen, Eder. E.Zuehlke was appointed 'Building,Electrical and Plumbing Inspector'during the ensuing official year. The applicati®n of Grayc.e 1. Lee for appointment as Stenographer in the office of the Building,Elec'trical and Plumbing Inspector, was read, . and upon motion by Richman second by Amundsen, Grayce L.Lee. was appointed Stenographer in the office of the Building Electrical and Plumbing Inspector during the ensuing official year.. The application of Theo.H.Tollefson for reappointment as supervisor of the F.E.Williams Estate Properties, was read, and upon motion by Green second by Amundsen, Theo.H.Tlollefson.was"reappointed as Supervisor of the F.E.Williams Estate properties, for the ensuing official year. The applications of Henry C.Lindberg, Joseph.J.Schuster, and Peter C.Murray for appointment as As.si.stant Custodians of the City Hall, were each read, and upon motion by Moody second by Williams, Henry C.Lindberg and Joseph J.Schuster were appointed Assistant Custodians of the City Hall for the ensuing official year. The application of Geo. C.Wood for appointment as City Dog Catcher was read, and upon motion by Green second by Richman Geo.C.Wood was appointed City Dog 'Catcher during the ensuing official year. The application of George Watson for appointment as City Scavenger Was read and President Lemmon. referred the same to the Board of Public Health and Welfare. The applications of Elias A.Hollo, Fred W.Yochem,' Geo. W.Parker, M.A. Campion, and C.A.Cottingham for appointment as City Weighmaster, were each read,!; and on motion by Fryer sec-ond by Green, C.A.Cottingham was appointed City Weighmaster during the ensuing official year. The application of Jacob Olsen for appointment as Custodian of the Williams Apartment building, together with a communication from Theo.H.Tollefson Supervisor recommending• him for the position, were each read, and on motion by Moody second by Richman., Jacob Olsen was appointed Custodian of the Williams Apartment building during the ensuing official year. The applications of W.E.Mitchell, Albert C.Chance, Paul Dornack, Henry Zimmerman, John M.Keily, Ross.E.Phil.lips, Al Glasby, Adolph W.Berndt, Erwin Standke, M.W.Campbell, Clarence L.Steward, Fred R.Baker, Charles F.Fritsch, Otto Karrau, Ed. Darnell, John Ploof, for appointment as Assistant Superintendent of the Dumping Grounds, were each read, and upon motion by Green second by Amundsen, W.E.Mitchell was reappointed Assistant Superintendent of the Dumping Grounds during the ensuing official year. The applications of Peter D.Claude, William F.Eklund, and Gust W.Bottke for appointment as Second Assistant Superintendent of the Dumping Grounds, were each read, and on motion by Amundsen second by Moody,Peter D: Claude was appointed Secon-d-As_s.istant Superintendent of the Dumping Grounds during the ensuing official year. Upon motion by Fryer second by Williams, the above applications for positions at the Dumppag Grounds were ordered placed on file for possible future consideration. Upon motion by Green second by Amundsen, C.E.Ginther was appointed Fire Warden for the City of Rochester for the ensuing official year, he to serve without pay. The application of Geo. J. Anderson for appointment as Milk Inspector was read and President Lemmon referred the same to the Board of Public Health and Welfare. President Lemmo.n announced. this as being the time and- place fixed for receiving and, opening bids for being designated Ehe official newspaper of the City for the ensuing official year. The City Clerk reported that no bids had been received for doing the offi.c.ial-printing during the ensuing official year, and. President Lemmo-n referred the -matter to the Purchasing Committee. President Lemmon.announ.ce.d.thi.s.as being the time and place fixed for receiving and opening bids for being designated as City Depositories. The Ifollowing proposals were read-: First Rational Bank $200,000.00, Union National Bank $100,000.00, Olmsted -County Bank.& %rust Company $50,000.00. Alderman Fryer introduced the following resolution, which was read: WHEREAS, The Common Council of _the City of Rochester, Minnesota, has here- tofore called for proposals for the designation of banks as depositories for city funds , and WHEREAS, The First National Bank -of Rochester, Minnesota, Union National Bank, Rochester, Minnesota -and Olmsted County Bank and Trus-t Company, Rochester, Minnesota; have -submitted prop.o.sal.s for such designation; NOW, THEREFORE, Be it -anal it is hereby resolved by the Common Council of the City of Rochester, -Minnesota that the proposals of the above named banks be and thesame are hereby accepted in accordance with'the terms of said proposal nov on record and onfile in.the office. of the City Clerk. BE IT FURTHER RESOLVED By said Commo-n Council that said above named banks be and the same are hereby designatedasas depositorie-s of'all funds belonging to the City' of RochBster. - BE IT FURTHER RESOLVED. that the above named depositorie-s shall deposit collateral to the full amount of the designated -deposits, such collateral, to consist of Home Owners Loan.Corporation Bonds, Federal Farm Mortgage Corporation bonds and any other United States'Governme-nt Bonds. The report of the City Engineer for the month of March,1939, showing' expenditures from the General Fund,for labor $104.09, from the Street and Alley Fund $2911.42, from the Sewer Fund $336.02, from the Bridge Fund $19.15, lwas read, and upon motion by Green se-cond by Moody it. was ordered that the said report be placed on file. The annual report of the. Board of Park Commissioners was presented, and upon motion by Williams second. by Moody it was .ordered that the same be placed on file. The report of the Building, Electrical and Plumbing Inspector for the month of _March,1939, showing building permits issued $100.00, Electrical permits $11.50, and plumbing permits $52.00, was read, and President Lemmon referred the same to the Finance Committee=. 188 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., Ap r i 1 3 ,19 3 9 A communication from the Board of Park Commissioners, requesting authority to enter into contract with the Toro Manufacturing Corporation for the purchase of moving equipment for the Park Department, was read, and upon motion by Williams second by Amundsen action on the said request was deferred until such time as the new Board have had an opportunity to consider the matter.. Upon motion by Amundsen second by Fryer William Schacht was appointed a member of Firemen's Civil Service Commibtion for a term of three years. Upon motion by Fryer second by Amundsen the sum of $199.00 was appropriated from the General Fund and ordered paid to Paul Grassle, mayor, for use in his Mayor's Contingent Fund, he to properly account for the expenditures therefrom. The applications of the Murphy Finance Company and the Rochester Credit i Company for loan company licenses were each read, and,on motion by Fryer second by Richman, licenses were granted. The applications of the -Yellow Cab Company for seventeen taxicab licenses, ,J. C.. Adams for six taxicab licenses, and Harold McGoon-for one taxicab license, were each read, together with the insurance policies of the Great Lakes Casualty Company for J.C.Adams, and the Hartford Accident and Indemnity Company for the ,Yellow Cab C'ompany, were each read, and upon motion by Green second by Moody, the Licenses were granted, and the insurance policies accepted and ordered placed on''file. The application of Leonard V.Gilday for a license to operate a popcorn vending wagon license at Broadway Street South and Third Street, and the application of Chamberlain Brothers for a popcorn vending wagon license at Broadway Street South and Second Street, were each read, and -on motion by Williams second by Richman, licenses were granted, subject to each signing an ---agreement to move the wagons away from the curb during the winter. The application of Fred A.Fische.r for a plumbers license together with la suety bond in the sum of $1,000.00 with the Fidelity & Casualty Company of New York as surety thereon, were each read, and upon motion by Green second by iMoody, the license was granted, the bond approved, the surety thereon accepted, ,and -it was ordered that the same be placed on file. The applications of James Hubbard, and T.W.Dee for drivers licenses, were each read, and on motion by Moody second by Richman, licenses were granted. The -application of H.Dornack for a license to connect with sewers and drains, together with a surety bond in the sum of $1,000.00 with the Employers' 'Liability Assurance Corporation, Limited, as surety thereon, were each read, and upon motion by Richman second by Amundsen, the license was -granted, the bond approved, the sureties thereon accepted and it was ordered that the same be placed on file. a license to operate The application of Bremer & Kleckner for/three pin ball machines at INo.11! North Broadway was read and upon motion by Green second by Richman, License was granted, subject to the payment of fees as set forth in a new pin ball ordinance being considered at this meeting. The application of Peter Anton -for a license to operate a pin ball machine at 1129 Second Street Southwest, was read, and upon motion by Amundsen, second by Moody, the license was granted; subject to applicant complying with new ordinance under consideration. Upon notion by Green second by Williams, the City Clerk was instructed to prepare a resolution authorizing. a salary. of $25.00 to be paid to the Dog Catcher, in addition to the fees he receives, during 'the ensuing official year. Upon motion by Williams second by Fryer, the matter of'preparing a City Government Booklet was referred -to the Purchasing Committeewith power to act. The application of the American Legion for an off sale license to sell non -intoxicating malt liquors at their Club rooms in the Mayo Civic Auditorium was referred to the License Committee and the Park Board, said motion having been made by Alderman Fryer and seconded by Alderman Amundsen. Applications for permits _pd_.place and -maintain signsp were read,; said applications having been examined and approved by the Building Inspector, and upon motion by Fryer second by Richman permits were granted.
